Agos, l'hebdomadaire bilingue - turc et arménien de la communauté arménienne publié depuis 1996 et Şalom unique journal de la communauté juive publié depuis 1947, ont une importance stratégique en ce qui concerne leurs relations avec les représentants des deux minorités. L’examen de la presse minoritaire dans l'émergence des leaders au sein des communautés minoritaires de Turquie, nous montre que la presse minoritaire peut changer l’opinion de la majorité et créer de nouvelles normes et un mouvement social. Afin de connaître et d’appréhender la représentativité civile de Hrant Dink dans la minorité arménienne, cette recherche essaye d’analyser les dynamiques complexes de la presse minoritaire et nous permet de saisir la démarche de Dink en tant que leader d’opinion de la communauté arménienne. Ainsi nous pourrons démontrer que la presse minoritaire est capable de créer un leader et un journal avec un tirage de moins de deux mille exemplaires peut être une plateforme connue du monde entier et le rédacteur en chef de ce journal peut être une source potentielle d’influence. / Agos, the bilingual Turkish and Armenian weekly newspaper of the Armenian community has published since 1996 and Şalom, the unique weekly newspaper of the Jewish community has published since 1947, have strategic importance in their relations with the representatives of the two minorities. The examination of the minority press in the emergence of leaders in Turkey's minority communities shows that the minority press can change the opinion of the majority and create new norms and a social movement. In order to understand the civil representativeness of Hrant Dink in the Armenian minority, this research tries to analyze the complex dynamics of the minority press and allows us to grasp Dink's approach as an opinion leader of Armenian community. Thus, we can demonstrate that the minority press is capable of creating a leader and a newspaper with a circulation of less than two thousand copies can be a known platform of the whole world and the editor in chief of this newspaper can be a potential source of influence.

Heritage Language Preservation and its Impact on Integration: The Case of the Vietnamese in the Czech Republic.

Heritage language preservation or conversely, a language shift (a loss or decrease of language proficiency) can directly impact a minority ethnic group's integration into a host society. Multiple theories and studies have demonstrated that students from an ethnic group who are encouraged to celebrate their ethnicity and practice their heritage language have better relationships with parents and peers and overall are more academically and cognitively advanced, less likely to commit crimes and have more economic opportunities available to them. In short, these individuals would seem more likely to successfully integrate into a host country's society. Therefore, looking at the Vietnamese community in the Czech Republic I attempted to gauge the standing of Vietnamese as a heritage language within this ethnic community by using qualitative research to better understand the existing sociolinguistic landscape. Ultimately, what I determined from my research is that heritage language preservation can act as a barrier to integration for the first generation if retaining the heritage language comes at the expense of learning the host country's language. Since its inclusion in the Copenhagen criteria, the protection of minority rights has been an important political condition set by the European Union (EU) for candidate states. This thesis examines the effectiveness of EU conditionality on the Baltic States of Estonia, Latvia and Lithuania to change their ethnic policies and its affect on the Russian-speaking minority of the states. The main argument of this thesis is that the European accession process has promoted minority rights in the three Baltic states, following which the Russian-speaking minority in the Baltic States have been partially integrated. However, the domestic opposition and the potential threat from Russia hindered EU's efforts to influence outcomes of the domestic policies.

1 Abstract Thesis title: The legal status of minorities in Russia This work is an overview of the legal status of minorities in Russia and their mutual interaction with the dominant nation in individual historical stages. Its subject is to explore changes in the status of minorities in political, cultural, linguistic, religious and fundamental human rights. This is put in the historical context and the influence of the state's minority policy on state integrity is examined, including the assessment of the adequacy of the state-legal arrangement for the needs of national minorities. The space is also devoted to the administrative division of the country, which plays an important role in Russian terms. The pros and cons of period legislation are evaluated. Its impact on the practical life of minorities is illustrated by examples of specific minorities. Educational change : the case of Newfoundland

Text in English, abstract in English and Afrikaans / Dramatic changes in Newfoundland's environment and global developments during the past decade, significantly influenced growing demands for restructuring the education system of Newfoundland. Responding to these demands, Newfoundland educators succeeded in creating a single unified non-denominational education system which became fully operational at the beginning of the 1998/99 school year. This achievement has been hailed by the majority of Newfoundlanders as a monumental landmark in the provinces' lengthy experience with denominational education. As well, it is viewed as pivotal in achieving educational excellence and ensuring that children receive a relevant education that will prepare them for the demands of the next century. The former education system (which consisted of four separate denominational school systems operated jointly by the church and the state) had become too cumbersome and inefficient, thus adversely affecting the quality of education. This thesis looks in particular at the contextual realities and perspectives that influenced the demands for changing the system. Such factors as the declining school population, economic conditions, technological developments, as well as legal and political issues have distinctly changed the Newfoundland society during the past number of years, hence the necessity to restructure the education system. The thesis furthermore discusses the proposed government model for restructuring the system and highlights the proposals for improving education. It also focuses briefly on the minority rights issue in Canada, as this has bearing on the legal rights of the church to educate in Newfoundland and its current role within the new structure. An evaluation of Newfoundland's educational reform initiatives (which includes the views of key educators in Newfoundland on these issues), deals with some of the problem areas which currently exist within the new system. However, the focus centres mainly on the obvious improvements in such areas as management, organization, parent involvement, curriculum development, educational achievement and accountability. The impact of these reforms on the social, educational and political dimensions of the Newfoundland society will only become evident in time, yet they hold the promise of having a lasting impact on educational achievement. Sex and the Supremes: Towards a Legal Theory of Sexuality

This thesis examines how the Supreme Court of Canada, across legal contexts, has tended to conceptualize sexuality. It focuses primarily on areas of public law including sexual assault law, equality for sexual minorities, sexual harassment and obscenity and indecency laws. There were a number of trends revealed upon reviewing the jurisprudence in this area. First, the Court’s decisions across legal contexts reveal a tendency to conceptualize sexuality as innate, as a pre-social naturally occurring phenomenon and as an essential element of who we are as individuals. This is true whether one is speaking of the approach to gay and lesbian rights, the occurrence of sexual harassment, or the sexual abuse of children. However, there is an exception to this trend. The exception relates to the Court’s conceptual approach towards sexual violence against adults. The research revealed, likely as a result of feminist activism both in the legislative and judicial arenas, that there has been a shift in the way that the Court understands sexuality in the context of sexual violence. It is a shift away from understanding it as pre-social and naturally occurring towards understanding it as a product of society, as a function of social context. This change in the Court’s conceptual approach towards sexual violence has engendered a shift in the law’s moral focus as well – a shift away from a moral focus on specific sexual acts and sexual propriety and towards a moral focus on sexual actors and sexual integrity. The thesis weaves together the analytical observations about the jurisprudence just described with a theoretical argument that is both grounded in the case law and which draws upon a number of different theorists. The argument developed suggests that the Court, regardless of the legal issue involved, ought to conceptualize sexuality as socially constructed/ contextually contingent, that it ought to orient itself towards protecting sexual integrity, and that it ought to understand this sexual integrity as a common interest.

Minority rights and majority politics : a critical appraisal

In the interplay between protection of rights and majoritarianism, the court is the arena. This research focuses on the conflicting role of the court within a constitutional democracy and a contestation of the counter-majoritarian dilemma that emerges from such a role. The counter-majoritarian dilemma centres on the idea that judges overturning decisions of the legislature through judicial review undermines democracy by thwarting the will of the majority through a subjective reading of abstract constitutional principles. As a point of departure, the counter-majoritarian dilemma is contested by revealing that the court can be seen as a democratically consistent institution if democracy can be reconceptualised. The examination of the South African jurisprudential climate and the adjudicative guidelines followed by the court suggests a rejection of such anti-democratic contention. The court upholds the commitments consented to at the time of the Constitution’s adoption and adjudication is reflective of the values undertaken by the country in reaction to its past. Within these values, minority rights can find a lifeline. Thus minority rights can exist through the implications of majoritarian consent. This research further identifies, in response to the counter-majoritarian dilemma, a constraining self-consciousness on the part of the court and an acute awareness of the court’s precarious role within a democratic infancy. The core of the counter-majoritarian dilemma is the view that interpretative indeterminacy of the Constitution means that the will of the people could be substituted for judicial preference. Through the examination of the court’s interpretative strategies and judicial subjectivity, this research suggests that within judicial subjectivity, adjudication continues to be reflective of the will of the people. Far from a constraining and mechanistic interpretation to avoid judicial subjectivity, the research reveals that open and non-formalist interpretative strategies are necessary to effectuate democratic conciliation within the judicial mandate. The results of this research suggest that, far from being a democratically deviant institution, the court in the current South African jurisprudential context, is the most suited to uphold the concept of democracy. / Jurisprudence / LL. Minority rights in Kosovo : A case study on Torbeshis experiences / Minoritetsrättigheter i Kosovo : En fallstudie om Torbesjers upplevelser

Ever since Kosovo’s declared Independence in 2008, the nation has opted for a multi-ethnic approach by adopting a legal framework that contains several laws promoting and protecting minority rights, although these have remained rather stagnant in implementation. The minorities in Kosovo have furthermore been affected by the Serb-Albanian relations and inter-ethnic tensions by creating divisions and societal challenges. The purpose of this study is to examine the current situation for minorities in Kosovo, along with studying the limitations and possibilities of the implementation of minority rights and societal opportunities. Additionally, this is a case study based on the experiences and views of Torbeshis being a minority in Kosovo which exemplifies the situation of how minority rights are expressed in a social and political context. The  methodological approach of semi-structured interviews was applied which provided the primary data consisting of empirical findings and results from interviews. The data was then analyzed with the assistance of the theoretical framework of social constructivism, along with the intersectionality concept as a complementary tool with an applied narrative analysis. The results indicated that the inadequate implementation of rights is the common denominator concerning minorities' situation, possibilities, limitations and experiences. The focus of the international community on Serb-Albanian relations has further shifted the attention from minority issues. Although the legislative framework is advanced, minorities generally seem to face more limitations than possibilities, with potential for a positive turn. Minorities face limitations such as security concerns, freedom of movement caused by linguistic obstacles, together with restricted participation and access in political life. The Torbeshis face similar issues as mentioned, together with forms of discrimination, ethnic redefinition, assimilation and interrelationship between to major ethnic groups. / Sedan Kosovos förklarade självständighet 2008 antog konstitutionen en lagstiftningsram innehållande flera lagar som främjar och skyddar minoritetsrättigheter, men trots implementeringen har dessa lagar förblivit relativt stillastående i praktiken. Kosovo definierar därmed sig själva som ett multietniskt samhälle i samband med fastställandet av dessa lagar. Minoriteterna i Kosovo har dessutom påverkats av Kosovos efterkrigstid och den Serbisk-Albanska dynamiken där spänningar mellan etniska grupper förekommer i landet och skapar diverse splittringar och samhällsutmaningar för minoriteterna. Syftet med denna studie är att undersöka den aktuella situationen för minoriteter i Kosovo, tillsammans med de existerande begränsningar och möjligheter som finns för implementeringen av minoritetsrättigheter och samhällsmöjligheter. Studien tillämpar en fallstudie som utvärderar Torbesjers erfarenheter av att vara en minoritet, vilket illustrerar hur den nuvarande situationen av minoritetsrättigheter uttrycks i en viss social och politisk kontext. Det metodologiska tillvägagångssättet som tillämpas är semistrukturerade intervjuer och utgör det primära materialet bestående av resultat från intervjuer samt empirisk data. Datan analyserades sedan med hjälp av det teoretiska ramverket social konstruktivism med intersektionalitetskonceptet som ett kompletterande verktyg, och slutligen applicerades en narrativ analys för att behandla datan. Resultatet av studien visar på att den otillräckliga implementeringen av rättigheterna är den gemensamma nämnaren när det kommer till minoriteters situation, möjligheter, begränsningar och erfarenheter. Det omfattande fokus som läggs på relationen mellan serber och albaner av det internationella samfundet skiftar ytterligare uppmärksamhet från minoritetsfrågorna. Trots den avancerade lagstiftningsramen verkar minoriteter i Kosovo möta fler begränsningar än möjligheter, med potential för en positiv förändring. De begränsningar som minoriteter bemöter i Kosovo är säkerhetsproblem, rörelsefrihet, språkliga hinder, samt ett begränsat deltagande och tillgång i det politiska klimatet. Torbesjer står inför liknande problem, tillsammans med former av diskriminering, etnisk omdefiniering, assimilering och ett mellanförskap i förhållande till de etniska majoriteterna i landet.
