For the construction of this study we conducted a qualitative and interpretive research emphasizing the socially constructed nature of reality and the importance of understanding the phenomenon in a contextualized and systemic way. The methodological strategy adopted for this work was the case study, without exhausting it and/or making generalizations, but only considering the uniqueness and richness of the chosen case. The instruments used were a semi-structured interview, the Map of Social Network proposed by Sluzki (1997) and the Timeline of the couple. We interviewed two gay male couples and for purposes of this study a wealthy couple with diversity of information was chosen. We had three meetings with this couple an individual meeting with each member of the dyad and a joint meeting. The analysis and the results of the research show that building a gay male couple relationship requires of its members a sense of identity and clarity as to the desire to live together. For the participating couple, disclosing does not necessarily mean that they must tell everyone of their social network about their relationship. Living as a couple, living together, being always socially together and also rely on each other, preserving a certain personal life privacy are ways of socially legitimate their relationship and turn it visible. Despite the difference in meaning and the consequent attitudes about disclosing or not their relationship, each member of the couple respects the other's position and that does not generate conflicts in their relationship. Disclosing brings people closer, keeping their relationship secret builds boundaries between the couple and their social network. These limits are more visible in the family of origin, reflecting on the rejection of the couple, and when the family of one of the participants incorporates the couple but with little intimacy between the parties. Friendly relationships offer more intimacy and closeness to the couple when they are aware about their condition, and at work, the more comfortable coexistence between the couple and their colleagues is when they do not disclose their gay male couple condition. We believe that the knowledge of such features of gay male couples is relevant to the work in the mental health area / Este estudo teve como objetivo compreender como o processo de revelação da conjugalidade homossexual masculina reflete na construção da rede social do casal e na dinâmica de seus relacionamentos. Para a construção deste estudo realizamos uma pesquisa qualitativa e interpretativa enfatizando a natureza socialmente construída da realidade e a importância de compreender o fenômeno de forma contextualizada e sistêmica. A estratégia metodológica adotada para este trabalho foi o estudo de caso que buscou conhecer o caso a ser pesquisado sem a pretensão de esgotar e ou fazer generalizações, atendo-se à singularidade e riqueza do caso escolhido. Os instrumentos utilizados foram a entrevista semiestruturada, o Mapa de Rede de Social proposto por Sluzki (1997) e a Linha do Tempo do casal. Foram entrevistados dois casais homossexuais masculinos e, para fins deste estudo, foi escolhido um casal que apresentou riqueza e diversidade de informações para o tema proposto. Com este casal foram realizados três encontros, sendo um encontro individual com cada membro da díade e um encontro em conjunto. A análise e os resultados da pesquisa apontam que construir uma relação conjugal homossexual requer de seus membros uma consciência de suas identidades e uma clareza quanto ao desejo conjugal. Para o casal participante, revelar não significa necessariamente contar sobre a relação para qualquer pessoa da rede social. Viver como um casal, coabitar, estarem sempre juntos socialmente e também contar explicitamente sobre sua conjugalidade, preservando certa privacidade quanto a vida pessoal, são formas de legitimar socialmente a relação e dar visibilidade a mesma. Apesar da diferença de significado e conseqüentes atitudes sobre revelar ou não suas conjugalidades, cada membro do casal respeita a posição do outro e tal situação não é geradora de conflitos na relação. Revelar aproxima as pessoas da rede e não revelar mantém limites entre o casal e sua rede social. Limites esses mais aparentes em relação à família de origem com reflexos de rejeição ao casal, até incorporação do mesmo por parte da família de um dos participantes, porém com pouca intimidade entre as partes. As relações de amizade são as que oferecem maior intimidade e proximidade ao casal quando cientes da sua condição, e nas relações de trabalho, preservar a identidade do casal pela não revelação da situação aparece como condição de convivência mais confortável entre o casal e os colegas. Consideramos que o conhecimento de tais características sobre a homoconjugalidade masculina é relevante para o trabalho na área de saúde mental

It also sought to know the available legal supports for these unions, which are fundamental to guarantee the social rights and coexistence. Another goal was to provide greater visibility of family identity of those couples, and contribute to the professionals in the area of social services and related to expansion of knowledge on identity and its dynamics of daily life. The thesis is justified by the needs to deepen knowledge on the socio-emotional relationships generated from the stable union in the same sex couple and to reflect on the identity of family that forms this union, highlighting the importance of keeping the pressure up for legal supports. The research was conducted through non-structured free interviews, guided by some guiding questions, conducted together with the couples, through the methodology of the Oral History. Noted that the unions are stable by emotional links, revealing that the issues that founded the family identity is overlap the law. The construction of the family identity is consisted in the daily life events and the families values and legacy, which also appear to be the odd importance. The recognition of these couples as a family impetus for political positioning, showing their wish to do not live in anonymity, by contrast, expecting the society has a new and different look at the relationships between same-sex couples / A presente tese teve como objetivo principal identificar as dimensões da identidade de família constituída por casais do mesmo sexo, bem como os vínculos afetivos que permeiam tais uniões. Buscou também conhecer os amparos legais disponíveis para estas uniões, os quais são fundamentais para garantir direitos e a convivência social. Outro objetivo foi propiciar maior visibilidade à identidade de família desses casais, e contribuir com os profissionais da área de serviço social e afins para ampliação de conhecimento sobre sua identidade e suas dinâmicas de vida cotidiana. A tese justificou-se pela necessidade de se aprofundar o conhecimento sobre as relações sócio-afetivas geradas a partir da união estável entre casais do mesmo sexo e refletir sobre a identidade de família que se constitui nestas uniões, evidenciando a importância ainda premente de luta por amparos legais. A pesquisa foi efetuada através de entrevistas livres, não-estruturadas, orientadas por algumas questões norteadoras, realizadas junto aos casais, através da metodologia da História Oral. Constatou-se que as uniões estáveis se dão a partir de persistentes vínculos afetivos, revelando que os aspectos que fundam a identidade familiar se sobrepõem aos jurídicos. A construção da identidade de família se faz nas ocorrências da vida cotidiana e está referida aos valores herdados das famílias de origem, as quais também se apresentaram com importância ímpar. O reconhecimento destes casais enquanto família os impulsiona para posicionamentos políticos, evidenciando que não desejam viver no anonimato, ao contrário, esperam que a sociedade tenha um novo e diferenciado olhar sobre as relações entre casais do mesmo sexo

O presente trabalho pretende analisar a possibilidade do reconhecimento jurídico de novas formas de famílias advindas da união entre pessoas do mesmo sexo. Partindo do pressuposto de que a sociedade reclama por uma nova estrutura na prestação das relações jurídicas, além de uma nova estrutura na satisfação do direito pleiteado, a presente pesquisa tem por objetivo traçar um paralelo entre a trajetória das normas jurídicas que disciplinam as relações familiares e os novos arranjos sociais que constituem a família contemporânea em razão dos novos conceitos estabelecidos pela sociedade do séc. XXI, ainda em razão de o Estado possuir a responsabilidade de adequar os meios e os fins, com o intuito de garantir a melhor e plena aplicabilidade do direito. Busca-se identificar o novo conceito de família, a partir do art. 226 da Constituição Federal e dos Princípios Constitucionais, agregado a pluralidade de arranjos sociais identificáveis. Ademais, apresenta a preocupação em estabelecer essas novas regras jurídicas do direito de família em consonância com a realidade social do território brasileiro, para que garanta o acesso pleno à justiça, bem como respeito ao princípio da isonomia e da liberdade nas relações intersubjetivas / This study aims to examine the possibility of legal recognition of new forms of families arising from the union between same-sex. The history of family constitution will not be tackled, as the idea is focusing on the legal system which was in force after 1988, as well as analysing the redesign of the family concept, mainly with respect to the familiar entity originated from the stable union. Therefore, it is necessary to analyse the International and the Comparative Laws, with due regards to the ONU s and the world blocs position. We shall analyse the Homoaffective Union before the Brazilian Constitution and check if it is in concordance with the principles in force. Afterwards, it will be analysed the Civil Code and the demand originated by the androgynous couple. Later, it will be found out whether there was a reception by the law Maria da Penha, and which were its repercussions next to the Civil Code. It is within this context, that adoptions made by homosexual couples will be analysed. This work will also focus on analysing the position of national Tribunals and the existing federal legislative projects. Last, this work intends to establish if the Brazilian Constitution developed a new concept of the family and also a new way to look at it. It also concerns this study to investigate if the above mentioned situation agreed with the regulamentation of homoerotic unions, that is, if it is possible to affirm that there was, with the Homoafective Unions, a redefinition of the family concept in the Brazilian Law / Esta pesquisa tem por objeto verificar a constitucionalidade e a legalidade das uniões estáveis entre pessoas do mesmo sexo, bem como verificar quais reflexos jurídicos desta decorrentes. Não abordaremos o histórico da formação da família, vez que a ideia é focar no ordenamento jurídico vigente pós 1988 e o redesenho que houve no conceito de família, especialmente no tocante à entidade familiar decorrente da união estável. Assim, necessário que se analise o Direito Internacional e o Direito Comparado, com maior atenção ao posicionamento da ONU e dos blocos mundiais. Passaremos à análise da União homoafetiva perante a Constituição Brasileira e se esta se encontra em harmonia com os princípios vigentes. Após, será analisado o Código Civil e a exigência positivada do par andrógino. Posteriormente, será verificado se houve recepção pelo ordenamento da Lei Maria da Penha e quais seus reflexos junto ao Código Civil. É dentro deste contexto que se analisará a adoção por casais homossexuais. O trabalho terá por objeto, ainda, a análise do posicionamento dos Tribunais nacionais e os projetos legislativos federais existentes. Por fim, o trabalho tem o fito de estabelecer se a Carta Maior estabeleceu um novo olhar e conceito da família, e se tal situação esposou a regulamentação de uniões homoeróticas
