1 Abstract Nationality in sport environment The main task of this thesis is to consider the current state of nationality in sport environment with the respect to increasing numbers of international transfers of athletes and the following possible connections of nationality and sport eligibility. At the same time, I am trying to find the answer to question whether it is possible to create complex regulations within international sport law on this issue. The main sources for my research were international treaties, different national laws and also European Union Law. Since much of this work is influenced by lex sportiva it became an integral part of this work as well. Within the first and second chapter I am dealing with the concepts of nationality and naturalization in general, which are analyzed mainly in the light of international treaties, international customs and available case law. I am complementing this data with the findings of national regulations which have had great influence for the field of nationality. In the following text I am analyzing the concept of sport eligibility, mainly its content and significance in general and within this work. The association between the nationality of nurses and safety culture in maternity care units of Oman

Yes / Background: Patient safety culture/climate in maternity units has been linked to better safety outcomes. Nurses have a crucial role in patient safety and represent the majority of staff in maternity units. In many countries, nurses are recruited from abroad, bringing their own perceptions of patient safety culture. Nonetheless, little is known about the relationship between perceptions of patient safety culture and nurses’ nationality. Understanding this relationship will assist stakeholders in designing a responsive programme to improve patient safety culture. Aims: To investigate the association between nurses’ nationality and their perceptions about patient safety culture in maternity units in Ministry of Health hospitals in Oman. Methods: In 2017, the Safety Attitude Questionnaire (SAQ) was distributed to all staff (892 distributed, 735 returned) in 10 maternity units. Results: About three-quarters (74%, 541/735) of the returned SAQs were completed by nurses, of whom 34% were non-Omani, 21.8% were Omani and 44.7% did not report their nationality (missing). Overall, the mean safety score for non-Omani nurses was significantly higher than for the Omani nurses: 3.9 (SD 1.3) vs 3.6 (SD 1.2) (P < 0.001). The mean safety score for stress recognition was significantly lower for non-Omani nurses: 2.8 (SD 1.5) vs 3.2 (SD 1.3) (P < 0.001). Conclusion: Non-Omani nurses have a more positive perception of patient safety culture than Omani nurses except in respect of stress recognition. Decision-makers, directors, and clinicians should consider these differences when designing interventions to improve patient safety culture. / This study is part of a PhD study that was funded by the Ministry of Health in Oman

Les présents travaux de thèse se proposent de réévaluer les rapports qu’entretiennent la nationalité et la souveraineté. Le lien entre ces deux notions s’est en effet longtemps exprimé autour de l’idée d’un pouvoir quasi absolu de l’État pour déterminer les individus qu’il tient pour ses nationaux. La nationalité est ainsi souvent citée comme l’exemple même d’une prérogative présentant un très haut (si ce n’est le plus haut) degré de liberté pour l’État. Ce « dogme » de la souveraineté en droit de la nationalité reflète-t-il encore l’état du droit positif ? Pour contribuer à répondre à cette question, cette étude entend interroger à lafois l’étendue de la compétence de l’État, mais aussi la discrétionnarité de son pouvoir, en prenant principalement appui sur le droit français, les droits européens et le droit international. Un résultat se dessine alors : le droit de la nationalité, produit d’une lente évolution historique et de profondes mutations contemporaines, ne peut plus s’exprimer sur le mode de la souveraineté. Le rapport de la nationalité au territoire, sa pénétration dans le champ des droits de l’homme, et la progression des contrôle juridictionnels font en effet reculer – jusqu’à l’effacer – la liberté de l’État pour octroyer, refuser ou révoquer lanationalité. / This work aims to review the relationship between nationality and sovereignty. The bond between these two legal notions has repeatedly expressed itself as an absolute power of the State to determine which individuals it considers to be its nationals. Accordingly, nationality is widely selected to exemplify a State’s power with a high (if not the highest) degree of liberty. However, does this sovereignty “dogma” in nationality law still reflect current positive law? To further contribute to the debate, this thesis needs to examine – through a study of French domestic law, European laws, and International law – both the scope of the State’s jurisdiction and the discretion of its power. Then, results show that nationality law, because ofhistorical developments and contemporary transformation, is no longer able to express itself as a sovereign power. The connexion of nationality with the territory, its integration in the field of human rights, and the growth of judicial review are altogether eroding and erasing the State’s freedom to grant, deny or revoke nationality.

Probing into the Jurisdiction and the Judgment Basis of Cross-strait Matrimony Cases by Conflict Law Theory

The influence of the cross-strait matrimony is not only to the parties theirselves, but also to the problems of complexsive population policy, the allocation of internal social resources, safeguard against noational interests, the consideration of the safety of national defense and foreigners treatment. If the cross-strait matrimony asise disputes and gets into the litigation procedure, the court do not deal with it appropriately, it will cause the damage of parties¡¦ rights and interests, the influence of the mutually preferential relationship of cross-strait judicial systems and deteriorate relationship of Cross-Strait. For this reason, it is very important to solve the cross-strait matrimony cases properly. The law of the cross-strait matrimony cases is not complete, the court is not clearly how to probe into and solve problems in the cross-strait matrimony cases. By the viewpoints of trail practice and conflict of laws, the nature of the cross-strait matrimony cases is equivalent to the generally foreign matrimony cases what is called international identity disputes, and the court confronts the problems of the cross-strait matrimony cases similarly to international identity disputes. The theories, legislative and precendent of conflict of laws of international identity disputes is also applicable to the cross-strait matrimony cases, therefore, it will contribute to solve the problems. This article introduces legislatives of every nation, international convention and judicial practice, from the viewpoints of legislative policy and trial practice to analyze the court in Taiwan district how to decide the problems of the delimintation of jurisdiction and the conflict of laws of the cross-strait matrimony cases.
