Previous issue date: 2013-08-30 / CAPES / REUNI/UFPE / O conteúdo televisivo constitui um importante referencial para o homem na produção de sentido e construção social da realidade. Da análise do ambiente regulatório brasileiro sobre o tema, percebe-se que a legislação fornece somente a saída judicial para a defesa de conteúdos que abusem da liberdade de expressão contra outros direitos fundamentais ou que contrariem as normas de classificação indicativa. Esta dissertação analisa o controle judicial do conteúdo televisivo, traçando um diagnóstico das Ações Civis Públicas impetradas pelo Ministério Público Federal contra conteúdos televisivos veiculados pelas cinco maiores emissoras comerciais brasileiras de canais abertos. Objetivou-se conhecer em que termos estão sendo propostas e julgadas estas ações em defesa da coletividade. Através de pesquisa empírica e de conteúdo, utilizou-se uma abordagem qualitativa para se analisar os seguintes dados: polos passivos e ativos das ações; programas contestados; tempo dos processos; doutrina, legislação e jurisprudência citadas nas ações; pedidos formulados e sentenças proferidas. A partir dos dados coletados, sobretudo do tempo do processo e das decisões prolatadas, concluiu-se que a via jurisdicional não constitui a melhor forma de resolução desses litígios. A morosidade processual se contrapõe à lógica imediatista da veiculação de conteúdo televisivo resultando na ineficácia do direito pretendido. Ainda, o grau abstrato e não enquadrável das formulações legais que regulam o conteúdo televisivo como, por exemplo, “valores éticos e sociais da pessoa e da família”, “moral pública” e “bons costumes”, requer uma resposta mais plural e democrática baseada em diversas mundividências, o que diverge do julgamento tradicional baseado nos fatos oferecido pela justiça. / The television content is an important model for the man in the production of meaning and social construction of reality. In analysis of the Brazilian regulatory environment on the subject, we find that the law provides only legal outlet for the defense contents that abuse the freedom of expression against other fundamental rights or contrary to the classification standards indicative. This dissertation examines the judicial control of the TV content, making a diagnosis of Public Civil Actions filed by federal prosecutors against television content served by five major commercial stations Brazilian open channels. The objective was to know on what terms are being filed and adjudicated these actions in defense of the community. Through empirical research and content, we used a qualitative approach to analyze the following data: pole passive and active actions; programs disputed; process time; doctrine, legislation and case law cited in the actions; orders and judgments required. From the data collected, mainly from the time of the process and the decisions, we conclude that the judicial process is not the best way to resolve such disputes. The processing delays opposes the logic of immediate placement of television content resulting in ineffective law intended. Still, the degree of abstract and not classifiable legal formulations that regulate television content such as, "ethical and social values of the person and the family", "public morals" and "morality", requires a more plural and democratic based on different worldviews that diverge from the traditional judgment based on the facts offered by justice.

Previous issue date: 2016-12-01 / This dissertation, linked to the Contemporary Legal and Criminal Systems line of research of the Graduate Program in Criminal Sciences stricto sensu of the Faculty of Law, is an expansive interdisciplinary, historical and in-depth study, concerning the unconstitutionality and unconventionality of how the adage in dubio pro societate incides into the judicial order, as a form of solving legal doubts as to the sufficiency of evidence as to criminal authorship and proof of materiality. Based on hermeneutical discussions, we seek to examine the decision-making act, notably in judicial analysis of the evidence produced by the parties. In this sense, the study found that such judicial protagonism, rather than providing fundamental rights protection, functions in fact, as a reminder of the inquisitorial culture to which the of Criminal Process Code of 1941 and much of the legal institutions that followed are linked. The adoption of the referred to adage as a decision-making standard for the solution of legal questions, violates the rule in dubio pro reo, or the presumption of innocence and human dignity, to the extent that it submits a person to trial, despite no certainty as to the minimum requirements for the delivery of the verdict. Finally, under the new Constitutional order established in 1988, and opening rules provided by paragraph 2 and paragraph 3 of Article 5, of the Federal Constitution, it is necessary to exercise conventional jurisdictional control of normative or judicial acts especially in the course of criminal proceedings. All of this occurs, within the continuing process of human rights internationalization of which Brazil is part of. Through a brief review, the study shows that despite all of the internal and external regulatory efforts to secure human rights, the Brazilian Judiciary, through its Superior Courts, has both systematically and massively been removing the presumption of innocence, in order to consecrate an incompatible adage to the founding values of the Republic. / A presente disserta??o, vinculada ? linha de pesquisa Sistema Jur?dico-Penais Contempor?neos do Programa de P?s-gradua??o stricto sensu em Ci?ncias Criminais da Faculdade de Direito, representa uma pesquisa expansiva e aprofundada, interdisciplinar, hist?rica sobre a (in)constitucionalidade e a (in)convencionalidade da incid?ncia do ad?gio do in dubio pro societate na decis?o de pron?ncia, como forma de solu??o da d?vida judicial quanto aos ind?cios suficientes de autoria e prova da materialidade delitivas. Previous issue date: 2012-10-25 / The following paper aims at the study of Fundamental Rights, especially of a social
nature which ensure availability to health, education, housing and food. The study of
these constitutionally consecrated rights focuses on the identification of the rights
that can be immediately demanded from the Public Power, even if by means of
judicial intervention and without legislative intermediation. It is recognized, moreover,
that the full and immediate efficacy of fundamental social rights stems from the
normative configuration of each of the rights secured by the Constitution itself, which
permits the conclusion that some rights, although provided in the Constitution,
demand political decision-making to complete the normative framework, necessary to
the enforcement of these rights, even if they are not mere future commitments. On
the other hand, the study analyzes the feasibility of jurisdictional control over public
policies, either in the event of omission from the legislator or another governing body
in charge, or in the event of inadequacy or delay in execution of public policies, which
already shows the political decision, or, lastly, in the event of insufficiency of public
policies carried out by the Public Power, always observing the limits of jurisdictional
intervention, when admitted / O presente trabalho volta-se ao estudo dos Direitos Fundamentais, especialmente
dos direitos sociais de cunho prestacional como saúde, educação, moradia e
alimentação. Busca-se no estudo desses direitos constitucionalmente consagrados a
identificação daqueles que podem ser imediatamente exigidos do Poder Público,
ainda que por meio de intervenção judicial e sem intermediação legislativa.
Reconhece-se, ademais, que a eficácia plena e imediata dos direitos fundamentais
sociais decorre da configuração normativa de cada um dos direitos, fixada pela
própria Constituição, o que permite concluir que alguns direitos, ainda que previstos
no texto constitucional, exigem a tomada de decisões políticas para completar o
arcabouço normativo necessário à concretização desses direitos, ainda que não
sejam meros compromissos futuros. Por outro lado, analisa a viabilidade do controle
jurisdicional sobre políticas públicas, seja na hipótese de omissão do legislador ou
de outro órgão encarregado, seja na hipótese de inadequação ou retardamento da
execução de políticas públicas que já contam com a marca da decisão política, seja,

O presente trabalho examina a questão dos limites da intervenção judicial sobre os atos políticos. Para tanto, parte de um apanhado histórico que abrange o desenvolvimento da political questions doctrine junto à Suprema Corte dos Estados Unidos e da teoria dos actes de gouvernment junto ao Conselho de Estado francês, até chegar ao Brasil. Após, examina como o Supremo Tribunal Federal vem enfrentando o tema ao longo dos anos, fazendo uso de três questões pontuais, quais sejam, o controle dos atos administrativos discricionários, a participação do Poder Judiciário na definição e implementação das políticas públicas e o controle jurisdicional dos processos político-disciplinares. Ao final, esboça uma solução em que se define a amplitude da atividade política do Estado e traça os limites das esferas de atribuições dos poderes do Estado, fiel ao disposto pelas normas constitucionais. / The current paper examines the field of the limits of the judicial intervention in political decisions. To do it so, it starts with a historical overview that covers the development of the 'political questions doctrine' by the United States Supreme Court and the 'actes de gouvernment' theory by the French State Council, until it arrived in Brazil. After, examines how the Brazilian Supreme Court has been deciding the matter throughout the years, using three punctual questions, namely, the control of discretionary administrative acts, the participation of the Judiciary in the definition and implementation of public policies and the jurisdictional control in political-disciplinary cases. In the end, suggests a solution that defines the amplitude of the political activity by the State and indicates the limits of attributions of the State powers, faithful to the dispositions of the Constitution.

[pt] A presente dissertação se propõe a analisar a extensão do controle judicial
aplicável às decisões proferidas pelo Conselho Administrativo de Defesa
Econômica - CADE (“CADE”), autarquia vinculada ao Ministério da Justiça que
detém a competência legal de prevenir e reprimir infrações à ordem econômica.
Analisaremos a extensão, e não a viabilidade em si, do controle judicial aplicável
às decisões do CADE, pois é princípio assente em nosso Direito, com respaldo no
próprio texto constitucional, que nenhuma lesão de direito poderá ser subtraída à
apreciação do Poder Judiciário (art. 5º, inciso XXXV, da Constituição Federal de
1988). Por uma questão lógica e programática, iniciaremos o estudo abordando
aspectos relevantes da discricionariedade administrativa, que é um dos temas mais
apaixonantes do Direito Público e que mereceu a incansável dedicação de juristas
ilustres, como Seabra Fagundes, Caio Tácito, Afonso Rodrigues Queiró, Eduardo
García de Enterría, Celso Antônio Bandeira de Mello, apenas para citar alguns.
Dentro do amplo tema da discricionariedade, despertou-nos especial interesse a
relação entre a competência discricionária e os conceitos jurídicos
indeterminados. Essa discussão, embora ainda incipiente em nosso ordenamento
jurídico, vem atraindo cada vez mais a atenção dos estudiosos em direito
administrativo, não havendo ainda uma uniformidade de opiniões a respeito do
assunto. A seguir, analisaremos as técnicas de controle judicial dos atos
administrativos de forma geral, que, desde as Teorias do Desvio de Poder e do
Controle dos Motivos do Ato Administrativo, foram sendo aprimoradas ao longo
dos anos. Aqui também abordaremos a superação, a partir do pós-positivismo, do
antigo dogma da insindicabilidade do mérito do ato administrativo, especialmente
em caso de violação a princípios gerais de direito assegurados pelos ordenamentos
constitucional e infraconstitucional vigentes. Abordados os aspectos relevantes
acerca da discricionariedade administrativa, passaremos a analisar os princípios jurídicos que regem a ordem econômica, a finalidade inspiradora da legislação
infraconstitucional de proteção ao direito da concorrência e, em especial, as
competências legais do CADE. Em capítulo específico, examinaremos ainda a
natureza jurídica das decisões proferidas pelo CADE nos processos de conduta e
nos atos de concentração econômica, o que é imprescindível para se determinar a
extensão do controle judicial aplicável. Pretendemos dar especial ênfase à
controvérsia na doutrina quanto à existência ou não de discricionariedade em
favor do CADE para deferir ou indeferir atos de concentração submetidos à sua
análise, identificando em que situações hipotéticas a discricionariedade poderia se
verificar. Nesse contexto chama a atenção a faculdade outorgada ao CADE pela
Lei nº 8.884, de 11 de junho de 1994 (art. 54, parágrafos 1º e 2º), de aprovar
determinadas operações que, embora sejam potencialmente lesivas à concorrência,
são capazes de gerar eficiências, segundo a acepção do termo no âmbito do direito
econômico, como, por exemplo, avanços tecnológicos, aumento ou diversificação
na produção, aprimoramento na qualidade dos bens ou serviços, entre outras.
Pretendemos indicar como a doutrina tem interpretado esses dispositivos legais,
isto é, se eles representam ou não a outorga de uma certa margem de discrição ao
CADE nessas situações. A nossa proposta, assim, é tentar delimitar o núcleo de
incidência da discricionariedade, acaso existente, e a extensão do controle judicial
aplicável às decisões do CADE, levando em consideração a existência de
conceitos jurídicos indeterminados na Lei nº 8.884/94, bem como o papel que os
princípios hoje exercem como balizadores da atuação de qualquer ente
administrativo. Também buscaremos traçar um perfil dos litígios existentes contra
o CADE, realizando uma análise crítica da jurisprudência brasileira, para após
tecer nossas considerações finais sobre o tema. / [en] The objective of the present essay is to analyze the
judicial review
applicable to the decisions rendered by the Administrative
Council of Economic
Defense (Conselho Administrativo de Defesa Econômica -
CADE), an agency
reporting to the Ministry of Justice legally competent to
prevent and repress
violations to the economic order. This essay analyzes the
extent but not the
viability, per se, of the judicial review applicable to
CADE s decisions, because it
is a principle of Brazilian Law, supported by the Federal
Constitution, that the
law shall not exclude from appreciation by the Judiciary
Branch an injury or
threat to a right (art. 5, XXXV, of the 1988 Federal
Constitution). For the sake of
logic and planning, this essay will initially approach
relevant aspects of
administrative discretion - one of the most fascinating
themes of Public Law and
worthy of endless dedication by distinguished jurists such
as Seabra Fagundes,
Caio Tácito, Afonso Rodrigues Queiró, Eduardo García de
Enterría, and Celso
Antônio Bandeira de Mello, among others. In the scope of
administrative
discretion, the relationship between discretionary
competence and undetermined
legal concepts was an issue that has specially called our
attention. This discussion,
although still incipient in our legal system, has
increasingly been attracting the
attention of scholars dedicated to administrative law.
Nonetheless, a peaceful
understanding has not been reached in this respect yet.
The techniques for judicial
review of administrative acts - which have been perfected
since the establishment
of the theories of Deviation of Power and Control of the
Reasons of the
Administrative Act - will be analyzed subsequently. We
will also address the
elimination, in the post-positivism era, of the ancient
dogma banning the judicial
review of the merits of the administrative act, especially
in case of violation of
legal principles guaranteed by the Constitution and
ordinary legislation. After the
analysis of the relevant aspects of administrative
discretion, we will review the
legal principles that govern the economic order, the
objectives of antitrust legislation and, mainly, CADE s
legal competence. In a specific chapter, we will
focus on the legal nature of the decisions rendered by
CADE in cases involving
anticompetitive practices and in the analysis of
concentration acts, which is
necessary in order to determine the extent of the judicial
review applicable.
Special attention was drawn on the controversy regarding
the existence or not of
discretional powers on the benefit of CADE in granting or
denying approval to
concentration acts submitted to its analysis. We will also
identify situations in
which such discretional powers could theoretically take
place. In this scenario, the
faculty granted to CADE by Law 8,884 of June 11th, 1994
(art. 54, paragraphs 1
and 2) to approve certain transactions which, although
potentially harmful to
competition, might give rise to efficiencies - in the
scope of the meaning
attributed to the term by economic law - such as, for
instance, technological
progress, production increase or diversification,
improvement of the quality of
goods or services, among others. This essay also indicates
how legal scholars have
construed such legal provisions, i.e., whether or not such
legal provisions actually
confer a certain discretion to CADE under those
circumstances. Thus, the aim of
this essay is to outline the area of administrative
discretion, if any, and the extent
of the judicial review applicable to CADE`s decisions,
taking into consideration
the existence of undetermined legal concepts in Law No.
8,884/94, as well as the
role played by the principles in guiding the acts
performed by any administrative
entity. This essay also seeks to delineate the profile of
the existing disputes
against CADE in Brazilian Courts and to make a critical
analysis of our case law.

Previous issue date: 2011 / O presente trabalho tem o objetivo de verificar a extensão e os limites do controle jurisdicional sobre o ato administrativo impositivo de sanção disciplinar. A partir da evolução do modelo de estado, surge o Estado Constitucional e Democrático de Direito, responsável por introduzir no Direito Administrativo uma nova construção teórica que permite a releitura de institutos jurídicos. Sustenta-se que, no âmbito do Direito Administrativo contemporâneo, cuja finalidade precípua é a defesa do cidadão e a efetivação de direitos fundamentais, a discricionariedade administrativa deve ser dissociada do conceito de mérito administrativo e não pode ser concebida como liberdade de escolha do administrador público. Para tanto, analisa-se a evolução do modelo de Estado e do modelo jurídico que lhe oferece suporte, a fim de que se demonstre a existência de um direito fundamental ao controle jurisdicional sobre os atos administrativos. democrático de direito, são definidas, na constituição e demais documentos legislativos infraconstitucionais, diretrizes a serem concretizadas a partir da adoção de políticas públicas,
as quais servem como instrumentos para a realização dos objetivos estatais que devem ser direcionados para o bem comum. A proposta é analisar o controle jurisdicional sobre políticas públicas, observando o confronto entre a necessidade de concretização de direitos fundamentais, especialmente aqueles que servem para assegurar a implementação do mínimo
existencial, e a obrigatoriedade de observância dos princípios da divisão harmônica das funções estatais, da legitimidade democrática, bem como as limitações decorrentes da reserva
do possível e da microvisão do Poder Judiciário. Para solucionar esse embate entre princípios de hierarquia constitucional, será imperiosa a aplicação do princípio da proporcionalidade,
como forma de possibilitar o exercício do controle jurisdicional sobre políticas públicas, sem que se promova uma atuação exacerbada dos magistrados nem tampouco que se deixem de
efetivar direitos constitucionais em razão da inércia do Estado na realização de políticas públicas.

O presente trabalho examina a questão dos limites da intervenção judicial sobre os atos políticos. Para tanto, parte de um apanhado histórico que abrange o desenvolvimento da political questions doctrine junto à Suprema Corte dos Estados Unidos e da teoria dos actes de gouvernment junto ao Conselho de Estado francês, até chegar ao Brasil. Após, examina como o Supremo Tribunal Federal vem enfrentando o tema ao longo dos anos, fazendo uso de três questões pontuais, quais sejam, o controle dos atos administrativos discricionários, a participação do Poder Judiciário na definição e implementação das políticas públicas e o controle jurisdicional dos processos político-disciplinares. Ao final, esboça uma solução em que se define a amplitude da atividade política do Estado e traça os limites das esferas de atribuições dos poderes do Estado, fiel ao disposto pelas normas constitucionais. / The current paper examines the field of the limits of the judicial intervention in political decisions. To do it so, it starts with a historical overview that covers the development of the 'political questions doctrine' by the United States Supreme Court and the 'actes de gouvernment' theory by the French State Council, until it arrived in Brazil. After, examines how the Brazilian Supreme Court has been deciding the matter throughout the years, using three punctual questions, namely, the control of discretionary administrative acts, the participation of the Judiciary in the definition and implementation of public policies and the jurisdictional control in political-disciplinary cases. In the end, suggests a solution that defines the amplitude of the political activity by the State and indicates the limits of attributions of the State powers, faithful to the dispositions of the Constitution.

O presente trabalho dedica-se ao estudo do mínimo existencial enquanto critério de adjudicação dos direitos sociais no controle jurisdicional de políticas públicas. A análise parte do conceito usualmente adotado pela doutrina e pela jurisprudência pátrias, isto é, um conceito intimamente ligado ao princípio da dignidade da pessoa humana que condensa em si o núcleo duro e essencial dos direitos fundamentais e que teria, portanto, justiciabilidade imediata, independentemente das condições fáticas presentes em determinada situação concreta. Esse critério, cujo conteúdo seria determinado a priori, é posto à prova diante das outras premissas adotadas em nosso ordenamento dentre elas a reconhecida aplicação do princípio da proporcionalidade, na teoria de Robert Alexy. Nesse contexto, o mínimo existencial assume maior relevo enquanto critério se analisado diante de uma situação concreta, juntamente com outros parâmetros, na tentativa de estabelecer balizas coerentes e seguras à intervenção judicial no âmbito das políticas públicas. / The present paper analyzes the concept of minimum core of economic and social rights as a standard for the adjudication of such rights under the judicial control of public policies. The starting point of our analysis is the concept usually adopted by Brazilian doctrine and jurisprudence, which is a standard closely linked to the principle of human dignity and which has been applied to provide determinacy and justiciability to those rights, creating immediately specific governmental obligations. This concept is confronted to other premises adopted in Brazilian legal system (specially the principle of proportionality under Robert Alexys theory). By doing so, this paper develops a different approach to giving content to the minimum core and proposes its analysis together with other parameters for judicial control taking into account the facts under a concrete situation. This paper further demonstrates how this new approach provides consistent and reliable guidelines for judicial intervention in government policies.
