The general objective was fulfilled through the following specific objectives: we verified the lack of instruments which judges have in order to apply the law fairly and we analyzed how the elements of the theory of interpretation are used in practice by judges. We intended to give to this dissertation a practical and real focus of interpretation and application of law by judges. That is why we chose the structured interviewed as a technique. So, three judges were interviewed and the same questions were made. The questions were previously organized and they followed the same order in all interviews. From the interviews, we wrote down the answers given by the judges and we selected the most expressive parts of the judges talk. After that, these parts were reduced to meaningful unit contexts that is the most important expressions and phrases from the interviews were selected and organized in such contexts so that the essential content could be easily understood. These meaninful unit contexts were organized in parts for reflection and they were the origin for the development chapters of this work: the importance of the extrajuridical knowledge, sources of law, ways of interpretation, application of law with security, application of law with in security. With the data collected through the interviews, we compared them with the bibliography already available. To sum up, we concluded that judges make use of something undetermined in order to apply the law fairly because there is no juridical instrument that can cover all the reality of law. / O presente trabalho objetivou visualizar os instrumentos de que os juízes dispõem para uma aplicação justa do direito. Esse objetivo geral foi perseguido através dos seguintes objetivos específicos, que serviram de instrumentos para a consecução daquele: verificar a insuficiência de instrumentos de que se servem os juízes para uma aplicação justa do direito e analisar como os elementos da teoria da interpretação são utilizados, na prática dos juízes. Pretendemos dar à dissertação um enfoque mais prático e real da interpretação e aplicação do direito por parte dos juízes. Por isso, optamos pela técnica da entrevista estruturada e gravada. Assim, três juízes foram entrevistados, sendo feitas as mesmas perguntas a todos eles, perguntas essas que foram previamente estabelecidas e formuladas seguindo a mesma seqüência em todas as entrevistas. A partir das entrevistas realizadas, transcrevemos as respostas dadas pelos entrevistados e selecionamos os trechos mais expressivos das falas dos juízes. Em seguida, esses trechos foram reduzidos em contextos de unidades de sentido, ou seja, as expressões e frases mais importantes dos trechos das falas dos juízes foram selecionadas e organizadas em tais contextos para que fosse entendido o conteúdo essencial que os entrevistados quiseram ressaltar. Esses contextos de unidades de sentido foram agrupados em blocos para reflexão, os quais originaram os capítulos do desenvolvimento do presente trabalho: A Importância dos Conhecimentos Extrajurídicos, Fontes do Direito, Modalidades de Interpretação, Aplicação do Direito com Segurança, Aplicação do Direito com Insegurança. De posse dos dados coletados nas entrevistas, os mesmos foram confrontados com a bibliografia existente. Por fim, concluímos que os juízes recorrem ao indeterminado para uma aplicação justa do direito, uma vez que nenhum instrumento jurídico pode abraçar toda a realidade do Direito.

A presente tese se dedica a examinar alguns aspectos do romance Acenos e afagos, de João Gilberto Noll, publicado em 2008. A obra, que privilegia a ambiguidade e a indeterminação, é narrada em primeira pessoa por um personagem que, ao longo do texto, não sabe se está morto ou vivo. Passando por uma transformação corporal, operada discursivamente, o narrador tampouco pode afirmar se é um homem ou uma mulher. A partir de elementos como o foco narrativo, o discurso do narrador, a construção de personagens e a configuração do tempo no texto em exame, é possível verificar estratégias formais que colaboram para a construção de uma narrativa indeterminada. Analisamos, portanto, tais elementos, articulando-os à não causalidade do enredo, bem como a temas centrais do romance, como a morte e o relacionamento amoroso. Alguns conceitos mostram-se especialmente produtivos para o estudo de Acenos e afagos: a situação-limite, o limiar e o excesso, que se relacionam tanto com os conteúdos trabalhados no enredo do romance, quanto com procedimentos estéticos utilizados pelo autor, visando a preservar a indeterminação na obra. / This thesis aims at examining some aspects of the novel Acenos e afagos, by João Gilberto Noll, published in 2008. The novel, which privileges ambiguity and indeterminacy, is narrated in the first person by a character who, throughout the text, does not know if he is dead or alive. Going through a body transformation, operated discursively, the narrator, originally a man, cannot say whether he has become a woman or not. Analyzing elements such as the narrator\'s position and discourse, character construction, and time setting in the text under review, it is possible to verify formal strategies that collaborate to construct an indeterminate narrative. We therefore interpret such elements, articulating them to the non-causality of the plot, as well as to central themes of the novel, such as death and the love relationship. Some concepts are especially productive for the study of Acenos e afagos: the limit situation, the threshold and the excess, which relate both to the contents worked on in the plot of the novel and to the aesthetic procedures used by the author, in order to preserve the indeterminacy in the story.

A indeterminação recobre uma noção semântica em que o referente não é identificado: alguma coisa na frase designa um ser (ao que tudo indica animado) cuja referência, em princípio, não é possível determinar. Retomando trabalhos já feitos sobre esse assunto, e investigando textos de diferentes séculos, nosso objeto de estudo é a função de indeterminação, sob as diversas formas em que se apresenta, em português. Nosso estudo assume uma perspectiva funcionalista, com apoio também na Lingüística Histórica. O objetivo geral da pesquisa é identificar e analisar casos de indeterminação, manifestada por marcas morfossintáticas e lexicais, em português escrito, em diferentes séculos, buscando evidências de variação (e mudança) dos recursos de expressão de tal uso e analisando sua freqüência de emprego, através de estudo qualitativo e quantitativo. Os resultados permitem algumas verificações. Uma é o aumento de frases de interpretação dupla (tanto reflexiva como passiva), que apareceram com muita freqüência no século XX. Embora a construção seja ambígua, a informação transmitida não é. Outra verificação é a das restrições morfossintáticas que incidem sobre expressões lexicais que expressam indeterminação. Confirma-se mais uma vez o uso do se indeterminador como a forma mais freqüente desde o século XVI. Também marcam presença – e desde registros muito antigos – a terceira pessoa do plural e a passiva sem agente. Todas as formas que indicam indeterminação têm restrições de alguma ordem – sintática, semântica, morfológica. Assim, embora a interpretação arbitrária se construa no discurso, suas marcas acabam entrando no sistema da língua. / Indeterminacy or arbitrary interpretation recovers a semantic notion in which the referent is not identified: some particular construction or lexical unit indicates a being (so far animate) whose referent, in principle, cannot be determined. Our object of study is the set of morpho-syntactic or lexical forms that indicate such indeterminacy in Portuguese, in different periods of time. Indeterminacy is assumed as a function, under its various forms. Functional Grammar and Historical Linguistics provide us with theoretical support. Our main goal is to identify and to analyse forms of indeterminacy in Noun Phrases, in written texts, in different periods of the History of Portuguese. We also search for variation (and change) of the forms of indeterminacy and observe its frequency of use, through the use of both qualitative and quantitative approaches. One of our results shows the increased number of sentences of double interpretation, either passive or reflexive, that appear in texts, mainly throughout twentieth century. Although the interpretation of their construction is ambiguous, the semantic information transmitted does not change. Other result investigates the morpho-syntactic restrictions that lexical expressions undergo when expressing indeterminacy. The use of indefinite se as the most frequent form, since sixteenth century, is once again confirmed. Other forms, like verbs in the third person plural and passive without agent, are noticeably frequent. All the forms that indicate indeterminacy have some restriction of any order, either in the field of syntax, semantics, or morphology. So, despite the fact that arbitrary interpretation is built in discourse, its marks become part of the linguistic system.

A partir da análise de textos publicados em jornais de grande circulação nos estados do Rio de Janeiro e de São Paulo, analisamos as principais características, sintáticas, semânticas e discursivas da indeterminação do sujeito, diferençando-a da indeterminação do papel temático exercido pelo sujeito (de ordinário, agente). Ressalta-se a importância de analisar o verbo, com suas propriedades, para melhor apreciar o fenômeno da indeterminação. Levantamos as principais noções de sujeito e de indeterminação do sujeito, em diversos estudiosos da Língua Portuguesa. Cuidamos em compará-las e em verificar os critérios (sintáticos, semânticos, mórficos e discursivos) implicados na indeterminação do sujeito. Outrossim, buscamos em livros didáticos e em gramáticas escolares (Ensinos Fundamental e Médio) a forma como o assunto é introduzido, as definições, os exercícios, etc, de forma a podermos compará-las e refletir sobre elas / In this work, we study the structures in Portuguese language where occurs the so called indetermination of the subject. From the analysis of texts published in periodicals of great circulation in the states of Rio De Janeiro and São Paulo, we analyse the main syntactic, semantic and discoursive characteristics of the indetermination of the subject, distinguishing it from the semantic role played by the subject (usually, agent). We emphasize the importance of analysing the verb and its properties to give a better account of the phenomenon of indetermination. We search the main concepts of subject and 'indetermination of the subject' in several scholars works on Portuguese. We compare them and verify the criteria (syntactic, semantic, morphological and discoursive) implied in the expression 'indetermination of subject'. Besides, we search in schoolbooks and grammars how the subject is introduced, its definitions, the exercises etc., in order to be able to compare them and to reflect on them

Neste trabalho são observados processos de trabalho envolvidos na criação musical dentro do que se pode chamar de música experimental, observando, particularmente, o trabalho de alguns grupos brasileiros realizado entre os anos de 2000 e 2016. O trabalho é dividido em três partes: na primeira, estabelece-se um contexto, por meio de uma discussão do termo \"música experimental\", da observação de práticas históricas e de uma análise das condições dessa produção no Brasil no período citado. Na segunda, são abordadas práticas desenvolvidas por alguns grupos / coletivos (Artesanato Furioso, Brechó de Hostilidades Sonoras, Circuito de Improvisação Livre, Hrönir, Orquestra Errante, QI) bem como práticas associadas ao tema nas quais o autor do trabalho participou, especialmente durante o período da pesquisa (2013-2016), junto a diversos artistas e grupos. Na terceira, são feitas reflexões sobre algumas características de tais práticas, trazendo à tona questões relacionadas a autoria, especificidade, identidade individual e coletiva, oralidade e relações de trabalho / In this thesis, the work processes involved in musical creation are observed within what may be called experimental music, observing, in particular, the work of some Brazilian groups between the years 2000 and 2016. The thesis is divided in three parts: in the first part, a context is established, through a discussion of the term \"experimental music\", the observation of historical practices and an analysis of the conditions of this production in Brazil within the above mentioned period. The second part deals with practices developed by some groups (Artesanato Furioso, Brechó de Hostilidades Sonoras, Circuito de Improvisação Livre, Hrönir, Orquestra Errante, QI) as well as practices in which the author of the work participated, especially during the research period (2013-2016), along a few artists and groups. In the third part, reflections on some characteristics of such practices are made, raising questions related to authorship, division of labor, identity, orality and specificity.

Este trabalho tem por objeto de estudo um fenômeno do português do Brasil mais comumente encontrado em textos formais. Trata-se do pronome fraco se precedendo verbos infinitivos. Esse item compete com zero na indeterminação do sujeito em orações encaixadas, mais precisamente em orações completivas de nome e adjetivo, temporais e finais. Propõe-se descrever os fatores condicionadores da inserção do se em sentenças nãofinitas do português brasileiro e promover um análise da questão à luz da teoria gerativa no seu modelo de Princípios e Parâmetros (Chomsky 1981, 1986a). Tomou-se como corpus textos formais de alunos da pós-graduação de diversas áreas do conhecimento da Universidade de São Paulo, hipotetizando que o teor científico do texto proporcionaria a estratégia de indeterminação por nós analisada. Em seguida, foram elaborados testes de produção junto aos alunos da graduação dessa mesma universidade a fim de verificar se as respostas produzidas por eles corroborariam os resultados encontrados nas dissertações e teses. Dentre os fatores mais relevantes para justificar a inserção de se nas construções com verbos infinitivos, destacou-se a preposição. Para a análise interpretativa desse achado, seguimos a proposta de Mioto & Kato (2002). / This dissertation aims at studying a Brazilian Portuguese phenomenon commonly found in formal texts. It is the se insertion as subject of infinitive clauses. This particle competes with the null category in the subject indetermination in embedded clauses, more precisely in the complement of noun and adjective clauses and clauses of time and finality. It is intended to describe the conditioning factors of the se insertion in non-finite sentences from Brazilian Portuguese and promote an analysis of the matter having the Generative Theory in its model of Principles and Parameters (Chomsky 1981, 1986a) as a reference. At first, it was used as corpus formal texts by graduate students from different areas of knowledge from Universidade de São Paulo, hypothesizing that the text scientific wording would allow the strategy of the indetermination analyzed in this dissertation. Secondly, production tests were elaborated with undergraduate students from the same university in order to verify if the answers produced by them would confirm the results found in the dissertations and theses. Among the most relevant factors to justify the se insertion in the constructions with infinitive verbs, the preposition stood up. For the interpretative analysis, we followed Mioto & Kato (2002) proposal.
