La prolifération des acteurs non étatiques, favorisée par la mondialisation, est un phénomène marquant de notre histoire contemporaine. Rassemblés sous le vocable de «société civile», ils ont contribué à créer un foisonnement de normes sur le plan international allant, pour certains commentateurs, jusqu'à concurrencer l'État sur sa capacité de dire le droit. Parmi ces acteurs privés, les organisations non gouvernementales (ONG) et les entreprises multinationales jouent un rôle prépondérant. Notre imaginaire collectif oppose cependant trop souvent l'ONG, symbole du désintéressement, à la multinationale assoiffée de profit. Le présent mémoire vise à relativiser ce constat manichéen et simplificateur. En analysant, dans une perspective de droit international, les moyens d'action des ONG et des multinationales, on se rend compte que les passerelles entre les deux «mondes» sont en réalité nombreuses. ONG et multinationales se retrouvent d'ailleurs dans leur aspiration commune à être reconnues formellement sur la scène internationale. L'opportunité d'une reconnaissance juridique de la société civile sera discutée. / The multiplication of non state actors that emerged as a consequence of globalization is a striking phenomenon of contemporaneous history. These actors otherwise referred to under the concept of «civil society», have contributed to a proliferation of norms in the international arena. Some commentators even convey the idea that the State is being overtly rivalled in this respect. Among these private actors, non governmental organizations (NGOs) and multinational firms play a significant role. In this regard, a common assumption is that NGOs are the symbol of selflessness, while multinationals would be profit-thirsty monsters. This master's thesis aims at relativizing this over-simplification. Under an international law perspective, the analysis of NGOs and multinationals' means of action, leads to the realization that many links do exist, between these two supposedly closed «worlds». Moreover, NGOs and multinationals share a common quest for formaI recognition on an international scale. The potential for legal recognition will be discussed.

The concepts and theory of recognition from which the research rested upon derive from the writings of Axel Honneth in the book "The Struggle for Recognition: The Moral Grammar of Social Conflicts". Grounded on this approach, a theoretical framework is built to support a migratory policy that promotes social justice, which can be adopted at the municipal level, an area that is essential for the realization of the rights of the aforementioned group. Thus, a research is carried out around the Brazilian legislation and policies that dealt and deal with the migratory issue in the country, making it possible to estimate the degree of legal recognition of the Senegalese immigrant in its formal aspect. In addition to the abovementioned, we present the results of an empirical research that seeks to demonstrate the vision of the mentioned immigrants with respect to Brazilian laws and policies. The social esteem of this group is established from the categories that have been identified as socially relevant values that form, in Brazilian society, the axiological set that composes the social recognition of the Senegalese in Brazil, namely: the slavery of blacks in the country, racism, the locus of the African descendants in Rio Grande do Sul, territoriality, and xenophobia. Data collected from empirical research within Pelotas and Rio Grande help to identify the contours and intensity of this sphere of recognition. Finally, we investigate the need for the materialization of rights for effective legal recognition, as well as the possible strategies for raising the social recognition of a group. Considering the possibility that the increase of recognition in the legal sphere can influence the social esteem of the group affected by it, feasible paths are ultimately drawn for the construction of focused migratory policies of municipal scope capable of transforming the reality of the Senegalese immigrants, increasing their legal and social recognition. / Esta Tese apresenta como tema central a análise do reconhecimento jurídico e da estima social do imigrante senegalês no extremo sul do Rio Grande do Sul, especialmente nos municípios de Pelotas e de Rio Grande. Os conceitos e teoria do reconhecimento a partir dos quais se elaborou o roteiro da pesquisa são decorrentes dos escritos de Axel Honneth na obra “Luta por Reconhecimento: a gramática moral dos conflitos sociais”. A partir da referida abordagem, se constrói um arcabouço teórico capaz de fundamentar uma política migratória promotora de justiça social, possível de ser adotada em âmbito municipal, esfera que se compreende essencial para a concretização de direitos desse grupo. Assim, é realizada uma pesquisa em torno da legislação e políticas brasileiras que trataram e tratam a questão migratória no país, possibilitando a aferição do grau de reconhecimento jurídico do imigrante senegalês em seu aspecto formal. Além do aludido, traz-se os resultados de uma pesquisa empírica que busca demonstrar a visão dos mencionados imigrantes no tocante às leis e políticas brasileiras. A estima social desse grupo é averiguada a partir das categorias que foram identificadas como valores socialmente relevantes que formam, na sociedade brasileira, o conjunto axiológico que compõe o reconhecimento social dos senegaleses no Brasil, quais sejam: a escravidão dos negros no país, o racismo à brasileira, o papel do negro no Rio Grande do Sul, a territorialidade e a xenofobia. Os dados colhidos de pesquisa empírica com munícipes de Pelotas e Rio Grande auxiliam na identificação dos contornos e intensidade dessa esfera de reconhecimento. Por fim, investiga-se a necessidade de materialização de direitos para o efetivo reconhecimento jurídico, assim como as possíveis estratégias para a elevação do reconhecimento social de um grupo. Diante da possibilidade de que o aumento de reconhecimento na esfera jurídica possa influenciar a estima social do grupo afetado por aquele, traça-se ao final caminhos viáveis para a construção de políticas migratórias de âmbito municipal, focalizadas, capazes de transformar a realidade dos imigrantes senegaleses, aumentando o seu reconhecimento jurídico e social.

A luta pelo reconhecimento jurídico e a conquista da ampliação de direitos trabalhistas são de suma importância para diminuir as situações de desigualdade, vulnerabilidade e desvalorização do trabalho doméstico. Tem-se que as recentes alterações na legislação brasileira implementadas pelos referidos diplomas legais trouxeram efetivas mudanças para os trabalhadores domésticos. Cabe, então, um questionamento acerca das transformações no cotidiano destes atores envolvendo a ruptura com o arranjo social paternalista e clientelista que tradicionalmente tem caracterizado o exercício desta modalidade de trabalho. Dentre os procedimentos metodológicos que serão empregados para a obtenção dos dados para a análise proposta estão a realização de entrevistas focalizadas a partir de um roteiro semiestruturado de perguntas, e observação etnográfica, a fim de que se possa, então, compreender a percepção dos trabalhadores domésticos, empregadores e sindicalistas a respeito dessas alterações legais. / The present research aims at understanding how social relations between domestic workers and their respective employers take place after the advent of Constitutional Amendment No. 72, 2013 and Complementary Law No. 150/15, especially with regard to issues of power, Affection and professionalization of this working relationship. The struggle for legal recognition and the achievement of the expansion of labor rights are of paramount importance in order to reduce situations of inequality, vulnerability and devaluation of domestic work. It has been that the recent changes in Brazilian legislation implemented by the mentioned legal texts have brought about effective changes for domestic workers. It is then a question about the transformations in the daily life of these actors involving the rupture with the paternalistic and clientelistic social arrangement that traditionally has characterized the exercise of this modality of work. Among the methodological procedures that will be used to obtain the data for the proposed analysis are the interviews focused on a semi-structured questionnaire, and direct observation, so that one can then understand the perception of the Workers, employers and trade unionists regarding these legal changes.

La vie consacrée en droit canonique et en droit public français : critères de reconnaissance dans les associations de fidèles / Consecrated life in Canon law and French law : recognition criteria in associations of the faithful

Aujourd'hui, dans l'Église Catholique Romaine, des nouvelles formes de communautés « associatives » émergent et posent un certain nombre de questions au regard du droit canonique de l’Église. L'une d'entre elles concerne les personnes qui font le choix du célibat pour vivre un état de « vie consacrée » dans ces nouvelles formes de vie associative. Au-delà des structures et des critères organiques de vie consacrée qui asphyxient bien souvent toute réflexion sur la consécration, quels sont les critères qui, in utroque iure, permettraient la reconnaissance d’un tel état de vie ? En droit public français, ces nouvelles formes de vie consacrée au sein de l'Église Catholique interrogent aussi : certaines de ces nouvelles formes acquièrent un statut d’association publique internationale en droit canonique, et demandent, par exemple, leur reconnaissance légale comme « congrégation religieuse » (notamment, quant à la sécurité sociale, au droit du travail, et d’autres encore) avec le statut congréganiste. Ce sont ces critères essentiels pour ces mouvements que notre étude se propose de préciser, comme la profession des conseils évangéliques, les liens sacrés, la stabilité, une vie fraternelle, une soumission à une règle de vie approuvée : afin que l’état de vie consacrée soit plus manifeste dans ces mouvements qui attendent, pour une part, une certaine reconnaissance de la part de l’Église, sans compter les contentieux, relativement nombreux, relatifs notamment aux régimes de sécurité sociale et de retraites, devant les juridictions étatiques. / Today in the Roman Catholic Church new forms of “associative” communities are emerging and posing a certain number of questions in regard to Canon Law. One of the questions concerns those who choose to live a celibate state of "consecrated life" in these new forms of community life within the Church. Beyond the structures and organic criteria of consecrated life, which sometimes in itself can frustrate any serious reflection, what are the criteria in utroque iure, that would allow for the recognition of such a state of life in Canon law? New forms of consecrated life in the Catholic Church can also question French law. Some of these new forms acquire the status of an international public association in Canon law, and ask, for example, for legal recognition as a “religious congregation", in French law. Questions than arise on matters such as social security, labor law, and other issues within this legal congregational status. These are the essential canonical and French legal criteria for these movements that our study is to clarify. How can the profession of the evangelical counsels, the sacred bonds, stability, fraternal life, and submission to an approved rule of life, all canonical requirements be fulfilled, while also satisfying French legal requirements, such as social security, pension schemes and litigation activity, in the new forms of “associative communities?”

This short dissertation is an appraisal of same-sex marriages. The traditional arguments against same-sex unions are examined and rejected as being circular, unconvincing and baseless. Some of the international developments on the subject of same-sex unions are examined and it is noted that a slow but distinct change in attitude towards same-sex marriages is beginning to emerge from international judiciaries. The legal position of people with same-sex orientation in the South African legal system is examined with special reference to our Constitution. It is submitted that our Constitution is the foremost vehicle for legal change in this regard and that the equality clause of our Constitution is authority for the recognition by the law of same-sex marriages. This dissertation concludes that same-sex marriages ought to be fully accepted and recognised by the law for reasons, inter alia, of fairness and equality for people of same-sex orientation. / Constitutional, International & Indigenous Law / LL.
