Employees' lived experiences of having been declared in excess during a restructuring process

The purpose of this study was to explore and describe the meaning employees attributed to the lived experiences of having been declared in excess in the Gauteng Health Department during restructuring. A qualitative, phenomenological research design was selected as the most appropriate approach in conducting this study. Phenomenology offers both methodological and philosophical perspectives with the aim of developing a greater understanding through description, reflection and awareness of the meaning of having “been declared in excess”. Purposive sampling was implemented. A total of ten (10) female professional nurses participated in the study. Data were collected using one common ontological question that enabled the researcher to gain a greater understanding of what it means to be declared in excess from the participants’ perspective. Data were collected until saturation was reached. Unstructured audio-taped interviews were conducted with study participants. Data were analysed using the method developed by Giorgi (1985). The study highlighted different reactions from different participants despite being exposed to the same experience. / Health Studies / Thesis (D. Litt. et Phil.)

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / The survey had as a goal indicate the perspectives of development of the mechanical-metal sector from the region of mechanical Panambi - RS, whose companies develop correlate activities of high and medium technological complexity. The sector, composed by an organizational arrangement, involves several agents who contribute to the empowerment and competitiveness among companies. The identification of agents that configure the arrangement and their inter-relationships permitted to diagnose the problems of the sector. As a method it was used the approach of qualitative research, with collect of data for nonprobabilistic and intentional sample, through unstructured interviews. With the results of the analysis of these data it was possible to present the priorities of development of the sector in the region. / Essa pesquisa buscou indicar as perspectivas de desenvolvimento do setor metal mecânico da região de Panambi RS, cujas empresas desenvolvem atividades correlatas de alta e média complexidade tecnológica. O setor, formado por um arranjo organizacional, envolve agentes diversos que contribuem para a capacitação e competitividade das empresas. A identificação dos agentes que configuram o arranjo e suas inter-relações permitiram diagnosticar a problemática do setor. Como método utilizou-se a abordagem de pesquisa qualitativa, com coleta de dados por amostragem não probabilística e intencional, por meio de entrevistas não estruturadas. Com os resultados da análise desse dados foi possível apresentar as prioridades de desenvolvimento do setor na região.

O objetivo do estudo é a interpretação da expressão “relação de trabalho”, inserida no art. 114, I, da CF/88, pela EC. 45/2004. Por meio do método analítico investigam-se os fundamentos políticos, jurídicos e sociológicos que respaldam a interpretação constitucional e demarcam a função institucional da Justiça do Trabalho para a sociedade brasileira. Inicia-se com breve relato da história da Justiça do Trabalho e seu regime de competências. Segue-se apanhado geral da doutrina e da jurisprudência que dá sentido e localização ao objeto de estudo ao evidenciar os pontos de convergência e divergência dos mais variados autores que se debruçaram sobre o tema. Após localizar o leitor no objeto de estudo, parte-se para a tentativa de aprofundar as razões sociológicas e políticas que estão por trás da alteração da norma constitucional de modo a dar fundamento à conclusão que se seguirá. Concluída a análise político-social sobre o modo de ser do trabalhador contemporâneo, retoma-se o prisma estritamente jurídico para concluir que a expressão “relação de trabalho” inclui na competência da Justiça do Trabalho todas as demandas promovidas pelos trabalhadores em face dos respectivos tomadores de serviço, independentemente da existência de relação de emprego a partir, única e tão-somente, do pressuposto do trabalho prestado por pessoa física, de um lado, e, de outro, a conjugação dos pressupostos da onerosidade ou da profissionalidade. Thesis (MTech (Human Resource Management))--Cape Technikon, 1996. / Labour relations in South Africa is directly influenced by affirmative action in the work place, creating potential labour relations opportunities and threats within organisations. An investigation was done to ascertain the influence of affirmative action on labour relations. A comparative study of employer and trade union perceptions indicated a marked consensus between the two parties. The differences between the parties can be addressed by collective bargaining. A theoretical framework was developed, which demonstrated that worker participation and joint decision-making on affirmative action programmes should be regarded as essential for the success of these programmes. Shortcomings in current affirmative action programmes emanate from unilateral decision-making by management. A lack of legitimacy in affirmative action programmes results from non-consultation with trade unions. This has a detrimental effect on the credibility of affirmative action programmes and as a result no real employee development occurs. The labour relations climate is thus impaired. The research methodology included interviews (conducted with a number of academics, human resource managers and trade unionists) and postal questionnaires, which were completed by 231 managers (human resource and line managers) in both private and public organisations in the Western Cape.

A theoretical framework for the labour relations between the farmer and farm workers during industrial strike actions

Thesis (MTech (Public Management))--Cape Peninsula University of Technology, 2017. / The purpose of this study was to analyse the labour relations of the workers in the agricultural sector, with reference to the De Doors area in the Western Cape. Despite the political, social and economic changes to better the lives of the farm workers that have been implemented to rectify the inequalities of the past, the labour conditions on farms stayed unchanged. It is evident that there is a gap in the labour relations in the agricultural sector, due to the 2012/13 strike actions that took place. Qualitative research methodology was employed in the study; it provided the researcher with the opportunity to personally interact with the farm workers. It further allowed the researcher to gain a holistic understanding of the daily lives of the farm workers which would foster a better understanding of their daily struggles. Interviews were used as method of data collection. This methodology also enables the researcher to interpret and describe the actions of participants. Good labour relations play a vital role in any industry or organisation. Farm workers are generally classified as vulnerable and the most exploited group of the South African society. They often work irregular hours throughout the year in various weather settings. Regardless of the physical strain that their jobs entail, farm workers earn a low wage and are often deprived of the basic benefits that an employee should be entitled to. This was the reason the farm workers embarked on a strike in 2012/13. The researcher proposed recommendations to the Agricultural department on how to improve the labour relations on the farms in the De Doorns area by suggesting that more labour inspectors are being employed to oversee that legislation are implemented. Skills Development needs to be become compulsory for all farm workers as farming is becoming more technological. Skills Development unlocks talents and creative energy for the farm workers which have a positive impact on production.

I arbetsmarknadsparternas gemensamma intresse: Mellan rationalitet och ideologi : En uppsats om varför kollektivavtal utan centralt angivet löneutrymme träffas på svensk arbetsmarknad

Denna uppsats undersöker varför kollektivavtal utan centralt löneutrymme träffas på svensk arbetsmarknad. Det empiriska materialet utgörs av svar från tjugotre semistrukturerade intervjuer med arbetsmarknadsorganisationer och Medlingsinstitutet. Den empiriska datan analyseras utifrån Walter Korpis maktresursteori och Peter Swensons mellanklassteori och dess förklaringar av arbetsmarknadsorganisationernas beteende. Studien finner inget stöd för hypotesen härledd ur maktresursteorins förklaring – att det skulle vara svaga förbund som tvingats till kollektivavtal utan centralt angivet löneutrymme. Huvudslutsatsen är istället att kollektivavtal utan central angivet löneutrymme är en produkt sprungen ur parternas gemensamma intresse att skapa en mer segmentalistisk ordning med en mer prestationsbaserad lönebildning och större lönespridning. Bland förbunden finns två något olika motiv till att lämna ett mer solidarisk lönebildningsarrangemang. Majoriteten av förbunden ser ett stort egenvärde i en mer segmentalistisk ordning i syfte att åstadkomma större lönespridning och för att möjliggöra för den individuella medlemmen att påverka sin egen lön och möjlighet till lönekarriär. Det andra motivet är att använda det sifferlösa avtalet, och implicit de segmentalitska effekter det innebär, för att åstadkomma relativlöneökningar för förbundsmedlemmarna som kollektiv. När kollektivavtal utan centralt angivet löneutrymme väl har träffats förändrar det förutsättningarna för beslut om kollektivavtal utan centralt angivet löneutrymme vid nästa avtalsrörelse. Avtalet stärker relationen till arbetsgivarparten på alla nivåer i avtals-och lönebildningsprocessen och alla nivåer är nöjda med avtals- och löneproceduren – vilket gör det svårare att inte träffa avtalet vid nästa avtalsrörelse.

Tal discurso continua prevalecendo na mídia, na academia, nas organizações internacionais; ganha espaço no ideário dos trabalhadores e no campo das políticas públicas. Parte-se nesse trabalho da perspectiva de Marx para a análise das tendências do capital, que são propensas a prevalecer caso se adote uma regulação via mercado e não via poder público/social. Para Marx, o capital busca a valorização como único objetivo, enquanto os trabalhadores devem buscar seus direitos e a desmercantilização da força de trabalho, através da luta de classes. Sendo a valorização do capital o objetivo do sistema e já que a mesma ocorre com a exploração da força de trabalho, um aumento do poder discricionário do capital pressiona os trabalhadores, estimula o progresso técnico para poupar força de trabalho, precariza o trabalho, intensifica a jornada, entre outros efeitos deletérios para a classe trabalhadora / Abstract: In this thesis, a study on the discourse of flexibility and deregulation of labor relations - which are inserted in the mainstream and Austrian economics framework -, its theoretical bases and effects was made. Such discourse remains prevalent in the media, in the academy, international organizations, gaining space in the workers' mindset and in the public policy field. A Marxian perspective is assumed in this study to analyse capital's trends, which are likely to prevail if a market regulation rather than a public/social one is adopted. To Marx, capital seeks appreciation as its single objective, while workers should pursue their rights and the decommodification of the labor force through class struggle. M.Comm. / The purpose of the study is to determine, through literature research, what the current situation is regarding Labour Relation Management in Education. In order to search for answers, various resources have been used -the majority of which are primary and authoritive of nature. In the first instance a few basic concepts and definitions in labour law in education were studied. Issues which were discussed focused on the definition of employer and employee and the relationship between them. The professional nature of the teaching profession was discussed, including the various councils which have an impact on industrial relations in education. In chapter three an in depth analysis has been made of the role of the various legislation regarding industrial relations in the educational field. The focus of this analysis was on the following key legislation: The Constitution 108 of 1996 The Labour Relation Act 66 of 1995. The Employment of Educators Act 76 of 1998. The Basic Conditions of Employment Act 75 of 1997 The Employment Equity Act 55 of 1998 The Development of Basic Skills Act. South African Schools Act 84 of 1996 10 Regulations: Regulations Regarding Terms and Conditions Of Employment of Educators R 1743 OF 13 November 1995. Regulations on Personnel Administration Measures (PAM) 18 February 1999. In chapter four the disciplinary process in education was discussed at length. The focus here was on the disciplinary code, principles of the disciplinary process as well as internal disciplinary procedures -specifically by whom and at what level it should be managed. A clear distinction was made between internal and external procedures. The principle of natural justice under the audi alteram partem and the nemo iudex in propria causa principle was discussed. An important aspect here is the appointment and dismissal of teachers in governing body posts. In chapter six the grievance procedure in education-such as the definition of grievance and how it should be dealt with, were discussed. The management of grievances as quickly and as close as possible to the cause as well as the reaction and conduct of the parties concerned, were also discussed. In conclusion the study was summarized and certain shortfalls highligted. Certain recommendations were also made, especially concerning the Administrative Act 3 2000, and the use thereof in labour relations.
