From the beginning of this first decade of Century XXI, service companies, and especially law firms well established in Brazil - many of them specializing in serving clients of foreign origin – have been associated with international partners or have opened branches in known international places. This trend not only serves to commercial or economic purposes, but involves issues related to organizational learning, with strategic and operational impacts on the decision-making process of these firms. This is the basic hypothesis of this master thesis, which relies on two methodological approaches, secondary and primary researches, to perform the test of this hypothesis and analysis of organizational consequences of internationalization. The dissertation is presented in three nuclear chapters, besides introduction and conclusion, where are examined the methodological procedures, the theoretical and conceptual basis and researches results, summarized in some impacts that affect the originally prevailing organizational culture, culminating with influences on the decision-making process of marketing, pricing and organization of these companies. / O movimento de empresas brasileiras em direção ao exterior é considerado um fenômeno recente. Desde o princípio dessa primeira década do século XXI, empresas de serviços e, especialmente, os escritórios de advocacia já consolidados no Brasil – muitos deles especializados no atendimento de clientes de origem estrangeira – se associaram com “partners” no exterior ou abriram filiais em conhecidas praças internacionais. Esse movimento de internacionalização não guarda apenas uma dimensão comercial ou essencialmente econômica, mas envolve aspectos relacionados ao aprendizado organizacional, com impactos operacionais e estratégicos sobre o processo de tomada de decisões desses escritórios de advocacia. A presente dissertação de mestrado tem como hipótese, fundada no conceito de “knowledge intensive firm”, dentre outras bases teóricas, que as organizações de advocacia brasileira passaram por um processo de aprendizado com a abertura para o exterior. Esse aprendizado tem influência sobre o padrão cultural anteriormente prevalecente na unidade brasileira, transformando-o. Para efetuar o teste desta hipótese e a análise das conseqüências organizacionais da internacionalização, são utilizados dois procedimentos metodológicos combinados, a pesquisa secundária e a pesquisa primária. A dissertação apresenta-se em três capítulos nucleares, além da introdução e da conclusão, detalhando a metodologia, os fundamentos teóricos e conceituais utilizados e apresentando os resultados das pesquisas, sumariados num conjunto de impactos que afetam as decisões mercadológicas, de formação de preços e de organização dessas empresas.

A abrangência dessa relação jurídica pelo Código de Defesa do Consumidor e a natureza negocial multiforme da relação estabelecida entre o advogado e o cliente, cuja normativa deve ser estabecida tendo em vista o caso concreto, são pontos de destaque desse trabalho, assim como a aplicabilidade do consentimento informado. Nessa toada, pretende-se conferir o enfoque funcional a partir da releitura das classificações tradicionais da responsabilidade civil em contratual, extracontratual, subjetiva, objetiva e entre as obrigações de meio e resultado para em seguida, analisarmos das hipóteses mais frequentes de responsabilização, quais sejam: a perda de uma chance, o abuso do direito processual e a reversão de liminares revertidas ao final do processo. Por fim, dentre as tendências de prevenção e precaução de danos da responsabilidade civil, revela-se a formalização de seguros de responsabilidade profissional para advogados. / Liability of attorney is a topic that deserves attention from the perspective of the constitutional civil measure. The scope of this legal relationship by the Consumer Protection Code and the nature of multifaceted relationship between lawyer and client, whose rules must be developed further in view of the case, are highlights of this work, as well as the applicability of informed consent. In this tune, it is intended to confer the functional approach from the rereading of traditional classifications of liability in contract, tort, subjective, objective, and between the obligations of means and results to then analyze the most common assumptions of accountability, which are: the loss of a chance, the abuse of procedural law and the reversal of court orders reversed at the end of the process. Finally, among the trends of precaution and prevention of damage to civil liability, it is the formalization of professional liability insurance for lawyers.

Knowledge-sharing practices by legal information professionals at Hogan Lovells : law firm in South Africa and England

Knowledge-sharing practices are all the actions aimed at improving the internal flow and use of knowledge within a virtual team. The collective knowledge of team members only becomes powerful if it is shared among those who possess common goals. The main purpose of this study was to explore the knowledge-sharing practices of Hogan Lovells’ virtual team of legal information professionals and establish how these practices could be enhanced in order to provide a superior information service to the firm’s lawyers. Hogan Lovells is a multinational law firm with offices in South Africa and England, and its virtual team of legal information professionals were experiencing challenges in sharing knowledge. The study adopted a qualitative methodology and a case-study research design. Interview guides were used to collect qualitative data from study Participants. Out of the 23 potential interviewees from the London and Johannesburg team who were purposively selected as the target population for the study, the researcher interviewed 14 on reaching the point of saturation. The Participants interviewed were in possession of suitable information related to the objectives of the study. Qualitative data collected were analysed using content analysis; findings were then made from the completed analysis. From the findings, it emerged that there were several gaps in the knowledge-sharing practices. Several enablers to the knowledge-sharing practices by legal information professionals were identified. The study recommended several ways by which the knowledge-sharing practices at Hogan Lovells’ virtual team of legal information professionals may be enhanced, amongst which are: formalising team meetings as a virtual community of practice, stimulating informal peer mentoring, valuing storytelling and regularly conducting After-Action Reviews. In addition to this, the virtual team should use other knowledge-sharing practices, such as brainstorming, subject-matter experts, and face-to-face virtual meetings. The study suggested that additional studies, particularly surveys and quantitative studies, be conducted on other virtual teams of legal information professionals in South Africa in order to explore their knowledge-sharing practices. / Information Science / M. Kampen om advokaten : Incitamentssystemets påverkan på frivillig personalomsättning inom kunskapsintensiva organisationer / Fighting for lawyers

Bakgrund: Kunskapsintensiva organisationer upplever svårigheter när det kommer till att behålla medarbetare och de tvingas således arbeta för att hantera den frivilliga personalomsättningen. Den svenska advokatbranschen genomgår förändring och medarbetare byter arbetsgivare i allt större utsträckning. Samtidigt pågår diskussioner kring huruvida monetära- och icke-monetära incitamentssystem påverkar medarbetarnas motivation, arbetstillfredsställelse och engagemang. Därav har intresset väckts för att studera huruvida incitamentssystem påverkar den frivilliga personalomsättningen inom advokatbyråer verksamma i Sverige. Syfte: Syftet med studien är att skapa en ökad förståelse för hur incitamentssystem påverkar den frivilliga personalomsättningen inom advokatbyråer verksamma i Sverige. Metod: Studien innehar en kvalitativ forskningsstrategi och ett konstruktionistisktperspektiv. Arbetet följer en abduktiv ansats och en tematisk analys används viddata analysen. Syftet och forskningsfrågorna besvaras genom att utnyttja en flerfallsstudie på två olika advokatbyråer verksamma i Sverige, där 14 semi-strukturerade intervjuundersökningar ligger till grund för inhämtandet av det empiriska materialet. Slutsats: Studien påvisar att kunskapsintensiva organisationer bör utforma incitamentssystem med både monetära och icke-monetära incitament där en förståelse för att incitamentssystem kan påverka andra medarbetare än vad som var avsett är viktig. Monetära incitament tycks påverka arbetstillfredsställelsen men har begränsad effekt på medarbetarnas motivation och engagemang. De icke-monetära incitamenten tenderar att påverka den frivilliga personalomsättningen i större utsträckning / Background: Knowledge-intensive organizations experience difficulties when it comes to retaining employees and they are obliged to handle the voluntary turnover. The Swedish law branch of industry experiences a period of change where employees change employers to a greater extent. At the same time, there are ongoing discussions about how monetary- and non-monetary incentives affect employee motivation, job satisfaction and commitment. Therefore, it is interesting to study how incentive systems affect voluntary turnover in Swedish law firms. Purpose: The study aims to increase the understanding of how incentive systems affect the voluntary turnover in Swedish law firms. Methodology: The study is designed according to a qualitative research strategy and has a constructionist perspective. The work follows an abductive approach, and a thematic analysis is used when analyzing the data. The purpose and research questions are answered by utilizing a multiple-case study of two Swedish law firms, where 14 semistructured interviews generate the empirical material. Conclusion: The study shows that knowledge-intensive organizations should design incentive systems with both monetary and non-monetary incentives where an understanding that incentive systems can affect other employees than what was intended is important. Monetary incentives seem to affect job satisfaction but have a limited effect on employee motivation and commitment. The non-monetary incentives tend to affect voluntary employee turnover to a greater extent.

<p>\textbf{Chapter 1}\\</p> <p>This paper explores the implications of the mismatch hypothesis in the context of the labor market using a survey on newly licensed US lawyers called the After the JD Study. Using a triple difference approach, I measure the impact of diversity quotas on marginal minority workers’ future salaries, promotion rates, and leaving rates for occupation and job. With middling statistical power, my findings are in line with the mismatch hypothesis in that beneficiaries of the diversity quota policy are made ex-ante worse off. My findings are also in line with recent literature on diminishing racial outcome gaps by skill.</p> <p><br></p> <p>\textbf{Chapter 2}\\</p> <p>In this paper, we provide theoretical framework for three models of Digital Media Firm behavior called \textit{Premium}, \textit{Free-to-Play}, and \textit{Play-to-Earn} as well as suggest an empirical measure of firm ponzi-likeness. First, we study a baseline model optimal price and quality of a digital product, the premium model. Second, we extend the baseline model where some customers, called minnows, receive the product for free and other customers, called whales, pay a price for a better version of the product, this is the free-to-play model. Finally, we explore a model where customers receive a security-like asset from the firm and this asset acts like a negative price while also subsidizing the firm's revenue. This final model provides an environment for much research. We show that, even when firms are ponzi-schemes in this final model, quality of the product need not be at a minimum. We also briefly discuss how one would measure the ponzi-likeness of a digital media firm in the third model setting. </p> <p><br></p> <p>\textbf{Chapter 3}\\</p> <p>In this paper, I explore unique measures of racial prejudice and their impact on black wages in the labor market using the General Social Survey, Current Population Survey and the NLSY79. I generate two variables to proxy for racial prejudice which are extracted from the GSS and the NLSY79. The first variable, drawn from the GSS, measures prejudice sentiment towards blacks and the second, drawn from the NLSY79, measures individual experience with racial discrimination. I use these measurements to proxy for racial prejudice and its impact on the black-white wage gap. I find that these variables are two distinctly different measures of racial discrimination in the labor market, providing a powerful instrument for measuring racial discrimination in the labor market. They also provide the insight that, while racial prejudice may be high in certain occupations and regions, this sentiment does not directly impact black outcomes. Specifically, wages are more sensitive to racial prejudice in WC jobs than in BC jobs. </p>
