This work is devoted to problems of support systems of families with handicap children. The aim of this work is exploring the support systems of families with handicap children in the Czech Republic. (There is possibility to compare the region of Prague and Pardubice.) The theoretical part describes basic characterization of disability, it is intent on families who are take care of children with disability, it describes too social network and it also points out the common problems of the social care for individuals with handicap and possibilities of support goups. In order to achieve the aim of this work, it was necessary to obtain needful data. Therefore, a structured interview was used as one of the techniques of qualitative research. Among those who were interviewed were parents of handicap children. Because there are only twenty families in the research group of this diploma thesis it is not possible to generalize obtained information for all families with handicap children. The Brazilian Civil Code, published in 2002, despite the ability to relate to the constitutional system of protection of human dignity, not encompassed in its content the admission of full autonomy of persons with disabilities. Nevertheless, the Federative Republic of Brazil became a signatory to the International Treaty on the Rights of Persons with Disabilities, which promoted a paradigm shift on the focus of the concept of disability, which, of course, sparked a significant impact on the study of theories of disabilities and its corollaries. Brazilian law inclusion of people with disabilities (Law no. 13,146 - 2015), called the Disabled status, in obedience to the fundamental principles of the Convention on the Rights of Persons with Disabilities, raised transformation in the parental system of disability and, consequently, the procedural issues relating to the protection of the disabled person. The changes brought about by People with Disabilities Statute generated sequels in the Civil Law inherent institutions such as marriage and interdiction, and Civil Procedure, like the reflections in prescription and decay and the institution of the new decision-making tool supported. / Após a ratificação em 2009 por parte do Brasil da Convenção sobre os Direitos da Pessoa com Deficiência, editada em 2007, a sistemática jurídica atinente à teoria das incapacidades e seus desdobramentos sofreu modificações intensas. O Código Civil brasileiro, editado em 2002, em que pese a aptidão para se relacionar com a sistemática constitucional de proteção da dignidade da pessoa humana, não abarcou em seu conteúdo a admissão da integral autonomia das pessoas com deficiência. A despeito disso, a República Federativa do Brasil se tornou signatária do Tratado Internacional sobre os Direitos das Pessoas com Deficiência, sendo promovida uma mudança paradigmática sobre o enfoque do conceito de deficiência, o que, naturalmente, deflagrou consequências significativas no estudo das teorias das incapacidades e seus corolários. A lei brasileira de inclusão da pessoa com deficiência (Lei nº. 13.146-2015), denominada de Estatuto da Pessoa com Deficiência, em obediência aos preceitos fundamentais da Convenção sobre os Direitos das Pessoas com Deficiência, suscitou transformação no sistema pátrio de incapacidade e, por consequência, nas questões processuais relativas à proteção da pessoa com deficiência. As mudanças trazidas pelo Estatuto da Pessoa com Deficiência geraram sequelas em institutos inerentes ao Direito Civil, como o casamento e interdição, e Processual Civil, a exemplo dos reflexos na prescrição e decadência e na instituição do novo instrumento de tomada de decisão apoiada.

Longtemps ignorés ou déniés, des faits de maltraitance sont aujourd’hui régulièrement signalés et reconnus comme avérés dans des institutions qui accueillent des personnes en situation de handicap. Pour les prévenir, il est préconisé de former le personnel et même de rendre cette thématique obligatoire dans la formation initiale des différents accompagnants. Cependant, pratiquement rien n’est dit sur le contenu des formations à dispenser, ni les modalités pédagogiques à mettre en œuvre. Cette thèse analyse un programme de formation et ses retombées. Ce programme a été élaboré dans une perspective de prévention active en prenant en compte l’évolution du concept de maltraitance, la nécessité d’un travail préalable sur ses représentations et l’option d’une vision écosystémique de cette problématique. Il propose trois modalités pédagogiques distinctes afin d’en vérifier les retombées. Il est dispensé à des travailleurs sociaux en dernière année d’une formation initiale. Notre démarche vérifie l’hypothèse que des changements de représentations sur ce qu’est la maltraitance et ses facteurs de protection surviennent en cours de formation et que ces derniers pourront amener le déploiement d’actions spécifiques afin de la prévenir. Elle permet d’une part de dessiner des perspectives méthodologiques pour l’analyse d’une telle formation et d’autre part de faire des recommandations quant aux contenus et aux modalités pédagogiques à prioriser. / Long ignored or denied, incidents of abuse are now regularly reported and recognized as commonplace in institutions catering for people with disabilities. It is widely recommended that staff should receive training in order to help prevent such abuse, and even that such training modules should now be made compulsory in initial training programmes for all staff working directly with residents. However, virtually nothing is said about the content of such courses, nor about the pedagogical approaches that should be adopted. This thesis analyses such a training program and its outcomes. The programme was conceived with a view to improving active prevention, taking into account the evolution of the concept of abuse, the need for prior work on representations of abuse and the option of an eco-systemic approach to the issue. In order to better understand outcomes, three distinct pedagogical approaches were included. The programme is proposed to social workers during the final year of their initial training. Our approach tests the hypothesis that changes in representations of what constitutes abuse and its factors of protection occur during the training course and may result in specific preventive action. It allows us to develop the methodological approaches needed to analyse such a training programme and also to make recommendations regarding the content and the adoption of appropriate pedagogical methods.
