Se discute si para esto último cabe atender solamente al criterio adoptado por la Corte al emitir sentencias, o también cuando formula opiniones consultivas. Existen distintas opiniones. El autor se inclina por incluir a las opiniones consultivas entre las fuentes obligatorias en el control de convencionalidad.

This thesis aims to examine when democratic consolidation took place in Costa Rica from a maximalistic perspective. The hypothesis is that it’s likely that the democracy was not consolidated as early as 1953 which would be the case if applying a minimalistic perspective. Linz and Stepan’s theory about democratic consolidation has been chosen as the theoretical framework of the thesis and the research has been conducted by using a qualitative text analysis. The thesis comes to the conclusion that Costa Rica’s democracy completed its consolidation 1978 when the previously banned communist party Partido Vanguardia Popular was allowed to compete for votes again in the 1978’s presidential and parliamentary elections. From that point no party was excluded from taking part in free and fair elections.

Le Traité de Libre-échange avec l'Amérique Centrale et les États-Unis (CAFTA), approuvé à la suite d'un référendum populaire en octobre 2007, a été l'accélérateur d'un processus de libéralisation du secteur des télécommunications au Costa Rica, très similaire à celui vécu par la France. Le nouveau cadre juridique introduit une réforme du droit de la concurrence malheureusement applicable qu'au seul secteur des télécommunications. Le droit général repose encore sur les mêmes bases de la loi de 1994, qui comporte des lacunes critiquables. L'autorité de régulation des télécommunications sera responsable du contrôle de la concurrence dans le secteur, au détriment des compétences de l'autorité générale. De l'analyse comparée, il ressort un très grand parallélisme en dépit d'un retard notable dans le cas du Costa Rica. La présente étude met en évidence les atouts et les inconvénients des mécanismes de contrôle de la concurrence existant au Costa Rica, en faisant le point dans le secteur des télécommunications. Au vu de l'expérience française et communautaire, de nombreux efforts sont encore nécessaires pour aboutir à une législation qui est aujourd'hui encore loin d'être en pleine maturité. La forte présence d'entreprises multinationales sur le marché centroaméricain, et l'absence de mécanismes de contrôle quant aux stratégies anticoncurrentielles au niveau régional représentent un nouvel enjeu pour la mise en place d'un environnement concurrentiel. L’Accord d'Association entre l'Union Européenne et l'Amérique Centrale (AACUE) doit servir de base pour le développement d'un droit régional de la concurrence, selon le modèle communautaire. / The Central America Free Trade Agreement with the United States (CAFTA), approved after popular referendum in October 2007, has sped up the liberalisation process of the telecommunications sector in Costa Rica, very much like in France before. The new juridical framework introduces a competition right reform, unfortunately only applicable to the telecommunications sector. The general law is still based on the 1994 law, which has questionable drawbacks. The telecommunications regulation authority will be in charge of monitoring competition in the sector, at the expense of the competences of the general authority. According to a comparative analysis there is a striking parallelism despite a significant delay in the case of Costa Rica. This study highlights the pros and cons of the competition monitoring tools existing in Costa Rica, by taking stock in the telecommunications sector. ln the light of the French and community experience, numerous efforts are still needed to lead to a legislation that is still far today from being full y mature. The strong presence of multinational companies on the Central American market and the absence of monitoring tools regarding the anti-competitive strategies on the regional level constitute a new challenge for setting up a competitive environment. The Association Agreement between the European Union and Central America should serve as a basis for the development of a regional competition right, according to the community law.

Interactions of Dietary Antioxidants and Methylmercury on Health Outcomes and Toxicodynamics: Evidence from Developmental Rat Model Studies and Human EpidemiologyBlack, Paleah January 2011 (has links)
The contamination of seafood with methylmercury (MeHg) is a global health issue, as MeHg is a well known neurotoxin. Since dietary nutrients may interact with MeHg toxicity, and oxidative stress is one of the primary mechanisms underlying MeHg neurotoxicity, we characterized dietary antioxidant-MeHg interactions. Firstly, we used an ethnobotanical study to confirm the antioxidant activity of Northern Labrador Tea, Rhododendron tomentosum ssp. subarcticum (Tea), for the Canadian Inuit, a population with elevated MeHg exposure. Secondly, we determined the ability of Tea to ameliorate MeHg-induced toxicity in a rat perinatal exposure study. MeHg exposure (2 mg/KgBW/d) was associated with perturbed development and behaviour, elevated brain N-methyl-D-aspartate receptors, and serum lipid peroxidation. Surprisingly, Tea co-exposure (100 mg/KgBW/d) modulated MeHg’s effects on brain NMDA-R levels and lipid peroxidation, but also increased mercury serum concentrations. Thirdly, using a toxicogenomics approach we determined that MeHg exposure caused the down-regulation of Nr4a2 and its protein product Nurr1. These novel MeHg targets are implicated in developmental learning functions and were corrected with MeHg + Tea co-exposure. Lastly, we conducted a risk assessment survey and cross-sectional dietary epidemiology study in Costa Rica to further investigate dietary nutrient-MeHg interactions. Costa Rica is a Central American country with multiple sources of Hg and a high per capital fish consumption. Here, 5 of the 14 populations we studied exceeded the recommended MeHg provisional tolerable daily intake (pTDI) of 0.2 µg/KgBW/d. In Heredia the pTDI was exceeded by 34% of woman participants, primarily associated with canned tuna consumption. Interestingly, we detected that Hg body burden was significantly reduced by the consumption of antioxidant-rich dietary items. Considering our collective results, we hypothesized that MeHg toxicokinetics may be altered by dietary nutrients at the site of intestinal absorption from the disruption of gut flora, or at the site of cellular demethylation in tissues from the improvement of cellular redox state. The interaction of dietary nutrients on MeHg outcomes has a large impact on risk assessment and may provide a public health approach for managing the risk associated with MeHg exposure without reducing local fish consumption.

and easily collected, the biology, ecology, and taxonomy of Ptiliidae Heer,
1843, or featherwing beetles, have not been well studied. In a study from 2007
to 2009, Ptiliidae were extracted from various polypore fungi collected
throughout Costa Rica in an effort to expand biogeographic knowledge of
Ptiliidae. Fungi
and Ptiliidae were identified to genera and collection sites mapped. Beetle
genera are able to inhabit different polypore genera and were found at a
higher rate of co-occurrence than reported in previous studies. We
identified <i>Cylindrosella costariciensis </i><b>sp. n.</b>, with the
potential of two more new species to be described.</p>

The oceans are essential for humanity, yet these systems continue to be degraded and suffer from pollution, habitat destruction and overexploitation. The Costa Rican Gulf of Nicoya is a productive gulf that is fished by both large-scale industrial fisheries and small-scale artisanal fishermen. However, the gulf is profoundly overfished and there has been a shift in both the type of species and size of fishes being targeted, which has had devastating economic and ecological effects in the region. To improve their livelihoods, artisanal fishermen have together with governmental agencies instituted partially protected marine protected areas, known as AMPRs which are intended to give artisanal fishermen exclusive fishing rights and to better the health of the ecosystems. However, these AMPRs can vary greatly within and between each other in aspects such as what types of fishing gear is allowed. To investigate how fishing techniques impact the health of the fish stocks and the wellbeing of fishermen within an AMPR, the size of a target fish, Spotted Rose Snapper (Lutjanus guttatus) and the number of undesired fish caught, was compared based on the number of approved fishing methods such as nets, longlines and commercial scuba diving, between different zones. This was conducted by identifying and measuring catch in collaboration with the National University of Costa Rica, who contributed with databases and field assistance, and artisanal dead bait longline fishermen (bottom long line) in the Paquera-Tambor AMPR. The results showed that in areas where fishing gear is more restricted, the mean weight of Spotted Rose Snapper was higher, but the relative proportion bycatch was not different. Furthermore, there was no difference in legal capture or breeding lengths between areas with high and low restriction of fishing gear. This indicates that the effects of overfishing are less predominant in zones where fewer fishing methods are permitted. The restriction of fishing methods could increase biodiversity and size in fish by exploiting less cohorts of populations. The preservation of size in fish species is very important regarding reproductive success, and it is therefore paramount that larger individuals are protected. This could be accomplished by for example, restricting the amount of allowed fishing gear or introducing maximum catch sizes. However, an improvement of the fish stocks, and therefore human wellbeing cannot be achieved in the Gulf of Nicoya without a revision of the strategies of two influential governmental bodies, the Costa Rican coast guard and the Costa Rican Institute of Fisheries and Aquaculture.

Themes of activism as seen on social media : A deep dive into social media-based activism of organizations for Nicaraguan citizens out of Costa Rica from 2019-2022Drewes, Miriam January 2023 (has links)
This thesis covers the methods and the goals of organizations located in Costa Rica working for the good of Nicaraguan citizens. Through a thematic analysis of 10 Facebook posts per 8 civil society organizations, four different themes within the posts were found: active action, cooperation, informing, and political speech. These themes as well as different extracts from the posts have together given a picture of the methods and goals of the organizations. Active action, cooperation and informing are used to see the methods of the organizations, while political speech and some cases of informing show the goals of the organizations. Through the extracts there are examples of what they do and why they do it. What has been found is that the organizations are different from each other in some respects. The organizations with a focus on Nicaraguans who are in Costa Rica have a higher count of posts using active action while those focusing on the situation in Nicaragua use more political speech. It has also been found that theories regarding the development of social movements, activism and peaceful disobedience can be used to understand the actions and the goals of the organizations.

The Integration of Local Actors in Policy Implementation: The Case of Organic Farming in Costa RicaGruber, Mirjam 20 October 2023 (has links)
Like other countries of the world, Costa Rica faced the challenge of dealing with a variety
of trade-offs when implementing sustainability goals in agriculture. Very often, economic promotion
is in conflict with goals regarding human and environmental health protection. Organic farming
practices could provide strategies to overcome some of these trade-offs. However, in Costa Rica, the
majority of farmers still relies on conventional farm practices. In this paper, I investigate the potential
for a sustainable transformation in Costa Rica’s agriculture by focusing on organic farming policies. I
shed light on the role local actors and organizations play in this process compared to other actor types.
I argue that local actors are “the agents of change” in these processes, as these are the target groups
of organic farming policies and are the ones who are asked to change their farm practices. Based
on survey data and network analysis, I was able to illustrate how differently integrated local actors
are compared to other actor types in Costa Rica’s implementation of organic farming policies. Local
actors show interest and willingness to further participate in land-use implementation processes
when institutional barriers are alleviated, and further promotion instruments are available.
