The government should take a more serious look at private prisons as an alternative to public production of correctional service due to its efficiency. It is clear that the privatization of correctional facilities is a viable option for the future of correctional facilities. The expansion of privatization in this country will depend upon public and political confidence that private prisons will as effectively and accountable as public prisons. Private prisons have also demonstrated to have other advantages such as continuous audits on site. Developing a sourcing strategy in the South African Police Service Garages

Thesis (MPA)--Stellenbosch University, 2012. / ENGLISH ABSTRACT: research study was about finding the right sourcing strategy that would work effectively for the South African Police Service (SAPS) garages. Its purpose was to help the SAPS garages deal strategically and effectively with their work load while repairing the SAPS vehicles, as the current evidence indicated that the garages might not have sufficient capacity to cope with the volume of repairs they were receiving. The research was structured as a case study design, in which personal interviews were held with SAPS garage managers, SAPS strategy drivers (Head Office) and executive managers at the City of Cape Town, Western Cape Provincial Government Fleet, and Passenger Rail Agency of South Africa (PRASA). To follow up on these initial one-on-one interviews, a further questionnaire comprising similar, information-gathering questions was sent out to various SAPS garage managers to elicit more detailed information on the circumstances of their individual garages. A literature review, which formed the basis of the study, explains the sourcing strategy, and explores different sourcing options including how to make the best sourcing decision. In this study, three models of sourcing strategy were considered, and were supported by the case study of the City of Cape Town, Western Cape Provincial fleet management, and PRASA. This study has proved that what the different authors have written and recommended about in-sourcing and outsourcing can still be considered in conjunction with the current legislative and policy framework. The cost analysis was conducted in order to be able to assess which option would be the more expensive between in-sourcing and outsourcing. The fundamental finding of this research was that the SAPS garages could not handle all the work they were receiving, as they did not have the capacity, for various reasons, to deal with the volume of vehicle repairs that were coming in, and that the variety of sourcing strategies at the different garages were not effectively reducing the backlog. There was no clear sourcing strategy in place from the National office to guide the garages. From these findings, the recommendation is that the big garages should handle all the services and minor repairs including some major repairs, with the majority of the major repairs being outsourced to service providers, while the smaller garages should focus on services and minor repairs only, and outsource all major repairs. The vehicles that are not within a 30km radius of the SAPS garages must be directly outsourced to providers using the RT46 contract, or similar arrangement. Further research studies are needed regarding the demographic structure of the garages, and also regarding the effectiveness and efficiency of the actual running of the garages. A balance then needed to be found between in-sourcing and outsourcing, whilst ensuring that the garages were operating efficiently and outsourcing responsibly. / AFRIKAANSE OPSOMMING: Die navorsingstudie is gedoen om die effektiefste en geskikste verkrygingstrategie vir die voertuigwerkswinkels van die Suid-Afrikaanse Polisiediens (SAPD) te bepaal. Die doel was om die werkswinkels te help om strategies en effektief te werk gegewe hulle werkslading, aangesien huidige bewyse getoon het dat hulle nie voldoende kapasiteit daarvoor het nie. Die navorsing is gestruktureer as ’n gevallestudie, waartydens persoonlike onderhoude met SAPD-werkswinkelbestuurders, SAPD- strategiese drywers (Hoofkantoor), en uitvoerende bestuurders van die Stad Kaapstad, die Wes-Kaapse Provinsiale Regering-vloot en die passasier-spooragentskap van Suid-Afrika (PRASA) gevoer is. Ter opvolging van die oorspronklike individuele onderhoude is ’n verdere vraelys gebruik waarin soortgelyke vrae aan SAPD-werkswinkelbestuurders gestel is om meer inligting aangaande die toestand van hulle werkswinkels te bekom. ’n Literatuuroorsig, wat die basis gevorm het van die studie, verduidelik die verkrygingstrategie en ondersoek verskillende verkrygingsopsies, asook hoe om die beste verkrygingsbesluite te neem. In hierdie studie is drie verkrygingstrategiemodelle oorweeg, wat ondersteun is deur die gevallestudie van die Stad Kaapstad, die Wes-Kaapse Provinsiale Regering-vlootbestuur en PRASA. Die studie het bewys dat dít wat die onderskeie outeurs oor in- en uitkontraktering bevind en aanbeveel het, steeds oorweeg behoort te word, aangevul deur die bestaande wetgewing en beleidsraamwerk. Die kosteontleding is gedoen om te bevestig watter in- of uitkontrakteringsopsies die effektiefste sou wees. Die fundamentele bevinding van hierdie navorsing is dat die SAPD se voertuigwerkswinkels tans nie al die werk wat hulle ontvang, kan hanteer nie, omdat hulle om verskeie redes nie die nodige kapasiteit het om die groot aantal voertuie wat inkom, te herstel nie. Die uiteenlopende strategieë wat die onderskeie werkswinkels volg sover dit uitkontraktering betref, verminder ook nie die agterstand nie. Daar is nie ’n duidelike verkrygingstrategie van die nasionale kantoor wat riglyne aan die werkswinkels verskaf nie. Die aanbeveling na aanleiding van hierdie bevindinge is dat die groot werkswinkels al die versienings en kleiner herstelwerk, met inbegrip van sekere groot herstelwerk, moet hanteer, terwyl die kleiner werkswinkels moet fokus op versienings en kleiner herstelwerk, en alle groot herstelwerk moet uitkontrakteer. Indien voertuie buite ’n 30 km-radius van ’n SAPD-werkswinkel is, moet sodanige herstelwerk uitgekontrakteer word deur gebruik te maak van die RT46-kontrak, of ’n soortgelyke reëling. Verdere navorsingstudies is nodig oor die demografiese struktuur van die werkswinkels, asook die doelmatigheid en effektiwiteit betreffende die werklike bedryf van die werkswinkels. ’n Balans moet gevind word tussen in- en uitkontraktering, terwyl daar verseker moet word dat die werkswinkels effektief bedryf word en uitkontraktering op ’n verantwoordelike wyse geskied.

Initially, a historical reconstruction is made with the scope of chronologically situating the emergence of the outsourcing institute and demonstrating its relations with the toyotista production model. Then the concept of the phenomenon is examined, in order to delimit its scope. It continues analyzing the legal and jurisprudential evolution, culminating with the enactment of Laws 13,429/2017 and 13,467/2017, the first laws to be dealt with regarding the general outsourcing of services in Brazil. It then reflects on the constitutionality and legality of the legal permission to outsource the service provider's final activity, as well as on the social and economic risks of the dissemination of outsourcing as a general contracting model, based on data provided by surveys in the area, on topics such as wages, work hours, length of employment, working conditions and union organization of outsourced workers. Finally, it presents a proposal for union restructuring, especially under the collective freedom of trade union approach, incompatible with the rigid criterion of aggregation by category imposed in Brazil, as a way to assure greater autonomy to outsourced workers, so that they themselves can seek, in the union of forces deriving from collective law, the solution to the problems arising from the adoption of the multiplied model of contracting, reconciling the values of human dignity with free initiative, foundations of the Federative Republic of Brazil – article 1, III and IV, of Constitution of 1988 / O presente trabalho tem por objeto o estudo das inovações legais introduzidas no ordenamento jurídico pelas Leis n.º 13.429/2017 e n.º 13.467/2017 acerca das relações triangulares de trabalho, especialmente sob o enfoque da terceirização da atividade-fim e seus efeitos precarizantes; e a investigação a respeito da influência da estrutura sindical brasileira nesses efeitos. Inicialmente, faz-se uma reconstrução histórica com o escopo de situar cronologicamente o surgimento do instituto da terceirização e demonstrar suas relações com o modelo de produção toyotista. Passa-se, após, ao exame do conceito do fenômeno, a fim de delimitar seu alcance. Prossegue analisando a evolução legal e jurisprudencial, culminando com a promulgação das Leis n.º 13.429/2017 e n.º 13.467/2017, primeiras a tratar sobre a terceirização geral de serviços no Brasil. Em seguida, reflete sobre a constitucionalidade e a legalidade da permissão legal de terceirização da atividade-fim do tomador de serviços, bem como sobre os riscos sociais e econômicos da disseminação da terceirização como modelo geral de contratação, a partir de dados fornecidos por pesquisas de relevo na área, sobre temas como salários, jornada, tempo de permanência de emprego, condições de trabalho e organização sindical dos trabalhadores terceirizados. Por fim, apresenta proposta de reestruturação sindical, especialmente sob o enfoque da liberdade coletiva de organização sindical, incompatível com o rígido critério de agregação por categoria imposto no Brasil, como forma de assegurar maior autonomia aos trabalhadores terceirizados, para que eles próprios possam buscar, na união de forças oriundas do direito coletivo, a solução para os problemas decorrentes da adoção do multicitado modelo de contratação, compatibilizando os valores da dignidade humana, com a livre-iniciativa, fundamentos da República Federativa do Brasil – artigo 1.º, III e IV, da Constituição Federal de 1988

在全球民營化的風潮中,臺灣地方政府已推動設置有32所公辦民營托兒所。本研究採個案研究,運用相關人士訪談、機構文件檔案、家長問卷與幼兒學習環境量表蒐集之資料,探究「臺北市政府社會局委託社團法人臺北市親子成長協會辦理吉利托兒所」的經營歷程。從承辦單位如何履行契約書中的教保服務內容,如何形塑教保品質與獲得哪些內/外在評價,以理解公辦民營幼托政策對幼托機構形塑教保品質的影響。研究結果分別從(一)過程評估觀點談公私協力關係中的曖昧現象;(二) 從建構整體教保服務生態品質觀點,論述公辦民營幼托政策於推動幼托機構設置的合理性。 / There has been a rapid growth in “privatization” over the past decade around world. Under the trend of global privatization, currently there are a total of thirty-two such publicly-funded, privately-managed day care centers in the fifteen counties of Taiwan. The purpose of this research is to inspect the influence of the Public-Private Collaboration Model on the quality of the early childhood programs. This research focuses on a case study of a publicly-funded, privately-managed day care center in Taipei in order to answer three research questions: how to implement contracts ,how to promote high-quality care in the process of managing, and what kind of outcome was achieved. Tools to collect data included interviews, documentation, questionnaires, and the Early Childhood Environment Rating Scale-Revised (ECERS-R). According to the result, the paper discusses the ambiguous relationship between the government and the day care center from the viewpoint of process evaluation, and the rationality of the Public-Private Collaboration Model for the quality of early childhood care and education.

臺北市公園附設游泳池委託經營之研究 / Studies on Contracting-out Project of Park Swimming Pools in Taipei City

摘要 臺北市政府順應世界潮流,推動公共事務委外,為達成撙節人力與預算支出,於民國八十九年率先將公園附設游泳池委託民間經營管理。然民國九十六年卻發生承包商中途歇業、游泳池關門以及新的標案無廠商投標的現象。 本研究主要目的在探討臺北市公園附設游泳池委託經營所面臨的問題,並就經營困境提供改善方案建議。本文應用之理論為公共選擇理論、交易成本理論、代理理論和公私協力理論,採用文獻分析法、深度訪談法及參與觀察法,探索臺北市政府轄管之公園附設游泳池經營管理之最佳模式。 經研究分析發現管理機關未嚴格依契約執行、未建立退場機制、低使用率之游泳池競爭力薄弱、法令限制多、游泳池缺乏活化以及未妥做政策之可行性評估等因素為之前委外經營失敗之原因。 經歸納後提出下列建議:(1)契約訂定要嚴謹並嚴格要求應依契約執行;(2)要建立退場機制;(3)加強監督以提高服務品質;(4)主管機關法令定位要明確;(5)審慎評估將使用率低的游泳池關閉或轉型;(6)確實做好可行性評估和先期規劃;(7)建置彈性的招商機制與強化自主的履約管理;(8)利用既有優勢,提高競爭力;(9)將使用率高有競爭力的游泳池優先更新;(10)應確實檢討委託經營政策;(11)加強教育訓練,提升專業能力;(12)應確實做好市場調查。 / Abstract Following the global trend of promoting the outsourcing of public affairs in order to reduce human resources and budget expenditure, Taipei City Government has contracted out park swimming pools since 2000. Then it happened that the contractor went out of business halfway and closed the swimming pools in 2007. Furthermore, no new tenders bided for the successive contract. This study aims to investigate problems of by contracting out Taipei City Government park swimming pools, to provide proposals to mitigate difficulties in outsourcing business operation and to explore the best mode of park swimming pools management. The theories used in this thesis include Public Choice Theory, Transaction Cost Theory, Agency Theory and Public-Private Partnership Theory. Study methods used include document analysis, in-depth interviews and participant observation. The study found that the followings are causes of failure in the previous outsourcing project: the administrative authority did not enforce strict accordance with the contract, exit mechanism was not established, some low-usage swimming pools were less competitive, there were too many legal restrictions, swimming pools activation was not sufficient and feasibility study of outsourcing policy was not well performed. The following recommendations are summarized: (1) Rigorous contract terms and strict execution in accordance with the contract; (2) Establishing exit mechanism; (3) Strengthening supervision in order to improve service quality; (4) Establishing clear regulations; (5) Closing or transforming low-usage swimming pools; (6) Well-performed feasibility assessment and preliminary planning; (7) Building flexible outsourcing mechanism and strengthening self-compliance management; (8) Improving competitiveness by using the existing strengths; (9) Renovating competitive high-usage swimming pools as top priority; (10) Reviewing outsourcing policies exactly; (11) Strengthening education and training to enhance professional skills; (12) Well-performed market research.

Three essays on the formation and finance of local governments

This dissertation follows a three-essay format. Each essay evaluates a different fiscal institution from a public administration perspective. In the first essay I examine whether state-funded property tax exemptions are effective in reducing the property taxes. This class of exemption is characterized by a grant from state to local governments that is intended to replace property tax revenue and lower property tax payments. Two separate theories of local fiscal behavior predict that that price effects and fiscal illusion will reduce the effectiveness of this type of tax relief. I test these predictions using panel regression analysis on county-level data from Georgia. I find that only two thirds of the revenue allocated to this program is actually used for tax relief. In the second essay I test a model of the property tax in which the levy is set to balance the difference between budgeted expenditures and expected receipts from all other revenue sources. This model demonstrates how the property tax can be used to offset unexpected changes to other revenues given a change in personal income. This model is contrasted with an alternative model in which expenditures are budgeted after expected total revenues have been determined. I will estimate both models for local governments in Georgia and test which more accurately describes local fiscal performance. I will also use both to predict changes to the property tax over a period of time and measure which model generated the more accurate forecast. Unlike the first two papers, which are quantitative analyses of fiscal data, this chapter is a case study of the contract city model of governance as implemented in the newly incorporated city of Sandy Springs, Georgia. I investigate whether the scope of outsourcing in contract cities creates additional challenges for city officials that manage contractor performance. I evaluate the incentive structures in the contract agreements that influence the principal-agent relationship using a textual analysis research method. I find that certain combinations of municipal functions in a single public-private partnership creates the potential for negative synergies to arise which would increase the difficulty of monitoring and managing the private partner.
