Electronic Legal Transaction: Comparative analysis with emphasis on the use of electronic signature under the EU law and laws of the Czech Republic and Germany Abstract (English) Objectives. This thesis provides a comparative analysis of electronic legal transactions under the EU law and laws of the Czech Republic and Germany, while emphasising the utilisation of higher versions of electronic signature, especially of a qualified electronic signature, which has legal effects of a handwritten signature in legal transactions performed by electronic means (Chapters 6 to 10). At the same time, increased attention is also paid to entirely novel concepts of advanced and qualified electronic seal, which are intended exclusively for use by juristic persons. The laws under scrutiny are based especially on recently adopted Regulation (EU) No 910/2014, known as eIDAS. To provide a general background, the comparative analysis is preceded by a theoretical part (Chapters 2 to 4, partially Chapter 5), dealing with the concept of legal transactions (also termed "legal acts" or "legal action") in general, while also focusing on the traditional handwritten signature and its functions, especially in view of the German and Czech legal doctrines and with occasional references to common law, as well as to requirements ensuing...

Darbe nagrinėjama atributinės informacijos sertifikavimo šiuo metu naudojamuose elektroniniuse parašuose problema. Trumpai apžvelgiami elektroninio parašo principai ir supažindinama su viešųjų raktų infrastruktūra, nurodant galimybes jai išplėsti, iškilus poreikiui užtikrinti aukštesnį saugumo lygį keičiantis papildoma (atributine) informacija. Nagrinėjami įvairūs atributinės informacijos sertifikavimo metodai, viešųjų raktų infrastruktūroje įvedant atributų sertifikato ir atributų sertifikavimo centro sąvokas. Pateikiamas tinkamiausio metodo pritaikymo pavyzdys, modeliuojant elektroninio parašo naudojimo situaciją, artimą dabartinei situacijai Lietuvoje. Sprendimo pritaikymas demonstruojamas apibrėžiant patobulintos elektroninio parašo infrastruktūros prototipą. / This paper analyses issues of attribute certification in currently used electronic signatures. Fundamentals of electronic signatures and public key infrastructure are briefly described, focusing on possibilities of achieving higher security level in communication when attribute information is important. Various suggestions for attribute certification are analysed, introducing atribute certificates and atribute authorities. Different certification methods are compared and evaluated, applying the most suitable one in the public key infrastructure usage model, that is constructed by simplifying the current situation of electronic signatures. The solution is represented by describing the prototype of improved electronic signature infrastructure.

This thesis deals with the use of electronic banking in the accountancy. The goal is to introduce the concept of electronic banking and its impact on accounting. The thesis describes the development of accounting and the impact of computer technology on the processing of accounting records and financial documents. The term of electronic signature and electronic brand are explained, as well as the possibilities of their applicaton. The thesis is to define the various forms of client (company) communication with the bank institutions and development of electronic banking as well as a summary of its advantages and disadvantages. The aim of the practical part is to evaluate the current state of direct banking service in the Czech Republic. The appendix includes a table with a list of e-filing of chosen particular tax types and overview of the structure of the questionnaire on the use of electronic banking.

The work deals with the topic of electronic communication with the tax authorities. The theoretical part starts with the research of related work and then the development of e-Government to nowadays form is presented. The legislation regarding electronic communication with tax authorities with possible changes towards future follows. The theoretical part of the work is finished with statistics regarding electronic communication with the tax authorities and with comparison of the situation in the Czech Republic with the situation in other European Union countries. In the practical part of the work, a set of best practices which should be obeyed by tax advisors is presented as a main output of the work. Practical part also contains a survey and statistical analysis of data arising from it. The survey is unique because of the fact that all respondents are tax advisors. In the last part, based on the survey, the benefits and shortcomings of the electronic communications with the tax authorities as well as possible steps to streamline are presented.

Diploma work deals with current aspects of information systems in public administration. The thesis assesses impact of introduction of the data box system on effective communication in public administration and evaluates to what extend the data boxes are beneficial to citizens of this state. After definition of terms used in this field, first part of the work is focused on the e-Government project and its four pillars. Further, thesis evaluates effect of the e-Government project on reduction of administrative burden for businessmen and on the lives of citizens in the information society. The following part of the work highlights gaps in the legislation, which creates rules for the data box system and has got an immediate impact on the efficiency of their operation. The work also surveys effects of the data box system introduction on effective communication between state and local governments on the citizens of our country. Diploma work points out the problems of the data box system, analyses their causes and offers possible solutions.

I uppsatsen utreds det tekniska och juridiska fenomenet elektroniska underskrifter, som idag till viss del har ersatt traditionella handskrivna underskrifter. Den rättsliga ställningen för elektroniska underskrifter påverkas direkt av den teknik de bygger på, varför juridiken bör anses vara nära sammankopplad med tekniken. Innebörden av en elektronisk underskrift kan sägas vara kontrollerbara uppgifter i elektronisk form som bland annat möjliggör att en person som har undertecknat en handling kan verifieras. Elektroniska underskrifters funktioner jämförs vanligtvis med handskrivna underskrifter trots att funktionerna uppfylls med hjälp av olika tekniska lösningar. En elektronisk underskrift fyller fem olika funktioner som bland annat gör användningen av elektroniska underskrifter säker för dess användare. EIDAS-förordningen är central för elektroniska underskrifters rättsverkan och avser att vara en teknikneutral reglering. Något regelverk för hur den underliggande tekniken ska vara utformad finns inte. Tre typer av elektroniska underskrifter kan identifieras av förordningen, vilka är enkla, avancerade och kvalificerade elektroniska underskrifter. De olika underskriftstyperna skiljer sig åt både avseende krav och rättsverkan. EIDAS-förordningens mest betydelsefulla bestämmelse torde vara att en elektronisk underskrift som huvudregel inte får förvägras rättslig verkan på grund av dess elektroniska form. Formkrav som uppställs i nationell rätt kan hindra elektroniska underskrifter från att användas. I svensk rätt förekommer både formalavtal som tillåter och inte tillåter att elektroniska underskrifter används. Bestämmelser kan även föreskriva att en viss typ av elektronisk underskrift får eller ska användas. Konsensualavtal kan till skillnad från formalavtal användas obehindrat med elektroniska underskrifter, eftersom avtalstypen är flexibel i sin natur. När elektroniska underskrifter används i en elektronisk miljö skulle problem avseende viljeförklaringar kunna uppstå och påverka konsensualavtal. Exempelvis om viljeförklaringar avges snabbt genom några knapptryck eller om elektroniska undertecknandetjänster är otydligt utformade för användare. Elektroniska underskrifter bör anses ha såväl juridiska som tekniska förutsättningar för att i framtiden kunna användas i ännu större omfattning än idag.

La tesis se encarga de analizar, por un lado, la integración y el desarrollo de las nuevas tecnologías en la Administración de Justicia; y, por otro, los parámetros que constituyen la validez y eficacia del documento electrónico. La primera cuestión se centra en la configuración de los Sistemas de Información de la Oficina Judicial y del Ministerio Fiscal, así como de la informatización de los Registros Civiles, donde el art. 230 LOPJ es la pieza clave. Se estudian sus programas, aplicaciones, la videoconferencia, los ficheros judiciales y las redes de telecomunicaciones que poseen la cobertura de la firma electrónica reconocida, donde cobran gran relevancia los convenios de colaboración tecnológica. La digitalización de las vistas quizá sea una de las cuestiones con más trascendencia, teniendo en cuenta que el juicio es el acto que culmina el proceso. Aunque no todos los proyectos adoptados en el ámbito de la e.justicia se han desarrollado de forma integral, ni han llegado a la totalidad de los órganos judiciales. El objetivo final es lograr una Justicia más ágil y de calidad, a lo cual aspira el Plan Estratégico de Modernización de la Justicia 2009-2012 aprobado recientemente.En referencia a la segunda perspectiva, no cabe duda que el Ordenamiento jurídico y los tribunales, en el ámbito de la justicia material, otorgan plena validez y eficacia al documento electrónico. Nuestra línea de investigación se justifica porque cada vez son más los procesos que incorporan soportes electrónicos de todo tipo, ya sea al plantearse la acción o posteriormente como medio de prueba (art. 299.2 LEC). Entre otros temas examinamos el documento informático, la problemática que rodea al fax, los sistemas de videograbación y el contrato electrónico. / La tesi s'encarrega d'analitzar, per una part, la integració i el desenvolupament de les noves tecnologies dins l´Administració de Justícia; i, per l'altra, els paràmetres que constitueixen la validesa i l'eficàcia del document electrònic. La primera qüestió es centra en la configuració dels Sistemes d´Informació de l´Oficina Judicial i del Ministeri Fiscal, així com de la informatització dels Registres Civils, on l'art. 230 LOPJ es la peça clau. S'estudien els seus programes, aplicacions, la videoconferència, el fitxers judicials i les xarxes de telecomunicacions que tenen la cobertura de la firma electrònica reconeguda, on cobren gran rellevància els convenis de col·laboració tecnològica. La digitalització de les vistes tal vegada sigui una de les qüestions amb més transcendència, tenint amb compte que el judici es l'acte que culmina el procés. Entre altres temes examinem el document informàtic, la problemàtica que envolta al fax, els sistemes de videogravació i el contracte electrònic. / The thesis seeks to analyse, on the one hand, the integration and development of the new technologies in the Administration of Justice; and, on the other, the parameters which constitute the validity and efficiency of the electronic document.The first question centres on the configuration of the Information Systems of the Judicial Office and the Public Prosecutor, as well as the computerisation of the Civil Registers, where the art. 230 LOPJ it's the part key. Their programmes, applications, the Video Conferencing, the judicial registers and the telecommunication networks which are covered by the recognised electronic signatures, are studied, where the agreements on technological collaboration gain great relevance. The digitalisation of evidence might perhaps be one of the questions with most consequence, bearing in mind that the judgment is the act by which the process is culminated. Although not all the projects adopted within the compass of e.justice have developed completely nor have reached all the judicial organs. The final objective is to achieve an agile, quality Justice, to which the recently approved Strategic Plan for the Modernisation of Justice aspires.With reference to the second perspective, there is no doubt that the juridical Ordinance and the tribunals within the compass of material justice grant full validity and efficacy to the electronic document. Our line of investigation is justified because there are more and more processes which are sustained by electronic supports of all kinds, whether it be at the establishment of the action or later, as a proof of it (art. 299.2 LEC). Amongst other things, we examine the computerised document, the problems which surround the fax, the systems for video recording and the electronic contract.
