Isto é, abandona uma perspectiva somente formal da laicidade a fim de propor uma crítica ética do tema, já que sem os limites impostos pela ética, o direito resvala num tecnicismo desconectado com os valores comuns. O Estado laico só poderá garantir a tolerância na esfera pública política quando o seu discurso promover o respeito mútuo entre cosmovisões. Os contornos do discurso jurídico laico possuem um caráter não-totalitário, que significa a não-rejeição a priori do discurso religioso ou do discurso naturalista. Um Estado totalitário, por sua vez, pressupõe o rebaixamento dos grupos minoritários a uma categoria de sub-cidadãos. O principal objetivo é contribuir para uma salutar relação entre o discurso religioso e naturalista na esfera pública e evitar que a sacralização de valores políticos constitua um obstáculo à compreensão das transformações sociais. Propõe, portanto, limites éticos tanto à esfera pública (proibição do uso abusivo do argumento ad hominem), quanto ao discurso jurídico da laicidade (dever de verificação do “projeto” e tradução). Incentiva, num segundo momento, que os participantes de cada grupo assuma limites para suas próprias ações, como o compromisso com a não-violência, o abandono do “fundamentalismo militante” violento. Em contrapartida, o Estado laico deve proteger o “fundamentalismo crença”, ou seja, aquele que não questiona suas próprias doutrinas, mas, em compensação, não utiliza de meios violentos para a propagação da sua fé. / Salvador

Esta nova atitude dos intérpretes vem reanimando o estudo das bases do positivismo jurídico e incomodando o dogmatismo existente por detrás da segurança jurídica consolidada pelos kelsenianos. Desta forma, procura-se investigar o surgimento do conceito de dignidade humana e, também, as bases de sustentação filosóficas positivistas e seu correlato conceito de validade com forte influência kantiana. Não apenas isto, mas se expõe a filosofia contemporânea do direito que atualiza o conceito de validade em temos de uma ética discursiva procedimental através de Habermas e Klaus Günther. A partir daí, lança-se uma análise diversa da universalista da moral para uma abordagem pragmatista próxima a Richard Rorty, de construção do princípio da dignidade da pessoa humana enquanto conceito ralo que vai se densificando no caso concreto através da teoria da argumentação. Não se quer um princípio afirmativista de cunho axiológico pronto, ou mesmo generalista, mas de cunho empírico, prático e contextual. Mais atento à condição humana negativa e à coerbilidade legítima do ordenamento jurídico. Nestes termos, articula-se um debate de cunho particularista e pragmatista na pretensão de qualificar as decisões judiciais de modo a trilhar os caminhos da idéia de justiça pretendida por Ihering e Gustav Radbruch. _______________________________________________________________________________ ABSTRACT / Nowadays, the judicial principle of the human person dignity, placed in the 1º article, nº III of the Federative Republic Constitution of Brazil is steadily been applied by the layers and the judges as an interpretational tool rehabilitating the communication between law and ethics. This refreshing attitude is renewing the studies of the judicial positivism bases, and is also disturbing the dogmatism stated behind the judicial security principle consolidated by the kelsenians. Thereby, here is investigated the appearance of the human dignity concept and, still, the philosophical sustenance of positivism structure and therefore its concept of validity with great kantian influence. Furthermore, is exposed the contemporary law philosophy, updating the concept of validity in terms of a discursive procedure ethics, developed by Habermas and Klaus Günther. Since then, is speeded an analyze diverse of the universal morality towards the pragmatism defended by Richard Rorty, which one can be built the judicial principle of the human person dignity as a thin concept thickly developed in the concrete case, through the argumentative theory. Is not intended an affirmative principle in an axiological sense, or even in an general sense, but in empirical, practical and contextual meaning. So that can be given attention to the negative human condition and also to the legitimacy coercion of the judicial system. In these terms, is situated the debate as a particularistic and pragmatist issue, intending to qualify the judicial sentences underway to the justice idea wished by Ihering and Gustav Radbruch.

A punição no sistema moral kantiano

Este trabalho constitui uma investigação sobre a finalidade que Kant atribui à punição na doutrina dos deveres e, portanto, analisa as questões punitivas relacionadas à doutrina do Direito, à doutrina da Virtude (Ética) e à doutrina dos costumes (Moral), bem como suas relações, afinal a Moral, entendida como um sistema composto por princípios puramente a priori, divide-se em Ética e Direito. A mencionada investigação inicia com a apresentação de noções básicas acerca do tratamento dispensado por Kant à pena, de forma a explicitar o que o filósofo entende por justiça punitiva, infração e punição, bem como apresentar alguns casos polêmicos analisados por ele. Na sequência, expõe-se e analisa-se criticamente algumas possíveis interpretações para os escritos kantianos sobre a punição. Assim, fala-se (i)do retribucionismo puro em sua versão tradicional e em duas versões sofisticadas, uma com a aplicação da noção de negação real e outra defendendo a punição como uma espécie de lei definida pela máxima do criminoso; (ii)do retribucionismo parcial decorrente da percepção de duas faces da punição ou da desaprovação moral social que acompanha a pena; (iii)da retribuição moral e do utilitarismo jurídico, que separa as punições moral e jurídica; (iv)da prevenção especial, entendida como neutralização e ressocialização. A partir da constatação dos problemas existentes nas possibilidades interpretativas postas, propõe-se a construção de uma nova interpretação, calcada na diferenciação de Direito, Ética e Moral e nas implicações da última nas doutrinas do Direito e da Virtude. A nova interpretação, ao contrário da tradicional visão puramente retributiva, defende a existência de um âmbito preventivo da punição, o qual pode ser verificado inclusive na obra A Metafísica dos Costumes, obra tardia de Kant que constituiria a visão madura do filósofo. Dessa forma, (a)a punição moral possui uma finalidade meramente retributiva, (b)não há uma punição ética, apesar da existência de um processo interno de autoavaliação, e (c)a punição jurídica possui finalidade preventiva e retributiva. A dupla finalidade da pena jurídica decorre de sua justificação moral e de sua necessidade hipotética, como meio para prevenir a ocorrência de crimes. As mencionadas finalidades da punição jurídica são alcançadas em três momentos: (i)quando se considera a sanção jurídica em abstrato que, contida na própria lei penal, intimida a coletividade; (ii)na determinação, pelo juiz, da pena aplicável àquele caso concreto, pois o magistrado deve fixar uma sanção retributiva, mas, nos limites da retribuição, deve escolher uma pena que previna novos crimes; (iii)na execução da pena, visto que essa fase possibilita que o condenado reeduque-se e/ou sirva de exemplo aos demais. Thereby, talks (i)about pure retributivism in your traditional version e in two sophisticated version, one with application of the notion of real negation and other defending the punishment like a kind of law defined by the criminal’s maxim; (ii)about partial retributivism stems from the perception of two punishment’s faces or of the social moral disapprobation that follows the penalty; (iii)about moral retribution and juridical utilitarism, that separates the punishments moral and juridical; (iv)about special prevention, understood like neutralization and resocialization. As from the verification of problems existents in interpretative possibilities established, proposes a construction of one new interpretation, based on a differentiation of Law, Ethic and Moral and in implications of this last (Moral) in the doctrine of the Law and of the Virtue. A new interpretation, in contrast to the traditional observation purely retributive, defends the existence of a preventive ambit of punishment, whose may be verified even in the book The Metaphysics of Morals, one of the latest works of Kant that would constitute the mature vision of this philosopher. That way, (a)the moral punishment have a merely retributive purpose, (b)there isn’t an ethical punishment, despite the existence of internal self-evaluation process, and (c)the juridical punishment have preventive and retributive finality. The dual purpose of juridical penalty stems from moral justification and its hypothetical necessity, as means to prevent the criminal occurrences. The mentioned purposes of juridical punishment are reached in three moments: (i)when considering the juridical sanction in the abstract that, contained in the criminal law itself intimidates the collectivity; (ii)in the determination, from the judge, of the penalty applicable to that particular case, because the magistrate must sets a retributive sanction, but, within the limits of retribution, must choose a penalty that prevents new crimes; (iii)in the execution of the penalty, since this phase allows that the condemned reeducate themselves and/or serve as an example to others. Finally, presents a subchapter with general clarifications that support the thesis of coherence in Kant writings about punishment.

Interrogando o interrogatório: uma reflexão de base ética sobre o encontro juiz-acusado no processo penal

By applying bibliography research, it aimed at analyzing the alterity of the accused since the moment of his meeting with the judge during the prosecution process. lt is an invitation to reflect on the process from a different standpoint, from the ethics of the alterity, submitting the prosecution process to a plain dialogue with the philosophy. The subject led firstly to the analysis of the human being question, taking into consideration the understandings of Martin Heidegger, Jean-Paul Sartre and Emmanuel Levinas. Therefore, it aimed at discussing on how to understand the “human” aspect within the complexity of the present time. Secondly, its purpose was to analyze the prosecution process, where it occurs the meeting between the judge and the accused, by considering the criminal guarantee of Luigi Ferrajoli, in order to identify lhe meaning of the prosecution process as an instrument of maximum efficiency of the guaranties of the accused. The research also covers lhe meeting considering the Ethics of Alterity of Emmanuel Levinas and, finally, it analyzes the judicial examination particularly from a legislative standpoint. As a conclusion, it aimed at approximating between the two perspectives and highlight the necessity of a reflection on the ethical basis of the prosecution process as an attempt to reduce the violence produced to the citizen who is submitted to the process. / A presente dissertação foi desenvolvida na linda de pesquisa “Política Criminal, Estado e Limitação do Poder Punitivo” na área de concentração em violência do Programa de Pós-Graduação em Ciências Criminais da Faculdade de Direito da Pontifícia Universidade Católica do Rio Grande do Sul. Buscou-se através de pesquisa bibliográfica analisar a alteridade do acusado desde seu encontro com o juiz no processo penal. Trata-se de um convite a pensar o processo a partir de outra ótica, a partir da ética da alteridade, submetendo o processo penal ao diálogo franco com a filosofia. O tema ensejou primeiramente a análise da questão do humano, a partir do pensamento de Martin Heidegger, Jean-Paul Satre e Emmanuel Levinas. Assim procurou-se discutir como pensar o termo “humano” na complexidade dos dias atuais. Em segundo lugar, objetivou-se a análise do processo penal de Luigi Ferrajoli, a fim de identificar o sentido do processo penal como instrumento de máxima eficácia das garantias do acusado. A pesquisa abordou ainda o tema do encontro, a partir da Ética da Alteridade de Emmanuel Levinas e, ao final, passou-se a análise do interrogatório judicial em especial a partir de sua disciplina legislativa. Como conclusão, buscou-se uma aproximação entre as duas perspectivas, apontando para a necessidade de uma reflexão de base ética no processo penal como uma tentativa de reduzir a violência produzida contra o cidadão submetido ao processo.

Socioeducação, restauratividade e tempo ético: desvelando sentidos no itinerário da alteridade

It starts by pointing out the issue of youth offending in the context of the Doctrine of Integral Protection; it qualifies the response in face of the transgression of the criminal law as a declaration of retributive nature; it sustains the necessity of a principiologic approach and confrontation from Socioeducative Law to Penal and Procedural Law as a method of appropriation of instrumental and material guarantees of freedom custody; it ponders over the symmetries and asymmetries of these two systems; and it considers the procedure through the socio-educative in harmony with the procedure by the charge system, a procedure viewed through only one perspective; moreover it refers to the lack of normativity in the execution of the measure as a serious open question. From the idea that there should be procedures in other dimensions, it presents and discusses the proposal of Restorative Justice, in which the involvement of those direct or indirectly interested on the conflict resolution, and the response according to the meaning built during the meeting prevails, as opposed to forms of the charge system. In the attempt to find new justifications for the procedure to achieve restoration, it dialogues with the philosophical thoughts of Emmanuel Levinas, so as to have a critical review of procedures to solve conflicts of infringement nature. In this context, it investigates in Levinas topics such as the I and the Other, the Phenomenology of the Face, the question of Justice as a synonym of priority of the Other previous to the freedom of the I, and the Dialogue language as a matter of transcendence and of pedagogy towards responsibility. And it is on the reason based on alterity ethics, which is understood as the responsibility for another person, that one may find foundation to practices of restorative nature, in the non indifference to the absolute value ofthe human possibility of giving priority to another person and to the meaning built from this relation. / O trabalho debruça-se sobre a fundamentação ético-filosófica do proceder segundo a Justiça Restaurativa para o atendimento do adolescente autor de ato infracional. Inicia por situar a problemática da infração na adolescência no contexto da Doutrina da Proteção Integral; qualifica a resposta em face da transgressão à lei penal como declaração de natureza retributiva; sustenta a necessidade da aproximação e da confrontação principiológica do Direito Socioeducativo ao Direito Penal e ao Direito Processual Penal como método para a apropriação das garantias materiais e instrumentais de tutela da liberdade; reflete acerca das simetrias e assimetrias desses dois sistemas; e considera o proceder pelo sistema socioeducativo sintonizado com o proceder pelo sistema acusatório, um proceder em uma só perspectiva; além de referir a ausência de normatividade na execução da medida como uma grave questão em aberto. A partir da idéia de que deveriam existir procederes em outras demissões, apresenta e discute a proposta da Justiça Restaurativa, proceder em que prepondera, ao contrário das formas do sistema acusatório da tradição, o envolvimento dos direta e indiretamente interessados na resolução do conflito e a resposta segundo o sentido construído no encontro. Na investida por novas e outros fundamentos para o proceder pela restauratividade, dialoga com o pensamento filosófico de Emmanuel Levinas como modo de revisão crítica dos procederes para a resolução dos conflitos de natureza infracional. Nesse contexto, investiga em Levinas a partir de temas como o Mesmo e o Outro, a fenomenologia do Rosto, a questão da Justiça como sinônimo de prioridade do Outro antes da liberdade do Mesmo e a linguagem dialogal como modo de transcendência e de pedagogia para a responsabilidade.E é na razão fundada na ética da alteridade que encontra a fundamentação para as práticas de natureza restaurativa, ética entendida como responsabilidade por outrem, na não-indiferença ao valor absoluto da possibilidade humana de dar prioridade ao outro e ao sentido construído na relação.

Orientador: José Carlos Garcia de Freitas / Banca: Euclides Celso Berardo / Banca: Maria Amália de Figueiredo Pereira Alvarenga / Resumo: Com efeito, os temas pertinentes ao Meio Ambiente são inesgotáveis e de impressionante atualidade, posto que o desequilíbrio ambiental acentua-se a cada dia que passa em um cenário complexo típico de uma sociedade tecnológica e científica em construção, ameaçando sobremaneira a qualidade de vida humana, senão a sua própria sobrevivência. Nesse modo de ver, a questão preliminar, ao abordar o tema proposto, refere-se à necessidade da sociedade global proteger juridicamente o Meio Ambiente em sua totalidade. Como conseqüência, constata-se que o campo de estudo do Direito Ambiental vem crescendo e se sofisticando com novos princípios e institutos, cedendo espaço para todos os elementos integrantes dos sistemas ecológicos, inclusive o humano. Aliás, possivelmente, a mais importante característica do Direito Ambiental é a de que seus princípios e normas possuem nítido caráter humanista do imperativo ético da dignidade da pessoa humana. A esse respeito, visando-se a promover um novo olhar sobre o Meio Ambiente é que caminha a presente dissertação de mestrado, ordenando reflexões dedutivas e históricas sobre o tema em sua inerente amplitude, integrando-se os conhecimentos da Ciência Ecológica, do Direito Ambiental e da Ética em torno de um conjunto de problemas e limitações humanas para que o maior bem estar possam vir a ser atingido por todos. De outra parte, torna-se igualmente importante à proteção do Meio Ambiente através do processo educativo. A Educação Ambiental deve ser promovida em todos os níveis de ensino, fato este disposto no artigo 225, parágrafo 1º, inciso VI da Constituição Federal, porquanto é necessário educar e conscientizar a coletividade quanto à efetiva gravidade da degradação ambiental mundial. From that viewpoint, the preliminary issue, when approaching the proposed topic, refers to global society’s need to juridically protect the Environment as a whole. As a consequence, it’s been noticed that the field of study of Environmental Law has been growing and becoming more and more sophisticated with new principles and institutes; making room for every component of ecological systems, including the human one. Possibly, Environmental Law’s most important characteristic is that its principles and rules have a sharp humanistic character of the ethic imperative of human dignity. With that respect, aiming at promoting a different look over the environment is the objective of this very master’s degree essay, with deductive and historic reflection on the theme in its inherent amplitude, integrating knowledge of Ecological Science, Environmental Law, and Ethics related to a group of human problems and limitations so that all people are able to achieve major well being. Moral e direito em Kant

O presente trabalho dissertativo tem como objetivo examinar a natureza das relações existentes entre as esferas da moral e do direito no âmbito da filosofia de Kant, a fim de compreender como é sustentada a legitimidade do exercício coercitivo das normas jurídicas, como elemento de justiça, de delimitação dos arbítrios, e pressuposto de uma convivência social racional. O problema que tencionamos investigar diz respeito a saber, em que medida se verifica uma eventual vinculação entre moral e direito nos escritos kantianos. Nessa perspectiva, o primeiro capítulo busca explicitar os conceitos de lei moral, boa vontade e imperativos, bem como as noções de autonomia e heteronomia, elementos esses diretamente implicados na hipótese kantiana da adequação humana necessária às leis prescritas pela razão, no âmbito da liberdade interna. A partir da base conceitual então estabelecida, busca-se, no segundo capítulo, examinar a proposta de um direito natural (racional) como conjunto de princípios a priori da razão pura prática que visam garantir a realização da liberdade na esfera da exterioridade. Para tanto, examina-se o modo através do qual se dá a construção do conceito kantiano de direito e seu respectivo princípio universal, tendo em conta ainda a forma a partir da qual se estabelece a relação entre liberdade (externa) e lei, e o papel da coerção. Uma vez demarcados os dois âmbitos, busca-se, no terceiro capítulo, aprofundar as distinções entre as esferas da interioridade e da exterioridade da liberdade, para então avaliar a hipótese de trabalho que está assentada sobre a possibilidade de uma conexão entre moral e direito na filosofia de Kant. Duas são as principais teses consideradas na investigação: i) a tese da independência e ii) a tese da dependência. A primeira é sustentada pelo grupo de interpretações que afirmam a separação entre moral e direito no pensamento de Kant, assumindo a coerção como elemento característico do direito e a não derivação de seu princípio em relação ao imperativo categórico. A segunda é sustentada pelos interpretes que entendem haver em Kant uma conexão entre moral e direito, baseando-se na desvalorização do elemento coerção e numa acentuação do elemento do dever, pelo que defendem a derivação dos deveres jurídicos da teoria moral kantiana e a derivação do princípio do direito diretamente do princípio da moralidade. The problem we intend to investigate concerns the extent to which there is a possible link between morality and law in the Kantian writings. In this perspective, the first chapter seeks to clarify the concepts of moral law, goodwill and imperatives as well as the notions of autonomy and heteronomy, these elements directly involved in the Kantian hypothesis of human adaptation necessary laws prescribed by reason, within the internal freedom . From then established conceptual basis, we seek to, in the second chapter, consider the proposal for a natural right (rational) as a set of a priori principles of pure practical reason intended to ensure the attainment of freedom in the sphere of externality. To do so, it examines the way in which it gives the construction of the Kantian concept of law and its respective universal principle, taking into account also the form from which establishes the relationship between freedom (external) and law, and the role of coercion. Once marked the two areas, we seek to, in the third chapter, further distinctions between the spheres of interiority and exteriority of freedom, and then evaluate the working hypothesis that sitteth upon the possibility of a connection between morality and law Kant. There are two main theses considered in research: i) the independence thesis and ii) the theory of dependency. The first is supported by the group of interpretations that affirm the separation between morality and law in Kant's thought, assuming coercion as a characteristic element of the right and not to bypass principle in relation to the categorical imperative. The second is supported by interpreters that understand Kant in a connection between morality and law, based on the devaluation of coercion element and an accentuation of the element of duty, by defending the derivation of the legal duties of Kantian moral theory and the derivation of principle of the right directly from the principle of morality. Explained the elements of these interpretations, takes place then at the end, consideration of the possibility of the link between morality and law, and the examination of the consistency of a possible dependence / derivation of a priori principles of the right to the principle of morality all in order to assess the extent to which gives the validity of the assumed hypothesis and points which support the eventual plausibility.

Desta forma, se tenta, demonstrar que o direito a conhecer a origem biológica deve preponderar sobre o direito do sigilo de identidade, pois é fundamental para o desenvolvimento da personalidade que cada ser humano saiba sua origem. É importante ressaltar que não se fala no direito a estabelecer estado de filho, e sim, no direito de conhecer a origem biológica. O trabalho evolui com uma breve conceituação de autonomia interligado com o conceito de liberdade, desenvolvendo uma análise sobre os direitos da personalidade desde o período antigo até os dias atuais. A partir da fundamentação trazida sobre a autonomia e direitos da personalidade se chega ao ponto crucial: responder ao questionamento lançado demonstrando a importância de se conhecer a origem genética para a formação da personalidade, preservação da saúde e afastamento de relações proibidas pelo ordenamento jurídico.

Para Habermas, o Direito ocupa posição de destaque na teoria crítica na medida em que desempenha, com primazia, a função integradora social nas sociedades complexas atuais. Especificamente, busca-se esclarecer o conceito de Direito para o autor, considerando-se a redefinição empreendida, por ele, entre sua Teoria da Ação Comunicativa e sua Teoria Discursiva do Direito, segundo a qual o Direito passou de meio ou instituição a mediador entre facticidade e validade, compreendidas enquanto sua tensão estrutural. Objetiva-se esclarecer as relações do Direito com a Moral e a Democracia, no que concerne às convergências e distinções, a partir do princípio do discurso. Faz-se referência a um possível diálogo crítico entre Habermas e Apel acerca da concepção discursiva de Direito. Isso se dá a partir do confronto da teoria habermasiana com a ética do discurso de Apel, em especial a partir de duas críticas à arquitetônica da diferenciação do discurso elaborada por Habermas na obra Direito e Democracia: entre facticidade e validade , consistentes nas problemáticas: (i) da neutralidade do princípio do discurso; e (ii) da identidade entre os princípios do direito e da democracia. A partir desse diálogo, são apresentadas algumas considerações críticas, à guisa de conclusão, sobre o conceito habermasiano de Direito, destacando-se alguns pontos entendidos como fragilidades, tais como o consensualismo exacerbado e o confronto ínsito ao Direito entre consenso e coerção. ______________________________________________________________________________ ABSTRACT / This paper is dedicated to the explanation of the concept of Law from the perspective of Habermas, particularly its relationship with Moral and Democracy. For Habermas, the Law holds a prominent position in critical theory as it plays, with primacy, the role of social integrative function in complex societies today. Specifically, it seeks to clarify the concept of Law to the author, considering the redefinition undertaken by him between his Theory of Communicative Action and its discourse of Law, in which Law is defined as institution and, after, intermediary structure between facticity and validity, understood as a structural tension. The purpose of the research is, moreover, to clarify the relations among Law, Moral and Democracy, in terms of convergence and distinctions from the perspective of the principle of discourse. Reference is made to a possible critical dialogue between Habermas and Apel about the discursive conception of Law. This happens from the confrontation of the Habermasian theory with two critical observations made by Apel regarding his conception of the architectural differentiation of discourse elaborated in "Law and Democracy: between facticity and validity", namely the issues of; (i) the principle of neutrality, and (ii) the principle of discourse and identity, proposed by Habermas. From this dialog, there are some critical considerations on the Habermasian concept of law, including some points perceived as weaknesses, such as consensualism exacerbated and the confrontation between consensus and coercion that is characteristic of Law.
