Impact of copyright law in museums and galleries in the digital age

The thesis explores the growing impact of copyright in art museums and galleries in the digital environment. Copyright has a great significance in these institutions but it has not received adequate academic consideration. The aim of this thesis is to examine the role of copyright and underline the foremost copyright challenges to museums and galleries in order to find out the appropriate approach to deal with them. The main argument is that copyright challenges museums and galleries to the extent it could disturb the survival of their mission in the digital domain. It argues that copyright provides insufficient protection to museums and galleries when they are copyright owners of digital and contemporary artistic works in particular. Also, it argues that copyright restricts the capacity of using artistic works by museums and galleries as cultural institutions and therefore it obstructs their activities and mission. Further, it argues that uncertain and deficient copyright policy and management practices represent impediment to the continuity and progress of museums and galleries in the digital era. To this effect, the thesis takes analytical approach and considers the legal primary and secondary resources of relevant laws, cases, academic commentary and journal articles. The legal framework is focused on copyright law of the United Kingdom as stated in the Copyright, Designs and Patents Act 1988 and its amendments. Furthermore, the thesis incorporates a review of an empirical study about the impact of copyright in museums and galleries and which is undertaken for this research purposes. The thesis concludes that it is necessary to deal with the specified copyright challenges in a way that maintains and promotes the mission of museums and galleries and facilitates a broader public access to their collections in the digital environment. In order to achieve this, it is recommended that some copyright law reform is needed concerning in particular copyright protection of artistic works and copyright exceptions available to museums and galleries for specific purposes such as preservation, research, and education. Also, it is proposed that museums and galleries require enhanced understanding of copyright law, more awareness, careful consideration and efficient management of copyright.

1 Abstract The topic of this thesis, "The legacy of Adalbert Stifter in his home region", is focusing on Adalbert Stifter, a novelist writing in the German language, and native of Horní Planá. While the story of his life will not be overlooked, this thesis concentrates mainly on his legacy, related to his home region. The purpose of this thesis is to map all monuments of Stifter's life, and the cultural projects linked to this gifted writer, that were realised in his home region. The following text is split into five chapters. The first chapter describes the life and work of Adalbert Stifter. The second chapter is focused on the Czech translations of his works. The third chapter shows how Adalbert Stifter's heritage can help develop the Czech-German relationship. Actual Accessibility: A Study of Cultural Institution Web Content

In 1998, the United States Congress amended Section 508 of the Rehabilitation Act to require federal agencies to make electronic and information technology accessible. The first accessibility guidelines from the World Wide Web Consortium’s Web Accessibility Initiative, Web Content Accessibility Guidelines 1.0, were published in 1999. This study tests the usable accessibility of cultural institution web sites. Four cultural institution web sites were selected, two that were WCAG 1.0 compliant and that were not, were selected for evaluation. A combination of qualitative and quantitative analysis was conducted. Significant differences were found in the perceived usability of the guideline-compliant web sites; significance was found for one of three tasks. Overall, the guideline-compliant sites received higher usability ratings, but the task completion rates did not support a claim of greater usability.

Artikelns syfte är att öka kunskapen om kulturprojektens speciella karaktär genom att undersöka vad det önskade resultatet är och vilka faktorer som är avgörande för ett kulturprojekts framgång eller misslyckande. Studien fokuserar på värmländska kulturinstitutioner som årligen får statligt bidrag genom samverkansmodellen. Studien bygger på kvalitativa semistrukturerade intervjuer med representanter från institutionerna där de berättade om sin respektive institutions verksamhet och projekt. Empirin har sedan analyserats mot en tidigare utformad framgångsmodell av Fors och Svedberg (2015) som illustrerar framgångskriterier för kulturprojekt, för att sedan kartlägga institutionerna bild av lyckade projekt. Forskningens resultat visade att institutionernas huvudsakliga mål, och det som de hoppas på att uppnå, är produktioner och projekt av hög konstnärlig kvalité mer än ekonomisk framgång. Resultatet visade även på att kulturmålen anses mer som riktlinjer än direkta krav. / The purpose of this article is to increase the knowledge about the special characteristics of cultural projects by examining what the desired outcome is and the factors that are critical to a projects success or failure. The focus of the study is the cultural institutions in Värmland which annually receive government subsidies through the collaboration model. The study is based on qualitative semi-structured interviews with representatives from the institutions where they talk about their respective institutions' activities and projects. The empirical data was then analyzed against a previously designed success model by Fors and Svedberg (2015) that illustrates success factors for cultural projects, and to then identify the institutions view of successful projects. The research results showed that the institutions main objectives, and what they hope to achieve, is productions and projects of high artistic quality rather than economic gain. The result also showed that the cultural goals are considered more as guidelines than direct requirements.

This research suggests that, once launched out exclusively from the artistic field, the curator became a complex communicational phenomenon and ceased to be an individual actor-subject. The objective of this masters dissertation is to purpose a preliminary discussion to deal with these resignifications of the term and the political, economical and institutional implications of these changes. The focus is to discuss specifically the musical curatorship, which in principle already presents a close relationship with the market, since the fact that music constitutes itself as a music industry. Under the light of bibliographies from the communications, cultural production and political philosophy areas, the research organizes a bibliographical review and analyses a case study: the Encontros Instrumentais (Instrumental Meetings) from Sesc. The knowledge commons in Victoria and Singapore: an exploration of community roles in the shaping of cultural institutions

‘The commons’ is a concept originating from the traditional shared use of land, but which now often refers to any social asset, physical or abstract, that is shared. This research concerns one aspect of the commons, namely the knowledge commons. The thesis explores community roles in developing and sustaining cultural institutions as key components of the knowledge commons. It focuses particularly on processes of participatory design, and on the capacity of digital technologies to support community engagement. The study takes place across the cultural contexts of the State of Victoria (Australia) and Singapore. The three key aims of the thesis are to explore in what ways and to what extent: I. The emerging concept of the knowledge commons relates to the role of cultural institutions as systems for the creation and sharing of sustainable knowledge resources by their communities. II. The notion of participative design may be applicable to the ongoing development of such systems as multi-stakeholder partnerships to meet community needs. III. Differences in national culture may affect the generality of such an analysis. The research design employs literature analysis and multiple case studies as a basis for proposing new theorisations and an analytical tool to assist future action by cultural institutions and relevant communities. The main perspective used in framing the literature analysis and case studies is Giddens’ structuration theory. Structuration sees the continuing interplay between social action and social structure as the means by which the cultural patternings known as institutions are recursively produced. A complementary perspective used is Hofstede’s model of cultural dimensions. Other theorists from a range of disciplines provide perspectives on particular concepts or aspects, such as the commons and participatory design. Five chapters are headed ‘Foundations’. These seek to explicate key dimensions of the research, namely the knowledge commons, community knowledge, cultural institutions, participatory design, and the cultural contexts of Victoria and Singapore. Four chapters are headed ‘Case Study’ and deal with individual cultural institutions, or clusters of institutions, which were the sites of exploratory enquiry (generally consisting of interviews and observation, but in the case of Museum Victoria also elements of action research). The cultural institutions covered by these chapters are Museum Victoria/Women on Farms Gathering, the Asian Civilisations Museum, Public Libraries in Victoria and Public Libraries in Singapore. These insights are analysed to propose a series of related typologies. The coverage of these typologies includes resource characteristics, collective processes, and cultural dimensions. The typologies come together as components of an integrated, explanatory conceptual model concerning the relationships between the commons, cultural institutions, communities, collective processes (including the role of information and communication technologies) and participatory design within cultural institutions. In the final chapter answers are formulated for the initiating research questions. Also the integrated model developed by the thesis is used as the basis for a proposed analytical tool to assist action towards enhanced community engagement in the development of cultural institutions. Use of the tool is illustrated by application to several examples of collective action encountered during the research.

Viena iš sąlygų – stiprinant socialinę sanglaudą. Todėl ir Lietuvoje dėmesys turėtų būti sutelktas į vieną iš svarbiausių sričių – žmoniškųjų išteklių ugdymą, investicijas į žmogų. Bendruomenė – viena svarbiausių socialinio gyvenimo savivaldos, bendradarbiavimo, socialinių subjektų bendradarbiavimo, kūrybiškumo, iniciatyvumo, vertybinio mąstymo ugdymo terpė. Kultūrinė (dvasinė) struktūra užtikrina kultūrinių – estetinių, dvasinių, aukštesnių vertybių patenkinimą. Todėl šioje studijoje bandėme diagnozuoti ir nurodyti galimybes kaip regioniniame mieste galima tenkinti bendruomenės sociokultūrinius poreikius. The goal of the strategy is to achieve that EU becomes the most competitive and dynamic economic of the world which is capable to grow harmoniously. Public Culture and Cultural Citizenship at the Thessaloniki International Film Festival

This dissertation explores the relationship between state, citizen and public culture through an ethnographic and historical examination of the Thessaloniki International Film Festival in northern Greece. In the two-year period leading up to and following its fiftieth anniversary in 2009, the festival was caught up in the larger economic, political and social crises that have overtaken Greece in the last five years - a painful period of rapid transformation and neoliberalization for one of Europe's staunchest social-welfare states. As the Greek state faces bankruptcy - both economic and political - it is being forced to revisit the terms of its social contract with its citizens. In a country where "culture" was once touted as a national "heavy industry," the relationship between the state and cultural production is also being restructured. Public culture is one of the areas of social life in which people are now struggling with these changes and attempting to redefine what it means to be a citizen of the Greek state - utilizing and revising local, national and transnational identities in the process. / Anthropology

One Butterfly : understanding interface and interaction design for multitouch environments in museum contexts

Museums can be perceived as stuffy and forbidding; web technologies can enable museums to expand access to their collections and counterbalance these perceptions. Museums are searching for new ways to communicate with the public to better make a case for their continued relevance in the digital information age. With the emergence of multitouch computing, other diverse forms of digital access and the popularization of the user experience, challenge museum design professionals to synthesize the information seeking experience that occurs on multiple computing platforms. As a means of addressing these issues, this Master’s Report summarizes the One Butterfly design project. The project's goal was to create a design for a multitouch interface for federated search of Smithsonian collections. This report describes the project’s three major phases. First, an idea for an interface was developed and designs based on that idea were captured and clarified. Second, a formal review of related research was undertaken to ground these designs in the museum informatics, user interface design, and multitouch interaction design literatures. Finally, the report concludes with a review and reflection on the designs and their underlying ideas in light of things learned in the previous phases. / text
