Esse trabalho se propôs a conhecer as justificativas para utilização da integração vertical no setor agroindustrial diante da presença de movimentos recentes e contrários de desverticalização a essa estratégia. A principal motivação do estudo partiu da busca pela compreensão da relação entre a estratégia de integração vertical e o fenômeno denominado financeirização que tem exercido, entre outros fatores, influência em decisões relacionadas à imobilização de capital. O método selecionado para o trabalho foi o estudo de casos múltiplos, sendo que devido às dificuldades de acesso às empresas selecionadas optou-se por desenvolver apenas dois casos, mas que representam as maiores agroindústrias instaladas no Brasil. Os principais resultados foram agrupados em cinco partes: relacionados à discussão teórica, destacando-se a percepção de influência da financeirização em ambas as estratégias (integração vertical e desverticalização) existindo alguma incidência maior do fenômeno em mercados que se comportam de forma desverticalizada; relativos ao comportamento setorial, no qual foram constatados argumentos históricos e características específicas do setor agroindustrial que justificam a manutenção de negócios no segmento de fertilizantes como forma de otimizar as operações no segmento de grãos; descrição das razões para a estratégia segundo a perspectiva do ambiente de operações; justificativas para a verticalização segundo a perspectiva do ambiente de negócios; e uma síntese conclusiva. Percebeu-se no estudo, entre outras conclusões, que a estratégia, caso não esteja sujeita ao fenômeno da financeirização, pelo menos atende aos seus requisitos, sendo que a forma como ela ocorre e os resultados (financeiros e operacionais) decorrentes garantem os aspectos demandados pelo movimento Shareholder Value. Enfim, ao final do estudo são relatadas as principais limitações do trabalho, assim como algumas propostas de continuação do mesmo. / This work searched to know the justifications for use of the vertical integration in the agro-industrial sector in presence of recent and contrary movements of deverticalisation about this strategy. The main motivation of the study was the search for the understanding of the relationship between the vertical integration strategy and the called phenomenon financialization that has exerted, among others factors, influence in decisions related to the capital immobilization. The method selected for the work was the study of multiple cases and because great difficulty to access the selected companies it was opted to developing only two cases, but that they represent the greaters agro-industries installed in Brazil. The main results had been grouped in five parts: related to the theoretical quarrel, being distinguished it perception of influence of the financialization in both the strategies (vertical integration and de-verticalisation) existing some bigger incidence of the phenomenon in markets with de-verticalisation form; relative to the sectorial behavior, which historical arguments and of business-oriented the agro-industrial sector had been evidenced specific characteristic that justify the maintenance in the fertilizer segment as form to optimize the operations in the segment of grains; description of the reasons for the according to perspective from strategy in the operations environment; justifications for the according to perspective from verticalisation in the business-oriented environment; and a conclusive synthesis. One perceived in the study, among others conclusions, is that the strategy, in case that it is not subjects to the phenomenon of the financialization, at least takes care of to its requirements, being that the form as it occurs and the results (financial and operational) decurrent guarantee the aspects demanded for the Shareholder Value movement. At last, to the end of the study the main limitations of the work are told, as well as some proposals of its continuation.

Pleinement intégrés dans les tissus urbains, les centres commerciaux verticaux se multiplient sous une forme variée sur le territoire sud-coréen depuis les années 1990. Un grand équipement urbain multifonctionnel, affichant une verticalité spatiale, présente une pluralité de comportements des consommateurs. La recherche s’interroge sur les principaux aspects de l’articulation entre le commerce et la ville et démontre comment interagissent la transformation de la société et la mutation des espaces marchands. L’hypothèse centrale est que d’une part ces nouveaux lieux marchands soient formés à partir du contexte local et que d’autre part ces lieux participeraient à une production urbaine spécifique et contribueraient ainsi à une recomposition sociale singulière. Dans ce cadre, la recherche interroge l’histoire locale, les conditions sociales, économiques, juridiques et culturelles comme matrice principale et s’appuie sur l’exemple des centres commerciaux verticaux à Séoul. À travers l’analyse géographique, la recherche aborde trois questions majeures : formes, dynamiques et pratiques urbaines qu’induisent ces lieux marchands. Les interrogations reposent aussi sur la variation des échelles d’analyse : villes, quartiers, lieu marchand et individu. Prenant l’architecture commerciale comme angle d’analyse, la recherche apporte un nouvel éclairage pour comprendre la morphologie actuelle de Séoul et aussi pour évaluer dans quelle mesure un tel équipement urbain peut contribuer à réinventer la ville. La thèse ouvre également une nouvelle perspective sur la circulation des modèles commerciaux dans le contexte de mondialisation actuelle et sur la verticalisation des espaces urbains. / Fully integrated into the urban fabric, vertical shopping centers multiply in varied form on South Korean territory since the 1990s. Large multifunctional urban equipment, displaying spatial verticality, has a plurality of consumer behavior. The research examines the main aspects of the articulation between the retail and the city and demonstrates how interact the transformation of society and the changing of shopping spaces. The central hypothesis is that on the one hand the new shopping places are formed from the local context and on the other hand these places would participate in a specific urban production and thus contribute to a singular social recomposition. In this framework, the research questions the local history and social, economic, legal, cultural situation as main matrix and is based on the example of vertical shopping centers in Seoul. Through geographic analysis the research addresses three major issues: forms, dynamic and urban practices that bring these shopping places. The questions are also based on the change in scales of analysis: cities, neighborhoods, shopping places and individual. Taking commercial architecture as analysis angle, the research provides new insights for understanding the present morphology of Seoul and also to assess how such urban equipment can contribute to reinvent the city. The thesis also opens up a new perspective on the circulation of retail models in the current context of globalization and the verticalization of urban spaces.

Questão de grande relevância, nos dias atuais, no âmbito da Ciência Política, diz respeito às decisões políticas tomadas pelo Supremo Tribunal Federal, o que se denomina ativismo judicial. O termo ativismo judicial indica que a Corte está deixando de se restringir à atividade interpretativa, para estabelecer novas condutas, criando direito novo. A tendência tem sido a de levar as questões políticas para serem debatidas no âmbito judicial, de forma que assuntos políticos passam a ser exteriorizados como jurídicos. Em todos esses temas, devemos ter em conta que o balizamento tanto da atividade política como da atuação jurídica é a Constituição. Todavia, o que se tem observado é que Supremo passou a adotar uma nova postura interpretativa, de modo a permitir que, por via hermenêutica, torne-se possível corrigir a lei, modificá-la ou mesmo criar direito novo onde a lei nada especifica, além de permitir a criação de normas de caráter constitucional por decisão judicial. Três casos importantes ilustram bem esse cenário: a verticalização das coligações, a instalação obrigatória de comissões parlamentares de inquérito e a perda de mandato decorrente da troca de partido. Por serem temas de cunho eminentemente político, as decisões judiciais proferidas nessas matérias enquadram-se bem no campo do ativismo judicial, daí por que foram escolhidos como estudos de caso. O objetivo desta tese é identificar as causas dessa nova postura do Supremo Tribunal Federal, tendo em vista que ela rompe com o entendimento adotado na jurisprudência anterior, em que essas mesmas matérias eram consideradas estritamente políticas e, portanto, fora da competência decisória da Corte / A question of great importance nowadays, in the domain of Political Science, is the fact that the Supreme Court is deciding political subjects, what is called judicial activism. This expression means that the Court is not only interpretating but also creating new rules. The tendency has been taking political questions to the Court, which causes political issues to be presented as judicial too. In all these subjects, we must remember that the the direction both for political and judicial activities is Constitution. However, the Supreme Court has adopted a new concept of interpretation, in order to allow the correction and modification of laws, the creation of new rules, including constitutional ones, all these by interpretation processes. Three important questions demonstrate clearly this tendency, which are: verticalisation of political colligations, compulsory installation of inquiry commitees and party loyalty. These questions are strictly political, so that the judicial decisions about them can be included in the domain of judicial activism. In fact, we can observe, in Brazil, an expansion of the Supreme Court in the analysis and deliberation of political questions, activities refused by its members in ancient decisions. Our goal is to identify the causes of this new behavior of the Supreme Court, which modifies the ancient patern concerning the imposibility to judge strictly political questions
