Outonomie in gevangeskap : 'n ekosistemiese perspektief

Text in Afrikaans / Die tradisionele Newtoniaanse wetenskapsbeskouing berus op drie basiese aannames, naamlik lineere oorsaaklikheid, reduksionisme en objektiwiteit. Ernstige kritiek word al hoe meer teen hierdie basiese aannames van die Newtoniaanse benadering geopper. Veral vanuit die sistemiese en ekosistemiese benaderings is alternatiewelike denkraamwerke tot hierdie benadering voorgestel. Die mees kontemporere denkraamwerk (epistemologie), naamlik die ekosistemiese benadering, is gebaseer op outonomie, struktuurgedetermineerdheid, attribusie van betekenis en konstruktivisme. Hierdie ekosistemiese beginsels is in hierdie studie gebruik om gevangenisproblematiek (wat tot op hede gekenmerk was deur Newtoniaanse denke) te herkonseptualiseer. Die nuwe konseptualisering is prakties in die psigoterapeutiese proses met gevangenes ge'lllustreer. In hierdie proses is outonomie op drie vlakke (die van gevangene, terapeut en gevangenisstelsel) bevorder. Hierdie konseptualisering skyn dus 'n wetenskaplikverantwoordbare basis te bied waarbinne gevangenisstelsels beskou kan word. / The traditional Newtonian approach to science is based on three fundamental assumtions, namely linear causality, reductionism and objectivity. Serious criticism is increasingly being brought against these fundamental assumptions of the Newtonian approach. Specifically the systemic and ecosystemic approaches have presented alternative ways of thought (epistemology). The mos t contemporary epistemology, namely the ecosystemic approach, is based on autonomy, structure-determinism, attribution of meaning and constructivism. These ecosystemic principles were used in this study to reconceptualize problems associated with prisoners, problems previously approached in a Newtonian way. This new conceptualization was practically illustrated in the psychotherapeutic process with prisoners. In this process autonomy of the prisoner, therapist and the prison system was promoted. Using e-learning to enhance education in correctional institutions in South Africa

The new millennium saw the explosion of Information Communication Technologies (ICTs), coupled with the Internet as the way to communicate and gain knowledge. Traditional schooling has moved to open and distance e-learning and many educational institutions are offering these as alternatives. In correctional institutions the education centres have fallen behind in this regard. This dissertation is based on a participatory study that will show how open and distance e-learning can benefit inmates. The researcher has a unique perspective as he is himself, an inmate in a correctional centre in South Africa, and has first-hand knowledge and experience of the correctional institution environment. In-depth interviews with inmates and correctional officers were performed resulting in different views on the subject. A survey was conducted to ascertain inmates’ educational levels and their requirements. This study also determines what role the digital divide plays in the education of inmates or the lack thereof. The research indicates that education can reduce recidivism. With e-learning more inmates could receive education and become better prepared for life outside of the correctional institutions. This could result in them becoming productive members of society. The feedback obtained via interviews shows that the majority of inmates are eager to better themselves. The major problem is financing, and the struggle with communication with the distance learning institution. With e-leaning these two problems could easily be resolved. There are a good deal of educational resources available for free called Open Educational Resources (OER), and communication with the distance institutions can be exchanged via e-mail and/or video-conferencing. A major hurdle that would have to be overcome is to get the government of South Africa behind the drive to implement e-learning. The correctional institutions are the ideal environment to test whether South Africans will be receptive to e-learning. The research in other countries is overwhelmingly positive, and with a successful pilot project e-learning could be shown to be effective in bridging the digital divide / School of Computing / M. Sc. Evaluation of financial management practices in the Department of Correctional Services

Thesis (MPA))--School of Public Leadership, 2011. / ENGLISH ABSTRACT: The objective of this study is the evaluation of financial management practices in the Department of Correctional Services (DCS). For the purpose of the study, "financial management practices‟ are defined and demarcated as the practices performed by the accounting officer, chief financial officer and other managers in the areas of budgeting, supply chain management, movable asset management and control. Recurrence of similar internal audit and inspection findings, as well as the continuous poor audit reports that the department had been receiving annually, led the office of the National Commissioner to request all branches and Regional Commissioners to compile action plans aimed at addressing non-compliance. In order to fulfil the study objective, the normative requirements for the identified financial management practices are first defined in terms of financial management theory, policy and legislation. The accounting officers are heads of departments, and they account personally for financial transactions. The concepts of "budget processes" and "planning" are explored in order to identify normative requirements. „Budget‟ is identified as part of organisational planning, which starts with the aim and the mission of the institution. Under supply chain management, the principles of procurement are discussed, as considerable amounts are spent on goods and services. The life cycle of assets is discussed in detail, including the procedure for giving account of assets. Control is defined as a process through which a manager ensures that activities are carried out as originally planned. With regard to policy and legislation, the Public Finance Management Act (PFMA), Act 1 of 1999 as amended by Act 29 of 1999 (South Africa, 1999) and Treasury Regulations are explained in detail, focusing on the budget process and financial management responsibilities of all different role players. With regard to supply chain management, policies are explained in detail, focusing on the acquisition of goods and services. The acceptable supply chain management system is also highlighted. According to Gildenhuys (1997:137), equipment is called movable assets and this category of assets are obtained and created to be utilised for a number of years as instruments for delivering services. With regard to control, in order to comply with financial management policies, an official in a department must ensure that the system of financial management and internal control established for that department is carried out within the area of responsibility of that official. The budget and planning processes of the Department of Correctional Services are explained in detail. How the financial management cascades through the department is highlighted by means of an organogram. Supply chain management processes are discussed in detail, focusing on the procurement procedures and requirements for acquisition of goods and services. The policy on asset management for the Department of Correctional Services is considered, focusing on the acquisition and control of assets. The legislative framework of the department is also examined in detail, focusing on the control measures within the department. The theory of evaluation is discussed in detail, with the emphasis on evaluation questions. A summary is provided of the financial functions of budgeting, supply chain management, asset management and control in terms of the financial functions of each of the following role players: the Accounting Officer, Chief financial officer and other managers. Evaluation questions are formulated, and audit reports contained in the annual reports, the internal auditor‟s reports and circulars of the department are used to answer those questions. Finally, recommendations are made, emphasising that Department of Correctional Services needs to continue to invest in the training and development of all staff, regarding The PFMA (South Africa, 1999) and Treasury Regulations. / AFRIKAANSE OPSOMMING: Die doel van hierdie studie was om finansiële bestuurspraktyke binne die Departement Korrektiewe Dienste (DKD) te evalueer. "Finansiële bestuurspraktyke" word vir die doel van die studie gedefinieer en omskryf as die praktyke wat deur die rekenpligtige amptenaar, die hoof finansiële bestuursbeampte en ander bestuurders binne die gebied van begroting, voorsieningskettingbestuur, roerende batebestuur en beheer beoefen word. Herhaalde voorkoms van soortgelyke interne ouditerings- en inspeksiebevindings, sowel as die voortdurende swak ouditverslae wat jaarliks deur die departement ontvang is, het die kantoor van die Nasionale Kommissaris genoop om alle takke en Streekskommissarisse te versoek om 'n plan van optrede op te stel om nie-nakoming aan te spreek. Die begrotings- en beplanningprosesse van die Departement Korrektiewe Dienste word in besonderhede verduidelik. Voorsieningskettingbestuursprosesse word in besonderhede bespreek met klem op die prosedure en die vereistes vir die verkryging van goedere en dienste. Vrae vir evaluering word geformuleer en antwoorde op daardie vrae word aan die hand van ouditverslae wat in jaarverslae opgeneem is, die interne ouditeur se verslae en departementele omsendbriewe verskaf. An Analysis of Oregon Youth Authority Populations: Who Receives Treatment and What Factors Influence Allocation of Treatment Resources?

Service provision in both adult and juvenile correctional settings is an understudied phenomenon. Research has evaluated the use of evidence-based practices (EBP) in the treatment of mental health and substance abuse among adults and juveniles. Young, Farrell, Henderson and Taxman (2009) highlight the role of organizational factors including climate and culture, opportunities for staff training, resources, administrator attitudes and interagency collaboration in the application of EBP in correctional settings. The Oregon Youth Authority (OYA) aims to provide services to youth under the guise of EBP. Literature in the field of juvenile justice is limited in scope in areas of organizational factors, which are likely to influence the allocation of mental health treatment to youth. This study addressed this gap in existing research by using thematic analysis of focus group data with 28 OYA employees representing seven facilities. Data on 594 youth is offered to illustrate the variability of youth characteristics in OYA facilities. Facility data reflective of youth management and operations is presented to suggest context for staff observations and perceptions of how youth are identified for treatment. Results indicate staff knowledge about treatment and consistency in training along with frequency of organizational change affect climates in which treatment recommendations are made. Findings from this study will be beneficial to OYA as they attempt to meet the growing needs of mental health populations and address ongoing changes to agency staff, culture and climate. Implications from this study will contribute to literature on treatment service provision in juvenile correctional settings.

The Right to Health Care of Terminally Ill Inmates in South Africa

Doctor Legum - LLD / In South Africa, prison authorities are not primarily concerned with the health of the prison population. This is evidenced by inter alia: the vast number of complaints regarding health care received by the Judicial Inspectorate of Correctional Centres; natural deaths in prisons reported annually; litigation regarding health care and treatment in prisons; and the notoriously poor conditions of detention which inevitably have a negative impact on prisoners' health. There is as a result a noticeable difference between state provided health care to the public and health care in prisons. This thesis is therefore aimed at unpacking what the right to health means in respect of terminally ill prisoners. This question has been overshadowed by issues regarding medical parole in South Africa and intermittently by calls for palliative care in prisons. Whilst these issues are relevant to their plight, there is a need to articulate the scope of the right to health of terminally ill prisoners. This is imperative as not all prisoners who are terminally ill are eligible for medical parole and there are instances where the granting of such parole may be impractical. An analysis of the right to health in relation to terminally ill prisoners will provide legal certainty as to the legal entitlements regarding health care for one of the most vulnerable groups in society. They will know what they may legally claim and what they cannot insist upon in terms of the law.

An investigation on the perceptions of officials on their role in the rehabilitation process: the case of the East London Correctional Centre

This report is the result of a literature study and questionnaire which gave insight on the role of officials in the rehabilitation process. Correctional Services has adopted a new approach, where offenders need to change their negative behaviour and be rehabilitated. Corrections have a societal responsibility towards the community to guide the offender on his rehabilitation path. This study was conducted to give a better understanding of rehabilitation to offenders The purpose of this research is to determine if the Department of Correctional Services delivers on its legal and social responsibility towards the rehabilitation of offenders. In this study the researcher gathered information on the department policies, training of officials, the programmes currently available in Correctional Services, and also the involvement of the community in this process. Corrections cannot work alone, and needs the help of the community and leaders in the community to assist it in this process. Correctional Services faces many challenges in order to succeed in the rehabilitation of offenders. Currently there is a shortage of officials in the Department of Correctional Services, and the Department cannot, therefore, fully succeed in its rehabilitative role. Another aspect is that rehabilitation programmes are voluntary, and offenders can decide if they want to become involved or not.

Integrated offender administration through correctional case management

The research into case management was made necessary by the emphasis that the South African prison authorities of today placed on the rehabilitation of offenders. The lack of respect for human dignity, the need to reduce crime in South African prisons and the successful reintegration of offenders into the community are some of the reasons why the research became important. The idea behind introducing case management is to bring back humanity to the offender; to make the offender part of a team which is working towards a mutual goal: to promote the well being of the offender. Topics addressed include the case management process as a sub-system of sentence planning, the role of the correctional officer and the role of the offender and the community in the successful implementation of case management in prisons. The philosophy of case management is also spelled out in the study, covering the implementation of case management within the criminal justice system in Australia, Canada, United States of America, South Africa and the United Kingdom. During any process of incarceration, documentation forms an integral part of the process and in the situation of the case management process, it is just as important. In this study, the researcher discussed those documents that form part of the case file and which play an important role in the successful implementation of case management. The importance of case management in prisons as well as the fact that it can be implemented without the support of the unit management approach cannot be overemphasised. The research contributes largely to scientific knowledge in stressing the importance of sentence planning for each offender within the Criminal Justice System. The case file, which includes the individual sentence plan and the active involvement of the correctional officer and the offender, forms a vital part of the management of the rehabilitation of the offender in today's prison systems. / Penology / D.
