While the company has dramatically grown in the last twenty years, the management structure has not changed to accomodate the organization's growth. The company is experiencing increased turnover and high absenteeism. The purpose of this study is to identify the threats and weaknesses facing the company in terms of decision making, job descriptions, and communication and management structure.

Reform of the 'doctrine of utmost good faith' : a comparative study between the UK and Saudi Arabia

In the UK and Saudi Arabia, it is necessary for the contracting parties in insurance contracts to comply with the requirement of the doctrine of utmost good faith. In recent years, the doctrine of utmost good faith and the mutual duties of the contracting parties have developed in different ways in each jurisdiction. Both jurisdictions provide consumer protection in insurance markets by Consumer Insurance (Disclosure and Representation) Act 2012 in the UK and Insurance Consumer Protection Principles 2014 in Saudi Arabia. However, there are many differences between the conduct of each jurisdiction since the coming into force of the Insurance Act 2015 in the UK, which revolutionised the insurance law in several key areas. This thesis particularly aims to critically analyse the reform of the doctrine of utmost good faith and looks at how the current reform impacts on the interpretation of this doctrine between the UK and Saudi jurisdictions. This study critically analyses the insureds’ pre-contractual duties for consumers and businesses in the UK with a comparison to Saudi law.

Challenges in international business communication : a study of language, culture and inter-cultural issues in Malaysian-Australian business discourse

This study aims to explore communication deviances and strategies in the negotiation discourse of Malaysian-Australian business encounters, from both a linguistic and nonlinguistic perspective. Specifically, it sees miscommunications/deviances as factors that may hinder the business communication process and prevent the negotiators from achieving their objectives. The study also focuses on strategies, or those discourse skills which promote successful business negotiation. The research method is based on the analysis of discourse generated from initial 'perception' interviews, business meetings, and post-meeting 'follow-up' interviews. The research involved a cross-section of Malaysian and Australian business people from various industries; such as tourism, information technology, hospitality and financial services. The initial 'perception' interviews were intended to gather data on the prior experiences of Malaysian and Australian businesspeople, both in terms of the reported difficulties and strengths in their business interactions and dealings in Western Australia. In the second stage of the analysis, the deviances which signalled miscommunication in the negotiation were identified in the recorded meeting data. Also identified were the strategies which were used by the negotiators to increase the likelihood that their goals will be achieved. The objective of the research was then to interpret why these strategies were being used, and their influence on the negotiation process. From the data a pattern emerged in the way that deviance occurred, and the way that strategies were being performed. This has made it possible to group deviance and strategies and present the findings thematically. Altogether, five themes identified, these were: Management of topics, Building rapport; Ethical business conduct; Building recognition; Styles in business practice. The study has shown that business communication discourse reflects the embedded culture of its speakers. Topic management was also found to play an important role in the business meetings as it enabled the participants to more effectively lead their discussion towards its intended goal. Both the deviance and strategies have been managed by the business negotiators in the way they select the appropriate topic categories in order to effectively maintain the discussion throughout the meeting.

The importance of bilateral agreements on trade flows: a case of the Trade Development and Cooperation Agreement (EU-SA TDCA)

This study analysed the intricacies of trade flows imbibed in the EU-SA TDCA. It assessed the trade creation and trade diversion effects of this bilateral trade agreement – using the top 10 selected commodity exports. This follows the report on the Harmonised System (HS) at the 2-digit codes. A Gravity Model Approach on bilateral trade flows is grounded on panel data models for the period 2000-2017 between South Africa as exporter country and the twenty EU countries (EU-20) as importer country-block out of the twenty-eight countries (EU-28). The study reports that the EU-SA TDCA enhanced significant trade expansion and trade creation effects. Mixed results for GDPs and GDPPKs for both South Africa and the EU countries were reported, but the overall results showed that the bilateral agreement do affect South African commodity exports more negatively, albeit with few positive effects from the EU countries in particular. Besides, ICTSA does have a negative effect on commodity exports, while the South African REER has the positive effect on export models. Lastly, the distance as a proxy of transportation costs negatively affects South Africa’s exports, while common colonial relationship and English as common official language have both a positive effect on exports. The findings imply that trade policies should focus on adequate telecommunication tools, alongside fair trade practices allowing South Africa to integrate with the global market, promote economic growth as well as enhance competitive advantage in most sectoral trades. / Business Management / M. Chat phases, disagreements and claim backing in simulated sales negotiations : an applied linguistics perspective

This study compared simulated sales negotiations with authentic negotiations. Specifically, three areas of language were considered: (i) chat phases, (ii) mitigation in disagreements, and (iii) argumentation. Findings indicated that greatly reduced use of chat phases in the simulations led to an impoverishment of the interactional aspect of communication. A statistical analysis indicated that mitigation of disagreements was significantly reduced when compared to authentic negotiations. Finally, in spite of the difference noted between professional and non-professional negotiators in the simulated negotiations, a significant increase in the use of argumentation was found in the simulations. Even though further research would be required, it could be hypothesized that these differences may be attributed to the one-off nature of simulations, the absence of a surrounding business context and the intrinsic difficulty of using interactional language in simulations.
