O objetivo do trabalho é compreender alguns princípios norteadores do habitat na década de 1960 através da análise da cidade com as megaestruturas de Yona Friedman; da análise do material teórico de Kisho Kurokawa sobre as cápsulas; e sobre o processo de produção através da industrialização de João Filgueiras Lima - Lelé. As megaestruturas de Yona Friedman eram estruturas com funções de cidade, utilizavam tecnologias emergentes e o objetivo era acolher a população como espaço do habitar. As cápsulas eram componentes do habitar, envoltórios ou invólucros para o habitar humano, produzidos industrialmente, propunham a autonomia e simbiose entre máquina e homem. A industrialização para João Filgueiras Lima era compreendida como instrumento para atingir a equidade e resultado da consciência social e coletiva. Para Lima, o habitat era constituído pelas partes necessárias para o desenvolvimento do ser humano, composto pela urbanização, habitação e equipamentos sociais. / The objective of this essay is to comprehend the guiding principles of habitation in the 1960s through the analysis of the city with Yona Freidman\'s megastructures; of Kisho Kurokawa didatic materials regarding capsules; and João Filgueiras Limas production process through industrialization. The megastructures of Yona Friedman were structures with functions of a city, utilized emerging technologies and their objective was to shelter the population in a living space. The flexibility of the environments, the users mobility and participation were fundamental. The capsules, components of the living, involucres to the human living and industrially produced, proposed autonomy and symbiosis between man and machine. The industrialization was comprehended as an instrument to achieve fariness and result of the collective social conscience. To Lima, the habitat is composed by the necessary parts for the human development, composed by the urbanization, habitation and social equipments.

Regulação da internet: os desafios do Estado desenvolvimentista para a construção de um ambiente competitivo, inovador e democrático no espaço digital / Internet regulation: the developmentalist states challanges to the building of a competitive, innovative and democratic environment in the digital space

Qual é a internet que queremos? Para o Direito essa pergunta oferece um enorme desafio. Com a expansão comercial da rede, muitos interesses foram afetados e demandam conformação no ambiente digital. Um novo comportamento social emerge, com vistas à produção não mercadológica, baseada na troca e no compartilhamento de arquivos e informações, que se torna interessante para o desenvolvimento econômico e para o surgimento de novas oportunidades de inserção e prosperidade social. Questiona-se se os conceitos e as técnicas jurídicas desenvolvidas para descrever, analisar e regular a dinâmica da economia industrial são aplicáveis ao espaço cibernético ou se as novas tecnologias da informação propiciam inovações e comportamentos que exigem novos conceitos e definições que se moldem à Sociedade da Informação. Os controladores da infraestrutura de conexão e as grandes indústrias de entretenimento demonstram interesse na inspeção do fluxo de dados transmitido pela rede, bem como na restrição de uso e de acesso a conteúdos por dispositivos digitais conectados à internet e transmitidos via redes de compartilhamento de arquivos (redes p2p). Seus argumentos se fundamentam tanto na questão da abertura de modelos econômicos mais rentáveis e necessários à expansão da largura de banda, em resposta à demanda infinitamente crescente por internet de qualidade, quanto na fiscalização e impedimento da troca e do acesso a conteúdos protegidos por direito de propriedade intelectual. O presente trabalho vem demonstrar como as restrições impostas aos usuários poderiam impactar o ambiente competitivo e inovador criado na internet. O Marco Civil da Internet é formulado sobre as novas diretrizes produtivas e vem para definir, diante de um debate aberto e uma construção compartilhada com a sociedade brasileira, os possíveis caminhos a serem perseguidos com a regulação da internet. Os contornos jurídicos que resultarão da legislação a ser aprovada dependerão do posicionamento do Estado em face das demandas apresentadas, em alinhamento com o projeto desenvolvimentista insculpido no art. 3º da Constituição Federal. / Which internet do we want? From the aspect of the Law, this question poses a great challenge. With the commercial expansion of the web, many interests were affected by it, and these interests demand conformity in the digital environment. A new social behavior emerges, not aiming at a non-commercial aspect, but based on exchanging and sharing files and information, which is interesting for the development of the economy and for new opportunities of social insertion and prosperity. What is in question is if the legal concepts and techniques developed to describe, analyze and regulate the industrial economic dynamics are applicable to cyberspace, or if the new technologies of information provide enough innovation and behaviors that demand new concepts and definitions that mold them into the new Information Society. The controllers of connection infrastructure and the big entertainment industries show interest in the inspection of data flow transmitted on the web, as well as the restriction of content use and access through digital devices connected to the internet and transmitted through file sharing networks (p2p networks). Their arguments are based on two ideas: the opening of more profitable and necessary economic models, needed for the expansion of broadband width connection, answering the escalating demand for quality provision of internet use; and the supervision and stoppage of sharing and accessing content that is protected by intellectual property right. Under both ideas stated above, the aim of this work is to show how the restrictions imposed on users could impact the competitive and innovative environment fostered on the internet. The Internet Bill, called Marco Civil da Internet in Brazil, is formulated on the new productive directives and comes to define, with an open debate and a shared construction with all Brazilian society, the possible ways to be followed in regards to the regulation of internet use. The legal framework that will result on the approval of this legislation will depend on the position of the State about the presented demands, in alignment with the development project registered in art. 3rd. of the Federal Constitution

Esta dissertação de mestrado se destina a analisar as bibliotecas digitais apresentando, de início, um breve retrospecto histórico e social sobre a importância do livro e o surgimento das bibliotecas como centros de armazenamento do conhecimento humano. Nesse sentido, serão apresentados os caminhos que levaram o mundo a viver atualmente a realidade da chamada sociedade da informação. Após a análise dos conceitos, características e funcionalidades das bibliotecas digitais, serão apresentados alguns exemplos de experiências concretas bem sucedidas nessa área para, em seguida, discutir os dois outros elementos que compõem esse trabalho: a busca pelo acesso à cultura e os limites a ele impostos pela proteção ao direito de autor. O objetivo final é colaborar com a busca de respostas que representem o equilíbrio entre o direito coletivo, representado pelo interesse social de livre acesso ao conhecimento e à cultura, e o interesse individual dos titulares de obras, protegido pelo direito de autor. / This masters dissertation aims to analyze the digital libraries presenting a brief history and social retrospect about the importance of the book and the creation of libraries as storage centers of human knowledge. In this sense, the paths that led the world to live the reality of the currently called information society will be presented. After analyzing the concepts, features and functionality of digital libraries, some examples of successful experiences in this area will be presented, and then discussion of two other elements of this work: the search for access to culture and the limits imposed on it by the protection of copyright. The ultimate goal is to collaborate with the search for answers that represent the balance between the collective right represented by the social interest of free access to knowledge and culture and the individual interests of the holder´s works protected by copyright.

Thus, it intends to analyze the consumer virtual relationships, and the consumer rights in such digital environment, as well as, briefly discuss, the study of the Project of Law from the Senate, no. 281/2012, that updates the Consumer Defense Code, including e-commerce provisions. Therefore, this work is a study of a theoretical nature and focused on bibliographic research and standards governing trade on the Internet. As an introduction, this work presents the rise of the consumer society and the evolution to the information society, as a result of the technological transformations of the latest decades. From the analysis of the beginning of the Internet and its evolution in Brazil, we evolve to discuss about the e-commerce, the contributions and controversies arising from such business model, and, the traits of the e-commerce consumer contracts. Thereafter, an overview of the consumer protection laws applicable to the e-commerce is presented, with focus on the UNCITRAL and European Directive in the international scale, and in the national scenario, the Brazilian Consumer Code, the E-Commerce Decree and the Internet Civil Mark in Brazil, laws that aim at the protection of the consumers. With such overview, the study finds grounds to discuss about the rights of the consumers inserted in the virtual commerce, the principles that should guide the actions of the suppliers and some commercial practices most commonly used in the virtual environment to reach the consumer and offer products and services. The result of this study points out that, regardless of the existence of rules for protection of consumers and establishment of guidelines for suppliers in the e-commerce environment, it is necessary to provide specific rules to regulate the consumer relations in such environments, in consideration of its specificities / O presente estudo traz como objeto de investigação o comércio eletrônico e a proteção do consumidor no direito brasileiro. Assim, pretende analisar as relações de consumo eletrônicas e os direitos dos consumidores inseridos no ambiente digital, além de, suscintamente, apresentar o estudo do Projeto de Lei do Senado n. 281/2012, que trata da atualização do Código de Defesa do Consumidor no que tange ao comércio eletrônico. Deste modo, este trabalho é um estudo de natureza teórica, centrado na pesquisa bibliográfica e na pesquisa de normas que regem o comércio na Internet. Com efeito, apresenta, primeiramente, o surgimento da sociedade de consumo e a evolução para a sociedade da informação, fruto das transformações tecnológicas dos últimos tempos. A partir da análise da origem da Internet e seu desenvolvimento no Brasil, discorre-se sobre o comércio eletrônico, as formas de contratação no meio digital, as contribuições e controvérsias advindas desse novo modelo de negócio, além das características dos contratos eletrônicos de consumo. Apresenta, ainda, um panorama legislativo de proteção do consumidor no comércio eletrônico, com destaque, no âmbito internacional, para a Lei modelo da UNCITRAL e para a Diretiva Europeia sobre comércio eletrônico; no âmbito nacional, para o Código de Defesa do Consumidor, para o Decreto do Comércio Eletrônico e para o Marco Civil da Internet, diplomas legais que preservam os interesses dos consumidores. À luz disso, o estudo encontra subsídios para discorrer sobre os direitos dos consumidores inseridos no comércio digital, bem como aponta os princípios que devem pautar as ações dos fornecedores atuantes e informa algumas práticas comerciais mais comuns utilizadas no ambiente virtual para manter a comunicação com o consumidor e ofertar produtos e serviços. The Internet is an international public good or an space with no borders that reaches all mankind. The Internet Governance claims that all countries set a consensus about the cyberspace having multiple sovereignties but none in particular, such as the Sea Convention (Montego-Bay Agreement). The Internet Governance mechanisms includes technical (Internet standards and protocols), social (social boundaries, virtual communities, digital divide), economical (electronic commerce, technology access), legal, and others. The Internet Governance players are: governments, private sector, civil society and international organizations. This research has the objective to discuss the sovereignty concept all the way through the history of Internet Governance mechanisms. The methodology concerns the bibliographical review. The scientific literature available is short, due to the fact that Internet is a recent phenomenon. Data resources are documents from the international events (World Summit on Information Society and Internet Governance Forum); Internet governance organizations (Internet Engineering Task Force and ICANN); and interviews with Internet specialists. In conclusion, there is no break face the actual sovereignty concept, although there is some new characteristics such as the multistakeholder participation throughout the soft law / A Sociedade da Informação, marcada pela Revolução Tecnológica cujo ápice é o surgimento da Internet, demanda a revisão das instituições jurídico-sociais tradicionais, como os conceitos de soberania e atores no cenário internacional, adequando-se aos novos desafios impostos pela realidade virtual. Constata-se que a Internet é um domínio público global, ou seja, um espaço sem fronteiras que a todos afeta. A governança da Internet demanda que os países estabeleçam um consenso no qual o espaço cibernético comporte as múltiplas soberanias sem pertencer a uma só, nos moldes da Convenção do Mar. Os mecanismos de governança da Internet abarcam os aspectos técnicos (padrões e protocolos da rede de computadores), sociais (vínculos sócio-afetivos, comunidades virtuais, inclusão digital), econômicos (comércio eletrônico, acesso à tecnologia), jurídicos, dentre outros. Participam da governança da Internet os diversos atores: governo, iniciativa privada, sociedade civil e organismos internacionais. O presente trabalho tem por objetivo discutir sobre o conceito de soberania e sua aplicabilidade na trajetória evolutiva dos mecanismos de governança da Internet. Como metodologia de pesquisa foi utilizada a revisão bibliográfica. A literatura científica disponível é reduzida, salientando a escassez de trabalhos acadêmicos justificada por se tratar de um fenômeno recente. Ainda como fonte dos dados foi incluídos os documentos produzidos em eventos internacionais, tais como a Cúpula Mundial da Sociedade da Informação e o Fórum Mundial da Governança da Internet; relatórios de organismos de gestão da Internet (a Força Tarefa da Engenharia da Internet e a ICANN); e entrevistas verbais com especialistas. Conclui-se que não houve a ruptura com o conceito atual de soberania, mas a inclusão de algumas características como a governança pluralista (ou multistakeholder), realizada através de normas flexíveis (ou Soft Law)

Towards a framework for cross-boundary collaborative open learning for cross-institutional academic development

This phenomenographic study, explores the collaborative open learning experience of academic staff and open learners in cross-institutional academic development settings, and adds to what is known in these settings. It provides new insights for academic developers and course designers about the benefits of crossing boundaries (i.e. open learning) in an academic development context and proposes an alternative model to traditional academic Continuing Professional Development (CPD). It engages academic staff in experiencing novel approaches to learning and teaching and developing as practitioners through engagement in academic CPD that stretches beyond institutional boundaries, characterised by diversity and based on collaboration and openness. Data collection was conducted using a collective case study approach to gain insights into the collective lived collaborative open learning experience in two authentic cross-institutional academic development settings with collaborative learning features designed in. At least one of the institutions involved in each course was based in the United Kingdom. Twenty two individual phenomenographic interviews were conducted and coded. The findings illustrate that collaborative open learning was experienced as two dynamic immersive and selective patterns. Boundary crossing as captured in the categories of description and their qualitatively different variations, shaped that experience and related to modes of participation; time, place and space; culture and language as well as diverse professional contexts. Facilitator support and the elasticity of the design also positively shaped this experience. The community aspect influenced study participants' experience at individual and course level and illuminated new opportunities for academic development practice based on cross-boundary community-led approaches. The findings synthesised in the phenomenographic outcome space, depicting the logical relationships of the eleven categories of description in this study, organised in structural factors, illustrate how these contributed and shaped the lived experience, together with a critical discussion of these with the literature, aided the creation of the openly licensed cross-boundary collaborative open learning framework for cross-institutional academic development, the final output of this study. A design tool developed from the results is included that aims to inform academic developers and other course designers who may be considering and planning to model and implement such approaches in their own practice.

Journeys to the edge : exploring the dimensions of tacit knowledge sharing in communities of practice

Tacit knowledge sharing has featured strongly in knowledge management literature in the last two decades. Knowledge management is an essential component attributed to underpinning organisational success and tacit knowledge sharing contributes directly to enhancing knowledge creation and to obtaining a competitive advantage in the business environment. Over the same period Communities of Practice (CoP) have risen in prominence as vehicles for tacit knowledge sharing and are seen as hotbeds of informal learning processes. There is, however, limited research into what may influence tacit knowledge sharing in CoPs. Additionally, although recognised as knowledge intensive organisations there has been limited research into knowledge sharing within and across educational institutions. The higher education (HE) sector in general has undergone significant change from a complex evolving landscape of political upheaval, funding divergence and an increasingly competitive worldwide market. Knowledge creation, combining and leveraging to improve an institution's performance, should therefore be considered of critical importance. Information Technology (IT) and Digital leadership have a key role in transforming Universities to meet the challenges in a global knowledge economy. The IT community within HE has a Sector Professional Organisation (SPO) that supports a number of voluntary CoPs which have operated over the last twenty years. The aim of the research was to explore the dimensions of tacit knowledge sharing in Communities of Practice working within the Higher Education Information Technology Sector. The study was undertaken from an interpretivist stance and used a phenomenological design with semi-structured interviews with participants who had experience of membership spanning several CoPs as the key data collection technique. The analysis was thematic in nature and brought to light expected and unexpected themes from the experiences of the participants. The key contribution is centered on the study findings that link the nature and movement of tacit knowledge from the core to the periphery of the CoP with its membership and leadership behaviors that are impacting on its success. From this a conceptual model that informs future HE IT CoP design and key leadership characteristics necessary for success, whilst supporting transferability, due to the findings' close association with tacit knowledge sharing was developed and is presented.

The making of postdigital experiential space : Punchdrunk Company, 2011-2014

This thesis presents my original contribution to knowledge, a combination of critical media and performance theories to analyse the production and augmentation of postdigital experiential spaces in Punchdrunk Theatre Company. Distributed agency is key to Punchdrunk's work, with makers within the company and audiences both being active participants in meaning-making, across complex and detailed interfaces. In order to investigate the making cultures on ‘both sides' of the interface, I undertook a two-year participant study as a researching designer within the company during the build of the productions The House Where Winter Lives and The Drowned Man in 2011-2014, gathering field data in the form of extensive interviews with members of the company and audience participants, supported by diary notations and photographs. I studied the processes and methods that extend, distribute and regulate agency to both audiences and makers within the company, and identified devices and features of the interaction design of the company that produce the immanent subject-event relationships that support immersion in their work. A core aspect of this research concerns the relationship between immersion and the sublime, and how subject-event relationships (immanent vs. transcendent) contribute to engendering sublime interactive experiences. I have analysed the consequences of this for the modelling of participation in interaction design, and how it influences conditions of possibility within interactive systems across physical, digital and blended media. The conclusion of this research includes the definition of a postdigital sublime, and proposes a delinquent system aesthetic that integrates proxies for gravity through articulation of the ‘shadow side' of interaction design.

Com novas formas de processamento informacional, novas estruturas e tecnologias, a chamada sociedade da informação vai criando novas possibilidades para os setores econômico, político, cultural e social. No entanto, se percebe novas fronteiras sendo erguidas ao privar a população, em seu todo, de ter acesso e condições de uso das tecnologias da informação e comunicação (TIC) e de toda a estrutura oferecida pelas redes digitais. Esta tese busca discutir como a exclusão digital pode ser contornada com a participação do Estado e da Sociedade Civil, a partir de um estudo sobre a informação, desde sua origem, até como o usuário passa a apropriar-se dela.
