O público e o privado na conservação biológica: o caso do INbio na Costa Rica / Public and private sectors in biological conservation: the INBio case in Costa Rica.

Por meio do processo conhecido como bioprospecção, propõe-se a aplicação dos lucros obtidos com a comercialização de produtos, como fármacos, em ações para conservação biológica. O objetivo deste trabalho é verificar a importância deste instrumento para a conservação a partir de estudo de caso focado na experiência do Instituto Nacional de Biodiversidade (INBio), na Costa Rica. Os procedimentos metodológicos estão baseados nas estratégias de pesquisa de: a) estudo de caso; b) documental e c) pesquisa bibliográfica. O INBio, uma associação sem fins lucrativos, se empenhou na elaboração do inventário nacional da biodiversidade e firmou diversos contratos de bioprospecção, entre eles o comentado acordo com a indústria farmacêutica Merck. Alguns pontos positivos devem ser destacados a partir dessa experiência: geração de conhecimento sobre os recursos biológicos locais em função do inventário; criação de sistema de controle ao acesso e identificação dos materiais coletados; o aparato jurídico desenvolvido; aprimoramento da capacidade de negociação; disseminação de informação em publicações científicas; atividades voltadas à Educação Ambiental e apoio a pequenas e médias empresas nacionais no desenvolvimento de produtos baseados em recursos biológicos do país. Por outro lado, os dados analisados mostram que tem sido baixo o retorno financeiro do Instituto; os pagamentos não têm sido suficientes para cobrir os gastos. Esta questão está ligada ao fato de que, ainda que tenha começado o recebimento pela comercialização de alguns produtos desenvolvidos internamente, ainda não há produtos desenvolvidos resultantes de contratos com grandes companhias e, portanto, ainda não foram correspondidas as expectativas com relação ao recebimento de royalties. Há deficiência com relação ao controle administrativo dessas atividades por parte do Estado, o que reflete na falta de transparência das fontes disponíveis de informações. A análise dos recursos financeiros obtidos versus repasse de verbas para fins de conservação fica comprometida em razão de informações incompletas ou pela falta de padronização na apresentação dos dados no decorrer dos anos. O desmatamento tem apresentado queda contínua, mas não é possível relacionar este fato com os contratos de bioprospecção, devido ao sistema variado de fontes de contribuições e pagamentos por serviços destinados à conservação biológica naquele país. Ademais, os conhecimentos tradicionais das populações locais estão sendo ignoradas em todo esse processo conduzido pelo INBio. Portanto, até o momento, o que acontece na Costa Rica está mais próximo de representar uma evolução no sentido de empreender medidas em direção ao uso e conservação dos recursos biológicos, porém ainda não representa a solução ou ajuda significativa à conservação biológica naquele país. / Using the process known as bioprospecting, it is proposed the use of the profits obtained with the commercialization of products, such as pharmaceuticals, in biological conservation activities. The objective of this work is to verify the importance of this instrument for conservation, by means of a case study focused in the experience of the National Biodiversity Institute (Instituto Nacional de Biodiversidade) (INBio), in Costa Rica. The methodology is based in the strategies of researching: a) case study; b) documents and c) bibliography research. The National Biodiversity Institute (INBio), a non-profit association which has endeavored to elaborate a national biodiversity inventory and signed various bioprospecting contracts, among them the renowned agreement with Merck pharmaceutical company. Some positive points should be emphasized from this experience: generation of knowledge about local biological resources through inventory; creation of a control system for accessing and identifying the collected materials; the development of a legal apparatus; the improvement of negotiation skills; the dissemination of information through scientific publications, activities oriented to Environmental Education and supporting national small and medium firms in the development of products based on the country\'s biological resources. On the other hand, the data analyzed show low financial return, in spite of the fact that the income for the commercialization of some internally-developed products has begun. Payments have not been enough to cover the Institute\'s expenditures and there are still no developed products resulting from contracts with big companies and, therefore, the expectations relative to the receiving of royalties were still not fulfilled. There is a deficiency relative to the administrative control of these activities by the State, which reflects the lack of transparency of the available sources of information. The analysis of the obtained resources versus the transfer of funds for conservation is jeopardized due to incomplete information or lack of standardization in the presentation of data through the years. Deforestation has declined continuously, but it is impossible to relate this fact to the bioprospecting contracts, due to the diverse system of contribution and payment sources for services destined to the conservation of that country\'s natural resources. Besides, the traditional knowledge of the local population has been ignored in the entire process conducted by INBio. Therefore, for the moment, what happens in Costa Rica is closer to represent an evolution in the sense of taking steps in the direction of using and conserving biological resources, but it still does not represent the solution or significant aid to the biological conservation in Costa Rica.

Bioprospecting and intellectual property rights on African plant commons and knowledge: a new form of colonization viewed from an ethical perspective

This study engages in an ethical examination of contemporary socio-ecological and economic issues which takes seriously the plight of Africa, African communities, indigenous knowledge and biodiversity. It studies the impact of bioprospecting, biopiracy and intellectual property rights regimes on the protection, use, access to, and conservation of biodiversity and indigenous knowledge in Africa. The study also examines the ways in which northern multinational pharmaceutical and biotechnology companies and their agents prospect and convert African resources (biological commons and indigenous knowledge) into their intellectual property as well as private property. It argues that the transfer of African biological commons and indigenous knowledge is exacerbated by economic globalisation and the neo-colonial mentality of conquest concealed under the guise of commerce. The study demonstrates through concrete case studies the tactics used by northern multinational corporations to claim these resources as their intellectual property rights and private property. It observes that the privatisation of biological commons and indigenous knowledge only brings about nominal or no benefits to African communities who have nurtured and continue to nurture them. It also observes that this privatisation results in fewer benefits for biodiversity as they lead to the promotion of monoculture, i.e. commercialisation of all things. To address the injustice and exploitative implications of bioprospecting, biopiracy and intellectual property rights, the study recommends the adoption and implementation of the African model law, the establishment of defensive intellectual property rights mechanisms, and the strategy of resistance and advocacy. Opening Pandora's Box : Exploring Flexibilities and Alternatives for Protecting Traditional Knowledge and Genetic Resources under the Intellectual Property Framework

What happens when resources get valuable and scarce? How is Intellectual Property dealing with market failures related to sub-patentable innovation or purely traditional knowledge with interesting applications? The protection of traditional knowledge and genetic resources (TKGR) has been one of the major modern challenges in international IP law. The entry into force of the Convention on Biological Diversity (CBD) and its implementation in national legislation has created more questions than the ones it answered. The objective of this dissertation is to assist in the evaluation of current national and regional implementation initiatives as well in the presentation and evaluation of different forms of entitlements that could be applicable in the case of TKGR. The dissertation has employed a theoretical framework for this evaluation, by combining the Coase Theorem and Rawls' theory of justice. The choice of these two theoretical models is not a random one. In order for the entitlement covering TKGR to be successful, it has to be efficient. It has to offer a stable and efficient marketplace where access to TKGR is possible without unnecessary frictions. However, efficiency could not be the only objective.  An entitlement focusing solely on efficiency would fall short of the needs and special considerations of TKGR trade. It would above all be counter to the objectives and major principles of the CBD, the “fair and equitable sharing of the benefits” and would certainly fail to address the very important North-South perspective.  Fairness is thus a necessary complement to the efficiency of the proposed entitlement. This dissertation proposes a thorough investigation of the special characteristics, of right-holders, subject-matter, market place as well as of the general expectations that an entitlement is supposed to fulfill. In parallel to that, it  looks into the meaning and scope of alternative entitlements in order to be able to propose the best alternative.

Este estudo descreve a diversidade de actinobactérias isoladas da esponja marinha Aplysina fulva e o potencial destes microorganismos como produtores de metabólitos bioativos com propriedades fungicidas e herbicidas. Actinobactérias são prolíficas produtoras de compostos farmacologicamente importantes, pois cerca de 70% dos antibióticos naturalmente derivados que estão atualmente em uso clínico são produzidos por estes microorganismos. Entretanto este valor é ainda inexpressivo na indústria agrícola. Agroquímicos sintéticos ainda são dominantes no mercado apesar de estarem menos efetivos contra plantas daninhas e patógenos cada vez mais resistentes. Neste trabalho, um total de 21 actinobactérias foram isoladas com a utilização de meios seletivos. Análises filogenéticas baseadas no sequenciamento parcial do gene que codifica para o rRNA 16S mostrou que estes microorganismos pertencem a oito gêneros do filo Actinobacteria: Kocuria; Citricoccus; Terrabacter; Gordonia; Agrococcus; Tsukamurella; Brevibacterium e Streptomyces. Os extratos de todos os isolados foram testados para verificar a produção de metabólitos secundários com propriedades fungicidas contra os fungos fitopagênicos de importância agrícola: Pythium aphanidermatum; Phytophthora capsici e Magnaporthe grisea. O extrato bruto de 43% dos isolados mostrou atividade fungicida para ao menos um dos patógenos. O perfil químico do extrato dos isolados com bioatividade positiva foram similares mesmo entre gêneros diferentes. Os metabólitos do Streptomyces ASPSP 103 foram mais eficientes devido à forte inibição contra todos os patógenos testados. Portanto este isolado foi selecionado e testado para atividade herbicida por meio de screening que teve início com testes de atividade algicida contra a microalga Selenastrum capricornutum. Acreditamos que actinobactérias associadas a esponjas marinhas desempenham um papel de defesa química contra microalgas que possam obstruir os porócitos asfixiando o animal, e que estes compostos algicidas possivelmente tenham ação herbicida. Foi verificada atividade do extrato bruto do Streptomyces ASPSP 103 contra S. capricornutum, e a atividade herbicida pré-emergência com um efeito fraco em Lactuca sativa (dicotiledônea) e uma forte inibição em Agrostis stolonifera (monocotiledônea). A purificação do extrato bruto para isolamento do composto bioativo foi guiado por bioensaio contra Pythium aphanidermatum, um oomiceto de rápido crescimento e sensível aos metabólitos de ASPSP 103 previamente testados. Foi identificado o composto da classe butenolida com atividade herbicida préemergência contra Agrostis stolonifera (IC50 33.43 μg/mL). Este é o primeiro relato da atividade de butenolida para atividade herbicida. Estudos aprofundados em taxonomia mostraram que as características filogenéticas, morfológicas e químicas do isolado ASPSP 103 são consistentes com o gênero Streptomyces. Portanto devido algumas diferenças em parâmetros taxonômicos, ASPSP 103T foi proposto como linhagem tipo para uma nova espécie de Streptomyces, para qual o nome Streptomyces atlanticus sp. nov. foi sugerido. Estes resultados enfatizam o potencial de Streptomyces marinhos para produzir compostos bioativos com potencial de aplicação em agrobiotecnologia. / Actinobacteria are producers of important pharmacological compounds. However, the use of natural compounds are still limited in the agricultural industry, even considering that synthetic pesticides are less effective against pathogens and weed plants. This study describes the diversity of actinobacteria associated with the marine sponge Aplysina fulva and their potential as producers of bioactive compounds with fungicidal and herbicidal properties. In this study, a total of 21 actinomycetes were isolated with the use of selective media. Phylogenetic analyzes based on partial sequencing of the gene encoding for 16S rRNA showed that these microorganisms belong to eight Actinobacteria genera, including Kocuria, Citricoccus, Terrabacter, Gordonia, Agrococcus, Tsukamurella, Brevibacterium and Streptomyces. The extracts of all isolates were tested for the production of secondary metabolites with fungicidal properties against the following phytopathogenic fungi: of Pythium aphanidermatum, Phytophthora capsici and Magnaporthe grisea. The crude extract of 43% of the isolates showed fungicidal activity for at least one of the pathogens. The chemical profiles of the actinobacteria extracts with positive bioactivity were similar even among different genus. The metabolites of Streptomyces ASPSP 103 were more efficient because of the strong inhibition against all tested pathogens. So, the isolate ASPSP 103 was selected and tested for herbicide activity through screening for algaecide activity towards microalgae Selenastrum capricornutum. We believe that actinobacteria associated with marine sponges play a role in chemical defense against algae that can obstruct the pores, choking the animal. These algaecides compounds possibly have herbicide action. Activity of the Streptomyces ASPSP 103 crude extract against S. capricornutum was observed. In addition, it was observed a weak pre-emergence herbicide activity on Lactuca sativa (dicot) and a strong inhibition in Agrostis stolonifera (monocot). The purification of the crude extract to isolate the bioactive compound was guided by bioassay against Pythium aphanidermatum, a fast growing oomycete and sensitive to metabolites from ASPSP 103 previously tested. The butenolide compound was identified with pre-emergence herbicidal activity against Agrostis stolonifera (IC50 33.43 μg/mL). This is the first report of butenolide activity with herbicide activity. Taxonomy studies showed that the phylogenetic, morphological and chemical characteristics of the isolated ASPSP 103 are consistent with the Streptomyces genus. Biochemical characterization of homing endonucleases encoded by fungal mitochondrial genomes

The small ribosomal subunit gene of the Chaetomium thermophilum DSM 1495 is invaded by a nested intron at position mS1247, which is composed of a group I intron encoding a LAGLIDADG open reading frame interrupted by an internal group II intron. The first objective was to examine if splicing of the internal intron could reconstitute the coding regions and facilitate the expression of an active homing endonuclease. Using in vitro transcription assays, the group II intron was shown to self-splice only under high salt concentration. Both in vitro endonuclease and cleavage mapping assays suggested that the nested intron encodes an active homing endonuclease which cleaves near the intron insertion site. This composite arrangement hinted that the group II intron could be regulatory with regards to the expression of the homing endonuclease. Constructs were generated where the codon-optimized open reading frame was interrupted with group IIA1 or IIB introns. The concentration of the magnesium in the media sufficient for splicing was determined by the Reverse Transcriptase-Polymerase Chain Reaction analyses from the bacterial cells grown under various magnesium concentrations. Further, the in vivo endonuclease assay showed that magnesium chloride stimulated the expression of a functional protein but the addition of cobalt chloride to the growth media antagonized the expression. This study showed that the homing endonuclease expression in Escherichia coli can be regulated by manipulating the splicing efficiency of the group II introns which may have implications in genome engineering as potential ‘on/off switch’ for temporal regulation of homing endonuclease expression . Another objective was to characterize native homing endonucleases, cytb.i3ORF and I-OmiI encoded within fungal mitochondrial DNAs, which were difficult to express and purify. For these, an alternative approach was used where two compatible plasmids, HEase.pET28b (+)-kanamycin and substrate.pUC57-chloramphenicol, based on the antibiotic markers were maintained in Escherichia coli BL21 (DE3). The in vivo endonuclease assays demonstrated that these homing endonucleases were able to cleave the substrate plasmids when expressed, leading to the loss of the antibiotic markers and thereby providing an indirect approach to screen for potential active homing endonucleases before one invests effort into optimizing protein overexpression and purification strategies. / October 2016
