For this, the study presents a discussion of the evolution process of science in society, presenting the concept of Weber's bureaucracy correlated to the concept of Schumpeter called "creative destruction." From this context, it is shown how competition leads to a process of construction and deconstruction of new products and processes, creating new technologies and methodologies that overlap the previous ones, in a continuous process of development. It also demonstrates how, in the context of the renovation of the State, public organizations need to be constantly innovating and seeking new ways of service delivery, to ensure citizens' satisfaction and, consequently, the legitimacy of its political actors. Finally, it is analyzed the concept of bureaucracy and "creative destruction" applied to public institutions through a brief explanation of the process of reforms in the public sector in the world and in more detail in Brazil. As an example of the innovative actions of public institutions, the case of Poupatempo Program of the Government of the State of São Paulo, showing in details its conception, structure and technological tools. / Este trabalho contribui para os estudos de Ciência, Tecnologia e Sociedade à medida que analisa a inovação nos serviços públicos, através da aplicação de conceitos de burocracia e inovação às instituiçãos públicas. Para tanto, realiza-se uma discussão do processo de evolução da ciência na sociedade, apresentando o conceito de burocracia de Weber correlacionado ao conceito de Schumpeter chamado destruição criadora . A partir deste contexto, discorre-se sobre como a concorrência leva a um processo de construção e desconstrução de novos produtos e processos, criando novas tecnologias e metodologias que se sobrepõem às anteriores, em um processo contínuo de desenvolvimento. A análise se detém sobre como, no contexto da reforma do Estado, as instituições públicas têm de se inovar constantemente, buscando novas formas de provisão de serviços, para garantir a satisfação dos cidadãos e, consequentemente, a legitimidade de seus atores políticos. Finalmente, analisa-se o conceito de burocracia e destruição criadora aplicado às instituições públicas, através de breve explanação sobre o processo de reformas no setor público no mundo e mais detalhadamente no Brasil. Para exemplificar as ações inovadoras das instituições públicas, é apresentado o caso do Programa Poupatempo, do Governo do Estado de São Paulo, expondo com detalhes sua concepção, estruturação e ferramentas tecnológicas.

O presente estudo tem por finalidade analisar as aproximações entre o tratamento conferido à noção de serviço público no direito francês e no direito da União Europeia. Utilizando-se de pesquisa bibliográfica, analisa-se, primeiramente, o desenvolvimento da concepção de serviço público no direito francês, discorrendo sobre a noção clássica e identificando os principais elementos que caracterizam o instituto atualmente. Após, examina-se a evolução da abordagem da questão no direito comunitário, delineando-se as noções forjadas no âmbito da União Europeia. Por fim, do cotejo entre o tratamento do tema no direito francês e no direito comunitário, destacam-se as aproximações encontradas, concluindo-se pela assimilação, por parte das instituições europeias, dos principais aspectos caracterizadores da noção francesa, mediante a consagração de novas expressões passíveis de serem compreendidas por todos os Estados-membros e cujo conteúdo reflete a realização das adequações necessárias à realidade da União Europeia, sobretudo no que diz respeito às atividades de interesse geral dotadas de caráter econômico. / This study aims to analyze the treatment given to the notion of public service both in french law and in European Union law. Using bibliographic research, it first analyzes the notion developped in french law, by reviewing the classic notion and identifying the main elements that characterize the institut nowadays. After that, it examines how the subject approach evoluted in the European Union, tracing the notions forged by it. At last, after the comparison between how the subject is treated under the french and the European Union law, the approaches are outlined, concluding that the European Union institutions assimilated the main aspects that characterizes the french notion, by the consecration of new expressions that can be understood by all member States, and which content reflects the necessary adjustments to the reality of the European Union, especially with regard to the activities of general interest endowed with economic character.

nÃo hà / O papel das instituiÃÃes no desenvolvimento econÃmico vem ganhando cada vez mais espaÃo nos debates acadÃmicos. Nessa discussÃo, o Estado desempenha uma funÃÃo fundamental. Mas, para entender melhor a relaÃÃo entre esses trÃs: instituiÃÃes, Estado e desenvolvimento, à necessÃrio conhecer o fator que os une, ou seja, a polÃtica.O principal objetivo deste trabalho à analisar a relaÃÃo entre a competiÃÃo polÃtica, a aÃÃo dos grupos de interesse e a oferta de serviÃos pÃblicos nos municÃpios do CearÃ. A competiÃÃo polÃtica foi medida por variÃveis que indicam alternÃncia de poder no executivo e legislativo, bem como o alinhamento polÃtico entre as diferentes esferas de governo. Os grupos de interesse foram denotados pelos doadores, Pessoas FÃsicas e Pessoas JurÃdicas, de campanha dos prefeitos e vereadores eleitos e a oferta de serviÃos pÃblicos foi medida pelo Ãndice de Desenvolvimento Social de Oferta (IDS-O).Montou-se um painel com os anos de 2005 e 2009 para todos os 184 municÃpios cearenses. Estimou-se um painel com efeitos aleatÃrios. Foram feitas duas estimaÃÃes, em uma delas excluiu-se o municÃpio de Fortaleza por este se destacar dos demais em termos de desempenho econÃmico. NÃo foram encontradas diferenÃas significativas nas duas estimaÃÃes. Os resultados mostram que, os municÃpios que possuem menor nÃvel de competiÃÃo sÃo os que apresentam maior IDS-O. Quanto à aÃÃo dos grupos de interesse, os grupos formados por Pessoas JurÃdicas, desde que sejam nÃo coesos, sÃo preferÃveis na medida em que impactam positivamente na oferta de serviÃos pÃblicos. / The role of institutions in economic development is gaining more space in academic debates. In this discussion, the State plays a key role. To better understand the relationship between institutions, State and economic development, it is necessary to explore the factor that connects them, namely, politics. The main objective of this paper is to analyze the relationship between political competition, the action of interest groups and public provision of services in the counties. Political competition was measured by variables that indicate alternation of power in the executive and legislative branches, as well as the political alignment between the different spheres of government. Interest groups were denoted by donors, Individuals and Legal Entities, for the campaign of mayors and elected councilors, and the provision of public services was measured by the Index of Social Development of Supply (IDS-O). With information from the 184 cities in the state of CearÃ, for the years of 2005 and 2009, the data was assembled in a panel which estimated considering random effects. There were two models: the city of Fortaleza was excluded from one of them because its economic performance was superior to the other citiesâ; in the results, however, there were no significant differences. The results also show that the municipalities that have lower competition level are those with higher IDS-O. Regarding the action of interest groups, the ones formed by corporations, provided they are not cohesive, are preferable to society since they influence public services in a positive way.

Specifically, it investigates if the governmental performance, that is, the set of economic and political evaluations, and the evaluation of public services, are relevant to the support to democracy in the country. Unlike studies of specialized literature, this present research incorporates the experience and the evaluation of public services - at individual level - as a constitutive aspect of governmental performance and it puts special attention to these effects on the analyses. nÃo hà / A presente pesquisa tem por objetivo fornecer subsÃdios teÃricos para reflexÃo no campo da avaliaÃÃo educacional frente Ãs prÃticas adotadas na educaÃÃo de jovens e adultos das sÃries iniciais do ensino fundamental e se estas favorecem ou nÃo o exercÃcio do direito à educaÃÃo, centrado no carÃter de permanÃncia, acesso e inclusÃo escolar do aluno. Para tanto, descortinou-se neste ensaio a âteceturaâ entre as concepÃÃes histÃricas da avaliaÃÃo no cenÃrio da educaÃÃo de jovens e adultos, da subjetividade individual e social que dÃo sustentaÃÃo à formaÃÃo da cultura escolar, por meio de suas falas, dialogicidade, relaÃÃes sociais e da avaliaÃÃo enquanto prÃtica pedagÃgica adotada na EJA. A problemÃtica pode ser traduzida na seguinte questÃo: a prÃtica avaliativa adotada no cenÃrio da EducaÃÃo de Jovens e Adultos em Escolas da Rede PÃblica de Fortaleza favorece o processo de permanÃncia do aluno na escola, corrobora para sua inclusÃo no seio da sociedade e por sua vez, no exercÃcio do direito à educaÃÃo? O trabalho està assentado em pesquisa de cunho bibliogrÃfico, documental e de campo. No campo, buscou-se adotar enquanto instrumentais o questionÃrio aplicado a dez por cento dos professores da rede pÃblica municipal e o grupo focal, aplicado com 06 alunos em escola da Regional seis, onde se procurou pontualizar o âmodus operandiâ da prÃtica avaliativa frente à possibilidade de cumprimento da funÃÃo social de incluir o aluno na escola e na sociedade. O ato de revolver e vasculhar a temÃtica da avaliaÃÃo enquanto prÃtica pedagÃgica na EducaÃÃo de Jovens e Adultos possibilita que o problema ocupe um espaÃo epistemolÃgico significativo, principalmente quando referenciadas Ãs inÃmeras variÃveis que entrecortam o trabalho do professor na construÃÃo de uma prÃtica avaliativa humanizada. ApÃs breve excursÃo sobre as concepÃÃes assinaladas, chega-se a enunciar como uma das principais consideraÃÃes finais, que o ato de avaliar està preso à formaÃÃo do âhabitusâ do capital cultural internalizado. / The present research aims to supply theoretical subsidies for reflection in the field of the educational evaluation facing the practices adopted in the education of youth and adults in the initial series of basic education and if these benefit or not the exercise of the education right, focused on the permanence aspect, access and scholar inclusion of the pupil. So, the âweavingâ was disclosed in this essay among the historical conceptions of the evaluation in the scene of youth and adults education, of the individual and social subjectivity that supports the schooling culture formation, through its speech, dialog aspect, social relations and evaluation concerning the adopted pedagogic practice in YAE. The topic might be translated into the following question: the evaluative practice adopted in the scene of the and Adults and Youth Education in Public Schools of Fortaleza suggests the permanence process of the pupil in the school, corroborates for its inclusion in the heart of society and then, in the exercise of education right? The work is based on bibliographical, documental and realistic experiments research. Through the experiments, we tried to adopt, as instrumentals, the commonly applied survey to ten percent of the MUNICIPAL public school teachers and the focused group, applying with 06 students from Regional VI schools, where we tried to point the âmodus operandiâ of the evaluative practice concerning the possibility of compliance of the social role of including the pupil in the school and in the society.Th e act of digging and searching the thematic of the evaluation as a pedagogical practice in Youth and Adult Education allows the problem to occupy a significant epistemologic space, mainly when we refer to the several variable aspects that cross the work developed by the teacher in the construction of a humanized evaluative practice. After an excursion on the designated conceptions, we can announce it as one of the main final considerations, which the act of evaluating is tied to the formation of the internalized âhabitusâ culturally.

Políticas públicas sobre as mais diversas dimensões socioeconômicas têm sua avaliação tipicamente estruturada acerca de seus retornos efetivos, observáveis após sua instaura ção, e sua implementação conduzida leviana ou ao menos ingenuamente no que diz respeito ao seu potencial de sucesso e aos recursos empreendidos. Um aspecto alternativo de avaliação, por outro lado, consiste na contemplação de políticas quanto ao seu impacto potencial previamente à sua implementação, questionando-se os interesses dos envolvidos em sua aplicação. Ou seja, temos no estudo de trade-off\'s de economia política permeando a sua prática um componente fundamental. Por meio da análise de uma particular reforma de descentralização, procuramos investigar de que modo se configuram as preferências governamentais sobre plataformas políticas e, com isso, o potencial apresentado por mecanismos de escolha pública em promover os resultados pretendidos para os programas. Levando em consideração a associação de cenários de descentralização das responsabilidades políticas a esforços de aprendizado { possivelmente social { por parte dos governos locais, direcionamos tal foco à investigação de quais informações sobre os distintos efeitos da provisão recém-assumida têm sua captação mais valorizada por tais governantes. Resumidamente, apresentamos evidências de que o processo de decisão político é basicamente motivado por questões eleitorais - sobrepondo-se a interesses genuínos e diretos quanto ao bem-estar social - e de que o alinhamento partidário entre governantes pode representar um fator essencial ao pleno exercício de políticas públicas. / Public policies over several economic dimensions are usually subject to an evaluation built on its observable impacts, following their implementation, and are thus associated with a naive conduction with respect to the employed resources. An alternative aspect of evaluation comprehends, on the other hand, the analysis of potential effects of such policies and the interests of the agents responsible for their coordination. In other words, we believe that the study of political economy trade-offs is an essential component for understanding and improving political practice. By analyzing a specific decentralization reform we proceed to the determination of how officials\' preferences over policies are configured and question the potential of public choice mechanisms in promoting the originally intended results. While acknowledging that decentralization programs are typically characterized by the lack of experience of local governments in conducting the decentralized policies and thus by a (possibly social) learning effort with respect to several of the policies\' details, we investigate what kind of information about policy outcomes are mostly valued by the officials involved. In short, we present evidence that the politicians\' decision making proc- ess is fundamentally based on electoral and opportunistic considerations - above ideology issues - and that party cohesion among officials may constitute an essential factor to the appropriate exercise of public policies.

There are analyzed in this dissertation thesis the public services delivered on the municipal level. This issue is analyzed comprehensive at first. There are analyzed six services in detail after then. These are the six following services: waste, cemetery, greenery, communications, lighting and sewage. The text of this thesis is divided into two major units. The first chapter describes the theoretical background of the problem and the methodology for elaboration. The second chapter analyzes the problem of public services in terms of theoretical con-cepts, legal terms and authors own investigation. This chapter analyzes in detail six selected public services. It is completed draft measures for the municipal public ser-vices. The aim of this dissertation thesis is to find out the State-of-Art of public service deli-vering and to purpose possible changes leading to demand approach of municipal service delivering.

The Czech Republic started to issue implementing quality standards in public services addressed to a greater extent especially in times of public administration reform, when the transfer of responsibilities to local government units and based on efforts to bring these services to the citizens. This thesis describes the approach of the Czech Republic to public services, and further analyzes the implementation of quality standards in these services. Aim of this work is to examine whether public services are defined in the Act and at what stage is the introduction of standards for selected services to these laws and implementing regulations. Part of this work is to evaluate the different sectors, which indicates at what stage is the process of standardization in these sectors.

Main aim of my thesis is to make analysis of eGovernment in the Czech Republic. Analysis is divided into two parts – theoretical part contains legislation in eGovernment and possibilities which can eGovernment offer to inhabitants. Second part is focused on research of electronic services which are located on the web sites of public services. The main gain of this work is assembly of the most important services in eGovernment.
