A Case Study of the Civil Rights of Institutionalized Persons Act: Reforming the Arizona Department of Juvenile Corrections

abstract: Research examining the long-term impacts of federal interventions under the Civil Rights of Institutionalized Persons Act on correctional institutions has been scant. The result has been a failure to understand the sustainability of reforms aimed at protecting the civil rights of confined persons. This dissertation examined the long-term reforms at the Arizona Department of Juvenile Corrections following a consent decree with the U.S. Department of Justice from 2004 to 2007. Interviews were conducted with current and former ADJC employees, juvenile justice advocates across Arizona, and county court representatives to determine how each of these groups perceived the status of the reforms at the ADJC. The findings of the current dissertation suggest that long-term reforms following consent decrees imposed on correctional institutions are possible. At the ADJC, the methods for securing the reform required that the agency reform its culture, implement a Quality Assurance process, revamp the Investigations and Inspections unit at the agency, and consider the perspectives of external agencies. One of the primary reasons why the department has been committed to making these reforms is because of the perceived loss of legitimacy and resources that would occur if they failed to reform. Such a failure for the agency could have potentially resulted in a closure of the agency. However, the increase in punitive and preventive policies used to enforce the reforms may have negative repercussions on the organizational culture in the long term. Policy implications for future CRIPA consent decrees are outlined, limitations are addressed, and suggestions for future research are made. / Dissertation/Thesis / Ph.D. Criminology and Criminal Justice 2013

A presente dissertação abarcará cinco temas bastante específicos: a defesa da concorrência, a defesa do consumidor, a prática do cartel, as formas consensuais de seu combate e investigação e o bem-estar do consumidor. No Brasil, verifica-se que, tanto a defesa da concorrência como a do consumidor se unem por um objetivo comum: o bem-estar do consumidor. Por isso, práticas tidas como ofensivas à ordem econômica podem desencadear danos graves aos consumidores, sendo um relevante exemplo disto a formação de cartéis, especialmente os relacionados à alteração artificial de preços. Dentre as práticas abusivas previstas no CDC, foi lançada elevação de preços sem justa causa, o que torna possível que a prática do cartel ou, ao menos, os seus efeitos sobre o preço, possam vir a ser reprimidos por ambas as esferas. Nesse sentido, buscou-se analisar os institutos consensuais de combate aos cartéis previstos na lei de concorrência: o “compromisso de cessação de conduta” e o “programa de leniência”, assim como seus possíveis efeitos benéficos sobre os consumidores. Desta feita, a presente dissertação visou a responder aos seguintes problemas de pesquisa: (i) qual o arcabouço jurídico-institucional à disposição da defesa do consumidor e da concorrência? (ii) qual o liame entre estas duas esferas? (iii) o que é “cartel” e de que forma ele atinge os consumidores (iv) o que são o “compromisso de cessação de conduta” e o “programa de leniência” e qual a sua utilidade ao combate dos cartéis? A conclusão obtida é que a defesa da concorrência e a do consumidor possuem um objetivo comum, o bem-estar do consumidor, a primeira de forma mediata e a segunda, imediata. Ademais, verificou-se o “cartel” como uma conduta altamente agressiva à livre concorrência e aos interesses dos consumidores, sendo possível que seus efeitos, de forma indireta, sejam penalizados pelo CDC. Finalmente, verificou-se a grande utilidade das formas consensuais – “compromisso de cessação de conduta” e “programa de leniência” – não apenas ao combate aos cartéis quanto à imediata cessação de seus efeitos, mas também como grande ferramenta de prova de sua ocorrência e garantia do bem-estar dos consumidores. / The presente dissetation involves five very specific issues: antitrust, consumer protection, cartels, consensual forms of its combat and investigation and consumer welfare. In Brazil, it is found that both the defense of competition as the consumer defense are united by a common goal: consumer welfare. Therefore, practices seen as offensive to the economic order can trigger serious harm to consumers, being a relevant example the cartel formation, especially those related to artificial price change. Among the abusive practices set out in Brazilian Consumer Defese Code (CDC), it was registered the prices raise without just cause, which makes it possible that the cartel, or at least its effects on the price, may be suppressed by both spheres. Therefore, it sought to analyze the consensual institutes of cartel’s combat and investigation under competition law: the "Conduct Consent Decree" and "Leniency Program", as well as their possible beneficial effects on consumers. Thereby, this dissertation aimed to answer the following research problems: (i) what is the legal and institutional framework available to the consumer’s and competition’s protection? An Examination of the Fulfillment of the Goals for Increasing Minority Enrollment and Black Faculty/Administrators Employment in the University of North Carolina, 1980-1999.

This study is a two-phase examination of the desegregation of the 16-campus University of North Carolina system. The first phase involved obtaining and analyzing copies of letters, books, journal articles, newspaper articles and annual reports concerning the court-mandated desegregation plan and its implementation and voluntary continuation after the mandate was rescinded. Reports of black and white student enrollment in historically black institutions (HBIs) and historically white institutions (HWIs) were analyzed for the years 1980, 1988, and 1999. The study found that very substantial increases in minority enrollments occurred in all HBIs and HWIs between 1980 and 1988 and, there were further increases from 1988 to 1999. In absolute numbers, white student enrollments in HBIs increased from 1,801 in 1980 to 3,009 in 1988 (for an increase of 67.1%) and to 3,421 in 1999 (which represented a 13.7% increase from 1988 and a 90.0% increase from 1980). black students in HWIs increased from 7,481 in 1980 to 10,186 in 1988 ( 36.0% increase) and to 14,489 in 1999 ( an increase of 42.2% from 1988 and 87.7% from 1980). black employment in HWIs in faculty and executive/administrative positions increased even more dramatically over the same period. black faculty members in HWIs increased from 138 in 1980 to 206 in 1988 to 310 in 1999, for a total increase of 124.6%. black executive/administrative employment in HWIs rose from 43 in 1980 to 76 in 1988 to 139 in 1999, for a 19-year increase of 223.2%. The second phase of this study involved interviewing the former president and other top-level University of North Carolina system administrators and other principal actors in desegregation planning, implementation and evaluation in the 1970s and 1980s. A second round of interviews was conducted with selected chancellors and directors of admissions in several HBIs and HWIs. The conclusions based upon the responses of both the former and current administrators are that the greatest impediments to increasing black enrollment on HWI campuses were geographic locations of the institutions and the greatest obstacles to increasing black faculty members in HWIs were geographic locations and the lack of new black Ph.D. graduates.

Outcomes of causes and control mechanisms constitute the basis for an applicable model for the Turkish National Police (TNP). Why is some police behavior deviate? What are the main determinants of police misconduct? Is police misconduct a result of sociological behavior and subcultural development within police organizations or a psychological behavior as an outcome of officers' personal traits? What are the control mechanisms for police misconduct? What are their strengths and weaknesses? Do they deter or not? Is there a control mechanism that deters better than others? What is the best deterrence model for the TNP?

A Study of the Rita Geier Case: Efforts to Desegregate Three State Universities in Tennessee from 1990-2006.

This study focuses on a 2-phase assessment of the desegregation of selected public postsecondary institutions under the Tennessee Board of Regents (TBR) [Tennessee State University and University of Memphis] and the University of Tennessee systems [University of Tennessee-Knoxville]. The 1st phase involved obtaining and analyzing the annual reports, court cases, legal journals, articles, and books concerning the 1968 Sanders v. Ellington case (better known as Geier v. Alexander); the 1984 Geier Stipulation of Settlement that mandated a desegregation plan; and the implementation of the 2001 Geier Consent Decree. The study also examines enrollment of black students in selected historically white institutions and white students enrolled in the selected historically black institution for the years 1985 (1 year after the 1984 Geier Stipulation of Settlement) through 2006 (5 years after the Geier Consent Decree and the same year the case was dismissed). The 2nd phase of this study involved interviewing administrators and principal actors responsible for the planning of, implementation of, and compliance with the Geier Stipulation of Settlement of 1984. The study reveals degrees of compliance or noncompliance with the Stipulation of Settlement of 1984 as well as the 2001 Consent Decree and examines more successful and less successful efforts to increase minorities enrolled and employed as faculty staff and administrators on each campus.

本論文では、日米両国の環境法における理論状況が法体系の性質からも大いに異なることを前提とした上で、米国において1970年代以降に制定された様々な環境法をめぐる議論を取り上げ、各種救済の態様について、事後救済、事前予防の両面から検証を行った。具体的には、我が国で検討の不十分な環境市民訴訟規定適用の根拠および要件と救済の機能、各種環境規制の導入において生じる収用をめぐる議論の検討を行った。 / This research examined the remedies of U.S. environmental law after 1970s. While their legal systems are quite different, the argument in U.S. could be helpful that of Japanese. The focus point of research is on the ground of citizen suits provisions and on the case when the plaintiff made consent decree.
