Moral reform and the desiderata of responses to wrongdoing: the production of a "morally autonomous person freely attached to the good"

Moral reform is a neglected response to wrongdoing that has been incorrectly portrayed as a practice involving illegitimate treatment of wrongdoers and as totally unsatisfying to those theorists advocating backward-looking practices such as retributive punishment. A clear explanation of the ethical legitimacy and practical necessity of the reformative techniques moral reform involves has been missed, and this paper details the design of moral reform proper in order to fill this gap in punishment theory. The moral reform of an offender is identified as a desideratum of responses to wrongdoing and it is explained what moral reform ought to entail. The claim that moral reform qualifies as the overriding aim of responses to wrongdoing is argued for on the grounds that this practice is capable of achieving all the established ends of responses to wrongdoing. The legitimate desiderata of our practices are identified as those usually selected as the ends of punishment practices, and moral reform must accomplish these if it is to be accepted. Moral reform is shown to realise the goals of punishments as the fortunate effects of what is done to achieve an offender's moral improvement and of what reformees do in taking responsibility for their actions. The suffering involved in moral reform receives particular emphasis since the practice will never satisfy unless it accommodates the widely-held intuition that the offender must suffer sufficiently as a consequence of his wrongdoing. Moral reform is further portrayed as the most meaningful practice for its ability to satisfy the appropriate needs and desires victims have in response to their victimization. A central claim of the thesis is that moral reform best serves the victim, since it most effectively relieves the victim's emotional responses to wrongdoing and is as adept as punishment at the expression of these same emotions. Alhoewel 1910 as vertrekpunt geneem is, is die fokus in die grootste mate geplaas op ontwikkeling sedert 1962. Considering the fact that the existing literature on penology has hardly any information regarding the release of the prisoner and more specifically the different types of release, various sources have been identified in order to condense the historical information and to discuss contemporary policy in this regard. Although 1910 was taken as the starting point, the focus has largely been placed on development since 1962. Social deprivation and criminal punishment

My aim in this thesis is to examine whether there are some mitigating factors, i.e. reasons to punish an offender less for his crime than an otherwise similar offender (other than that the offender suffered from mental disorder or disturbance or other forms of irrationality at the time of offence), that are more applicable to socially deprived offenders than to non-socially deprived offenders. I will answer the thesis question through a critical examination of twelve arguments for claiming that there is a mitigating factor that is more applicable to socially deprived offenders, each proposing a different mitigating factor. My conclusions are as follows: (1) Most of the arguments that I examine fail, i.e. they either fail to highlight a genuine mitigating factor, or we do not have much evidence that the mitigating factor highlighted by the argument has a greater applicability to socially deprived offenders than to non-socially deprived offenders. (2) However, one argument, which can be called the no violation of natural duties argument, is successful. (3) Moreover, the improvement of the worst off argument, an argument that is not often discussed in the literature, is particularly noteworthy. If my discussion about that argument is correct, then even if, as I will argue, the mitigating factor highlighted by that argument may not be more applicable to socially deprived offenders than to non-socially deprived offenders, the remaining parts of that argument would still have profound influence on punishment in our unjust societies.

Em março de 1907, o Decreto no 6.640 enunciou uma reforma policial na cidade do Rio de Janeiro que, entre outras modificações, fez emergir o periódico Boletim Policial. Este trabalho analisa como essa revista, como enunciado do discurso policial, foi um arquivo construtor da polícia da Capital Federal como polícia científica e moderna entre os anos 1907 e 1918. Esse período é marcado pela reorganização dos parâmetros científicos acerca do crime e do criminoso, em várias partes do mundo, que serviram de base para a polícia científica. É o momento em que a aplicação da antropologia criminal ainda estava em voga, do uso de novos métodos de identificação de criminosos, de inovações na análise do local do crime, entre outras transformações. Abordo, também, a aplicabilidade do discurso policial modernizador em diálogo com os pressupostos da Escola Positiva e com novas formas de tecnologias de identificação dos criminosos nos ditos sobre os portugueses na esfera criminal. / In March 1907, Decree no 6640 enunciated a police reform in the city of Rio de Janeiro, which, among other changes, brought into existence the periodic Boletim Policial. This paper examines how this magazine, as a voice of police discourse, helped turning the police of the federal capital into a scientific and modern police, between 1907 and 1918. Such time was marked by the reorganization of scientific parameters about crime and the criminal in various parts of the world, which formed the basis for the scientific police. It was the moment in which criminal anthropology was applied, along with the use of new methods of criminal identification and innovations in the analysis of the crime scene, among other changes. Also, this paper intends to analyse the applicability of police-modernizing discourse in dialogue with the assumptions of positivism and new forms of technologies of criminal identification, in the sayings about the Portuguese in the criminal sphere.

Fundamentando-se no principio de neutralidade e universalidade das leis o aparato jurídico ampliou seu poder resolutivo nas questões sobre a violência e os conflitos envolvendo homens e mulheres que viviam em terras matogrossenses, logo após o fim da Guerra com o Paraguai. Ao adaptarem os procedimentos judiciais as praticas de controle dos comportamentos sociais, os responsáveis pela justiça empregaram com margens de segurança os mecanismos legais e também ações coercitivas e repressivas para com aqueles menos privilegiados na hierarquia social. Nessa perspectiva, verificou-se que nem sempre os Códigos e as leis vigentes a época serviram para coibir a violência desencadeada entre indivíduos e grupos, em muitas situações, foram utilizados como instrumento de regulação das oportunidades e ascensão social. Tal atitude deixou brechas no judiciário, as quais foram utilizadas pelos grandes proprietários de terras, escravos e comércio na manutenção de seus privilégios e interesses. Rehabilitation is the responsibility of the rehabilitative, custodial staff and the community. The judicious, fair and consistent operation of prgrammes is an importnat aid in the hands of the Department of Correctional Services to regulate the behaviour of inmates to ensure a satisfied and orderly prison community. This research is primarily focused on how to encourage inmates towards good behaviour, to instill a sense of responsibility in them and to ensure their interest and co-operation in the integration into sport and recreation. The Department of Correctional Services aspires to be an institution that delivers results in sport and recreation by utilising programmes to achieve these goals.
