L'application de la peine de mort en France (1906-1981) / The enforcement of the death penalty in France (1906-1981)

Sur le point de disparaître en France à la fin du XIXe siècle, la peine de mort connaît un regain à pai1ir de 1906. S'appuyant sur les émotions punitives présentes dans l'opinion publique ainsi que sur les discours criminologiques, le système judiciaire vise à l'élimination de certains accusés. La peine capitale reste cependant marginale dans l'ensemble de la répression pénale et ne punit qu'une minorité de crimes de sang considérés comme particulièrement atroces. Les condamnés à mort sont fréquemment issus des couches les plus misérables et les moins intégrées de la société. Les discours judiciaires, plaidoiries, réquisitoires, expertises, s'affrontent pour déterminer si ces individus peuvent disposer de circonstances atténuantes. Les fonctions de la peine de mort sont alors discutées: s'agit-il de faire un exemple, de venger, ou d'épurer le corps social? S'entremêlent alors considérations rationnelles et émotionnelles. Ces discussions ont lieu à deux niveaux : celui de la cour d'assises d'abord, où l'enjeu est de convaincre les citoyens siégeant comme jurés, celui de l'administration ministérielle et présidentielle ensuite, où l'enjeu est de décider d'une éventuelle grâce. Les condamnés à mort, en attendant que l'on statue sur leur sort, sont détenus dans des conditions particulièrement sévères, devant éviter évasion ou suicide. Leur temps et leur espace sont extrêmement normés, ce qui ne les empêche pas de les aménager à des fins qui leur sont propres. La préparation à mort s'inscrit dans des perspectives tant laïques et religieuses Le cas échéant, la décision d'exécution mobilise forces de l'ordre, personnel pénitentiaire, l'exécuteur et ses aides, pour un acte conjuguant aspects bureaucratiques et brutale violence. Sinon, le condamné est rendu aux circuits pénitentiaires ordinaires, où il risque cependant une autre forme de mort pénale. / Death penalty was about to disappear in France at the end of the 19th century. But the number of death sentences rose after 1906. The judiciary relied on the punitive emotions of the public opinion and on the criminological knowledge to eliminate some of the defendants. The capital punishment was very minor in the whole penal repression and its enforcement punished a small number of murders, considered as particularly heinous. The people sentenced to death came from the most miserable and less integrated parts of the society. Judicial discourses, such as speeches for the prosecution or the defense, or testimonies, confronted each other to determine if these people should benefit of mitigating circumstances. The functions of the death penalty were then discussed: deterrence, retribution, revenge or purge of the social body? Emotional as well as rational arguments were used. The cases were exposed at two different levels: a first time in front of the criminal court and of the citizen seating in the jury, a second time in front of the presidential advisors and of the President of the Republic, who had to decide of the pardon or the execution. The people sentenced to death had to wait their fate in particularly harsh conditions, which aimed at avoiding suicide or escape. Very strong rules framed their time and their space but some of them succeeded to adjust their environment for their own purposes. The preparation to death could be religious or secular. It the need arose, police, army, penitentiary staff, as well as the executioner and his helps were summoned to perform the execution, an act combining bureaucratic aspects and rough violence. In the other case the prisoner was held back to the ordinary prison system, where he could still risk another form of penal death.

My diploma work follows up Czech Republic inhabitants' attitudes toward the death penalty. It also describes changes in death penalty perception in terms of historical aspect, its presentation to public society, changes in approach to death penalty and violence in general over time. It deals with execution types development, executioner's social position and craft. It brings elementary thoughts of advocates and opponents of the death penalty and describes related contemporary situation in the world. All these chapters are included for broader context description to allow me better use and identify results from the survey. The other part of my diploma work is survey with focus on attitudes toward the death penalty in Czech Republic. It was conducted in 2012-13, based on online respondent panel, with use of quantitative methods. This market research survey was executed on Millward Brown Czech Republic online panel with sample of 821 respondents. Results basically deliver knowledge of relation between attitudes toward the death penalty and sociodemographics, main arguments for and against the death penalty, clarifies the relation between attitudes toward the death penalty and some factors such as experience with crime or death penalty basic facts knowledge. Archives can tell us many things about the past. The purpose of this guide is to facilitate the work of those who want to know more about the documents associated with death sentences. The guide gives a brief introduction to the history of the death penalty in Swedish legal history, to the legal process and to the judicial authorities. It also adresses the relationship between the various bodies and the relationship between law and jurisprudence. The guide presents primarily the archives of Nedre justitierevisionen and of Svea hovrätt. The guide presents what kind of information can be found and provides guidance as to how these documents are sought. Through a case study, we learn that records can give answers to many questions regarding a person sentenced to death.

The "Death penalty as a response to the growing brutality of criminal offenses" diploma thesis discusses the increasing trend of the violent and brutal criminality and the resolution possibilities of the situation. As the main goal of this thesis, the author deals with the idea whether returning the death penalty back into our justice system would be the right response to the increasing degree of brutality of violent criminals. In the theoretical part, the term "death penalty" is explained in general, as well as its history and use. Next the thesis acquaints us with the use of the death penalty on our territory in the past and its legislative question in our history. Le règne du roi de France Charles VI (1380-1422) est caractérisé par plusieurs bouleversements, le premier étant la folie du roi, déclarée en 1392. En dépit des crises militaire, économique et sociale qui secouent le royaume, il s’agit néanmoins d’un temps fort pour la mise en place de l’État monarchique. L’instabilité permet en réalité à l'autorité royale de durcir ses positions et d’imposer plus efficacement son pouvoir, notamment en matière de justice. Ce renforcement s’appuie en grande partie sur le modèle du droit romain qui est étudié depuis le XIIe siècle par les officiers royaux, à savoir des membres importants de l’administration. Le présent travail analyse la façon dont les principes juridiques hérités de l’Antiquité sont reçus et engagés dans la littérature médiévale pour soutenir des réflexions en matière de justice. Il s’appuie pour cela sur l’étude des écrits de quatre officiers royaux influents : Nicolas de Clamanges, Jean de Montreuil, Laurent de Premierfait et Guillaume de Tignonville. Les concepts qui sont empruntés aux œuvres classiques s’expriment à travers une double affirmation : l’application plus sévère de la justice royale et le recours plus systématique à la peine de mort. Si les attentes des auteurs sont parfois incompatibles avec l’exercice d’une justice guidée par la clémence, les autorités royales tendent toutefois à sanctionner de façon plus rigoureuse. Les relations entre les théories juridiques et leur application sont complexes, mais tendent à converger vers une même voie, dans le cadre de l’affirmation de la souveraineté et de la lutte contre les crimes qui menacent la paix publique. / The reign of Charles VI (1380-1422) of France is characterized by several upheavals, the first one being the king's madness, declared in 1392. Despite the military, economic and social crises that shake the kingdom, it is nevertheless a strong time for the establishment of the monarchical State. The instability actually allowed the royal authority to strengthen its positions and to impose its power more effectively, especially in matters of justice. This strengthening is grounded on the Roman law, which had been studied since the 12th century by royal officers, important members of the administration. The present work analyzes the way legal principles inherited from Antiquity are received and engaged in medieval literature to support thoughts on justice. It is based on the study of the writings of four influential royal officers: Nicolas de Clamanges, Jean de Montreuil, Laurent de Premierfait and Guillaume de Tignonville. The concepts borrowed from the classical works are expressed through a double affirmation: a more severe application of royal justice and a more systematic use of the death penalty. If the authors expectations are sometimes incompatible with an exercise of justice guided by clemency, the royal authorities nevertheless tend to sanction more rigorously. The relationship between legal theories and their application is complex, but tends to converge towards the same path, in the context of the affirmation of sovereignty and the fight against crimes that threaten public peace.

To Know the One True God: Reconciling the God of the Old Testament with the God of the New Testament

There is a popular misconception in the world that Jehovah is too severe on occasion while Jesus Christ is always kind and merciful. The Latter-day Saint belief that Jehovah and Jesus are the same person presents a supposed conflict. There has not been much written on this subject by either non-Latter-day Saints or Latter-day Saints, thus, this thesis represents a unique contribution to a common perception prevalent in many Christian circles. The research of this thesis shows that the misconception is based on three problems: first, a misinterpretation of biblical stories in both the Old and New Testament; second, a lack of understanding biblical context and culture; and third, a lack of applying modern revelation to this subject. The research of this thesis focuses on these three areas in an effort to resolve this false perception. This thesis takes a deeper look into the acts of Jehovah and Jesus Christ as found in the Old and New Testaments respectively. Next, it looks as several doctrines related to this subject that have been revealed through latter-day prophets and incorporates them into the Old Testament. This analysis paints a broader picture of the Lord and illustrates that He was, indeed, merciful in the Old Testament but, at times, severe in the New Testament. Lastly, this thesis takes four of the most difficult Old Testament stories that seem to represent Jehovah as harsh, capricious, and unyielding, and puts them in their cultural setting. Though not every act can be completely explained, there is a high degree of similarity between Jehovah and Jesus. The study concludes, therefore, that much of the problem lies with perception and not with reality.
