Correlates of Recidivism: A Study Examining the Differences Between First Time Felony Probationers and Recidivist Felony Probation Offenders

The purpose of this study is to explore the differences and characteristics between first time felony probationer and recidivist felony probation offender. The importance of said studies grows significantly, given current trends of sentencing offenders to probation. Using archived data on random sample of felony offenders in 2000 and based on information acquired and maintained by the Denton County Community Supervision and Corrections Department (CSCD), the study consists of 40 first time felony offenders and 40 recidivist felony offender placed on probation during the year 2000. The method consists of a longitudinal comparison model. To examine the research question, descriptive statistics are used to compare basic demographics. Then, in order to answer the research question bi-variate significant tests, Chi-square and Independent Sample T-tests were employed when appropriate. Results indicate differences between first time felony probation offenders and recidivist felony probationers.

Hierdie bevoegdheid spruit uit sowel die gemenereg as die wettereg. Kragtens die Suid-Afrikaanse Strafproseswet word hierdie bevoegdhede gereel deur aa 42 en 49. Oewerbewoners as eienaars van grand is geregtig op die onverstoorde gebruik en genot van hulle eiendom. Daarteenoor is kanovaarders ook daarop geregtig om op openbare ri vi ere vir wedvaarte te oefen. Di t is egter belangrik om vas te stel of die portage van kano's op die oewer insidenteel is tot die reg om op die rivier te vaar. Ewewig moet bewerkstellig word tussen die botsende belange. Die Waterwet 54 van 1956 behoort gewysig en vereenvoudig te word, aangesien Suid-Afrika nie slegs op die RomeinsHollandse reg kan staatmaak nie - ons waterprobleme staan direk teenoor die van die Nederlande. / The private person has certain powers regarding the arrest and the use of force to effect the arrest of members of the public who have committed/are committing offences. These powers are derived from either common law or statutory law. In terms of the South African Criminal Procedure Act these powers are regulated by ss 42 and 49. Riparian owners are entitled to the undisturbed use and enjoyment of their property. On the other hand, canoeists are also entitled to practise on public rivers. It is important, however, to ascertain whether portage of canoes on the river bank is incidental to the right of canoeing on the river. A balance should be struck between these conflicting interests. The Water Act 54 of 1956 should be amended and simplified, since South Africa cannot rely on Roman Dutch law alone - our water problems are the complete opposite of those in the Netherlands. / Criminal & Procedural Law / LL.M. Chovanec, Š. Criminal proceedings against legal entities Criminal proceedings against legal entities represent a significant innovation for Czech criminal procedure law. Adoption of Act nř 418/2011, about Criminal liability of legal entities and criminal proceedings against them, is considered as acceptance of the world's phenomenon of enactment of the institute of Criminal liability of legal entities. The lawmaker had chosen a special regulation for criminal proceedings against legal entities which however does not describe the issues solely. So the Penal Code is considered subsidiary applicable regardless it does regulate criminal proceedings against a natural person. The author of this text deals with risks and potential problems connected to this construct. The author of this text describes selected aspects of criminal proceedings against legal entities from its beginning to the enforcement proceeding.

Hudáková, J. Criminal liability of legal persons Criminal liability of legal persons is a significant change to the continental European law. It is a sensible breakthrough into the core principle of an individual criminal responsibility of individuals. In connection with the adoption of Act No. 418/2011 Coll., on the criminal liability of legal persons and proceedings against them, the thesis deals with main aspects of the criminal liability of legal persons in the Czech Republic. After defining of legal grounds of the criminal responsibility author subsequently discusses sanctioning of legal persons. At the same time, the author discusses legal regulation of moral person criminal liability in France. She outlines the principles of criminal liability of legal persons, as well as the conditions for imposing sanctions. The author tries to demonstrate, by means of the attached statistical surveys, the numerous application of this institute in the French legal practice. Finally, the author tries to compare Czech and French legislation in selected aspects.
