La liberté d'association au Canada et la liberté syndicale à l'OIT : synonymes?

On June 8, 2007, the Supreme Court of Canada [SCC] overruled its jurisprudence of the past twenty years on freedom of association. The majority of the judges agreed that section 2d) of the Canadian Charter of Rights and Freedoms protects the right to the process to collective bargaining. In doing so, the SCC rejected the ratio of the majority enunciated in the 1987 trilogy and, at last, gave place to international labour law, in particular to freedom of association principles elaborated by the International Labour Organization's supervisory bodies. The analysis of these principles, focused on three related rights, i.e. the right to collective bargaining, the right to strike and the right not to associate, allows the author to conclude that for the first time, Canada is showing greater respect for its international obligations. What the SCC will decide for the right to strike remains to be seen.

What is Chinese behaviour like in the International Labour Organization (ILO) - is China a Status Quo or a Revisionist Actor? Despite the prominence of the issue of China's rise in international relations studies, little research has been published on China's behaviour in international organizations in other realms than the economic. This thesis, therefore, seeks the answer to the posed question. Chinese statements are examined concerning forced and child labour, as well as other distinct themes, their structure and a potential underlying strategy. The findings are retrieved from an analysis of Chinese statements in sittings of ILO organs and checked against information provided in ILO reports to detect discrepancies. A major finding is that the overall behaviour of China in the ILO can categorized as reform-minded status quo, even though there are some factors which could be interpreted as revisionist tendencies. Due to this categorization, a continued peaceful rise of China is considered to be possible.

Have the interventions of the International Labour Organization to the labour markets been effective? - Cases of Argentina and Finland

Global economical crisis has set high expectations to national politics. Working issues are highly connected to many political principles and actions. This is why concentrating on the form and efficiency of interventions of the International Labour Organization (ILO) can be seen as a very current topic. In this study there are two case countries, Ar-gentina and Finland. In democratic point of view they have fairly similar paths in the field of labour and the activity concerning these issues has been quite noticeable in the past, even though they are in different stage of development.Work is seen as a human right and fair conditions of work are presented through impor-tant international covenants. The ideology of social justice, as presented by John Rawls, is introduced here as the concept is central to the work of the ILO. In order to under-stand the meaning of social justice to the functionality of the ILO and to get a clearer picture of organizational relations in the labour markets, the organizational theoretical approaches by Starbuck and Scherer are brought up. This is also done in order to under-stand whether an international organizational actor, within field that is still seen to be highly under the control of sovereign countries themselves, can work efficiently.There were no directly related former studies found concerning not only the work of national labour organizations but also of the ILO. The indicators are based on most gen-eral and central subjects covered by the International Labour Standards, provided by the ILO. Indicators used to measure the efforts of the countries to appreciate the contents of international covenants are: ratification of international conventions, national legislation and labour organizational structure. The ones used to measure the efficiency of the ILO interventions are: activity of the ILO in the national level, functionality of the complaint system and the number of complaints. By analysing the information found through the indicators is meant to find out if the ILO has had effective interventions to the labour markets of the case countries in 1990s and the early 21st century. The hypothesis is that concerning the developing countries the ILO has more flexibility and power to its inter-ventions, and in question of highly developed and generally democratic countries more challenges are met concerning how to keep the response system active and abreast.

This thesis also focuses on the problems associated with the agency employment. The labour law is variable depending on social and economical changes not only in our country but also worldwide. It is related to the employment which should reflect the actual situation mostly on the labor market. In this situation there are a lot of people who can not find work and who must search for some alternative options. One of opportunities which are offered is the agency employment. This is the point of accent on quality legislation to minimize the risk of abuse and discrimination of the agency employees. The author analyzes the present legislation and outlines possible solutions of problems. This thesis is divided into eight main chapters. <p>Uppsatsens övergripande syfte är att studera fenomenen ledarskap och delaktighet i en kommunal verksamhet, mer specifik avses att undersöka ledarskapets betydelse för medarbetarnas delaktighet. Avsikten med föreliggande studie är således att studera vad i ledarskapet som ledarna och medarbetarna uppfattar påverkar delaktigheten, och hur dessa faktorer påverkar delaktigheten, stödjande eller hindrande. Den teoretiska referensramen presenterar en forskningsöversikt över ledarskapsforskning, delaktighetsbegreppets komplexitet samt faktorer i ledarskapet som påverkar medarbetarnas delaktighet. </p><p>Empirin har inhämtats genom tio kvalitativa intervjuer på två enheter inom en kommun belägen i Östergötland. Resultaten visar fler olika faktorer i ledarskapet som påverkar medarbetarnas delaktighet. Faktorerna som framkommit i studien som verkar stödjande är; visa intresse, förtroende, tillgänglighet, tillåtande, belöning och engagemang. De faktorer som påverkar både stödjande och hindrande är; relation och kommunikation. Även hur de intervjuade definierar begreppet delaktighet påverkar delaktigheten. Vi kan härleda alla faktorer förutom tillgänglighet till befintlig forskning. Undersökningen visar således att fler faktorer i ledarskapet har betydelse för medarbetarnas delaktighet.</p>

<p>I arbetslivet blir det mer och mer viktigt att företag och organisationer rekryterar rätt person. Den nyrekryterade måste ha rätt kompetens och samtidigt vara den person som passar in i företagets kultur. I det här arbetet har vi behandlat rekryteringsprocessen med inriktning mot anställningsintervjun. Uppsatsens syfte är att belysa rekryterares syn på anställningsintervjun och dess betydelse i rekryteringsprocessen. För att kunna besvara vårt syfte har vi valt att göra kvalitativa intervjuer med fem rekryterare. I vår studie beskrivs rekryteringsprocessen och anställningsintervjun ur rekryterarnas perspektiv. I intervjumanualen finns frågor om hela rekryteringsprocessen för att kunna sätta in anställningsintervjun i sitt sammanhang och ge en bild av dess betydelse. Frågeställningar som studien bygger på är: hur genomförs rekryteringsprocessen, hur genomförs anställningsintervjun för att få fram relevant information om den sökande samt vilken typ av information söker rekryteraren i anställningsintervjun och varför är den viktig. I vårt resultat har vi kommit fram till att rekryterarna har i stort sett samma syn på rekryteringsprocessen och anställningsintervjuerna. Samtliga rekryterare genomför alltid någon form av anställningsintervju och intervjun är en viktig del av rekryteringsprocessen. I vår studie har vi sett att rekryteringsprocessen följer i stort sett samma mönster: arbetsanalys, annonsering, urval, intervju, eventuellt olika tester och referenstagande. Anställningsintervjuerna genomförs ofta som panelintervjuer och den sökande får svara på nutids/dåtidsinriktade frågor. Rekryterarna söker information om den sökandes personliga egenskaper, sociala situation och i viss mån kompetens. Rekryterarna vill förvissa sig om att den potentiella medarbetaren ska passa in i arbetsgruppen och organisationen.</p>

The Effect of ILO’s Declaration on Fundamental Principles and Rights at Work on the Evolution of Legal Policy in Brazil: An Analysis of Freedom of Association

This dissertation analyzes the effects of the ILO’s 1998 Declaration on Fundamental Principles and Rights at Work, taking as a case study ILO’s promotion of freedom of association in Brazil. It suggests that the 1998 Declaration’s promotional approach offers mechanisms that have the capacity to change a country's behaviour. In the case of Brazil, this change would involve reform of a corporativist trade union law that violates the principle of freedom of association. The peculiarities of compliance with the freedom-of-association principle represent a significant challenge to the ILO, especially when a country lacks the political will to comply with the principle. This dissertation shows that the 1998 Declaration provides mechanisms − information, qualification of the bureaucracy and support of independent actors − that can be used in these situations even outside the scope of a cooperation program to reform the law and modify public policy.
