As faces de Jano: o simbolismo no direito / Janus faces: the symbolism in the law.

Esta pesquisa busca lançar bases para a caracterização do uso da linguagem simbólica dentro do Direito penal. Nesse sentido, estabelece-se uma divisão entre duas categorias: Simbolismo no Direito penal e Direito penal simbólico, sendo que a primeira diz respeito a todas as formas (intrínsecas, legítimas ou ilegítimas) de utilização de símbolos no Direito penal. Já a segunda categoria corresponde a uma parcela deturpada do uso de símbolos dentro do Direito penal, prejudicial a sua função e ilegítima perante seus princípios, o que acaba por gerar dois efeitos intoleráveis à dinâmica do Direito penal: sua inefetividade e sua seletividade. De início é elaborado um panorama do símbolo e suas implicações teóricas em diversas áreas do saber. Em um segundo momento, a temática do simbolismo é relacionada com o Direito penal, visando à construção de um conceito crítico de Direito penal simbólico apto a ser aplicado na realidade. Posteriormente, é esboçada uma análise da conjectura do Direito penal na contemporaneidade e como tal contexto deu gênese e fomenta o fenômeno do Direito penal simbólico. Por fim, uma série de propostas são estabelecidas com o objetivo de sanear o simbolismo no Direito penal de utilizações deturpadas do símbolo. / This research intends to investigate the use of simbolical language in the Criminal Law. In this sense, a division between two categories is made: the Symbolism in the Criminal Law and the Symbolic Criminal Law. The first is related to any kinds of uses of symbols inside the Criminal Law (even in the cases of negative utilizations). In other way, the second category corresponds specifically to a distorted portion of the use of symbols within the Criminal Law, damaging its correct function and going against its principles. This distortion generates two intolerable effects to the dynamic of Criminal Law: its ineffectiveness and its selectivity. In the beggining, this work will establish a theoretical analysis of the symbol in many differents areas of knowledge. After that, the symbolism will be related to the Criminal Law, in order to build a concept of Symbolic Criminal Law fit to be empirically applied. Subsequently, an analysis of the Criminal Law within the contemporary contexto will be sketched. Finally, some suggestion will be offered aiming the goal of cleansing the Symbolism in the Criminal Law of the misleading uses of symbols

Factors Influencing Members¡¦ Commitment and Participation in the Union Abstract Due to the special situation of Taiwan economical and political development in the past, unions were unable to provide their member the function they ought to do. However Government declared martial law ended in 1989, it offered Taiwan unions a new opportunity to perform their function. Recently Human Resource Management School suggests that company never need union if they have offered work conditions satisfied by their employees. So far, neither union operation nor human resource management can coordinate Labors-Employer relation completely. Thus, it is hard to decide which way is suitable for Taiwan¡¦s situation. Therefore, the extent of Taiwan labor¡¦s commitment and participation in the union is crucial in deciding the way of coordinating Labor-employer Relation. First, this study selected some of demographics in order to realize if there are differences among members with different demographics. Second, the study also selected some factors, including Recognizing and Evaluating of Union, Job Satisfaction, Organizational Commitment and Union Instrumentality to realize if there are any effects among the factors of Union Commitment and Participation. The critical findings of this research are as follows: 1. There are significant differences among gender, age, married status, company run by state or local people, work tenure, union tenure and some factors of union commitment and participation dimension. But there are no significant between education and union commitment and participation dimension. 2. Some factors of recognizing and evaluating of union, job satisfaction, organizational commitment have relation in some factors of union commitment and participation dimension. Some factors of recognizing and evaluating of union, job satisfaction, organizational commitment have significant effects in some factors of union commitment and participation dimension. 3. Union instrumentality has significant positive relation and effects in union commitment and participation. Quando bem articulados, estes elementos expressam a concepção do Assistente Social, inserido coerentemente em sua profissão e contextualizado no mundo em que vive. Para este entendimento apresentamos um breve histórico da profissão, desde a sua gênese (décadas de 1920 e 1930) até chegar aos anos 1990. Esta retrospectiva se fez necessária para que se possa compreender, ainda que de modo rápido, a relação entre o positivismo, a fenomenologia, a dialética e o Serviço Social brasileiro no âmbito do agir profissional no Brasil nos dias de hoje. O Serviço Social desenvolve ações instrumentais como exigências da sua forma de inserção na divisão social e técnica do trabalho e alocação nos espaços sócio-institucionais da ordem capitalista dos monopólios. Estas ações são amparadas por uma modalidade de razão e paralelamente requisitadas por ela. Dado o caráter que ocupa na constituição da profissão. The role of future time perspective: An examination of a structural model

abstract: The present study of two hundred and seven university students examined the structural relation of future-orientation (both valence and instrumentality), career decision-making self-efficacy and career indecision (choice/commitment anxiety and lack of readiness). Structural equation modeling results indicated that while the overall proposed model fit the data well, my hypotheses were partially supported. Valence was not significantly related to career decision-making self-efficacy, choice/commitment anxiety and lack of readiness. However, instrumentality completely mediated the relation between valence and career decision-making self-efficacy, choice/commitment anxiety and lack of readiness. Instrumentality was significantly related to career decision-making self-efficacy and lack of readiness. Career decision-making self-efficacy completely mediated the relation between instrumentality and choice/commitment anxiety; however, it only partially mediated the relation between instrumentality and lack of readiness. Although the proposed model was invariant across gender, the findings indicate that women reported higher instrumentality and lower lack of readiness than did men. No differences were found for career decision-making self-efficacy and choice/commitment anxiety across gender. Indirect perpetration Abstract The topic of this diploma thesis is the analysis of an institute of indirect perpetration, which is one of many possible ways of committing a crime. Its essence lies in using other person who cannot be liable for his/her actions, also called an innocent agent or instrumentality. Such a person is controlled by an indirect perpetrator in the backround who must have double intentions towards committing a crime and also an abuse of a person who for some reason will not be held criminally liable. The reasons for staying out of criminal liability are enumeratively listed in the Criminal Code and include the lack of age, insanity, mistake, emergency, necessity and other defenses, as well as the fact that the person acted with no culpability or at all. It also deals with a matter when the innocent agent acts with no mental state (or motive) sufficient for commision of the offense which is required for particular criminal act and in those cases his liability can be measured at least as negligence and does not exclude his liability for another offense. This institute sought its way into the Criminal Code for quite a long time, until the enaction in 2009. The new Criminal Code was considered a groundbreaking legal regulation. Artificial Resources : An Artistic Exploration of Material Subjectivity

This essay investigates questions concerning the illusion of control and how a change of attitude can counteract an irreversible deterioration of our living environment. The key question is how an artistic practice can help to challenge contemporary attitudes and the assumption that the living planet is an inexhaustible and limitless resource.  The aim is to explore three fields of experience where a shared and mutually independent relationship is possible: with ourselves, with our fellow human beings and with the living planet. It examines contemporary research that identify and describes the destructive development of a culture with an over-naturalized relationship to these thee fields of experience. It discusses how an artistic practice can operate on a methodological level to contribute to the development of this research from three perspectives: (a) by how it can relates to the materials used to communicate, (b) by how it is embodied or corporeal, and (c) by how it can apply what is called techniques of subjectivity. The essay also describes Tuva Widén’s specific piece exhibited at the spring exhibition at Konstfack 2020 and explains how the outlined methodological principles are applied in this specific work.

ABSTRACT: In this dissertation we deal with an issue of pupils and students attribution in relation to life goals and perceived learning instrumentality for achieving these goals. We use life goals as an area for the two variables examination research. Besides the above mentioned variables we deal with another factors that we consider important in goals realization - future time perspective and students volitional characteristics, too. We were interested in school success and failure attribution, verification the role of internal and controllable attribution in terms of future time perspective or difference between the concept learning instrumentality and future time perspective. We used modified version of Inventory of motivational goals importance and learning instrumentality (De Volder, Lens, 1982) that we supplemented by questions about the attributional tendencies. THE PATHOS OF TEMPORALITY IN MID-20TH CENTURY ASIAN AMERICAN FICTION

Lack of understanding regarding the role that temporality-pathos plays in Asian American literature leads scholars to misread many textual passages as deviations from the implied authors’ political critiques. This dissertation invites scholars to recognize temporality-focused passages in Younghill Kang’s East Goes West, Carlos Bulosan’s America is in the Heart, and John Okada’s No-No Boy, as part of a pathos formula developed by avant-garde Asian American writers to resist systemic alienations experienced by Asian Americans by diagnosing and treating America’s empathy gap. I find that each of pathae examined – the pathos of finitude, the pathos of idealism, and the pathos of confusion – appears in each of the major primary texts discussed, and that these pathae not only invite similitude-based empathy from a wide readership, but also prompt, via multiple methods, the expansion of empathy. First, the authors use these pathae diagnostically: the pathos of finitude makes visible American imperialism’s destruction of prior ways of life; the pathos of idealism exposes the falsity of the futures promised by liberalism; and the pathos of confusion counters the destructive nationalisms that fractured the era. Second, the authors use these temporality pathae to identify the instrumentalist reasoning underlying these capitalist ideologies and to show how they stunt American empathy. Third, the authors deploy formal and thematic complexities that cultivate empathy-generating faculties of mind and cultivate alternative forms of reasoning. / English

School Motivation Questionnaire for the Portuguese Population: Structure and Psychometric Studies.

It is presented the structure and psychometric studies of the “School Motivation Questionnaire”. The SMQ is a self-report questionnaire with 101 items, organized in sixteen scales that measure the students´ goal orientations, the perceived classroom goal structures, the perceived teacher’s autonomy support and the use of learning strategies. Twelve scales are adapted from the “Learning Climate Questionnaire”, “Perceptions of Instrumentality” and “Cuestionário a Estudiantes”. Four scales and five additional items are created new. The psychometric studies rely on a convenience sample consisting of 9th and 12th grade students ( = 485) of Portuguese schools. The factorial and construct validity, verified through several exploratory factorial analyses to the data, presents a final solution of six factors, labelled Strategies (F1), Teacher Extrinsic Goals (F2), Student Extrinsic Goals, Externally Regulated (F3) Teacher Intrinsic Goals (F4), Student Extrinsic Goals, Internally Regulated (F5), and Student Intrinsic Goals (F6). The six-factor solution explains a significant variance of the scale results (53.95%). Good coefficients of internal consistency are obtained for all factors, never below (.858; F6). In sum there is strong evidence to support the multi-dimensionality of SMQ, upholding that the data obtained is exploratory and applies for future validation studies. / Se presenta la estructura y los estudios psicométricos del “Cuestionario de Motivación Escolar“. El CME es un cuestionario de auto informe con 101 ítems, organizados en dieciséis escalas que miden las orientaciones de las metas de los estudiantes, la percepción de las estructuras de las metas de clase, las percepciones del apoyo del profesor a la autonomía y el uso de estrategias de aprendizaje. Doce escalas son una adaptación del “Learning Climate Questionnaire”, “Perceptions of Instrumentality” y “Cuestionario a Estudiantes”. Cuatro escalas y cinco frases adicionales se crearon para este estudio. Los estudios psicométricos se basan en una muestra de conveniencia compuesta por estudiantes de los grados 9 y 12 (N = 485) de las escuelas portuguesas. Se encontraron buenos coeficientes de consistencia interna para todos los factores, nunca por debajo de (.858; F6). En suma, hay una fuerte evidencia para apoyar la multidimensionalidad del CME. Estos resultados son exploratorios y servirán como una base para estudios de validación posteriores.
