penological investigaion regarding Correctional Policy and Legislation, which is the aim
of this research.
This penological literature study will focus on an historic overview of the prison as an
institution for punishment. Besides the historical background of the South African
prison system it is also thereby placed on the policy and legislation of countries such
as the Netherland's and England's prison institutions. After the implementing of policy
and legislation in the prison systems the basis for an improved prison system was
formed.
Important core understandings of policy and the application of lawful prescriptions were
checked and the different levels of the policy were included in the South African
correctional system. Features of the policy and legislation were continually adapted
after the changing needs and circumstances on social, economic and political
environments. Consequently indicating in this comparative penological investigation
it has come to the conclusion that no penalty institution can function normally and
efficiently without a well-considered policy and legislation. It has been found that the
formulation and implementation of the policy and prescriptions are an important part of
the planning process of the correctional system.
Rational for the search for correctional policy and legislation are mainly examined in
South Africa and consequently it was to identify the respective policy and lawful
prescriptions. It was contracted against the background of the maintenance and
protection of a just, peaceful and safe society as the Law enforces verdicts of courts to
imposed, charge like all captive sentence safe conservation to while their human dignity
is assured and same time around the Constitution of the Republic of South Africa, No 108 of 1996. This Act was also promoting the social responsibility and human
development of all prisoners and persons subject to community corrections.
The implementation of policy and lawful prescriptions were orderly emphasised to the
advantage or disadvantage of the captive and the prison system. This comparative
investigation gave recognisance to international principles over corrective events and
is included in a penological perspective at the same time. / Hierdie proefskrif is 'n poging om 'n teoretiese-prinsipiele uiteensetting te gee oor 'n
Vergelykende penologiese ondersoek rakende Korrektiewebeleid en Wetgewing ten
einde die doelwit van hierdie navorsing te bereik.
'n Literatuurstudie oor die historiese ontwikkeling van die gevangenis as strafinrigting
is ingestel en is gefokus op die gevangenisstelsels in Suid-Afrika, Engeland en Nederland.
Benewens hierdie historiese agtergrond is die doel om die ontwikkeling van die
strafbeleid en wetgewing in oorsese lande en in Suid-Afrika te identifiseer ten einde die
verandering binne die gevangenisstelsels te verstaan. Hierdie gebeurtenisse van
vroeer en hedendaags het die grondslag gevorm vir 'n verbeterde gevangenisstelsel.
Belangrike kernbegrippe van beleid en die toepassing van wetlike voorskrifte is
nagegaan en die verskillende vlakke van beleid wat betrekking het op die Suid-Afrikaanse
korrektiewe stelsel is omskryf. Wetgewing is as die hoogste vlak van beleid beskryf en gevolglik word beleid en wetgewing voortdurend aangepas na gelang van
veranderde behoeftes en omstandighede op maatskaplike-, ekonomiese- en politieke
terreine.
In hierdie penologiese ondersoek is aangedui dat geen strafinstelling normaal en
doeltreffend kan funksioneer sonder 'n deurdagte beleid en wetgewing nie. Daar is
aangedui dat die formulering en implementering van die beleid en voorskrifte deel is van
die beplanningsproses van die korrektiewe stelsel.
Die rasionaal van korrektiewebeleid en wetgewing is hoofsaaklik in Suid-Afrika
ondersoek en is onderskeie beleidsrigting en wetlike voorskrifte in oenskou geneem.
Oit is gedoen teen die agtergrond van die instandhouding en beskerming van 'n
regverdige, vreedsame en veilige samelewing wat deur die Wet voorgeskryf is om alle
gevangenes in veilige bewaring aan te hou terwyl hul menswaardigheid verseker word.

A critical analysis of gangsterism in South African correctional centres : the case of Barberton management areaNel, Sarah Lettie 31 August 2017 (has links)
Prison gangs are currently rife in South African correctional centres. Correctional officers and fellow offenders are frequently attacked by gang members, facilities are damaged and inmates are injured or killed in fights or during fires in correctional centres. Severe gang violence occurred at the Polls moor and Rustenburg correctional facilities at the end of 2016 and inexperienced correctional officers lacked the expertise to suppress the violence. This state of affairs necessitates further study into the management of prison gangs.
Given the above background, this study aimed to examine how correctional facilities can
suppress gang activity. The study provides an overview of the history of gangs in South Africa and shows how community gangs spread to prisons. This is followed by a meticulous documentation of the different elements of gang culture by means of observation in an effort to arm future correctional officers with knowledge regarding gangs. The findings of the observation revealed that gangs each have a unique way of greeting, using hand gestures, tattoos and verbal greetings. These communicative acts can be used as part of a strategy to prevent new offenders from becoming involved in gang activity.
The observational research was confirmed by means of qualitative research. The experiences of gang members were examined by means of questionnaires to better understand the dynamic. The qualitative study was conducted at four correctional facilities, namely a maximum, medium A and medium B facility and a town youth facility. These different facilities ensured that all age groups were represented. Questionnaires were distributed to offenders who voluntarily consented to participating in the research.
The literature study showed that South Africa has good legislature and policies in place, but that they have to be implemented more strictly and that the correctional officers have to be empowered by an increase in human resources and funding.
In addition to capacity building, the strategic framework presented as part of the study suggests that supervision of gang members should be sharpened by for instance reconsidering the lay-out of correctional facilities. Gang members should be involved in rehabilitation programmes, which are frequently available, but not implemented. Correctional officers should be trained to manage gang members and legislation and policies should be revised frequently, as criminals tend to adjust their modus operandi continuously.
The suggested framework can be of great value to the Department of Correctional Services, as managing gang activity in correctional centres can greatly change the efforts of the department to rehabilitate offenders. / Corrections Management / M. Tech. (Correctional Services Management)

the lack of discipline amongst prisoners and members of
Correctional Services has on the rehabilitation of offenders. A
complete literature study was done to investigate the current lack
of discipline amongst prisoners and members. Discipline is also
brought into relationship with community based sentences such
as Correctional Supervision as well as the involvement of the
community in the release of prisoners. Positive rehabilitation can lead to crime prevention but the Department of Correctional Services and the community will have to take hands to reach this common goal.
This subject needs further research in order to make recommendations to promote rehabilitation of off enders and to uplift the standard of discipline within the Department of Correctional Services. / Hierdie ondersoek is onderneem om die invloed van gevangenes en personeeldissipline binne die Departement Korrektiewe Dienste in verband te bring met die invloed wat dit het op die rehabilitasie van oortreders. Corrections has always been conventionally known as an occupational discipline and
not a profession. The organization of corrections has been spoken of as a
penitentiary, bearing in mind that the models of the buildings were meant for
punishment; with correctional officers recognized as guards. The role of the guards
was that of the keeper of the keys and their duty was mainly custodial in nature. The
occupation was mainly attractive to white males with a record of unemployment and
not much education. The occupation was stable, and did not require for any extra
skill. Certain researchers believe that the selection methods for prison warders were
extremely relaxed with a small amount of empirical validity. There was also thinking
that a correctional officer needed a 20/20 vision and an IQ of an imbecile.
Conversely, it has been perceived that a correctional officer can be the most
significant individual in the offender’s life, having an influence in refining or declining
the success of the different treatment programs that an offender undergoes (Josi &
Sechrest, 1998, p. 3).
Corrections is a human service occupation. Therefore, human service workers need
to have knowledge of human behaviour and be able to assess their perspectives on
any behaviour wisely and thus formulate reliable estimations. This will give them the
opportunity to enjoy suitable decision making powers and formulate a trend on
professional behaviour. Their knowledge of human behaviour will also strengthen the capability to foresee behaviour and give special knowledge to prevent any
hesitancy(Williamson, 1990, p. 43).
The role of the correctional officers (security staff) has intensely changed over the
past few decades.The correctional officer is in today's corrections, expected to
balance security and still be responsible for changing the behaviour of offenders
constructively (Josi & Sechrest, 1998, p. 11). In order to have a comprehensive
understanding of the distinctive and contradictory role of the correctional officer, it is
very important to appreciate the changes that have transpired in penal philosophy all
through the centuries. Throughout the research, the researcher will make an effort to
capture the heritage of corrections and the evolving systems of punishment of
Europe, the United States of America and South Africa and look at the applications
of the rehabilitation concept and how the Correctional Officer has been utilised as a
skilled and knowledgeable professional in the whole process. The aim of the
research being to determine the effect that correctional and professional officers
have on rehabilitation of offenders and determine the process by which the
Correctional environment can be transformed to a true profession of highest integrity
and competence.
Objectives for the study will be:
• To analyse the history and development of Corrections internationally and its
philosophical background
• To examine the impact of the history of rehabilitation in the South African
Corrections system, from the development of the first prisons in 1652 to the
demilitarisation of prisons system in the 1990s, right through to the
actualisation of the South African White Paper on Corrections, 2005
• To critically examine the professional status of the Corrections occupation
against other existing professions. The issues on education, training,
credentialing, autonomy, code of ethics and special expertise are some of the
aspects that will be looked at as the primary criterion for professions
• To explain the conception of rehabilitation and its development and

the mandated role of the Correctional officer and the duality of the role of
balancing security and rehabilitation.
The study will contribute on the basis of knowledge in particular regard to Education
and Training of Correctional Officers. A model will be developed for South African

The transformation of South African Correctional Centres of Excellence through equitable unit managementMasina, Joseph 29 April 2019 (has links)
The purpose of this study was to evaluate the implementation of the Unit Management into the South African Correctional Centres of Excellence. The focal point is based on the case management, multi-disciplinary approach, monitoring, and human rights of offenders. Unit Management was adopted into South African correctional system in 1995 under the leadership of the former Minister of Correctional Services Dr Sipho Mzimela. Unit Management was firstly practiced at Goodwood Correctional Centre of Excellence in the Western Cape. The concept of Unit Management was viewed as a strategic change by the Department in ensuring the core business of the Department and the rehabilitation of offenders. In an effort to examine the application of Unit Management into the Correctional Centres of Excellence and how Unit Management influences the rehabilitation of sentenced offenders, a study was conducted to acquire knowledge and perspective from the available literature. In ensuring good and proper work, the researcher employed a qualitative methodology. The researcher collected data by means of structured questionnaires. Data were analysed using SPSS system for statistical reasons. Frequency tables were used to simplify the analysis per section and category. The findings from this study revealed that there is no monitoring of Unit Management taking place into the Correctional Centres of Excellence from management, there is no management involvement. It also revealed that the human rights of offenders are not respected during the implementation of Unit Management. The findings revealed that multi-disciplinary approach is dysfunctional owing to lack of professional staff. The findings also indicate that efforts to implement Unit Management into the Correctional Centres of Excellence are a failure owing to the abovementioned factors. / Corrections Management / M.A. (Penology)

The research into case management was made necessary by the emphasis that the South African prison authorities of today placed on the rehabilitation of offenders. The lack of respect for human dignity, the need to reduce crime in South African prisons and the successful reintegration of offenders into the community are some of the reasons why the research became important. The idea behind introducing case management is to bring back humanity to the offender; to make the offender part of a team which is working towards a mutual goal: to promote the well being of the offender. Topics addressed include the case management process as a sub-system of sentence planning, the role of the correctional officer and the role of the offender and the community in the successful implementation of case management in prisons.
The philosophy of case management is also spelled out in the study, covering the implementation of case management within the criminal justice system in Australia, Canada, United States of America, South Africa and the United Kingdom. During any process of incarceration, documentation forms an integral part of the process and in the situation of the case management process, it is just as important. In this study, the researcher discussed those documents that form part of the case file and which play an important role in the successful implementation of case management.
The importance of case management in prisons as well as the fact that it can be implemented without the support of the unit management approach cannot be overemphasised. The research contributes largely to scientific knowledge in stressing the importance of sentence planning for each offender within the Criminal Justice System.
