One of the main objectives of any legal system is legal certainty, which is understood as the provision of decisions in the work of the courts. To this end, in order to standardize the diversity of decisions of courts for the same conflict, there are meetings of supreme judges who seek to give a unique sense of resolution to the same conflict. Those meetings are called Cassation Plenaries.In this article, the author comments and develops the decision taken at the IX Civil Cassation Plenary. At that meeting a broad criterion of manifested nullity has been chosen, whenever the causal is “easy to warn”. However, throughout the text the author highlights the methodological vices of the Supreme Court to reach this conclusion and, using a legal comparison, proposes a different criterion of manifest nullity, demonstrating that for our legal system this should not be restricted to an “easy to warn” causation. / Uno de los objetivos principales de todo sistema normativo es la seguridad jurídica, la cual se entiende como la previsión de las decisiones en la labor de las cortes judiciales. Con dicho propósito, a fin de uniformizar la diversidad de decisiones de las cortes para un mismo conflicto, existen reuniones de jueces supremos las cuales buscan dar un sentido único de resolución a un mismo conflicto. Aquellas reuniones son denominadas Plenos Casatorios.En el presente artículo, el autor comenta y desarrolla la decisión tomada en el IX Pleno Casatorio Civil. En dicha reunión se ha optado por un criterio amplio de nulidad manifiesta siempre que la causal sea “fácil de advertir”. Sin embargo, a lo largo del texto el autor pone en evidencia los vicios metodológicos de la Corte Suprema para llegar a esta conclusión y, recurriendo a la comparación jurídica, propone un criterio distinto de nulidad manifiesta, demostrando que para nuestro ordenamiento jurídico esta no se debe restringir a una causal “fácil de advertir”.

The opening of Peru to foreign markets in the past 20 years is a consequence of the signature of several Free Trade Agreements (FTA) with our main partners in business, both on a bilateral and multilateral level. In this article, on the one hand, important changes to customs regulations concerning obligations arose from the signature of several FTA will be analyzed and, on the other hand, a comparative analysis regarding regulations about facilitation of commerce and customs procedures contained in FTA signed with our main Asian partners in business will be developed. / La política de apertura comercial que el Perú ha venido impulsando desde hace más de 20 años ha originado la suscripción de sendos acuerdos comerciales con nuestros principales socios comerciales tanto a nivel bilateral como multilateral. En el presente artículo, de un lado, se desarrollan los importantes cambios generados en la normativa aduanera con ocasión de las obligaciones emanadas de la suscripción por parte del Perú de diversos TLC; y, de otro, se efectúa un análisis comparativo de las disposiciones en materia de facilitación del comercio y procedimientos aduaneros contenidas en los TLC suscritos con nuestros principales socios comerciales del Asia.

Inside the Peruvian civil process, there are warranties that seek to protect the rights of the persons who come to it. Since these warranties  are  affirmed in the   Peruvian Constitution and in international human rights treaties, they are considered as fundamental rights. One of them is the right to a second hearing.The present essay is a constructive critic of the principle of the right to appeal. The hypothesis consists in proving, through an economic analysis,  that  the  second hearing does not play a role in our legal system. / Dentro del proceso civil peruano, existen garantías que buscan la protección de los derechos de las personas que acuden al mismo.Estas garantías, al estar consagradas en laConstitución peruana y en tratados internacionales sobre derechos humanos, son con-sideradas  derechos  fundamentales.  Una de ellas es la doble instancia.El presente ensayo es una crítica constructiva al principio de doble instancia. La hipótesis que se sustenta consiste en acreditar a través de un análisis económico que la doble instancia no cumple una función en nuestro sistema jurídico.

Le Système d’Upwelling Péruvien (PUS) et la Zone à Oxygène minimum (OMZ) qui y est associée font partie des régions les plus marquées par les variations climatiques de type El Niño Southern Oscillation (ENSO), tant à l’échelle interannuelle qu’à l’échelle décennale. Or, peu d’enregistrements de l’impact de l’ENSO sur cette zone géographique atteignent ces résolutions temporelles, malgré des conditions propices à la conservation de dépôts sédimentaires laminés.Nous avons analysé ces archives sédimentaires à l’échelle de la lamine et en utilisant des marqueurs sédimentologiques, micro paléontologiques et géochimiques afin de retracer les variations de tous les paramètres susceptibles de répondre aux changements climatiques(précipitations, productivité, dénitrification, températures océaniques de surface). Cette approche nous a permis de disposer d’un enregistrement complet des conditions environnementales dans l’OMZ du Pérou à des échelles pluri-annuelle à multidécennale, ce qui est inégalé sur des périodes au-delà du dernier millénaire. Nous avons ainsi pu mettre en évidence une forte empreinte de la circulation de Walker sur le PUS. Cet impact est modulé par les régions extra tropicales de l’hémisphère Nord, en particulier par l’Oscillation Nord-Atlantique (NAO) à l’échelle multidécennale, par la circulation thermohaline à l’échelle centennale et par l’Anticyclone Sibérien à l’échelle millénaire. / The Peruvian Upwelling System (PUS) and the corresponding Oxygen Minimum Zone (OMZ) are part of the regions where the imprint of climatic variations due to El Niño Southern Oscillation (ENSO) at the interannual and multidecadal timescales is the strongest. However,only a few records of ENSO-like climatic variability reach such short timescales in thisgeographical area, despite prevailing conditions favorable to the preservation of laminatedsediments. We analyzed these sedimentary archives at the scale of the lamination, using sedimentology, micropaleontology and geochemistry. The aim was to trace variations in all parameters responding to climatic changes (rainfall, productivity, denitrification, sea surfacetemperatures). This approach has provided a full record of environmental conditions in thePeruvian OMZ at multiannual and multidecadal timescales for the first time on time intervals exceeding the last millennium. We thus evidenced a strong imprint of the Walker circulation on the PUS. This impact is paced by the extratropical northern hemisphere, especially by the North Atlantic Oscillation (NAO) at the multidecadal timescale, by the thermohaline circulation at the centennial timescale and by the Siberian High at the millennial timescale.

La presente investigación tiene como objetivo principal determinar los factores que influyen en la internacionalización de empresas pymes exportadoras de la selva peruana de cacao en grano, entre el periodo 2009 al 2019, puesto que el sector cacaotero en los últimos años ha presentado un alto crecimiento a nivel nacional y la presente investigación se centra en encontrar los factores que son fundamentales para que las pymes ingresen su producto al mercado exterior. Dentro de esta investigación se aplicaron encuestas en escala de Likert a una muestra de 31 empresas pymes exportadoras de la selva peruana de cacao en grano, a fin de obtener resultados a través del método cuantitativo. En base a la metodología, la presente investigación tiene un diseño descriptivo no experimental a nivel correlacional con enfoque cuantitativo. La información se analizó en el programa SPSS con la prueba de regresión logística. Como resultado, se obtuvo que cinco de las diez variables analizadas son significativas para la internacionalización de las pymes exportadoras de la selva peruana del cacao en grano. / The main objective of this research is to determine the factors that influence the internationalization of exporting SMEs of the Peruvian rainforest of cocoa beans, between the period 2009 to 2019, since the cocoa sector in recent years has presented a very high growth and this research focuses on finding the factors that are essential for small and medium-sized companies to enter their product on the foreign market. Within this research, Likert scale surveys were applied to a sample of 31 exporting SMEs from the Peruvian rainforest of cocoa beans, in order to obtain results through the quantitative method. Based on the methodology, this research has a descriptive non-experimental design at a correlational level with a quantitative approach. The information was analyzed in the SPSS program with the logistic regression test. As a result, it was obtained that five of the ten variables analyzed are significant for the internationalization of exporting SMEs from the Peruvian rainforest of cocoa beans. / Tesis

En todo el mundo, las explotaciones petroleras por lo general están ubicadas en espacios alejados de las ciudades o centros de procesamiento. Esa condición plantea un problema muy interesante referente al transporte del crudo de los centros de extracción a los centros de refinamiento o comercialización y el Perú no escapa a esta problemática. Por otro lado, se encuentran desafíos para la utilización del oleoducto de manera eficiente donde se permita mejorar la competitividad del sector hidrocarburos. Por ello, en la presente investigación estudiaremos los desafíos que enfrenta el Oleoducto Norperuano (ONP) como parte de la cadena logística del crudo de petróleo de los campos de la Amazonía Peruana. El objetivo de la investigación es conocer si el ONP sigue siendo la mejor alternativa logística para el transporte de crudo de petróleo de los campos petrolíferos ubicados en la Amazonía peruana. A tal efecto se ha realizado una investigación cualitativa, en la cual se han utilizado las opiniones de expertos en el área petrolera, mediante la realización de entrevistas personalizadas y a profundidad. Los resultados obtenidos del trabajo de investigación se presentan de la siguiente manera: el ONP es la mejor y más importante alternativa para el transporte del crudo de la Amazonía a los centros de refinación, comercialización y posterior exportación. También se hace necesario implementar programas de mantenimiento preventivo y correctivo con el fin de garantizar su funcionalidad. / Around the world, oil fields are usually located in spaces far from cities or remote areas. This condition generated a very interesting problem regarding the transportation of oil crude from the extraction centers to the refining or commercialization centers, and Peru does not escape of this problem. On the other hand, there are challenges for the efficient use of the pipeline where it is possible to improve the competitiveness of the hydrocarbon sector. Therefore, in this research we will study the challenges faced by the North Peruvian Pipeline (ONP) as part of the oil crude logistics chain from the fields of the Peruvian Amazon. The objective of the research is to know if the ONP can be consider the best logistical alternative for the transportation of crude oil from the oil fields located in the Peruvian Amazon. To this end, a qualitative investigation has been carried out, in which the opinions of experts in the oil field have been used, through personalized and in-depth interviews. The results obtained from the research work are presented as follows: the ONP is the best and most important alternative for transporting crude from the Amazon to refining, marketing and subsequent export centers. It is also necessary to implement preventive and corrective maintenance programs in order to guarantee its functionality. / Tesis

El periodismo especializado en música en el Perú, no es una rama que haya sido desarrollada con mucha frecuencia. Si bien sí han existido diferentes medios impresos que se han atrevido a publicar este tipo de información hace años, en la actualidad son casi escasos. Frente a ello, surgen diferentes plataformas en el mundo virtual, dispuestas a producir contenido periodístico musical. A raíz de ello, se decidió abordar este ámbito del periodismo digital especializado, tomando como casos a las plataformas peruanas Tercer Parlante, Conciertos Perú y Garaje del Rock. Este trabajo tiene como tema principal, realizar un análisis descriptivo de los tipos de relatos. Ya sean notas informativas, crónicas, reseñas y entrevistas, de las tres plataformas ya mencionadas. Asimismo, se busca descubrir si la información brindada por estas plataformas, es periodística. Para esto, se utilizó una metodología descriptiva e interpretativa y se hizo una observación a las publicaciones de los años 2017 hasta 2020, de las tres plataformas. Asimismo, se utilizaron las fichas como instrumento de investigación. Estas dos fichas se sub- dividieron en dos categorías. En la primera categoría, se describió la estructura de la página, se identificaron las secciones y la frecuencia con la que publican. Mientras que en la segunda categoría, se describieron los titulares, la agenda, el manejo de fuentes, los tipos de relatos, el manejo de lenguaje especializado y el uso de recursos digitales. Una vez terminada la investigación, se llegó a la conclusión de que estas plataformas sí brindan material periodístico especializado. / Music journalism in Peru is not a branch that has been developed very often. Although there have been different print media that have dared to publish this type of information years ago, nowadays they are almost scarce. Faced with this, different platforms emerge in the virtual world, willing to produce musical journalistic content. As a result, it was decided to address this area of specialized digital journalism, taking as cases the Peruvian platforms Tercer Parlante, Conciertos Perú and Garaje del Rock. This investigation's main theme is to carry out a descriptive analysis of the types of stories. Whether they are informative notes, chronicles, reviews and interviews, of the three platforms already mentioned. Likewise, it seeks to discover if the information provided by these platforms is journalistic. For this, a descriptive and interpretive methodology was used and an observation was made of the publications from the years 2017 to 2020, from the three platforms. Likewise, the files were used as a research instrument. These two files were subdivided into two categories. In the first category, the structure of the page was described, the sections and the frequency with which they publish were identified. While in the second category, the headlines, the agenda, the handling of sources, the types of stories, the handling of specialized language and the use of digital resources were described. Once the investigation was completed, it was concluded that these platforms do provide specialized journalistic material. / Trabajo de investigación

Durante la década de los 90s, el Perú se encontraba en una situación política inestable debido a conflictos internos previos y a cambios que ocurrían en el mundo. La población, entonces, adopta una actitud pragmática en búsqueda de la reconstrucción nacional; actitud que puede verse reflejada en la producción artística de la época. Frente a este contexto, el presente trabajo de investigación busca analizar cómo se representa el hedonismo en los videos musicales de la banda peruana “Nosequien y los Nosecuantos” durante los años 90. Para su desarrollo; en un primer momento, se explicará el papel del videoclip dentro del proceso comunicativo. Posteriormente, definiremos el hedonismo como doctrina moral. Y, por último, se describirá el contexto sociocultural de los 90s en el Perú. Este artículo de investigación se basará en una visión del mundo interpretativa y se realizará bajo un enfoque cualitativo. Asimismo, la técnica metodológica que se usará para la obtención de datos será la del análisis de contenido. / During the 1990s, Peru was in an unstable political situation due to previous internal conflicts and changes that occurred in the world. Population, then, adopts a pragmatic attitude in search of national reconstruction; attitude that can be seen reflected in the artistic production of the time. In this context, this research work seeks to analyze how hedonism is represented in the music videos of the Peruvian band “Nosequien y los Nosecuantos” during the 90s. For its development, at first; the video clip role in the communication process will be explained. Subsequently, hedonism will be defined as a moral doctrine. And finally, the sociocultural context of the 90s in Peru will be described. This research article will be based on an interpretive worldview and will be done with a qualitative approach. El presente trabajo de investigación (Optimeal) comprende diversos temas acerca de cómo se desarrollará la formulación e implementación de la marca de suscripción nutricional, Optimeal. Esta ofrece una variedad de platos saludables y agradables a base de los mejores ingredientes en el mercado de Lima, Perú así como la implementación de una dark kitchen. El objetivo de este proyecto es presentar a posibles inversionistas un modelo y un plan de negocio rentable y escalable, que tiene el añadido de ser sostenible. Se inició este trabajo de investigación con el proceso de ideación de la idea de negocio, dentro del cual se describe el modelo de negocio. Seguidamente, se desarrolló el proceso de validación del problema a través de experimentos. Producto de ello, se definió el segmento de clientes, así como el tamaño de mercado considerando la solución propuesta. Posteriormente, se diseñó el plan concierge por medio del cual se validan las ventas, y con ello se armó la proyección de ventas para tres años, considerando distintas variables. Tomando en cuenta los resultados de la proyección, se elaboraron los planes para el proyecto: Plan Estratégico, Plan de Operaciones, Plan de Recursos Humanos, Plan de Marketing y Plan de Responsabilidad Social Empresarial. Finalmente, la realización del Plan Financiero ha permitido conocer la factibilidad del proyecto gracias al análisis del pronóstico de ventas, costos, gastos, inversión y capital de trabajo. Así mismo, nos apoyamos en los indicadores financieros pertinentes para medir la efectividad de la administración del negocio y generar valor para los accionistas. / This research work (Optimeal) covers various topics about how the formulation and implementation of the nutritional subscription brand, Optimeal, will be developed. It offers a variety of healthy and pleasant dishes based on the best ingredients in the market in Lima, Peru, as well as the implementation of a dark kitchen. The objective of this project is to present potential investors in a profitable and scalable business model and plan, which has the added value of being sustainable. This research work began with the ideation process of the business idea, within which the business model is described. Next, the validation process of the problem was developed through experiments. As a result, the customer segment was defined, as well as the market size considering the proposed solution. Subsequently, the concierge plan was designed through which sales are validated, and with this the sales projection for three years was put together, considering different variables. Taking into account the results of the projection, the plans for the project were prepared: Strategic Plan, Operations Plan, Human Resources Plan, Marketing Plan and Corporate Social Responsibility Plan. Finally, the realization of the Financial Plan has allowed us to know the feasibility of the project thanks to the analysis of the sales forecast, costs, expenses, investment and working capital. Likewise, we rely on the relevant financial indicators to measure the effectiveness of the business administration and generate value for shareholders. / Trabajo de investigación
