O presente estudo analisa a legitimatio ad causam para as ações coletivas, em especial as que envolvem as relações de trabalho, sempre com ênfase na participação do sindicato como principal legitimado. A partir de premissas destacadas ao longo do texto, o estudo propõe uma legitimação privilegiada em favor do sindicato, permitindo a valorização da instituição, ampliando-se o conceito de democracia participativa para dentro do processo. O estudo da legitimação privilegiada foi ratificado pela análise do Direito projetado, assim como pelo sistema da class action, fonte inquestionável dos estudos sobre as demandas coletivas. Questões como o regime da coisa julgada ou o sistema de litisconsórcio nessas modalidades de ações, também fizeram parte do estudo, tendo o litisconsórcio necessário destaque especial. Desse modo, admitindo-se nas ações coletivas uma das formas mais modernas e eficazes de defesa dos interesses de massa, o estudo busca atribuir maior responsabilidade e prestigio aos sindicatos, na perspectiva de reconhecer em sua figura o representante adequado da class, contribuindo assim, com a tendência mundial de desenvolvimento sindical, lastreada na liberdade e representação abrangente. / The present study analyses the legitimatio ad causam for the collective actions , specially, those involving employment relationships, always with emphasis on the participation of the unions as the main legitimated. Based on the main assumptions in the text, this study proposes a privileged legitimation in unions favor, permitting the valorization of the institution, extending the concept of participative democracy in the proceeding. The privileged legitimizations study was ratified by the analysis of the bills, as well as the class actions system, unquestionable source of the essays on collective demands. Questions as the matter adjudged or the system of the joint action in those categories of actions also were part of the study, being the joint action a necessary special outstanding. Thus, admitting the collective actions as one of the most modern and efficient way of defense of the interest of the mass, the study expects to attribute more responsibility and prestige to the unions, in the perspective of recognizing in its figure the adequate representative of the class, contributing, with the worldwide tendency of union development, propagated in the freedom and comprehensive representation.

The study examined the policy responses of organised labour towards the informal sector. It is based on a qualitative survey of trade unions in the textile, clothing and footwear sectors. The dualistic, Marxist structuralist, feminist and growth theories of the informal sector were used to evaluate policy responses towards the informal sector. The investigation of the dynamic relationship of trade unions with workers in the informal sector was informed by the transformation of the nature of work that is characterised by informalisation and the increased employment of contingent workers, the majority of whom are women. Informalisation was found to manifest itself through the use of homeworkers and ‘independent’ contractors. The study further showed that the formal and informal sectors were interdependent. This makes a compelling case for trade unions to organise vulnerable workers and to pursue the mainstreaming of the informal sector. However a rigid gender discourse was found to militate against the development of solidarity with the informal sector. The findings of the study suggest that gender mainstreaming within trade unions is a prerequisite for effectively mainstreaming the informal sector and that organising the informal sector is a gender issue. / Prof. G. Previous issue date: 2016-03-10 / The Brazilian labor union system has as its two main characteristics the single-laborunion
rule and the compulsory representation, both of which contribute to a not very
effective environment for collective bargaining. This essay proposes a reflection
about that reality and, for this purpose, presents a detailed examination of the
Brazilian labor union system, including the study of the history of the workers
associations in unions and the legislative development in Brazil on this subject until
the current structure was established. From this analysis, a few particularities of the
union structure and of the environment in which the collective bargaining is
developed will be presented, what will allow understanding the issues and interests
involved and the reason of the resilience to reform the current labor union system.
Finally, this essay debates the necessity of adopting the unrestricted union freedom
in Brazil, as a method to solve the crisis of union representativeness and to recognize
the fundamental right of liberty / O sistema sindical brasileiro tem como duas principais características o princípio da
unicidade sindical e a compulsoriedade de representação, que contribuem para um
ambiente de negociação coletiva pouco efetiva. Este trabalho propõe uma reflexão
sobre essa realidade e, para tanto, aborda um exame detalhado do sistema sindical
brasileiro, com o estudo histórico da associação de trabalhadores em sindicatos e da
evolução legislativa no Brasil sobre o tema, até que se estabelecesse a estrutura
atualmente vigente. A partir dessa análise, apresentam-se algumas particularidades
da estrutura sindical e do ambiente em que se desenvolvem as negociações
coletivas de trabalho, que permitem entender as questões e interesses envolvidos e
o porquê da resistência à reforma do modelo sindical atualmente vigente. Por fim,
este trabalho debate a necessidade de adoção da ampla liberdade sindical no Brasil,
como meio de solucionar a crise de representatividade sindical e como
reconhecimento de direito fundamental de liberdade
