Notre thèse étudie un domaine qui est dominé à la fois par des lois très contraignantes et des données difficiles à analyser. Elle se situe à l’intersection entre l’analyse de l’existant et la prévision des tendances futures. Son objet est le comité d’entreprise. En matière de projet de réorganisation d’une firme, les élus peuvent se faire accompagner par un expertcomptable. Or, quel peut être le poids de son rapport ? Peut-il réellement modifier ou annuler un plan de restructuration ? Les pouvoirs qui lui sont dévolus par la loi sont restreints puisqu'il ne peut pas agir et alerter directement les instances judiciaires. Parallèlement, on a supposé qu'un plan de restructuration ne peut être qu'en accord avec la loi et la réglementation car les directions ne prendraient pas le risque de procéder à des licenciements « secs » si elles n'étaient pas en difficulté. Il est vrai que dans la majorité des cas, l’expert-comptable ne peut pas remettre en cause un plan de restructuration. Il pourra généralement fournir des informations aux élus leur permettant de négocier une prime de sortie. Néanmoins, à travers l'étude d'un cas réel, on a pu démontrer que suite au rapport d'un expert-comptable, un projet de licenciement a été remis en cause et annulé. Cela a été possible car le seul motif de baisse de chiffre d'affaires suite à la perte d'un client ne peut être retenu pour procéder à une réduction d'effectif. Les représentants du personnel sont devenus des acteurs clés dans la gestion de l'entreprise. / Our doctorate thesis studies a domain which is dominated at the same time by very binding laws and data difficult to analyze. It is situated in the intersection between the analysis of the existing and the forecast of the future tendencies. Its object is the works council. Regarding project of reorganization of a firm, the elected representatives can be accompanied by a chartered accountant. Yet, what can be the weight of its relationship? Can he really modify or cancel a restructuring plan? The powers which are devolved to him by the law are restricted because he cannot act and alert directly the judicial authorities. At the same time, we supposed that a restructuring plan can be only in agreement with the law and the regulations because the directions would not take the risk of proceeding to “dry” dismissals if they were not in trouble. It is true that in the majority of the cases, the chartered accountant cannot question a restructuring plan. He can generally supply information to the elected representatives allowing them to negotiate a bonus of exit. Nevertheless, through the study of a real case, we were able to demonstrate that further to the report of a chartered accountant, a project of dismissal was questioned and cancelled. It was possible because be held to proceed to a reduction in turnover further to the loss of a customer cannot be held to proceed to a reduction of staff. The staff representatives became key players in the management of the company.

Tax topics a trainee chartered accountant should be taught : a survey of perceptions in and outside of public practice

This paper presents the results of an e-mail study designed to determine what tax topics are important in terms of a trainee accountant entering the training environment in South Africa. These topics were then compared to the current tax syllabus being taught at universities and accredited institutions. The results indicated that the current syllabus is largely meeting the expectations of people in and out of public practice, though there are some topics that the syllabus setters and educators should consider including and excluding when next reviewing and updating the syllabus. Open-book assessment in the qualifying examination of South African chartered accountants

The global financial environment is constantly and rapidly shifting. This has resulted in changes to the International Financial Reporting Standards (IFRS). In support of the developments in the global business environment and the swift changes in IFRS, the local financial regulators have had to follow with supporting changes in national regulations. Taking the above factors into consideration, the auditing and accounting professions all over the world face various challenges, and South Africa (SA) is no exception. Thus, it was imperative for these professions in SA to make the same radical alterations. One of the areas demanding attention was the process of becoming a Chartered Accountant (CA). Inter alia, one focus area was the final examination in the qualifying process. The Chartered Accountant Qualifying Examination Part One (QE Part 1) has been changed from a closed-book assessment to an open-book assessment. This change is relevant because of the importance of the examination itself and the apparent lack of intensive research on students’ perceptions of this type of assessment. In my research I explored the perceptions of taxation students on open-book assessment in the QE Part 1. My study commenced with a focus group (consisting of students that had no previous open-book assessment exposure). I used Interactive qualitative analysis (IQA) as qualitative research method. During this focus group, the students identified ten perceptions (also referred to as affinities) on open-book assessment. For each affinity the focus group provided a descriptive name and an explanatory definition. These affinities were: good preparation, back-up, encourage, general advantages, improve quality of answers, negative symptoms, negative environment, personal experience and hindrance, different approach and time management. This group of students also identified relationships between these different affinities. These relationships were summarized and reflected in a system interrelationship diagram (SID). Findings from this SID indicated that students perceive good preparation as the strongest driver for successful completion of an open-book assessment. The SID indicates three primary outcomes namely negative symptoms, a different approach and time management. The affinities as identified by the focus group were then used during the interviews (conducted with students who had previous open-book assessment exposure). During the IQA interviews, the students were asked to comment on the posed affinities and the possible relationships between them. These findings were summarized and reflected in an interview SID. This SID indicated that these students perceived the primary driver in the system to be a different approach with two primary outcomes - negative environment and improvement in quality of answers. The usefulness of the value added statement in South Africa

Philosophiae Doctor - PhD / The value added statement is published by about 200 of the 400 companies listed in the industrial sector on the Johannesburg Stock Exchange. This is the highest incidence of publication of such statements reported to date. It appears from a literature review that the usefulness of the statement has never been tested in depth from the perspective of the users. The importance of this study stems from the increased incidence of publication of the statement in South Africa and the lack of evidence substantiating its usefulness. The study aims to investigate the usefulness of the value added statement in South Africa from the perspective of all the different users of external financial information. The literature review revealed that, although the value added statement is based on the theory of value added and was aimed at broadening the scope of financial reporting, it did not develop to the point of being governed by statutory requirements. This resulted in diverse accounting treatment in the statement and the resultant loss of consistency and comparability, which gave an early indication from the literature that value added statements might not be very useful. The usefulness of the value added statement was evidenced by users actually using the statement and the explanatory and predictive power of value added information. No reliable evidence of users actually using the statement was found in the literature. Evidence was found that value added information had greater predictive and explanatory power than earnings, but these findings were found to be inconclusive. A questionnaire survey among users representing the South African users of external financial reports revealed little evidence of actual use of the value added statement. The general usage trend from past to present, was to use the statement less rather than more. More than fifty percent of the respondents do not intend to use the statement in future, even if the shortcomings experienced could be overcome. The major reason for this lack of support for the value added statement seems to be the shortcomings experienced by the users when publishing and using the statement, which stems mainly from the lack of statutory requirements. Another reason is that the value added statement introduces very little information that is not already available from the other financial statements. The predictive and explanatory power of value added information was examined by doing statistical analysis on empirical data of South African listed companies. This analysis indicated that value added information did not have additional explanatory and predictive power when compared to earnings and that the high inter-correlation between value added and earnings prevented value added from being used in prediction models in combination with earnings. The predictive and explanatory power of value added information is therefore limited. This research study could not find sufficient evidence of the usefulness of value added statements to justify their continued publication, neither could it find significant support for future use. It is therefore suggested that the publication of the statement be discontinued and that additional information be included in the income statement disclosures to accommodate this.

Turnover of women audit managers in audit firms

This underrepresentation is a worldwide phenomenon that is also evident in the audit profession where there are few women at audit partner level. The purpose of this study was to explore the experiences of women audit managers – to gain an understanding of the reasons why they resign from audit firms before they are promoted to audit partner level. It was anticipated that this understanding could enable audit firms to develop and implement effective retention strategies to retain women in audit partner positions and to overcome the potential barriers to the equal representation of men and women in senior management positions in audit firms. An exploratory qualitative research approach and an interpretative phenomenological analysis design were used to explore and interpret the lived experiences of the women audit managers to understand the reasons why they resign from audit firms. The study found that unclear progression paths due to uncertain timelines, as well as the black economic empowerment pressures experienced by the audit firms, explained some of the women’s resignations from the audit firms. Unhealthy supervisor relationships, discrimination, no female role models and the “old boys club” as part of the audit firms’ leadership and organisational culture also played a prominent role in the women audit managers’ experiences. Moreover, unsatisfactory compensation together with no work-life balance were found to have influenced the majority of the women’s decisions to resign from the audit firms. Finally, the study also found that some of the participants’ aspirations to become audit partners were not distinct and that other matters were more important to them than their careers. / Alhoewel ongeveer die helfte van die wêreldbevolking vrouens is, is net een uit elke vyf senior bestuurders 'n vrou. L'expertise et le comité d'entreprise : mise en perspective / A perspective on expertise and the works council

Face à la complexité du monde de l’entreprise, le recours à l’expertise s’avère être indispensable afin de permettre au comité d’entreprise d’exercer pleinement ses attributions, et, in fine, de contribuer à l’application du principe de participation des travailleurs. Une approche plus réaliste de l’expertise permet d’établir que le comité d’entreprise a à sa disposition deux types d’experts : les experts institutionnels (l’expert-comptable, l’expert technique, l’expert libre et l’expert économique) et les experts non institutionnels (certaines commissions du comité d’entreprise et le comité d’hygiène, de sécurité et des conditions de travail). Les liens que le comité d’entreprise et les experts entretiennent oscillent entre vision traditionnelle et vision renouvelée. De façon tout à fait traditionnelle, ces deux types d’experts accomplissent, de façon inégale, une mission d’éclaireur pour le comité d’entreprise en lui apportant de l’information mais également en la traitant lorsque cela est nécessaire. De façon plus singulière, il apparaît que les experts interviennent également dans le processus de décision, mais également dans le processus de concertation. Au-delà du rôle que les experts peuvent jouer auprès du comité d’entreprise, les liens qu’ils entretiennent avec le comité révèlent l’existence de deux sortes de dynamique sous-jacentes : une dynamique relationnelle entre les différentes parties prenantes à l’expertise, marquée par un subtil équilibre entre dépendance et indépendance des uns envers les autres, et une dynamique collective qui témoigne de l’existence d’une expertise collective constituant un système d’intelligence collective nécessaire à l’effectivité du principe de participation des travailleurs. / Given the complexity of the business environment, resorting to expertise proves to be essential for the works council to fully exercise its powers and ultimately for the council to contribute to the application of the employee involvement principle. A more realistic approach to expertise enables us to establish that the works council has two types of experts at its disposal: institutional experts (chartered accountants, technical experts, expert consultants and economic experts) and non-institutional experts (some of the works council commissions and the Health, Safety and Working Conditions Committee (CHSCT)). The relations between the works council and experts oscillate between a traditional perspective and an updated perspective. In a very traditional fashion, these two types of experts unevenly act as pathfinders for the works council. They provide the council with information but also process this information when it is necessary. More strangely, however, experts also appear to be involved in the decision-making process as well as in the process of consultation. Beyond the tasks that experts can perform for the works council, two kinds of underlying dynamic can be evidenced by the relations between the experts and the council: a relational dynamic between the various players involved in the expertise that is characterised by a subtle balance between dependence on and independence from one other, and a collective dynamic that indicates the existence of a collective expertise. This collective expertise consists in a system of collective intelligence that is necessary to the effectiveness of the employee involvement principle.

Barriers and enablers to the career transition of chartered accountants in the South African financial services sector

Abstract in English, Southern Sotho and Afrikaans / South African chartered accountants (CAs(SA)), who are primarily trained as financially orientated technical specialists, play a significant role as part of management teams, which require expertise in leadership, strategy, marketing, communication and teamwork among other managerial skills. However, it has been found that accounting professionals have inherent characteristics that could act as barriers to career transition and adaptability in the volatile and challenging accounting profession. This study employed an interpretative phenomenological analysis research design to gain insights on the way CAs(SA) in the financial services sector have managed to overcome barriers and leverage enablers to transition their careers. Accordingly, interviews were conducted with CAs(SA) who occupy or have occupied a management position in the financial services sector. The findings revealed that the participants had prepared themselves for transition by gaining credibility and confidence by means of exposing themselves to challenging work, leading others, taking part in varied activities, updating their substantive knowledge base and using mentors. Through their attitudes, behaviour and decisions, participants were able to influence their career development context by being adaptable. Further, participants revealed that they were able to overcome barriers by gaining practical experience and exposure to varied tasks and career development opportunities, reading, listening and further training and education. Participants were also able to overcome barriers and create enablers by learning from others through informal mentorships and working in strong teams, which limited the extent to which they had to learn from their own mistakes. Hierdie studie het 'n interpretatiewe fenomenologiese ontledingnavorsingsontwerp gevolg om insig te bekom oor die wyse waarop CA’s(SA) in die finansiële sektor daarin geslaag het om sulke struikelblokke en hefboominstaatstellers te bowe te kom om loopbaanoorgang te bereik. Le recours aux experts par les instances de représentation du personnel / The employee representatives’ right to resort to the services of experts

Entre 1946 et 2016, ce sont plus de vingt cas de recours à des experts par les instances de représentation du personnel qui ont été créés, dont huit sur les trois dernières années. La possibilité sans cesse étendue de recourir à l’assistance d’experts pourrait laisser penser que le régime du recours à l’expertise est efficient. La facilité avec laquelle la loi associe désormais l’expert à chaque nouvelle mesure prise en faveur du dialogue social masque cependant mal l’incapacité croissante du législateur à préserver la fonction initiale de l’expertise : une fonction informative. Signe des dysfonctionnements qui grèvent le régime actuel du recours à l’expertise, le sujet est hautement polémique et fait l’objet d’un contentieux florissant. L’étude du périmètre ainsi que des modalités du recours à des experts exhorte à la construction d’un régime plus cohérent, de nature à assurer l’effet utile de l’expertise tout en préservant la compétence et la parole des représentants du personnel. / Between 1946 and 2016, this is more than twenty new cases in which the employee representatives were granted the right to resort to the services of experts, and only eight in the last three years. The ever-expanded possibility to be assisted by external experts might suggest that the expertise statutory regime is efficient. The ease with which the law associates experts to each new measures taken in favor of the social dialogue cannot hide the persistent difficulties encountered by the legislator to preserve the original function of expertise : an informative function. The controversial nature of the right to resort to the services of experts and the increasing amount of litigation in this area are manifestations of its failures. A study of the scope and the conditions under which the experts might be appointed urges to the construction of a more coherent system, that would ensure the effectiveness of the right to resort to experts while maintaining the employee representatives’ competence and voices.
