Records in the Land Register This diploma thesis deals with the institute of records in the Land Register, which, due to Act No. 89/2012 Coll., the Civil Code, underwent numerous changes that needed to be reflected in legal regulation of the Land Register. At the time of writing this thesis, it has already been 6 years since the recodification of the Civil Code and changes associated therewith. Thus, it is possible to evaluate the legal regulation of records in the Land Register in its whole complexity. The thesis is divided in five parts that analyse different aspects of this legal institute. The first part of the diploma thesis outlines the historical evolution of the evidence of real estate itself for better understanding of current legal regulation. The second part of the thesis is focused on current legal regulation of the Land Register, its essential principles of holding the Register and extracts from the Land Register providing information about the state of real estate. The third part deals with the subject of evidence, as not all real property is being registered in the Land Register. Regardless the general description, the contentious part of the issue based on legal regulation is being involved in the description of each real estate as well. To determine the price of land for agriculture, pasture and native vegetation remaining, were performed based in topological analyzes of relief, soil type, cover and land use, road infrastructure and proximity to the major urban centers of the state of Goiás and Federal District, noting that the highest price of the land for agriculture and pasture are concentrated in the south and higher land prices for savanna are located north of the state. In another part of this thesis, a comparative analysis was made between two types of geostatistics interpolation called kriging and co-kriging. The process of kriging interpolation proved itself sufficient for determining the price of land. The weight determination on environmental variables, economic and social is possible, during the process of co-kriging interpolation, however, variations different from the influence of the weights on the variables applied during the interpolation process for determining the price of land for agriculture, pasture or savanna. The weights defined for the secondary variables showed a higher correlation with the price of land for pasture. Finally, another factor analyzed in this thesis was the possible relationship between rural properties geo-referenced and registered by INCRA with the price of land in the state of Goiás, with the availability of certified professionals, with the densification of the geodetic network and cover and land use in the state. The study showed that the land market situation in the state of Goiás, in compliance with Federal Law 10.267/2001, is one of the most advanced work in Brazil and geo-referencing were performed independently of the price of land, availability of professionals, coverage and use soil and availability of landmarks of geodetic network in the state, however, for areas with native vegetation remaining, the process of geo-referencing rural properties is minor and can be considered that there is an inverse relationship between the process of deforestation and geo-referencing rural properties in the state of Goiás. / A determinação do preço da terra foi baseada no uso de geoestatística, levando-se em consideração variáveis de localização, socioeconômica e de infraestrutura nas análises realizadas por geoprocessamento. Para a determinação do preço da terra para agricultura, pastagem e vegetação nativa remanescente, foram realizadas análises topológicas baseadas no relevo, tipos de solos, cobertura e uso do solo, infraestrutura viária e na proximidade com os maiores centros urbanos do estado de Goiás e Distrito Federal. Observou-se que os maiores preços da terra para agricultura e pastagem estão concentrados na região sul e os maiores preços da terra para cerrado estão localizados ao norte do estado. Em outra etapa deste trabalho, foi realizada uma análise comparativa entre dois tipos de interpoladores geoestatísticos denominados krigagem e co-krigagem. O processo de interpolação por krigagem se mostrou suficiente para a determinação do preço da terra. A determinação de pesos sobre variáveis ambientais, econômicas e sociais é possível, durante o processo de interpolação por co-krigagem, contudo, ocorreram variações distintas da influência dos pesos aplicados sobre as variáveis durante o processo de interpolação para a determinação do preço da terra para agricultura, pastagem ou cerrado. Os pesos definidos para as variáveis secundárias apresentaram uma maior relação com o preço da terra para pastagem. Finalmente, outro fator analisado nesta tese foi a possível relação entre os imóveis rurais georreferenciados e cadastrados junto ao INCRA com o preço da terra no estado de Goiás, com a disponibilidade de profissionais certificados, com o adensamento da rede geodésica e com a cobertura e uso do solo no estado. O estudo mostrou que a situação fundiária no estado de Goiás, em atendimento à Lei Federal 10.267/2001, é uma das mais avançadas no Brasil e os trabalhos de georreferenciamento foram realizados independentemente do preço da terra, da disponibilidade de profissionais, da cobertura e uso do solo e da disponibilidade de marcos da rede geodésica no estado; contudo, para as áreas com vegetação nativa remanescente, o processo de georreferenciamento de imóveis rurais é menor, podendo-se considerar que há uma relação inversa entre o processo de desmatamento e o georreferenciamento de imóveis rurais no estado de Goiás.

The target of my diploma thesis is the proposal of project documentation of Land Register Office for a middle-big town. The administration building of the Land Register Office is designed for 20 people. The theoretical location of the construction is placed in the land register of a town called Litvinovice, in the location specified for building civic amenities. Literary overview limits the fundamental notions regarding the design of building construction, furthermore in this chapter are written out the paragraphs of the valid building act a its execute public notices associated with the projection of building civic amenities. The results of this diploma thesis contain the description of the location, where the building will be located, the project documentation for building permission that is made out according to a public notice No. 499/2006 about building documentation. The particular technical drawings are elaborated in the application AutoCAD 2006. The visualizations present the colour scheme of the front facade or architectural solutions of exterior are processed in the application ArchiCAD 8.1.

Les compoix sont, dans le Languedoc médiéval et moderne, les ancêtres des matrices cadastrales. Antérieurs à la Révolution, ils servent d’outils fiscaux à l’usage potentiel de chacune des 2700 communautés d’habitants de la province. Source documentaire abondamment employée par les historiens, depuis les travaux économiques et sociaux d’Albert Soboul et Emmanuel Le Roy Ladurie en particulier, elle n’a jamais fait l’objet, pourtant, de sa propre histoire. Celle-ci agit cependant comme un prisme qui révèle beaucoup d’aspects de l’évolution de la vie politique, institutionnelle et sociale du Languedoc ancien, considérée sur presque cinq siècles. Créés pour répartir l’impôt foncier, les compoix constituent ainsi un observatoire de la manière dont une société provinciale compose avec les progrès de l’État. Élaborés pour identifier les détenteurs du sol, ils cristallisent des enjeux relatifs à la sociabilité des communautés d’habitants rurales et urbaines. Réalisés par le recensement des parcelles et de la nature de leur mise en valeur, ils disent l’espace tel qu’on se le représente à un moment donné et tous ensemble, parlent de la conception évolutive du territoire. Prior to the French Revolution, they were potentially used as fiscal tools by each one of the Province 2700 former municipalities. This documentary source has been widely used by historians, at first by Albert Soboul and Emmanuel Le Roy Ladurie for economic and social investigations. But the own history of the compoix has never been written before. However it acts as a prism able to show a lot of facets in ancient Languedoc political, institutional and social life evolutions – and this nearly over five centuries. As they were created to distribute the land tax between taxpayers, the compoix constitute an observation point of the way a provincial society puts up with the State development. They were elaborated to identify the landowners and they crystallize many stakes in the sociability of urban and rural communities. As they were carried out by listing land plots and the nature of their land use, they talk about space such as we all visualize it, and deal about the evolving conception of territories. The compoix are the transceivers of the slow, deep and sometimes jerky changes in the ancient societies, which ordered to make these registers. The Languedoc only constitutes a convenient vantage point to gaze at the French Kingdom internal building, by developing the State, its administration, its institutions and finally its relationships with local populations and territories under its authority.

Zásady vedení katastru nemovitostí / Principles of the Land Register Keeping

This master’s thesis deals with the basic principles of the Land Register. It compares establishment of principles in the previous legal regulation in effect until the end of year 2013 with the new legislation effective from the 1st of January 2014, when the new Civil Code No. 89/2012 Coll. and the new Cadastral Law No. 256/2013 Coll. entered into force. The new Civil Code brings large changes in the recodification of private law. Some important changes are related to the topic of this thesis, it changes the definition of immovable property, expands the range of rights registered in the cadastre and significantly affects the principles of the Land Register. The thesis explains the principles and searches for the most significant changes brought by the new legislation. Furthermore the thesis also discusses the status of the property owner. So it focuses mainly on the principle of material publicity related to the protection of good faith. The conclusion summarizes the most important changes in legislation that significantly affected the principles of the Land Register and assurance of the correct acquisition of property rights.

Hence, the present work aims to identify how a register port coupled to a geographic information system can contribute to the planning. The study discusses results with applicability of port subsector in Brazil throughout its territory, however, is based on analysis from the Organized Port of Itajaí and other port facilities in your area and surroundings, so that the spatial area consists in the Port of Itajai and its influence area, in the state of Santa Catarina. The research methodology involves literature, including legal documents on the topic, data collection, data association of a geographic information system and thematic mapping. / O subsetor portuário tem papel fundamental dentro do desenvolvimento de uma economia, não sendo diferente no Brasil, e para melhor explorá-lo torna-se estratégico reconhecer espacialmente com o detalhamento necessário a infraestrutura existente. Observa-se ainda que as atividades portuárias interferem no ambiente em que estão inseridas, alterando a dinâmica local e regional. Diante disto, o presente trabalho tem por objetivo identificar como um cadastro portuário atrelado a um sistema de informações geográficas pode contribuir para o planejamento. O estudo busca apresentar resultados com aplicabilidade para o subsetor portuário no Brasil em todo o seu território, entretanto, baseia-se na análise a partir do Porto Organizado de Itajaí e demais instalações portuárias localizadas em sua área e adjacências, de forma que o recorte espacial consiste Porto de Itajaí e sua área de influêcia, no estado de Santa Catarina. On the base of map foundations (the cadastral map and the map of land cover) were created single drawings. The results of positional and areal comparison of map foundations were analyse from these drawings.
