First, it discusses the equality of men, the three causes of war of all against all, and how to understand the relationship between your theory and the historical moment in which he lived. Secondly, it is shown the concept of contract as a product of human capacity to transform the reality, and also the relationship between the mechanical and the moral, and the union of reason and passion in your anthropology. Finally, it analyzes the divine authority of the state and, because of this, the possibility of failure on the part of sovereign power with the rationale of the pact between individuals, which is the preservation of life. It intend to demonstrate that the seventeenth-century thinker sees the human condition as an agonizing journey, in which even the best guarantee of peace, the State, presents the possibility of serious drawbacks. / O objetivo deste trabalho é discutir a concepção de homem em Thomas Hobbes nos três pilares que compõe sua teoria: o estado natural, o contrato e o Estado. Em primeiro lugar, se analisa a igualdade entre os homens, as três causas da guerra de todos contra todos, e como compreender a relação entre a teoria do autor e o momento histórico em que ele viveu. Em segundo lugar, mostra-se a concepção de contrato como produto da capacidade humana de transformação da realidade e, ainda, a relação entre a mecânica e a moral, e a união de razão e paixões em sua antropologia. Por fim, destaca-se o Estado como detentor de uma autoridade divina e, em virtude disto, a possibilidade do descumprimento, por parte do poder soberano, com a razão de ser do pacto entre os indivíduos, a preservação da vida. Pretende-se demonstrar que o pensador seiscentista concebe a condição humana como uma trajetória agônica, na qual até mesmo a maior garantia de paz, o Estado, apresenta a possibilidade de sérios inconvenientes.

Le retour à la nature : l'étude du thème de la nature chez J.M.G. Le Clézio / Retrurn to nature : study on the theme of nature in Le Clézio's works

L’objectif de cette recherche est de mettre en évidence le thème de la nature comme noyau de l’œuvre de Le Clézio et de mener une étude synchronique et diachronique de ce thème basée sur un corpus complet de l’auteur. En suivant un processus de quête de l’identité naturelle, qui conduit de la « nature dénaturée » dans les premières œuvres à la « nature retrouvée » dans les œuvres ultérieures, en passant par l’horizon d’autres mondes dans les œuvres dans l’époque de transition, on essaie de refermer la boucle qui obsède Le Clézio. Contemporain de notre temps, Le Clézio esquisse une peinture de l’espace urbain moderne sous forme d’une prison où la nature universelle et la nature humaine sont aliénées, diabolisées ou expulsées dans la domination de la modernité. L’absence de l’existence et la fausseté de la réalité poussent à une recherche de vérité dans l’autre côté du monde à la lumière des philosophies orientales et amérindiennes. Le retour à la rêverie élémentaire du monde naturel primitif fait appel également aux philosophies présocratiques et aux mythes des civilisations primitives. L’identité idéale en tant que vraie nature humaine est reconstruite par Le Clézio en adoptant l’identification du soi à la nature universelle au niveau personnel, et en promouvant le métissage des sangs au niveau culturel, d’une manière qui tend à ce que le monde soit enfin remis en harmonie. / The objective of research is to clarify the theme of nature as the core of Le Clézio’s work and deepen the synchronic and diachronic study of this topic based on a full corpus of the author. Following a process of seeking the natural identity, that is to say from the “denatured nature” in his early works to the “return to nature” in his later works, through the horizon on the other side in his works in the period of transition, we try to close the loop that obsesses Le Clézio. Contemporary of our time, Le Clézio sketch a painting of modern urban space as a prison where the universal nature and human nature are alienated, demonized or expelled in the domination of modernity. The lack of existence and the falseness of reality grow to a search for truth in the other side of the world in the light of Oriental and Indian philosophies. The return to the primitive elemental reverie of natural world also calls on pre-Socratic philosophies and myths of primitive civilizations. The ideal identity as the true human nature is reconstructed by Le Clézio in adopting the identification of the self with the universal nature on a personal level and promoting the mixing of bloods at the cultural level in a way that the world is finally handed in harmony.

En France, l’apparition de la justice constitutionnelle et la création d’un juge spécialisé questionnent la montée en puissance du pouvoir juridictionnel. La relative jeunesse du Conseil constitutionnel, le perfectionnement des techniques de contrôle et l’essor de nouvelles voies de recours en droit constitutionnel offrent à la doctrine des champs de recherche importants. Pourtant, à l’issue de l’observation des études consacrées à ces thèmes, on découvre une terre inexplorée du contentieux constitutionnel : celle de la rhétorique du juge constitutionnel, et plus particulièrement, du recours à l’argument de la nature des choses. Si d’aucuns se sont interrogés sur cette référence en philosophie du droit, la jurisprudence y faisant référence n’a jamais fait l’objet d’une analyse détaillée. Pourtant, les décisions du Conseil constitutionnel offrent bel et bien des exemples d’utilisation discutable de cette locution. On peut vraisemblablement attribuer cette absence au fait que la nature, l’essence, la force des choses se sont imposées dans le langage courant et dans le langage juridique comme une formule topique, un outil langagier bien utile permettant de combler les points aveugles de la pensée. Cette réponse ne fait que confirmer l’intérêt de notre étude. Car qu’est-ce qu’un droit qui fait appel à la nature des choses pour pallier les failles de la logique ? / In France, questions about the part of judicial power are renewed by the recent introduction of constitutional justice administrated by a judge ad hoc created on purpose. The relative youth of Constitutional Council, the improvement of control techniques and the establishment of a new right of appeal open the field of research. Nevertheless, it must be observed that these studies fail to analyze one particular aspect of constitutional justice: the rhetoric arguing and, more specifically, the naturalistic justification. Now, as far as we know, it seems that no consequent works have been produced on this issue. The contentious aspect of this naturalistic topic had not been precisely analyzed contrary to the philosophical aspect of it in jurisprudence. And yet, we must observe the presence of this particular argument – under different forms – in Constitutional Council decisions. Beside, the undifferentiated uses of terms like “nature”, “essence”, “substance”, “in itself” etc. in both legal and common language can explain the lack of recent study on this subject in so far as this arguing is most likely appearing as a discursive tool, devoid of any scientific interest. In this regard, this assertion confirms and strengthens our interest for this topic which can be resumed in this terms: “how to define a legal system that fills in its own legal loophole by referring to nature of things ?”

La thèse aborde une question importante d’actualité et de vie qui lance à la société moderne des défis qui semblent n’autoriser aucun droit à l’erreur. Il s’agit de la définition du rapport de l’homme à la nature. Pour résoudre cette épineuse question, plusieurs réponses ont été proposées. Notamment Arne Naess qui professe une éthique biocentrique et Hans Jonas qui met au centre de toutes nos préoccupations la vie des générations futures. Mais ces solutions aboutissent par contre à une négation de la morale en faisant la promotion des régimes politiques totalitaires. En analysant le rapport de l’homme à la nature selon Descartes, nous avons découvert une philosophie de l‘écologie pour aujourd’hui, capable de contenter même le plus exigeant des écologistes. Bien que le nom de Descartes soit souvent associé à la crise écologique, notre thèse s’est donnée pour objectif d’abord de montrer que le rapport à la nature lui a permis de remarquer les capacités de découverte et de créativité de l’homme et ensuite que sa proposition est une véritable éthique de responsabilité qui répond à une exigence de l’homme tout entier. C’est une sagesse qui permet à l’homme d’utiliser le pouvoir que lui confère la technoscience de manière à atteindre un haut degré de sécurité, d’utilité, de bien-être, de plénitude des valeurs. Elle invite l’homme à faire bon usage de son libre arbitre de telle sorte que son pouvoir tienne toujours compte du développement de l’être humain en responsabilité, en valeur et en conscience. C’est pourquoi, la philosophie de l’éco-responsabilité viable de Descartes est un appel fait à l’homme pour passer de l’irresponsabilité à la responsabilité. / This doctoral thesis addresses an important issue of everyday life that launches to modern society challenges that seem to allow no room for error. It’s about the definition of the relationship of man to nature. To solve this thorny question, several answers have been proposed. In particular Arne Naess professes a biocentric ethics and Hans Jonas puts the lives of future generations at the center of all our concerns. But these solutions lead to a negation of morality by promoting totalitarian regimes. By analyzing the relationship of man to nature according to Descartes, we have discovered a philosophy of ecology for today, capable of satisfying even the most demanding ecologists.Although the name of Descartes is often associated with the ecological crisis, our thesis aims at raising two things: first to show that the relationship to nature has allowed him to notice the discovery capacity and creativity of man and second, that his proposition is a true ethics of responsibility that meets a requirement of the whole man. It is a wisdom that allows man to use the power given to him by technoscience so as to achieve a high degree of security, utility, well-being, fullness of values. It invites the man to make good use of his free will so that his power always takes into account the development of the human being in responsibility, in value and in conscience. This is why Descartes' philosophy of sustainable eco-responsibility is a call to man to move from irresponsibility to responsibility.
