O discurso de outrem em retextualiza??es

It presents events revealing different resources used, characterizing the discursive heterogeneity, recognized through various brands such as quotation marks, italics, etc. The material analyzed, ie, the corpus of this research, consists of 65 essays from the reading of a literary work - Jealous of Card, Moacyr Scliar - produced by students of the 8th year of high school while in the classroom. The data revealed that the resource most used by students was the indirect discourse, although there also occurred the use of other resources such as free indirect discourse and modalizations in fewer redactions. Notably, the autonym connotation was noted through the use of quotation marks, and the use of parentheses. The recurrence of the parentheses seem to be justified by the need to make clearer sentences that could raise questions to the reader, since the protocol request retextualization established a thirty lines of text, which would certainly limit the possibilities of expansion of the text / Este trabalho investiga recursos que locutores utilizam para introduzir diferentes vozes com que estruturam o discurso em retextualiza??es de uma obra liter?ria. Nele, s?o apresentadas ocorr?ncias que revelam diferentes recursos usados, configurando a heterogeneidade discursiva, reconhec?veis atrav?s de diversas marcas como as aspas, o it?lico, etc. O material de an?lise, ou seja, o corpus desta pesquisa, ? composto por 65 reda??es elaboradas em sala de aula, a partir da leitura de uma obra liter?ria Ciumento de carteirinha, de Moacyr Scliar produzidas por alunos do 8? ano do ensino m?dio, constituindo-se, assim, como uma atividade de retextualiza??o. Os dados revelaram que o recurso mais usado pelos alunos foi o discurso indireto, havendo, ainda, o uso de outros recursos como o discurso indireto livre e as modaliza??es, em n?mero menor de reda??es. ? necess?rio destacar que a conota??o auton?mica se revelou atrav?s do uso de aspas, al?m do uso de par?nteses. O presente trabalho faz uma análise, sob o aspecto do direito internacional e do direito brasileiro, do instituto do contributo mínimo em direito de autor, a qual pouquíssima atenção foi dada pela doutrina e jurisprudência brasileiras. Trata-se da análise do mínimo grau criativo que uma criação deve possuir para ensejar proteção por direito de autor esse é o sentido que damos à expressão contributo mínimo.Devido ao caráter internacional do direito de autor, fazemos a análise sob esse aspecto, passando por um pouco da história em âmbito global e tratando de que modo esse instituto é previsto e assegurado através do direito internacional público e do direito internacional privado. Como o tema é ainda novo no Brasil, fazemos observações de ordem terminológica, diferenciando o instituto do contributo mínimo de demais institutos do direito de autor. Durante todo o trabalho são feitas diversas menções e citações a doutrina, jurisprudência e normas estrangeiras, com objetivo de analisar da forma mais ampla possível o modo como tem sido tratado e discutido esse instituto.Por fim, são apresentados problemas clássicos e muitos práticos em matéria de direito de autor, tais como (i) definição de obra protegida, (ii) delineamento de requisitos para proteção aquisição de proteção por direito de autor, (iii) questões envolvendo plágio e obras derivadas e (iv) balanceamento justificador entre o exclusivo do direito de autor e os todas as formas de direito de acesso às criações. Em todas essas questões, são apresentadas as formas em que o contributo mínimo está presente e como é dada sua influência e contribuição para resolução das mesmas. / In the present work we make an international analysis of international law and Brazilian law about the minimum contribute, a requirement for copyright and authors rights protection that almost all the time has the same meaning as the originality requirement. Since the word originality not always mean the minimum degree of creativity that a creation must to bear in order to gain copyright or authors right protection, we preferred to use here, with this connotation, the expression minimum contribute. This subject still has not received much attention from Brazilian commentators and case law, in spite of its importance.The analysis focuses on the international dimension of this subject in attention to the copyrights / authors rights international character. We start with a little bit of history on the global dimension and then present the way the minimum contribute is found and guaranteed on public international law and on private international law. Thus, since the minimum contribute study is still new on Brazil, we make some terminology distinction between this expression and its meaning from other often apparent similar meaning terms and expressions on copyright. During all the work we present a lot of information and make quotation on foreign commentators, case laws and laws, in pursue of analyzing, in the broadest way possible, how the minimum contribute has been treated and discussed.Finally, we present typical and practical matters on copyright, like (i) definition of protected work, (ii) delineation of copyright requirements, (iii) plagiarism, (iv) derivative works and (v) copyright central balance. When we talk about each one of these matters, we also analyze how the minimum contribute appears and how it can influence and make contribution in finding solutions to them.

De Horgwarts a Paraisópolis: discurso e recepção da obra Harry Potter em um contexto de capitalismo periférico / From Hogwarts to Paraisópolis: discourse and reception of the Harry Potter literary work in a context of peripheral capitalism

O presente estudo teve o objetivo de compreender como a obra literária Harry Potter (edição brasileira), considerada em seu contexto de produção/disseminação e seu discurso, dialoga com leitores brasileiros, especificamente os jovens moradores da comunidade de Paraisópolis, na periferia da cidade de São Paulo. O estudo reconstituiu o percurso realizado pela obra até chegar aos leitores de Paraisópolis, com levantamento de dados primários e secundários do mercado editorial internacional e brasileiro. O embasamento para discussão teórica apoiou-se nos Estudos de Comunicação, além de estudos historiográficos e de Sociologia da Leitura, os quais trouxeram importantes subsídios para a compreensão dos múltiplos fatores envolvidos na prática da leitura na contemporaneidade, promovendo-se o diálogo interdisciplinar entre essas áreas. Para a constituição do corpus, realizamos a análise da discursividade dos sete volumes da série de livros voltada aos elementos de realidade e modelos ideológicos presentes na narrativa. Buscamos apoio nas teorias da área de Estudos de Linguagem, notadamente o ferramental bakhtiniano, por meio do qual foram identificadas relações de produção de sentido que se estabelecem entre o discurso da obra e os leitores adolescentes contemporâneos. O corpus discursivo constituído foi utilizado para o estudo de recepção de abordagem qualitativa realizado na comunidade de Paraisópolis com dez adolescentes, leitores espontâneos da obra. Adotou-se a técnica de formação de dois grupos de discussão segundo as variáveis gênero e faixa etária. Durante os encontros, foram aplicadas atividades de leitura, escrita, debates, dinâmicas (jogos e brincadeiras), exibição de cenas de filmes, além de questionário com perguntas abertas e fechadas sobre perfil socioeconômico e hábitos culturais. Também foi realizada entrevista em profundidade para coleta de dados e discursos que compuseram material para análise da recepção da obra. Apoiado por reflexões pertinentes às áreas de Estudos de Comunicação, Estudos de Linguagem, Estudos Culturais, notadamente os dedicados aos Estudos de Recepção, o conjunto de procedimentos possibilitou a identificação de indicadores de singularidade e diversidade cultural dos leitores de Paraisópolis perante formas hegemônicas de comunicação e cultura, com aspectos ambivalentes que contestam a oposição dicotômica inclusão/exclusão. A emergência e a análise, segundo a perspectiva bakhtiniana, de correlações discursivas inéditas entre a obra Harry Potter e o universo de vivências locais dos dez sujeitos da pesquisa deixaram evidente o seu posicionamento como enunciadores, situados em tempo e espaço concretos, conscientes de sua participação responsável no processo comunicativo que extrapola os limites da recepção cultural e define o seu lugar no mundo. / The present study aimed to understand how the Harry Potter literary work (Brazilian edition), taking its context of production/dissemination and discourse into account, speaks to Brazilian readers, especially young residents of the Paraisópolis community in São Paulo. It has reconstituted the path taken by the work to reach Paraisópolis community\'s readers, with primary and secondary data collection from both the international and the Brazilian publishing markets. The basis for the theoretical discussion was supported on Communication Studies, historiographical studies, and Reading Sociology, which enable understanding the multiple factors involved in the practice of reading in contemporaneity, nurturing the interdisciplinary dialogue among those areas. For the constitution of the corpus, we analyzed the Brazilian edition of Harry Potter books focusing on elements of reality and ideological models that integrate the narrative, with the support of Bakhtin\'s theories, in an attempt to identify the relations involving the construction of meaning that are established between the speech in the Harry Potter series and contemporary teenage readers. This discursive corpus was used in a survey of the reception of qualitative approach carried out in Paraisópolis community with ten adolescents, spontaneous readers of the referred literary work. Two discussion groups were delimited by demographics such as gender and age, with which we carried out reading and writing sessions, group discussions, group dynamics (plays and games), exhibition of movie clips, and the application of a questionnaire consisting of open- and closed-ended questions about their socioeconomic profile and cultural habits. An in-depth interview was also conducted, with a view to collecting data and speeches that made up material for the analysis of the reception of the referred literary work. Supported by reflections concerning the areas of Communication Studies, Studies of Language, Cultural Studies, especially those dedicated to the Reception Studies, the set of procedures allowed the identification of indicators of uniqueness and cultural diversity of Paraisópolis community\'s readers, in response to hegemonic forms of communication and culture, with ambivalent aspects that challenge the dichotomous opposition inclusion/exclusion. The emergence and the analysis, from Mikhail Bakhtin\'s perspective, of unknown discursive correlations between the Harry Potter literary work and the universe of local experiences of the participants showed their positioning as enunciators, situated at a particular time in a given space, and aware of their responsible participation in the communicative process that goes beyond the limits of cultural reception and defines their particular place in the world.

L’ambition de ce travail est de définir les conditions de possibilité d’une sociologie des œuvres littéraires. Cette démarche est illustrée par l’analyse des articles politiques, critiques littéraires et œuvres romanesques de l’écrivain Maurice Blanchot, de la période de l’entre-deux-guerres à la fin de la seconde guerre mondiale. La sociologie des œuvres littéraires doit être en mesure de produire une analyse de la forme et du contenu des œuvres. C’est en inscrivant notre travail dans la tradition compréhensive que nous tentons de dépasser les obstacles épistémologiques et méthodologiques d’une telle perspective. La compréhension des œuvres et du sens de la pratique littéraire de Blanchot passe par la reconstruction de ses expériences socialisatrices : son histoire de famille, son rapport au corps, à la maladie et à l’amour. Nous posons aussi que son passage à l’extrême droite et sa conception radicale de la pratique littéraire procèdent du même malaise existentiel. / The aim of this work is to define the conditions of possibility of a sociological approach applied to literary works. That approach is illustrated by the analysis of political and literary articles, and novels of the writer Maurice Blanchot, from the inter-war period to the end of the Second World War. We define sociology of literary works as an approach that must be able to produce knowledge about both content and style. We postulate that the theoretical framework of interpretive sociology is the most likely to answer the epistemological and methodological obstacles of such a perspective. We try to evidence that the understanding of the literary works and the literary practice of Blanchot can be achieved by the reconstruction of his socialization experiences: his family history, his relation to his body, to illness and to love. We also postulate that his political commitment at the far right and his radical view of literary practice are based on the same existential unease.

Annie Ernaux et l'écriture du journal / Annie Ernaux and the diary writing

Cette thèse a pour but d’étudier l’écriture du journal chez Annie Ernaux à partir de sept textes diaristiques : Journal du dehors, « Je ne suis pas sortie de ma nuit », La Vie extérieure, Se perdre, le « photojournal » d’Écrire la vie, L’Atelier noir et Regarde les lumières mon amour. Ces journaux se différencient par leur forme et par leur fond : journal intime, journal externe, journal d’écriture et photojournal. Ils entretiennent également des liens avec les textes littéraires de leur auteur. Nous nous sommes intéressé tout d’abord à leur poétique, en partant du cadre théorique de la forme journalière pour analyser leur transcription du temps, leur structure fragmentaire et la figure de la diariste. Puis nous avons étudié le rôle triple joué par la pratique diaristique chez l’auteur : le besoin de conserver une trace du vécu et du fait social, l’aide psychologique au quotidien et la découverte de soi. En dernier lieu, nous avons analysé les résonances des journaux dans les différents textes de notre corpus, les liens les unissant aux extraits intimes parus dans des revues littéraires, de même que les rapports entre journaux et récits, tant par leurs thématiques que par leur conception et le recours à la photographie. Notre étude montre ainsi toute l’importance jouée par le journal dans la vie et le travail littéraire d’Annie Ernaux. La forme diaristique lui est en effet indispensable pour retracer son existence, garantir sa vérité et accompagner ses projets d’écriture. / This thesis aims to study the diary writing of Annie Ernaux from seven diaristic texts: Journal du dehors, “Je ne suis pas sortie de ma nuit”, La Vie extérieure, Se perdre, “photojournal” in Écrire la vie, L’Atelier noir and Regarde les lumières mon amour. These diaries are differentiated by their forms and their contents: intimate diary, impersonal diary, literary diary, and photojournal. They also have links with the literary works of their author. We were interested first of all in their poetics, based on the theoretical framework of diary form in order to analyze their time transcription, their fragmentary structure and the diarist’s figure. Then we studied the triple role played by her diaristic practice: the need to keep a record of personal experience and social facts, the psychological assistance in daily life and the self-discovery. Finally, we analyzed the resonances in the texts of our corpus, their links with diary fragments published in literary journals, as well as the relationship between diaries and literary works, in their themes, their conception and the use of photography. Thus our study shows the diary’s importance in the life and the literary work of Annie Ernaux. The diaristic form is essential for her to trace her existence, guarantee her verity and accompany her writing projects.

Leitura de histórias em quadrinhos do PNBE 2012 : a Turma do pererê

Este estudo apresenta uma reflexão sobre a linguagem na modalidade narrativa denominada história em quadrinhos, a partir do estudo do livro A Turma do Pererê: 365 dias na Mata do Fundão, de Ziraldo. O referido título foi selecionado para estudo por pertencer ao acervo do Programa Nacional Biblioteca da Escola de 2012 (PNBE 2012), destinado aos anos iniciais do Ensino Fundamental. A pesquisa contempla a análise de procedimentos verbo-visuais empregados na construção do título e que deveriam ser apreciados em situação de leitura escolarizada, a fim de contribuir para o letramento dos estudantes. A investigação justifica-se em virtude do baixo desempenho da capacidade de leitura de estudantes, conforme resultados de avaliações de desempenho, da complexidade dos produtos culturais direcionados ao leitor mirim e, ainda, da inserção de histórias em quadrinhos nos acervos do PNBE. A investigação insere-se no Programa de Pós-Graduação em Educação da Universidade de Caxias do Sul – PPGEd/UCS, na linha de pesquisa Educação, Linguagem e Tecnologia e é parte integrante do projeto de pesquisa “Desafios e acolhimentos da literatura infantil: a mediação de leitura literária”, aprovado pela FAPERGS, que objetiva estudar obras selecionadas para compor acervos dos anos iniciais do Ensino Fundamental do PNBE. Entre teóricos que subsidiam a pesquisa, destacam-se: Mikhail Bakhtin (2006) e Lev S. Vygotsky (1998) com reflexões sobre linguagem; Will Eisner (2012), Moacy Cirne (1972, 1973, 2000), Álvaro de Moya (1993, 2002), Paulo Ramos (2009) e Valdomiro Vergueiro (2009) com aspectos da linguagem dos quadrinhos; Brian Street (1984) e Soares (2010, 2013), com estudos sobre letramento, entre outros. O estudo está organizado em capítulos, discorrendo acerca de (a) relações entre educação e linguagem, considerando a escola como espaço de letramento; (b) processos metodológicos da pesquisa e (c) análise da obra e indicação de elementos presentes na composição do título, que deveriam ser considerados na mediação de leitura literária. A metodologia pautou-se na descrição analítica de aspectos da obra selecionada, a fim de apontar procedimentos empregados na construção dessa modalidade discursiva presente nas bibliotecas escolares brasileiras. Como resultados, destacamos, a partir do corpus estudado, que as histórias em quadrinhos contemplam temas que possibilitam a identificação do estudante com o conflito posto, por apresentar situações presentes no cotidiano e que há constâncias no modo de enunciação das narrativas que precisam ser consideradas em propostas de leitura mediada no ambiente escolar. Alertamos, ainda, para a necessidade de o professor ter conhecimento acerca da linguagem dos quadrinhos e sua especificidade como gênero, a fim de contribuir para o letramento dos estudantes. / Based on a study on Ziraldo´s book A Turma do Pererê: 365 dias na Mata do Fundão, this piece of work presents some reflection on the language used in comic books (or comic strips). The book above mentioned was chosen for this study because it is part of 2012´s Library in the School National Program (PNBE 2012), a range of books aimed at the early years of Elementary School in Brazil. The study means to carry out an analysis on enunciation procedures used in the construction of the work, and which can be analyzed in the context of schooled reading, meaning to contribute to students´ literacy learning process. The research can be justified on the fact that students tend to present poor reading skills, as shown in assessments made public about this area, on the complexity of the cultural products aimed at the young reader, and, besides, on the insertion of comic strips in the PNBE range of books. The investigation follows the Education, Language and Technology approach, and it is part of the Post-Graduation in Education Program of the Caxias do Sul University (PPGEd/UCS). It is also part of a research project called “Challenges and welcomings in children´s literature: the mediation of the literary reading”, which has been approved by FAPERGS and which means to study the books that have been short-listed to make up the PNBE range of books for the early years of Elementary Education. Among the authors whose ideas have contributed to the research there are: Mikhail Bakhtin (2006), Lev S. Vygotsky (1998), both of which helped on reflections upon language; Will Eisner (2012), Moacy Cirne (1972, 1973, 2000), Álvaro de Moya (1993, 2002), Paulo Ramos (2009) and Valdomiro Vergueiro (2009), who discuss aspects of the language used in comic strips; Brian Street (1984), with his studies on literacy, and Joseph Schwarcz (1982), who elaborates on the role played by illustration on children´s books, among others. The study is organized in chapters, which contemplate (a) the relations between education and language, considering the school as a space for literacy; (b) the methodological processes of the research, and (c) an analysis of the work and indication of the elements present in the making up of the title, which should be taken into consideration in the mediation of literary reading. It was the analytical description of aspects of the work chosen that guided the method, aiming to pinpoint the procedures used in the construction of this discursive modality present in the Brazilian schools´ libraries. As a result, it stands out in the studied corpus that comic books contemplate themes that make it possible to identify the student with the expressed conflict, as it presents situations that are present in daily life and that there are instances in the way the narrative is enunciated which need to be taken into consideration when mediated reading is proposed in the school environment. Last but not least, one highlights the importance of teachers being familiar with the language used in comic strips, besides its specificity as a genre so as to make it possible for them to contribute for the students´ literacy.

Entendendo que os aspectos culturais e socioeconômicos são partes integrantes de uma configuração histórica regional, a pesquisa busca discutir a forma com que espaços distintos contribuem para a construção ficcional dos coronéis nas regiões de produção do charque e do cacau. Além disso, o estudo analisa como as atividades charqueadora e cacaueira estão relacionadas com as disputas de poder e como a modernidade, tanto em âmbito econômico quanto cultural, consiste em um fator importante na reorganização dos jogos de forças das oligarquias no cenário político regional e nacional. Le droit d'auteur sur la mise en scène

À la lecture de la Loi sur le droit d'auteur, il n'est pas clair que la mise en scène y soit protégée. C'est pourquoi nous nous questionnons sur la qualification juridique la plus adéquate pour la mise en scène. Le metteur en scène est-il un artiste-interprète ou un auteur? Après avoir étudié les caractéristiques artistiques des mises en scène, par types de productions et à la lumière de facteurs faisant varier la latitude du metteur en scène, nous étudions les différentes possibilités de qualification juridique de la mise en scène. Les possibilités sont vastes, car le metteur en scène évolue dans un cadre comprenant plusieurs intervenants. De plus, la mise en scène rencontre deux obstacles caractéristiques à sa qualification juridique en droit d'auteur: la fixation et l'originalité. Nous en venons à la conclusion que le metteur en scène est un auteur, car chacun des aspects de la mise en scène serait protégeable sous différentes qualifications juridiques. / Stage directions are not c1early protected under the current wording of the Copyright Law. This is why we wonder which legal qualification would be most appropriate. Is the stage director a performer or an author? We study the possibilities of legal qualification for stage direction, according to its artistic characteristics by production types, and considering the different factors which influence the Stage Director's liberty as well. The possibilities are vast since the Stage Director works in collaboration with several other intervening parties. Also, the Stage Director meets two typical obstacles: fixation and originality. We conclude that the Stage Director is an author because each and every aspect of the stage directions are copyrightable, under different legal qualifications.

RESUME The thesis 'Personal prose with an authorial commentary' consists of two parts. The first part is the authorial prose. The prose is titled The Subject: This is a novel in emails describing a partnership triangle. Jirka responds to Danka's advertisement on an Internet dating site looking for a pen pal. Although both of them are living with a partner their pen friendship grows into a love afair. The relationship and intimacy of characters are revealed through the correspondence of other people. Not only does Jirka correspond with Karel, his friend, but also his girlfriend confides Jirka's behavior to her friend Šárka. Jirka gets himself into a difficult position between two women. They then resolve the situation for him - both abandon him. In the second part of the thesis - reflection - the circumstances of the work's origin are discussed and particular aspects of the novel are reflected. In addition to the plot construction, character configuration and their characteristics the main focus is on the meaning of the work, and due to which the work's conclusion and the title have suffered. Coping with the form of emails, which is used in the novel, is also taken into consideration and the inclusion of the text into the genre of women's literature.
