Les droits de l’enfant face aux punitions corporelles dans la famille / Children’s rights and corporal punishment in the family / Derechos de los niños y castigo físico en la familia

L’objectif de cette recherche est d’appréhender les punitions corporelles en tant que phénomène éducatif au regard des droits des enfants à partir des représentations sociales des parents ordinaires. L’étude a impliqué des mères et pères de familles biparentales, sans risque économique, habitant la ville de Barranquilla en Colombie. La démarche s’inscrit dans une perspective pluridisciplinaire combinant l’éducation familiale, la théorie des représentations sociales issue de la psychologie sociale et les études sur la conscience du droit, issues de la sociologie juridique (Legal Consciousness Studies - LCS). Le recueil de données a été réalisé avec deux instruments : le réseau d’associations et l’entretien semi-directif. Le premier permet de recueillir les mots évoqués de façon spontanée à partir d’un terme inducteur et d’atteindre la construction du contexte sémantique de la représentation. L’analyse prototypique des réseaux avec le logiciel EVOC 2003 a permis d’explorer la structure représentationnelle. Cinq objets de représentations ont été examinés pour la caractérisation de son contenu et de sa structure : Punitions-récompenses, Droits de l’enfant, Autorité des pères et mères, Éducation dans la famille, Garçons-Filles. Cette approche a contribué à une compréhension approfondie du phénomène des punitions corporelles du point de vue des acteurs. L’analyse des entretiens a été faite avec le logiciel Atlas.ti en s’appuyant sur les catégories conceptualisantes. Cette analyse permet d’approfondir la connaissance des éléments représentationnels et leur relation avec la narration du quotidien par les parents. Les récits obtenus décrivent la reconstruction par les participants des discours issus de la tradition, du champ juridique et du champ savant, trois discours qui sont intégrés dans le réseau de la pensée sociale. L’examen de la reformulation du discours juridique et de la représentation sociale des droits des enfants ouvrent la voie à la compréhension de la construction par les parents ordinaires d’une légalité particulière. / The research aimed to characterize corporal punishment as an educational phenomenon in tension with the rights of the children, from the social representations of ordinary parents. The study included parents from bi-parental families, excluding the population in economic risk, living in Colombia. The approach involved a multidisciplinary perspective -family education, theory of social representations and legal consciousness studies (LCS)-. The gathering of data is performed with two instruments: the associations networks and semi-structured interviews. The first one allows to reach the construction of the semantic context of the representation. The prototypical analysis of networks made with the EVOC 2003 software led to the exploration of the representational structure. Five objects of representation were examined for the characterization of their content and structure: Punishments-rewards, Children’s rights, Parental authority, Family education, Boys-girls. This approach searched for a deep understanding of the phenomenon of corporal punishment from the point of view of the actors. The treatment of the interviews by the Atlas.ti software was made using conceptualizing categories. This analysis allowed deepening the knowledge of representational elements and their link with stories of everyday life from the parents. The obtained narratives exposed the participants' reconstruction of the discourses emerging from tradition, the legal field, and the learned field; which would be integrated to the social thought network. The examination of the reformulation of the legal discourse and the social representation of children’s rights opens the way to understanding the construction of special legality by the parents on a daily basis. / La investigación tuvo por objetivo caracterizar el castigo físico en tanto fenómeno educativo en tensión con los derechos de los niños desde las representaciones sociales de los padres ordinarios. El estudio se desarrolló en Colombia con madres y padres de familias biparentales. Éste se inscribe en una perspectiva multidisciplinaria - educación familiar, teoría de las representaciones sociales y estudios de la consciencia del derecho -. La recolección de los datos se realizó a través de dos instrumentos: las redes de asociaciones y las entrevistas semi-estructuradas. El primero permite alcanzar la construcción del contexto semántico de la representación. El análisis prototípico de las redes con el software EVOC 2003 conduce a explorar la estructura representacional. Cinco objetos de representaciones fueron examinados para la caracterización de su contenido y estructura: Castigos- premios, Derechos de los niños, Autoridad de los padres y madres, Educación en la familia, Niños-niñas. Esta aproximación busca la comprensión del castigo físico desde la perspectiva de los actores. El tratamiento de las entrevistas en el software Atlas.ti se realizó con la ayuda de categorías conceptualisantes. Dicho análisis permite acceder al conocimiento de los elementos representacionales y su relación con las narrativas acerca del cotidiano de los padres. Los relatos recogidos exponen la reconstrucción realizada por los participantes de los discursos emergentes de la tradición, el campo jurídico y de origen experto, los cuales estarían integrados en la red de pensamiento social. El examen de la reformulación del discurso jurídico y la representación social de los derechos de los niños abre la vía a la comprensión de la legalidad particular construida por los padres en el cotidiano.

A mãe que trabalha fora: a criança e a família em relação ao trabalho materno / The working mother: the child and family in relation to maternal employment

Este estudo pretendeu investigar como a variável trabalhar fora interfere na constituição do lugar da mãe para o filho. Utilizamos uma metodologia de pesquisa de campo, de natureza qualitativa a partir do estudo comparativo de seis famílias da classe média paulistana. Foram realizadas entrevistas semi-dirigidas com os casais e com as crianças aplicamos o Procedimento de Desenhos de Família com Estórias, proposto por Walter Trinca (1997). Nosso estudo procurou articular o conhecimento advindo da história da trajetória da família burguesa, com os aportes oferecidos pela análise dos desenhos e entrevistas com as famílias inseridas nesse contexto, contando também com o auxilio do substrato teórico da psicanálise. Nossos dados apontaram que o fato da mãe trabalhar fora, enquanto fator isolado, não parece discriminar entre os dois grupos. Verificamos que os fatores mais importantes têm relação com a constituição da conjugalidade e da parentalização. Outro aspecto identificado esteve associado à possibilidade de um pai participativo, esse aspecto demonstrou ter forte relação com a satisfação conjugal, igualmente influente na percepção da criança sobre seu lugar na família / This study aimed to investigate how the variable \"out-of-home work\" affects the constitution of the place of the mother to the child. We used a methodology of field research, qualitative in nature, from the comparative study of six middle-class families in São Paulo. We executed semi-directed interviews with the couples and applied the Procedure of Family Drawings with Stories, proposed by Walter Trinca (1997), with the children. Our study sought to articulate the knowledge gained from the history of the trajectory of the bourgeois family, with contributions offered by the analysis of drawings and interviews with the families inserted within this context, also counting on the help of the theoretical basis of psychoanalysis. Our data showed that the mothers that work out of home, as an insulated factor, does not seem to discriminate between the two groups. We found that the most important factors are related to the establishment of conjugality and parenthood. Another aspect identified was associated with the possibility of the participation of the father. This aspect has demonstrated a strong relationship with marital satisfaction, equally influential in the child´s perception of his place in the family

The subject of this diploma thesis is the Employer's Strategy for Employing Parents on Parental Leave. The theoretical starting points of the thesis map the area of equal opportunities policy, the concept of family policy and employment policy in the Czech Republic. In addition, the work focuses on the personal and working life of parents on parental leave, describes the development of personal and work satisfaction, the motivation of parents to return to work and the expectation of parents from the employer. The last part of the theoretical framework focuses on employers' strategy, focuses on the social responsibility of organizations in the context of the topic, the motivation of employers to employ parents, their expectations of cooperation, and examples of different approaches to employing parents in the private and public sectors. The aim of the research part of thesis is to identify the causes that prevent parents from taking part in the labor market during parental leave and to educate and broaden their qualifications and to identify opportunities that lead to facilitating access to the labor market for parents on parental leave. Promítnutí práva znát svůj původ do českého právního řádu (kritická studie) / Reflection of the right to know one's own origin in the Czech legal order (critical study)

(Abstract) The diploma thesis deals with the reflection of the right to know one's own origin in the Czech legal order. Knowledge of one's own origin and the right to know one's own origin constitute not only a legal but also a moral and ethical question. The right to know one's own origin (i.e. the right to know one's parents, one's biological family and one's ancestors) is one of the subjective human rights, which belongs to every natural person. This right is more or less reflected in majority of institutes of family law. The thesis analyses the most important of them and indicates how the right to know one's own origin is reflected in these institutes or it is not, although it should be. The work seeks to highlight possible shortcomings of the legislation and tries to propose possible solutions de lege ferenda. There are also stated (for the purposes of comparison) some examples of foreign legislation in cases of some legal institutes. The diploma thesis is based on the legislation effective on the 26th March 2016. It is composed of an introduction, five chapters and a conclusion. The first chapter deals with the right to know one's own origin and its legal regulation in the Czech Republic. Preventive psychosocial parental and school programmes in a general population

Introduction Numerous preventive programmes have emerged, and need to be investigated to determine their effects on the normal population. Earlier studies have shown a decrease in depressive symptoms, positive effects on children’s disruptive behaviour problems, and an improvement in parental competence. About a fifth of the parents in previous studies had problem-oriented (targeted) reasons for enrolment, whereas the rest of the parents had general (universal) reasons. The results of those studies suggest that the programmes are cost effective in terms of Quality-Adjusted Life Years. Aim Four sub-studies were performed, and their aims were to investigate the effect of parental training programmes (PTPs) in a naturalistic setting on parents’ mental health in the general population, to investigate how PTPs affect parents’ sense of parental competence, to investigate how PTPs affect parental stress and analyse the parents open questions about the PTPs, and to investigate the feasibility and to measure the effect on depression, anxiety, and social problems of two preventive school programmes for pupils in grade 7. Method In a longitudinal quantitative study in a real-world setting, 279 parents from the general population in northern Sweden participated in five PTPs. A comparison group of 702 parents without intervention was included. Simultaneously, a community sample of 59 pupils in grade 7 participated in two preventive school programmes. Both studies were conducted from 2010 to 2013. Parents were assigned to professionally supported interventions that included 5-10 two-hour sessions. Respondents filled in a web-based questionnaire with the General Health Questionnaire (GHQ), the Parents Sense of Competence (PSOC) for parents who had children aged 0-17 years, and the Swedish Parenthood Stress Questionnaire (SPSQ) for parents who had children aged 0-10 years. The intervention groups’ results were compared to comparison group of 702 parents from northern Sweden that had not participated in any parental training programme. In the school study, one of the preventive programmes was an ongoing programme called “Life-Skills”, and the other was an implemented Canadian programme called “Choosing Healthy Actions and Thoughts” (CHAT). The pupils completed a test battery including the Sense of Coherence (SOC), the Children’s Depression Inventory (CDI), and the Youth Self-Report (YSR) instruments. Follow up of the parental programme study was done six months after the post-intervention measure, and follow up of the school study was at one year. Results The improvements in GHQ were statistically significant for the mean of the 279 parents in the intervention group compared to the mean of a comparison group of the 702 parents who did not receive any intervention. This suggests that evidence-based PTPs enhance parental well-being even for parents without problems. The intervention group showed a statistically significant improvement in parental competence compared to the comparison group over time. The intervention itself had a significant effect on parental satisfaction, but the efficacy effect was not sustained when taking into account potential confounders. In the SPSQ, the intervention group was smaller due to the fact that the instrument was not validated for children over the age of 10 and one of the parental training groups was only for parents of teenagers. A reduction of stress in the sub-scale of health problems was detected, but no other subscale showed the intervention to have a significant effect when controlling for confounding variables. In the school study, both programmes had good feasibility according to the stake- holders and had several positive mental health outcomes over time. Compared to Life-Skills, CHAT had more significant positive effects on reducing anxious/depressive symptoms and girls experienced significant positive effects on reduced anxious/depressive behaviour, while boys reduced their aggressive behaviours. Conclusions Earlier studies indicate that PTPs enhance perceived parental competence among referred parents. The present study shows that PTPs applied in the general population might also enhance perceived parental benefits such as improved health and satisfaction, suggesting that PTPs can be an important preventive strategy to enhance parenthood. The results suggest that parents who feel a need to increase their parenting competence might participate in PTPs based on lower scores than the comparison control group both before and after the intervention. The school-based programme shows that schools may be a suitable arena for preventive programmes because there was a significant short-term improvement in depression symptoms. Further studies need to explore how parents’ participation in PTPs affects children’s mental health in the general population in quantitative longitudinal studies in real-word settings. There is also a need for bigger studies and RCTs on school preventions and on how children’s health develops naturally in the population.

Précédée par le tumulte de multiples scandales médiatiques ayant dévoilé des faits de maltraitances, ignorés ou provoqués par le dispositif de la protection de l'enfance, la loi du 5 mars 2007 se voulait remédier à des dysfonctionnements intrinsèques au service de protection en restructurant sémantiquement et formellement le fonctionnement, la mission et le champ définitionnel recouvrant l'ensemble du dispositif. S'enracinant autour d'une mission de « prévention » des risques de maltraitance et de « soutien à la parentalité », de nouveaux vocables (« risque de danger », « danger »), instruments (« Informations Préoccupantes », « Projet Pour l'Enfant ») et de nouvelles instances (« Cellule de Recueil des Informations Préoccupantes », « Observatoire ») ont accompagné le caractère réformateur de la loi. Au-delà du simple changement et renouvellement sémantique, cette constellation de mots et de syntagmes n'était pas sans produire de profondes altérations dans l'agencement des rôles, des fonctions et des identités de chaque acteur pris dans le réseau énonciatif du dispositif. À partir d'un ensemble d'énoncés prescriptifs, la loi façonnait et engageait les professionnels à faire-avec un nouveau paradigme général sur la représentation du lien parent-enfant. Il ne s'agissait plus pour les professionnels, à l'intérieur de cette vision, de sanctionner un parent potentiellement « carencé », ou de couper un lien jugé « toxique » pour protéger un enfant, mais de permettre au sujet parental de se découvrir (« s'éliciter ») et d'investir son rôle de parent. Soutenu par une médiation institutionnelle, le parent se voyait en cela potentiellement désigné, depuis l'article 375 du Code civil, comme un actant responsable du bon « développement physique, affectif, intellectuel et social » de l'enfant. Réagençant les linéaments sur lesquels reposait la prise en charge d'un usager, la loi réorganisait en profondeur la structure du comportement des différents acteurs. S'interrogeant sur ces diverses modifications normatives, ce travail de recherche se propose de saisir les « effets » opérés par la loi du 5 mars 2007 sur les pratiques, la pensée et les relations entre professionnels, usagers et institutions. À travers les analyses des dossiers de la protection de l'enfance, des évolutions législatives, institutionnelles, discursives et d'entretiens réalisés avec des travailleurs sociaux, nous chercherons à comprendre comment se sont redessinés les rapports de pouvoir entre des familles et des professionnels porteurs d'une intervention « parentaliste ». Se rapportant aux répercussions du discours d'un dispositif de régulation sociale sur des sujets, cette étude empruntera une lecture et une analyse similaire, dans ses principes et ses méthodes, à celles que M. Foucault a effectuées sur la prison ou la sexualité. À l'issue de l'analyse critique, et ce pour dépasser les difficultés rencontrées autour de nouvelles pistes de réflexion, la recherche donnera lieu à la formalisation de préconisations. / Preceded by the tumult of multiple media scandals having unveiled the facts of abuse, ignored or provoked by the child protection system, the law of March 5, 2007 was intented to remedy to intrinsic failures in the protection service by semantically and formally restructuring the operation, the mission and the definitional field covering the entire device. Rooting around the abuses risk « prevention » mission and « parentality support », a few new vocables (« Danger Risk », « Danger »), instruments (« Worrying Information », « Project For the Child ») and new instances (« Cell Collecting Information of Concern », « Observatory ») have accompanied the law's reformist character. Beyond the simple change and semantic renewal, this constellation of words and sentences was not without producing profound alternations in the arrangement of roles, functions and identities of each actor caught in the enunciative network of the device. From a set of normative statements, the law shaped and committed professionals to do-with a new general paradigm on the representation of the parent-child link. It was no longer for the professionals, inside of this vision, to punish a parent potentially « deficiencied », or to cut off a link judged « toxic » to protect a child, but to allow the parental subject to discover itself (« to elicit ») and invest its role of parent. Supported by an institutional mediation, the parent was potentially designated, since Article 375 of the Civil Code, as an protagonist for the good « physical, emotional, intellectual and social development » of the child. Reordering the elementary lines on which was based the care of a user, the law reorganized in depth the behavior's structure of the various actors. Wondering about these various normative changes, this research work offers itself to seize the operated « effects » by the law of March 5, 2007 on practices, the thought and the relationships between professionals, users and institutions. Through analyzes of child protection files, legislative, institutional, discursive evolutions and interviews with social workers, we will seek to understand how did the power reports between the relatives and the professionals carriers of « parentalist » intervention. Referring to the repercussions of the speech of a social regulation device on topics, this study will borrow a similar reading and analysis, in its principles and methods, to what Mr. Foucault has done on prison or sexuality. At the end of the critical analysis, and to overcome the difficulties encountered around new lines of thought, the research will lead to the formalization of recommendations.

Familiale Generationenbeziehungen und der Übergang in die Elternschaft: Eine qualitativ kulturvergleichende Studie

Das Forschungsinteresse der Arbeit zielt auf die Funktion und Bedeutung familialer Beziehungen in einem Mehrgenerationennetzwerk aus Sicht verschiedener Akteure und in verschiedenen kulturellen Kontexten. Die Rekonstruktion familialer Generationenbeziehungen zwischen erwachsenen Kindern und ihren Eltern erfolgt im Rahmen eines spezifischen Lebenslaufereignisses: dem doppelten generationalen Übergang in die (Groß-)Elternschaft. Dieses familiale Übergangsereignis bringt ein Aufrücken der einzelnen Familienmitglieder im Generationengefüge und eine Pluralisierung individueller Generationenzugehörigkeiten mit sich und führt so zu verstärkten (inter-)subjektiven Aushandlungsprozessen und einer Neubestimmung von familialen Rollen. Gleichzeitig ist die Arbeit als ein Kulturvergleich zwischen ostdeutschen und süditalienischen Familien angelegt. Damit wird die Absicht verfolgt, die Funktion und Bedeutung intergenerationaler Familienbeziehungen in unterschiedlichen geschlechterkulturellen Kontexten zu untersuchen. Es handelt sich um eine qualitative Untersuchung, in deren Rahmen insgesamt 19 leitfadengestützte teilnarrative Interviews mit Müttern und Vätern eines Kindes bis max. 3 Jahre und den dazugehörigen Großmüttern durchgeführt wurden. Jeweils drei der untersuchten Familienkonstellationen stammen aus Dresden und Neapel. Aus dem empirischen Material wurde ein vierstufiges Phasenmodell des Übergangsprozesses entwickelt, welches diesen als einen Prozess der geschlechterspezifischen Elternrollendifferenzierung auf der Paarebene konzipiert. Zentral sind dabei die beiden komplementären Konzepte der natürlichen Mütterlichkeit und der fragilen Väterlichkeit. In Analogie dazu wurden für die Beziehungen der neuen Eltern zu den jeweiligen Herkunftsfamilien die komplementären Konzepte der natürlichen Matrilateralität und der fragilen Patrilateralität entwickelt, welche das Muster einer latenten intergenerationalen Asymmetrie zum Ausdruck bringen. Der Übergang in die Elternschaft wird somit als ein familiales Übergangsereignis beschrieben, welches maßgeblich zur Reproduktion einer weiblichen bzw. matrilinearen Dominanz im familialen Bereich beiträgt. Dieses Muster findet sich sowohl bei den deutschen als auch bei den italienischen Familien und kann somit in gewissem Sinne als kulturübergreifend angesehen werden. Unterschiede zwischen den beiden Untersuchungsgruppen zeigen sich hingegen mit Blick auf grundlegende Wertorientierungen, die der alltäglichen Lebenspraxis und den familialen Beziehungen zugrunde liegen. So sind die Familienbeziehungen deutscher Interviewpartner(innen) stärker durch Vorstellungen von Unabhängigkeit und Autonomiestreben (independence) charakterisiert. The thesis deals with the role of media in the life of "young" parents. The theoretical part presents the current trends in the attitude to printed and online media for a selected target group, specifically women and men on maternity and parental leave. The principal question of the thesis is the attitude of a selected group of people to the media content. Has the relation to the media subjectively changed in this new life role? The research method is a qualitative interview with ten respondents (seven women and three men). The analysis is based on methods of grounded theory - first at the level of open coding, then the axial coding. The conclusion summarizes the researched findings, and among other things, whether the interviewees see changes in their relation to the media due to parenthood and if they do, which changes they realize.
