La spécialité contraventionnelle en matière pénale / The specificity of contraventional offences, “petty offences”, in criminal matters

La question contraventionnelle est devenue fondamentale dans la société française du XXIe siècle, tant elle est au coeur de la vie quotidienne de chacun. En matière contentieuse, nos juridictions répressives traitent autant d’affaires contraventionnelles que délictuelles, mais lorsque l’on considère que la majorité des sanctions contraventionnelles sont exécutées hors l’intervention du juge, cela érige la matière contraventionnelle en une question majeure de notre droit pénal. L’inflation des normes réglementaires techniques au cours de la seconde moitié du XXe siècle, a contribué à faire des contraventions un ensemble répressif très hétérogène et le développement de la circulation routière a conduit à une répression de masse dont la viabilité ne pouvait que reposer sur une simplification du droit, tant substantiel que formel. C’est ainsi que les normes régissant la matière contraventionnelle ont progressivement gagné en autonomie, se différenciant de plus en plus nettement du droit commun. Toutefois, en écartant le juge de la répression des contraventions, la simplification du droit n’a pas manqué de porter atteinte aux droits fondamentaux et en particulier aux règles du procès équitable. Cette problématique est aujourd’hui au coeur de l’évolution de la matière qui semble ne pas avoir encore trouvé son point d’équilibre entre efficacité répressive et respect des droits de la défense / The question of petty offences called “contraventions” in French law, has become fundamental in the twenty first century French society, as it is at the heart of every citizen’s daily life. In litigious matters, our criminal courts deal with as many contraventional cases as misdemeanour cases. However, when we consider that the majority of contraventional penalties are executed without the intervention of the judge, this makes the issue of contraventions a major issue in our criminal law. The inflation of technical regulatory standards during the second half of the twentieth century, has contributed to make contraventions a very heterogeneous repressive set of rules and the development of road traffic has led to a mass repression whose sustainability could only be based on simplification of the law, both from a substantive and a formal perspective. As a result, the norms governing contraventional matters gradually gained autonomy, differentiating themselves more and more clearly from common law. However, by excluding the judge from the repression of contraventions, the simplification of the law did not fail to infringe the fundamental rights and in particular the rules of the fair trial. Today, this issue is at the heart of the evolution of the contraventional offenses, which seems to have not yet found its point of balance between repressive effectiveness and respect for the rights of the defence

The infringements of civil procedure were already defined in the procedural law of 1964 in Lithuania. They always used to determine the absolute nullity of legal proceedings and decreed judgement. Currently these procedural breaches are regulated in final enumeration of the second and third parts of 329 article of valid civil procedure Lithuanian code.

Notre étude intitulée « dramaturgie et morale », porte sur la mise en scène des valeurs morales dans les comédies de Ménandre et de Plaute. Notre approche consiste à repérer quelles sont les valeurs mobilisées, à étudier la manière dont elles sont exprimées et articulées entre elles. Il s’agit d’analyser leur traitement et la place qui leur est conférée : sont-elles soumises à réflexion, confirmées, mises à l’épreuve ? Ainsi l’enjeu n’est pas tant de chercher la « morale » des pièces ou le message moral qu’elles délivreraient, mais de décrire l’architectonique des valeurs dans les comédies. Nous nous sommes intéressée plus particulièrement à l’axiologie, c’est-à-dire à la forme que prend l’évaluation morale dans les comédies de Ménandre et de Plaute. Quels sont les critères qui déterminent cette évaluation ? Quel est l’enjeu de cette évaluation ? La valeur, telle qu’elle apparaît dans les comédies de Ménandre et de Plaute, est essentiellement de trois types : matérielle, symbolique et éthique. La question est de comprendre comment elles sont pensées et articulées les unes aux autres dans chacun des deux corpus. Cette perspective rejoint la question du rapport entre l’intérêt particulier et l’intérêt d’autrui, centrale dans les philosophies antiques qui posent la question de savoir dans quelle mesure il est nécessaire pour l’agent éthique de prendre en compte l’intérêt d’autrui pour atteindre son propre bonheur.Une première partie est consacrée aux notions de valeurs et d’échange, autour de deux types d’échange : l’échange marchand et l’échange social, le premier mettant en œuvre une morale de type utilitariste et le second faisant appel à des vertus coopératives. Une seconde partie étudie la notion d’infraction. Il s’agit d’examiner les modalités d’évaluation d’une action singulière. Dans une troisième partie, nous étudions la comédie comme expérimentation éthique. / This study, entitled “dramaturgy and morals”, looks at the dramatization of moral values in the comedies of Menander and Plautus. I employ an approach that identifies which values are evoked and looks at how they are conveyed and structured in relation to one another. The aim is to analyse how they are treated and the place that is accorded to them. Are they subjected to reflection, affirmed, or critiqued? Thus what is at stake is less about finding the “morals” in the plays or their supposed moral message, but rather delineating the architectonics of values in these comedies. This study will focus more specifically on axiology, that is to say the form that moral evaluation takes in the comedies of Menander and Plautus. According to which criteria is this evaluation carried out? What is at stake in this evaluation?The concept of value, as it appears in the comedies of Menander and Plautus, entails essentially three domains: the material, the symbolic, and the ethical. The issue at hand is understanding how they are conceived of and related to one another in the comedies of Menander and Plautus. Such a perspective intersects with the question of the relationship between personal interest and the interests of others, a key concern in Ancient philosophy which seeks to discover to what extent an ethical agent is obliged to take into consideration others in order to achieve happiness. The first section is concerned with the concepts of moral values and trade. It looks at two types of trade: commercial trade, which outlines the primacy of utilitarian morals, and communal trade, which is based on co-operative values. The second section deals with the idea of contravention. It examines the procedures used to judge a particular action. The third section looks at comedy as ethical experimentation.

1 Abstract - Administrative penalties and protection measures Description of all administrative penalties and protection measures is the primary goal of this thesis. Due to wide extent of chosen subject, this work aims to individual categories of administrative penalties and protection measures, examines every single condition for its imposition a notices possible contradiction within legislation. The thesis does not include the criteria for imposing penalties, noticed set from section 37 till section 44 Contraventions Act which serve as instruments for determination and length of penalties. Concurrence of contraventions is also not included. In the opening chapter the definition and description of an administrative liability is described as well as basic issues of administrative penalization, considered to be a part of administrative authority's activity. The resemblance of principles of criminal and contravention law is described, that leads to using the same principles either in criminal and contravention law. There's explored what basic sources of administrative penalization are. Each of following chapters describes one of the penalties set in section 35 Contravention Act.
