Direito de protocolo: limites e possibilidades no processo de licenciamento construtivo

The only unanimous understanding on the matter relates to the possibility that the new law expressly regulates the topic. However, whenever the law is silent, the opinion of jurists and the case law are not unanimous with respect to the time such right arises: if upon submission of the construction project to the Municipality; upon its final approval; or, furthermore, upon actual commencement of the works. This work analyses this difficult question, trying to show that, excluding some exceptions that will be explicitly mentioned, the landowner has the right to execute its construction according to the applicable law at the time of filing of the request for construction license, both in the situations in which it was regularly issued and when the previous law was still in effect or, furthermore, in those cases in which the term for analysis of the administrative requirement elapses before the amendment to the law and, also, in those events in which the request is regularly presented pursuant to the law in effect at the time, jointly with the applicable evidence and in full compliance with the statutory requirements. We try to show that the acknowledgment of such right does not result from the mere balancing of constitutional principles, including the principle of isonomy, legal certainty and vested right, but rather from the specific legal system of the construction licenses, according to the Brazilian law / Uma das grandes discussões ainda sem solução pacificada em relação aos requerimentos administrativos de licenças edilícias diz respeito ao momento em que o direito de construir conforme o projeto protocolado passa a integrar a esfera de direitos subjetivos do proprietário, não mais podendo ser subtraído por legislação superveniente, sem prévia e justa indenização. O único entendimento uníssono sobre a matéria concerne à possibilidade de a nova legislação regulamentar expressamente o assunto. Quando esta se omite, contudo, a doutrina e a jurisprudência ainda divergem quanto ao momento em que tal direito surgiria: se com a submissão do projeto construtivo ao Município; com a sua aprovação final; ou, ainda, com o início efetivo das obras. O presente trabalho dedica-se ao exame dessa tormentosa questão, pretendendo mostrar que, salvo algumas exceções que serão explicitamente mencionadas, o proprietário possui o direito de executar seu projeto construtivo conforme legislação em vigor na data do protocolo do pedido de licença construtiva, tanto nas situações em que esta foi regularmente expedida quando ainda vigorava a legislação anterior, ou, ainda, nos casos em que o prazo de análise do requerimento administrativo é ultrapassado antes da alteração legislativa, como, também, nas hipóteses em que o pedido é regularmente apresentado segundo a legislação da época, devidamente instruído e em integral atendimento às exigências legais. Busca-se demonstrar que o reconhecimento de tal direito não decorre do simples sopesamento de princípios constitucionais, entre eles, o da isonomia, segurança jurídica e do direito adquirido, mas sim do regime jurídico próprio das licenças construtivas, segundo o ordenamento jurídico pátrio

Propriedade urbanística e edificabilidade: o plano urbanístico e o potencial construtivo na busca das cidades sustentáveis

To accomplish such task the study revisits basic concepts of Urban Planning, Urban Law and Right to the City disclosing the connection between the science of urban planning and related legal mechanisms which turn mandatory the conclusions of the studies and plans made under their guidelines. From this overview reviews the fundamentals of Urban Law in our country, considering the text of the Federal Constitution and the City Statute, from which are highlighted key themes of this branch of law in Brazil. Theoretical foundations that support the understanding adopted in the study are exposed with special considerations to the Theory of the Legal Hypothesis according to Engisch and the possibility of updating rules of the Constitution and Laws by virtue of changes within the society. And considering these assumptions the study analyzes the Urban Property according to the Brazilian legal context and its content highlighting key elements of their understanding, such as the phenomena of constitutionalization and democratization of the Civil Law and the social function of property. From this point it examines the building potential institute within Brazilian urban land highlighting the contraposition between the classic civilistic vision and the urbanistic perception on the subject. Once based on the study of the created land institute and on its main tools got from the City Statute it is possible to adopt a concept of building potential in urban sites that promotes urban planning. The analysis of the building potential as a legal good for urban real estate closes the study; and its characterization as a tool for regulating the urban environment due to the task constitutionally marked to provide sustainable cities for everyone is not a result of the property right; but actually it is a legal good that can be analyzed from different perspectives - urbanistic, civil and environmental / O presente estudo dedica-se a investigar a edificabilidade em solo urbano e a propriedade urbanística, assim como sua relação com o plano urbanístico e com o bem jurídico potencial construtivo na busca das cidades sustentáveis. Para realizar esta tarefa, revisita os conceitos básicos de urbanismo, direito urbanístico e de direito à cidade, mostrando a relação entre a ciência do urbanismo e os correlatos jurídicos que tornam exigíveis as conclusões dos estudos e planos elaborados sob suas diretrizes. A partir desta visão panorâmica, são analisados os fundamentos do direito urbanístico em nosso país, partindo-se do texto da Constituição Federal até o Estatuto da Cidade, do qual são destacados temas fundamentais deste ramo do direito no Brasil. São expostos, então, os fundamentos teóricos que dão suporte ao entendimento adotado no estudo, assim especialmente considerados a teoria da hipótese legal de Engisch e a possibilidade de atualização normativa dos textos constitucionais e legais por mudanças de fato e de valor ocorridas na sociedade. Com tais premissas, é realizada a análise da propriedade urbanística vigente no ordenamento jurídico pátrio e de seu conteúdo, destacando-se elementos essenciais à sua compreensão, tais como os fenômenos da constitucionalização e publicização do direito civil e o da função social da propriedade. Investiga-se, a partir deste ponto, o instituto da edificabilidade em solo urbano no Brasil, destacando-se a contraposição entre a visão civilista clássica e a percepção urbanística sobre o tema. Com o estudo do instituto do solo criado e de seus principais instrumentos de utilização trazidos no Estatuto da Cidade mostra-se possível adotar um conceito de potencial construtivo nos sítios urbanos que privilegie o planejamento urbanístico. Encerra o trabalho a análise do potencial construtivo em imóveis urbanos como bem jurídico que serve de instrumento para a regulação do meio ambiente urbano, em razão da tarefa constitucionalmente assinalada de propiciar a todos as cidades sustentáveis, concluindo-se que o potencial construtivo não constitui uma decorrência do direito de propriedade, mas sim um bem jurídico que pode ser analisado sob diferentes perspectivas a urbanística, a civil e a ambiental

The work identifies these facilities, their construction and development of their attempts to absolute dating and interpretation of their relationship. In this context seems to be showing the remains of an important festival that year, a week before the Feast of Corpus Christi, the city turned into a stage sacred representation. Besides the city itself was in the medieval concept of the founding hosnot reflection of God on earth.

O Estatuto da Cidade, lei federal N. 10.257/01, reconhecido como marco regulatório de promoção da reforma urbana, passados mais de quinze anos de sua aprovação, têm sido deveras debatido quanto à sua real eficácia, em razão da inoperância de aplicabilidade de seus instrumentos urbanísticos. Esta dissertação tem como objetivo geral demonstrar, a partir de um estudo de caso, quais são os entraves enfrentados na aplicabilidade de um instrumento, para além da condição rasa da dificuldade política. Neste sentido, a narrativa revela como transcorreram as questões técnicas que permearam a implementação do instrumento Outorga Onerosa do Direito de Construir, desencadeadas durante o processo de desenvolvimento do projeto de lei de regulação do uso do solo na cidade de São José dos Campos. A partir da leitura de documentos, disponibilizados em endereço eletrônico da prefeitura na época, ou de materiais elaborados e desenvolvidos como consequência da atividade enquanto técnica da gestão pública, foram descritas algumas etapas administrativas e legais, referente ao processo deste projeto de lei. A pesquisa descortina os interesses diversos nas condutas das relações intersetoriais dos atores representativos da sociedade e os caminhos adotados nas busca de consensos. The research reveals the diverse interests in the conduct of the intersectoral relations of the representative actors of society and the paths adopted in the search for consensus. In the end, it is intended to highlight the potentiality of the instrument and, in an antagonistic way, its limitations of implementation, and fundamentally, to contribute to the reflection for the search of strategies of reversion of the current scenario.

Contract Administration Functions and Tools for Design-Build and Construction Manager/General Contractor Project Delivery in U.S. Highway Construction

abstract: The demand for new highway infrastructure, the need to repair aging infrastructure, and the drive to optimize public expenditures on infrastructure have led transportation agencies toward alternative contracting methods (ACMs) such as design-build (DB) and construction manager/general contractor (CM/GC). U.S. transportation agencies have substantial experience with traditional design-bid-build delivery. To promote ACMs, the Federal Highway Administration and the National Cooperative Highway Research Program (NCRHP) have published ACM guidance documents. However, the published material and research tend to focus on pre-award activities. The need for guidance on ACM post-award activities is confirmed in NCHRP’s request for a guidebook focusing on ACM contract administration (NCHRP 2016). This dissertation fills the crucial knowledge gap in contract administration functions and tools for DB and CM/GC highway project delivery. First, this research identifies and models contract administration functions in DBB, CM/GC, and DB using integrated definition modeling (IDEF0). Second, this research identifies and analyzes DB and CM/GC tools for contract administration by conducting 30 ACM project case studies involving over 90 ACM practitioners. Recommendations on appropriate use regarding project phase, complexity, and size were gathered from 16 ACM practitioners. Third, the alternative technical concepts tool was studied. Data from 30 DB projects was analyzed to explore the timing of DB procurement and DB initial award performance in relation to the project influence curve. Types of innovations derived from ATCs are discussed. Considerable industry input at multiple stages grounds this research in professional practice. Results indicate that the involvement of the contractor during the design phase for both DB and CM/GC delivery creates unique contract administration functions that need unique tools. Thirty-six DB and CM/GC tools for contract administration are identified with recommendations for effective implementation. While strong initial award performance is achievable in DB projects, initial award performance in this sample of projects is only loosely tied to the level of percent base design at procurement. Cost savings typically come from multiple ATCs, and innovations tend to be incremental rather than systemic, disruptive, or radical. WISETales: Designing a New Niche Online Community for Women in Science and Engineering to Share Personal Stories

User contributions are vital to online communities; therefore it is important to know how to motivate user participation to ensure flow and quality of content, and to generate more traffic and revenue to community owners. In contrast to previous research which has explored the motivations of participants in already existing online communities, I investigate whether a new niche online community with a particular focus(women in Science and Engineering sharing their personal experiences through stories) can be started through a design that follows best practices for community design and principles derived from theories of motivation. The design of the WISETales community is based upon insights from literature in three main areas: social psychology, computer science, and gender studies. A social visualization which serves informational, navigational and motivational tool was also developed. One pilot study and two exploratory studies were carried out to evaluate the need for such a community, its design and interface usability. The design of the community and visualization, along with the results from the studies, their analysis and discussion are presented in the thesis.

Geometric Build-up Solutions for Protein Determination via Distance Geometry

Proteins carry out an almost innumerable amount of biological processes that are absolutely necessary to life and as a result proteins and their structures are very often the objects of study in research. As such, this thesis will begin with a description of protein function and structure, followed by brief discussions of the two major experimental structure determination methods. Another problem that often arises in molecular modeling is referred to as the Molecular Distance Geometry Problem (MDGP). This problem seeks to find coordinates for the atoms of a protein or molecule when given only a set of pair-wise distances between atoms. To introduce the complexities of the MDGP we begin at its origins in distance geometry and progress to the specific sub-problems and some of the solutions that have been developed. This is all in preparation for a discussion of what is known as the Geometric Build-up (GBU) Solution. This solution has lead to the development of several algorithms and continues to be modified to account for more and different complexities. The culmination of this thesis, then, is a new algorithm, the Revised Updated Geometric Build-up, that is faster than previous GBU’s while maintaining the accuracy of the resulting structure.

Presumtionsreglerna i 11 kap. ÄB får anses vara ett hjälpmedel vid tolkning av testamenten som i sig inte ger tillräcklig ledning för vad testatorn avsett ska hända med sin kvarlåtenskap. Dessa presumtionsregler är tänkta att ge uttryck för vad testatorer i allmänhet vill ska hända med sitt arv efter sin bortgång i specifika situationer. Att reglerna ska ge uttryck för vad den ”genomsnittlige” testatorn vill innebär att reglernas utformning måste vara av generell karaktär. I denna uppsats utreder vi presumtionsregeln i 11 kap. 5 § ÄB som behandlar panträttsbelastade saklegat. Arbetet är avgränsat till att enbart behandla det fall då en fastighet har pantsatts och belånats för att finansiera uppförandet av en byggnad på ofri grund. Uppsatsen framställer en kritisk syn på utformningen av nu nämnda presumtionsregel enligt gällande rätt. För att utreda och peka på brister i gällande rätt används en deskriptiv metod, vilket är en förutsättning för den kommande analysen som undersöker möjligheten till en förändring av presumtionsregeln i fråga. Rättsläget analyseras sedermera med hjälp av en analytisk och problemorienterad metod. I denna del av uppsatsen inventeras argument för och emot de framlagda förslagen till förändring, varefter argumenten vägs mot varandra. På grundval av argumentationen tar författarna ställning till huruvida varje enskilt förslag är möjligt att genomföra. Resultatet av analysen är att införandet av ett andra stycke till presumtionsregeln i 11 kap. 5 § ÄB är det mest lämpliga alternativet för att lösa den problematik som behandlas. Ett sådant stycke skulle tydligt stadga vem som ska bära panträttsbelastningen vid testatorns bortgång för det fall att testatorn har pantsatt en fastighet för att finansiera uppförandet av en byggnad på ofri grund. / The rules of presumption in chapter 11 of the Swedish Inheritance Code are to be considered as an aid in the interpretation of wills, if the will itself does not provide sufficient guidance for what the deviser intended to happen with his legacy. These rules of presumption are meant to express what a deceased person in general would want to happen with his legacy in specific situations. The rules of presumption have to be of a general nature in order to represent the average deceased persons intentions. The purpose of this thesis is to investigate the rule of presumption given in chapter 11. 5 § of the Swedish Inheritance Code concerning estate with an attached mortgage lien which the deviser in his will has left to a specific legatee. This thesis is limited to only treat the case where a mortgage lien on property is deposited as security for a loan in order to finance the construction of a building on leasehold. The thesis presents a critical view of the design of the aforementioned rule of presumption according to current legislation. In order to investigate and identify shortcomings in current law, a descriptive method is used, which is a prerequisite for future analysis that examines the possibility of a change of the rule of presumption in question.The legal position is analyzed with an analytical approach. In this part of the thesis, arguments for and against the proposals of change are being evaluated. On the basis of these arguments, the authors consider whether each proposal is possible to implement or not. The result of the analysis is that the introduction of a subparagraph to the rule of presumption in chapter 11. 5 § of the Swedish Inheritance Code is the most suitable option to solve the issues being treated in the thesis. Such a subparagraph would clearly state which one of the legatees who is obligated to carry the burden of the mortgage lien attached to the property that has been deposited in order to finance the construction of a building on leasehold.
