Significance of family mediation in the resolution of legal conflicts in a family The purpose of my thesis is to analyse the issue of family mediation. Family mediation which is a form of Alternative Dispute Resolution (ADR) could be defined as a structured process in which family members agree to appoint a neutral third party (the mediator) who assists them to find a mutually satisfactory solution to their problem based on their own decisions. The mediator must be impartial, their role is to encourage communication between the parties but has no authority to make any substantial suggestions or decisions with regard to the parties' issues. The mediation process is voluntary and confidential. One of the reasons why I chose this topic is my belief that family mediation can be in many cases a more suitable way to solve family conflicts than litigation. In many foreign countries (especially western European countries, the USA and Canada) mediation has a long history and is used frequently to solve conflicts that relate to separation, divorce, custody, financial questions in family etc. In the Czech Republic, however, family mediation has not been developed very well and I find this situation unfavorable. A Study of Work and Family Roles Conflicts of the Boss's WifeHuang, Shin-ping 25 July 2004 (has links)
The majority of companies in Taiwan are small and medium businesses, and most of companies are run by couples. Therefore, it is very common to see boss¡¦s wife in the company. Nonetheless the boss¡¦s wife puts different amounts of effort in the family field and the work field depending on the amount of her participation in managing family business and which stages of the family life cycle she is in. That is, the boss¡¦s wife frequently has a trade off between family and work life. The purpose of this study is to discover what kinds of conflicts the boss¡¦s wife experiences when looking after both work and family and how they cope with conflicts and thus balances their work and family life. This study has adapted case study method, a way of qualitative research to collect and analyze data.
The propositions are as follows:
Proposition 1: If the boss¡¦s wife takes her participation in family business, it is the extension of family responsibility, and they will be involved in managing the company.
Proposition 2: Housekeeping is remained as the boss¡¦s wife¡¦s major responsibility. However, the boss and his parents will lower their expectations of housekeeping quality in order to lessen the loading of the boss¡¦s wife in the family field.
Proposition 3: Motivated by family responsibilities, the boss¡¦s wife will look after both family and family business.
Proposition 4: Prerequisites of maternity and intentions to take on the family role first, even if the permeability of family boundary is higher, the work and family conflicts come mainly from family interference with work, not vice versa.
Proposition 5: One of characteristics embedded in the boss¡¦s wife¡¦ work is work-family boundary ambiguity.
Proposition 6: It is because the boss is considerate to the fact that his wife is too busy to look after both the work filed and the family filed and vice versa, spouses can eliminate each other¡¦s role conflicts.

Previous issue date: 2013-08-21 / Este trabalho teve como objetivo analisar a dinâmica dos atendimentos jurídicos dos conflitos familiares realizados no Núcleo de Prática Jurídica da Faculdade de Direito da Universidade Federal de Juiz de Fora destinado a pessoas de baixa renda. Mais especificamente, importou analisar como o interesse das partes em conflito foi transformado em uma demanda jurídica pelos operadores do Núcleo de Prática Jurídica e como esse processo de transformação foi influenciado pela maneira como os significados de conjugalidade e família foram produzidos nesse contexto, considerando que esses significados orientaram a dinâmica de administração dos conflitos. Em outras palavras, as tomadas de decisões no processo de administração de conflitos familiares no Núcleo de Prática Jurídica estiveram orientadas por uma lógica específica de discursos e práticas que foram analisadas nesse estudo. A pesquisa que orientou essa dissertação foi realizada no período de agosto/2012 a março/2013, nesse ambiente jurídico, através da observação dos atendimentos, entrevistas semiestruturadas e análise de documentos produzidos pelos estudantes. Foram selecionados oito casos observados, mais representativos, para delinear a análise proposta nessa dissertação. A etnografia dos atendimentos demonstrou que o interesse das partes pela procura do atendimento jurídico e pelo ajuizamento das demandas não se restringia à demanda jurídica exposta, mas abarcava uma dimensão afetiva e moral, muitas vezes distinta daquele interesse verbalizado durante o atendimento. Essa constatação apontou para uma desarticulação entre o interesse que moveu a busca do Núcleo pelas partes em conflito e o direito que se queria ver efetivamente reconhecido. / This study aims analyze the dynamic of legal services in family conflicts performed inside of Núcleo Prática Jurídica da Faculdade de Direito da Universidade Federal de Juiz de Fora destined to low-income people. More specifically, matter analyze how the interest of parts in conflict is transformed in a legal demand by operators of Núcleo de Prática Jurídica and how this transformation process is influenced by the way how the meanings of conjugality and family are made in this context, considering that these meanings guide the dynamic of conflict management. In other words, the making decision in the process of management of family conflicts inside the Núcleo de Prática Jurídica are oriented by a specific logic of speeches and practices that are being analyzed in this study. The research that guides this dissertation was performed in the period of august/2012 to march/2013, inside that legal environment, through observation of attendances, semistructured interviews and review of documents made by the students. Were selected eight cases observed most representative to delineate the analysis proposed in this dissertation. The ethnography of the attendances shows that the interest of parts for searching legal attendance and by the insight of the demands was not limited to legal demand exposed, but covered an affective and moral dimension, often distinct of that interests verbalized during the attendance. This finding pointed to a disarticulation between interest that moved the search for Núcleo by the conflict parts and the right that was wanted to see actually recognized.

À l’heure où un mariage sur deux finit en divorce, la question du rôle du juge aux affaires familiales (JAF) est plus que jamais d’actualité. Ce rôle a été modifié à de nombreuses reprises en fonction des considérations sociales du moment et, aujourd’hui, l’heure est à la déjudiciarisation. Mais est-ce pertinent ? Le rôle du JAF tend à être de plus en plus réduit à tel point que des pans entiers du droit familial sont retirés de sa compétence. Le règlement des conflits familiaux subit une tendance générale de déplacement vers la sphère privée dont le point culminant a été atteint, il y a peu, par la loi Justice XXI qui a déjudiciarisé le divorce par consentement mutuel et confier son règlement privé aux notaires et aux avocats. Quant aux autres pans du droit familial qui restent de sa compétence, ils subissent des délais judiciaires de plus en plus longs ou une présence symbolique du juge ; tant le nombre de ces derniers est bas. Les fautes sont dédramatisées, ce qui conduit à une absence d’indemnisation de ces dernières. Afin de pouvoir correctement appréhender les conséquences de ce mouvement de recul du judiciaire, une enquête a été menée sur le terrain auprès des JAF, avocats, notaires, psychiatres et, surtout, des justiciables. Les résultats de cette enquête ont permis de démontrer les conséquences dramatiques que ce mouvement entraîne ; tant sur le plan des conjoints/parents, que sur celui des enfants, voire des tiers. L’importance sociale des conflits de famille a toujours été la motivation première de l’intervention étatique afin de protéger les victimes que ces conflits peuvent engendrer. Il est regrettable que cette protection ne soit plus à l’ordre du jour. / At a time when every second marriage ends in divorce, the question of the role of the family affairs judge (JAF) is more relevant than ever. This role has been changed many times based on the social considerations of the moment and nowadays it is time for diversion. But is it relevant? The role of the JAF tends to be reduced to such an extent that entire sections of family law are removed from its jurisdiction. The settlement of family disputes is under-going a general trend of displacement towards the private sphere, the culmination of which was recently reached by the Justice XXI Act, which di-verted divorce by mutual consent and entrusted its private settlement to notaries and public servants. lawyers. As for the other parts of family law that remain within its jurisdiction, they suffer longer and longer court delays or a symbolic presence of the judge; as the number of these is low. The faults are played down, which leads to a lack of compensation for the latter. To be able to correctly grasp the consequences of this movement of retreat of the judiciary, an investigation was carried out in the field near the JAF, lawyers, notaries, psychiatrists and, especially, litigants. The results of this investigation have shown the dramatic consequences that this movement entails; spouses / parents, children and even third parties. The social importance of family conflicts has always been the primary motivation for state intervention to protect the victims that these conflicts may engender. It is regrettable that this protection is no longer on the agenda.

Professional Immigrant Women's Experiences of Managing Work and Family Conflicts: The Case of Chinese and Taiwanese Faculty in Research Intensive UniversitiesLi, Yun Ling 05 June 2017 (has links)
This study investigates first-generation Chinese and Taiwanese immigrant women faculty's workplace experiences and their strategies for managing work and family demands. By looking at how immigration, ethnicity, gender, and work processes shape these women's ideology and practices, this study addresses the following questions: How do married Chinese and Taiwanese immigrant women in research-intensive universities handle work and family conflicts? How do they negotiate their gender-role expectations and actual practices at work and home? And, finally, do their practices vary by academic disciplines based on the work processes involved in conducting research? This study points to the dynamic nature of cultures such that immigrant women can challenge some aspects of the traditional culture and retain those aspects that help them to receive support for managing work and family demands. Findings from this study also suggest that based on different work processes, what may seem to be flexible can, in fact, present particular barriers and impede workplace performance. Finally, these findings show that in some academic fields, being women may place obstacles for career advancement, but that co-ethnic network provides alternative opportunities for them and can lead to greater research productivity. This study resonates with previous studies showing that childcare responsibilities place women faculty at a disadvantageous position in terms of job evaluation and career advancement. As well, it illuminates how disciplinary differences concerning work process shape women faculty's capability of arranging work schedule flexibly. / Ph. Purpose: To describe the consultant’s experience of Work-life balance and how they feel that HR promotes this. Method: In this study we have chosen to start from a deductive approach since there is solid research within the subject of Work-life balance. In order to answer our descriptive purpose, a case study is applied to give us detailed data. The study is of a qualitative nature and we have chosen to collect data via semi-structured interviews with active consultants. Theoretical framework: The study is based on research within Work-life balance and primarily Greenhaus and Beutell (1985) Work-family conflicts as well as Zedeck and Mosier (1990) relationship between work and non-work. In addition to these theories, our theoretical framework consists of Ulrich and Brockbank (2005) HR roles and research on HR practices. Empirical framework: The gathering of the empirical data has taken place through seven interviews with active consultants. Conclusion: Based on the study’s questions, we can conclude that the consultants generally feel that they have a good Work-life balance. We have also identified factors that have a major impact on this experience. We can conclude that consultants find that HR promotes Work-life balance to a great extent. Here too, we have identified important factors for how this experience appears.

Statut socioéconomique familial à l’adolescence et les symptômes dépressifs au début de l’âge adulte : rôle médiateur de la détresse psychologique parentale et des conflits familiauxLarose, Carol-Ann 07 1900 (has links)
La dépression représente un enjeu de santé publique majeur au début de l’âge adulte en
raison de ses nombreuses répercussions à long terme. Les jeunes adultes provenant de familles
ayant un faible statut socioéconomique (SSE) sont particulièrement susceptibles de développer des
symptômes dépressifs. Selon le Modèle du stress familial (Conger et al., 1993), les difficultés
économiques et financières exerceraient des effets directs sur la santé mentale des parents et sur la
qualité de la relation conjugale qui auraient ensuite des répercussions sur la santé mentale des
jeunes. Cette étude visait à étudier le rôle médiateur de la détresse psychologique parentale et des
conflits familiaux à l’adolescence dans l’explication du lien entre le SSE familial à cette même
période et les symptômes dépressifs au début de l’âge adulte. Cette relation a été testée auprès d’un
échantillon (n = 350) d’adolescents âgés de 14 à 19 ans provenant majoritairement de milieux
défavorisés de Montréal et de régions avoisinantes et surreprésentant les élèves ayant abandonné
leurs études avant d’obtenir leur diplôme. Un lien direct a été observé entre les conflits familiaux
et les symptômes dépressifs au début de l’âge adulte. Toutefois, contrairement aux hypothèses,
aucun lien indirect n’a été observé entre le SSE et les symptômes dépressifs via les processus
familiaux. Des analyses supplémentaires impliquant d’autres aspects de la vie ont, par ailleurs,
démontré un lien indirect entre la structure familiale et ces symptômes via les conflits familiaux.
Des enjeux méthodologiques et des pistes d’explication théoriques seront discutés pour tenter
d’expliquer les résultats. / Depression represents a major public health issue in early adulthood due to its many long-term repercussions. Young adults from families with low socioeconomic status (SES) are particularly susceptible to developing depressive symptoms. According to the Family Stress Model (Conger and al., 1993), economic and financial difficulties have direct effects on the mental health of parents and on the quality of the marital relationship, which in turn impact the mental health of young people. This study aimed to investigate the mediating role of parental psychological distress and family conflicts in adolescence in explaining the link between family SES during this same period and depressive symptoms in early adulthood. This relationship was tested with a sample (n = 350) of adolescents aged 14 to 19 coming mainly from underprivileged backgrounds in Montreal and surrounding regions and overrepresenting students who had dropped out of school before obtaining their diploma. A direct link has been observed between family conflicts and depressive symptoms in early adulthood. However, contrary to hypotheses, no indirect link has been observed between SES and depressive symptoms via family processes. Additional analyzes involving other aspects of life have, moreover, demonstrated an indirect link between family structure and these symptoms via family conflicts. Methodological issues and theoretical explanations will be discussed to try to explain the results.

Объектом исследования явились межличностные конфликты в семейных взаимоотношениях. Предметом исследования стали психологические особенности межличностных конфликтов людей, состоящих в браке. Магистерская диссертация состоит из введения, двух глав, заключения, списка литературы (70 источников) и 5 приложений, включающего в себя бланки применявшихся методик. Объем магистерской диссертации 110 страница, на которых размещены 9 рисунков и 8 таблиц. Во введении раскрывается актуальность проблемы исследования, разработанность проблематики, ставятся цель и задачи исследования, определяются объект и предмет исследования, формулируются основная и дополнительные гипотезы, указываются методы и эмпирическая база, а также этапы проведения исследования, научная новизна, теоретическая и практическая значимость работы. Первая глава включает в себя обзор иностранной и отечественной литературы по теме межличностных конфликтов людей, состоящих в браке. Представлены разделы, посвященные исследованию межличностного взаимодействия, специфики межличностных конфликтов в семье, а также консультированию людей, состоящих в браке в ситуациях межличностных конфликтов. Выводы по первой главе представляют собой итоги по изучению теоретического материала. Вторая глава посвящена эмпирической части исследования. В ней представлено описание организации и методов проведенного исследования и результатов, полученных по всем использованным методикам: методике «Анализ семейной тревоги» Э.Г. Эйдемиллера и В.В. Юстицкиса, шкале самоуважения М. Розенберга, опроснику «Характер взаимодействия супругов в конфликтных ситуациях» Ю. Е. Алешина и Л.Я. Гозмана). Также в главе представлен корреляционный и факторный анализ результатов исследования. Выводы по главе 2 включают в себя основные результаты эмпирического исследования. В заключении в обобщенном виде изложены результаты теоретической и эмпирической частей работы, а также выводы по выдвинутым гипотезам, обоснована практическая значимость исследования и описаны возможные перспективы дальнейшей разработки данной проблематики. / The object of the study was interpersonal conflicts in family relationships. The subject of the study was psychological features of interpersonal conflicts of married people. The master's thesis consists of an introduction, two chapters, conclusion, list of literature (70 sources) and 5 appendices, including forms of applied methods. The volume of the master's thesis is 110 pages, on which there are 9 figures and 8 tables.
The introduction reveals the relevance of the research problem, the development of issues, sets the goal and objectives of the study, defines the object and subject of the study, formulates the main and additional hypotheses, specifies the methods and empirical basis, as well as the stages of the study, scientific novelty, theoretical and practical significance of the work. The first chapter includes a review of foreign and domestic literature on the topic of interpersonal conflicts of married people. Sections devoted to the study of interpersonal interaction, specifics of interpersonal conflicts in the family, as well as counseling of married people in situations of interpersonal conflicts are presented. The conclusions of the first chapter represent the results of the study of theoretical material. The second chapter is devoted to the empirical part of the study. It presents a description of the organization and methods of the research and the results obtained by all the methods used: the methodology “Family Anxiety Analysis” by E. G. Eidemiller and V. V. Justickis, the self-esteem scale by M. Rosenberg, the questionnaire “The nature of interaction between spouses in conflict situations” by Yu. Yustitskis, M. Rosenberg's self-esteem scale, Y.E. Aleshin and L.Y. Gozman's questionnaire “The nature of interaction between spouses in conflict situations”). The chapter also presents correlation and factor analysis of the research results. The conclusions of Chapter 2 include the main results of the empirical study. The conclusion summarizes the results of the theoretical and empirical parts of the work, as well as conclusions on the hypotheses, substantiates the practical significance of the study and describes the possible prospects for further development of this issue.

The literature review extensively covers the topic of strategic planning, family business dynamics and major salient features of family business described by various authors. These critical factors helped in designing the strategic planning model for the family owned firms of Saudi Arabia. The model was practically implemented and validated in 10 family businesses of the kingdom and results confirm the applicability of this model. The model formulation and validation in the family firms of Saudi Arabia, forms the main focus of this dissertation.
