The legal construction of migrant work relations : precarious status, hyper-dependence and hyper-precarity

This thesis is concerned with the ways in which the laws and policies governing labour migration shape the relationship between migrant workers, employers, and labour markets in advanced industrialised countries. Specifically, it elucidates the intersections of immigration and labour market regulatory norms, structures, and processes that have salient implications for migrants’ work relations. The notions of ‘hyper-dependence’ and ‘hyper-precarity’ are developed as the main analytical and normative lenses in this thesis for examining the particular vulnerabilities associated with migrants’ precarious statuses under contemporary labour migration regimes. Hyper-dependence refers to an acute dependence that transcends the immediate context of an employment relationship, where other aspects of a worker’s life critically depend on that employer. For migrant workers, hyper-dependence may arise where their legal statuses is tethered to a specific employer sponsorship, accompanied by other de jure and de facto restrictions on their labour mobility. Hyper-precarity seeks to capture the multifaceted insecurities and uncertainties in migrants’ work relations and their broader migration projects, which are linked to their exclusion, in law and in practice, from a wide array of social, economic, and civil rights in the host state. Engaging with the various and often competing goals and concerns of immigration law and labour law, the two concepts of hyper-dependence and hyper-precarity are developed and applied through an in-depth comparative analysis of the legal and regulatory architectures of two contemporary temporary migrant workers’ programmes (TMWPs): Australia’s Temporary Work (Skilled) Subclass 457 Visa (‘457 visa’) scheme and the United Kingdom’s Tier 2 (General) visa scheme. In recent years, TMWPs in advanced industrialised countries have been touted by global and national policymakers as a desirable labour migration instrument that delivers ‘triple wins’ for host states, home states, and migrants and their families. I situate the normative concerns of the legally constructed hyper-dependence and hyper-precarity in the ethical debates on TMWPs in liberal states. I also consider how the worst extremes of the two ‘hyper’ conditions combined in highly exploitative work relations could be ameliorated, and in doing so propose some ideas for reforming key features of current TMWPs to enable migrants to exit any employment relationship and to resort to a range of voice mechanisms in the workplace.

Les déterminants de la présence du programme d'aide aux employés dans les entreprises du secteur privé au Canada

L’objectif de la présente étude vise à déterminer les caractéristiques des entreprises et de leur main-d’œuvre qui adoptent un PAE. Cette pratique serait en effet distribuée inégalement entre les différentes entreprises du secteur privé au Canada. Les facteurs identifiés dans la littérature en lien avec la présence du PAE sont regroupés sous les caractéristiques de la main-d’œuvre, les caractéristiques organisationnelles ou les caractéristiques du marché du travail, de manière à faire ressortir leur valeur respective pour voir celle qui a le plus d’influence sur la présence du PAE. Pour chacun des facteurs, une hypothèse ou une proposition de recherche est formulée. Pour vérifier les hypothèses et les propositions de recherche, nous avons utilisé des données secondaires issues de l’Enquête sur le milieu de travail et les employés (EMTE), réalisée en 2005 par Statistique Canada. Nous avons principalement eu recours à la base de données des employeurs, mais à défaut d’y avoir toutes les variables importantes, celle des employés a aussi été utilisée en agrégeant les données à la moyenne échantillonnale par entreprise, et en les imputant à la composante des employeurs. Notre échantillon final se compose de 5630 établissements du secteur privé au Canada. Les résultats nous ont appris que les caractéristiques organisationnelles sont de meilleurs déterminants de la présence du PAE que les caractéristiques de la main-d’œuvre. Les PAE sont répartis de façon inégale entre les différentes entreprises au Canada. En effet, les entreprises qui adoptent un PAE ont souvent moins d’immigrants. Elles ont aussi plus de probabilité d’avoir une grande proportion d’employés ayant complété des études secondaires, et qui travaillent à temps plein. Les PAE sont de plus beaucoup plus présents dans les grandes entreprises qui sont syndiquées, et dont l’organisation du travail est plus flexible. Enfin, ce sont les entreprises du secteur primaire qui adoptent le plus de PAE. Les PAE ne couvrent alors qu’un secteur limité et privilégié de la main-d’œuvre puisque certains groupes, tels que les immigrants, y ont moins accès. Ainsi, les PAE bénéficient aux employés les plus avantagés financièrement, indiquant que ce sont surtout les plus « riches » qui accèdent aux meilleurs services de santé mentale et sociale. This practice should not be randomly distributed in firms operating in the private sector in Canada. In the literature, there are three factors that are identified to be related to the presence of an EAP : 1- workforce characteristics, 2- firm characteristics, and 3- labour market characteristics. This study search to evaluate the relative value of each factor in predicting the presence of an EAP. One hypothesis or one research proposal is made for each factor. In order to empirically test the hypotheses and the research proposals, secondary data from the Workplace and Employee Survey (WES) are used. This survey was conducted in 2005 by Statistics Canada. This survey collected data from employers and their employees. Almost all variables used in this study come from the employers’ database. The sample comprises 5,630 establishments operating in the private sector. Results show that organizational characteristics are better determinants of the presence of EAP than the characteristics of the workforce. EAPs are not randomly distributed in firms in Canada. Indeed, firms that adopt an EAP often have fewer immigrants. They are more likely to have a larger proportion of employees who have completed a high school level and working full time. EAPs are more likely to be found in larger companies that are unionized, and whose work organizations are more flexible. Compare to firms in the secondary and in the tertiary sectors, it is firms in the primary sector that are more likely to have adopted an EAP. Overall, the results of this study indicate that EAP are available only to the better off workers. These workers have access to the best social and mental services. Rétro ingénierie des modèles d’objets dynamiques pour JavaScript

La compréhension des objets dans les programmes orientés objet est une tâche impor- tante à la compréhension du code. JavaScript (JS) est un langage orienté-objet dyna- mique, et son dynamisme rend la compréhension du code source très difficile. Dans ce mémoire, nous nous intéressons à l’analyse des objets pour les programmes JS. Notre approche construit de façon automatique un graphe d’objets inspiré du diagramme de classes d’UML à partir d’une exécution concrète d’un programme JS. Le graphe résul- tant montre la structure des objets ainsi que les interactions entre eux. Notre approche utilise une transformation du code source afin de produire cette in- formation au cours de l’exécution. Cette transformation permet de recueillir de l’infor- mation complète au sujet des objets crées ainsi que d’intercepter toutes les modifications de ces objets. À partir de cette information, nous appliquons plusieurs abstractions qui visent à produire une représentation des objets plus compacte et intuitive. Cette approche est implémentée dans l’outil JSTI. Afin d’évaluer l’utilité de l’approche, nous avons mesuré sa performance ainsi que le degré de réduction dû aux abstractions. Nous avons utilisé les dix programmes de réfé- rence de V8 pour cette comparaison. Les résultats montrent que JSTI est assez efficace pour être utilisé en pratique, avec un ralentissement moyen de 14x. De plus, pour 9 des 10 programmes, les graphes sont suffisamment compacts pour être visualisés. Nous avons aussi validé l’approche de façon qualitative en inspectant manuellement les graphes gé- nérés. Ces graphes correspondent généralement très bien au résultat attendu. Mots clés: Analyse de programmes, analyse dynamique, JavaScript, profilage. / Understanding of objects in object-oriented programs is an important task for understanding the code. JavaScript (JS) is a dynamic object-oriented language, Its dynamic nature makes understanding its source code very difficult. In this thesis, we focus on object analysis in JS programs to automatically produce a graph of objects inspired by UML class diagrams from an execution trace. The resulting graph shows the structure of the objects as well as their interconnections. Our approach uses a source-to-source transformation of the original code in order to collect information at runtime. This transformation makes it possible to collect complete information with respect to object creations and property updates. From this information, we perform multiple abstractions that aim to generate a more compact and intuitive representation of objects. This approach has been implemented in the JSTI prototype. To evaluate our approach, we measured its performance and the graph compression achieved by our abstractions. We used the ten V8 benchmarks for this purpose. Results show that JSTI is efficient enough to be used in practice, with an average slowdown of around 14x. Moreover, for 9 out of the 10 studied programs, the generated object graphs are sufficiently small to be visualized directly by developers. We have also performed a qualitative validation of the approach by manually inspecting the generated graphs. We have found that the graphs generated by JSTI generally correspond very closely to the expected results. Keywords: Program analysis, dynamic analysis, JavaScript, profiling.

Le premier chapitre du travail rappelle les prémices de la radio dans le monde et présente les différentes étapes qui ont mené à la création d’un service public de radiodiffusion en Suisse, ainsi que ses premières années de développement. Le deuxième chapitre examine la construction des grilles de programmes à l’antenne et se penche sur les rôles et implications des différents acteurs qui participent au développement des émissions musicales de l’époque : programmateurs, musiciens et auditeurs. Le troisième chapitre est une étude statistique réalisée à partir d’un échantillon de programmes musicaux diffusés entre 1930 et 1939. En procédant à une catégorisation des émissions musicales recensées et à l’identification des différents auteurs/compositeurs présents dans les émissions, nous proposons une typologie des programmes et des compositeurs. Le travail est illustré par plusieurs archives sonores. / This thesis proposes a study of the musical programming of Radio Suisse Romande (RSR) in the 1930s. The first chapter of the work recalls the beginnings of radio in the world and shows the different steps that led to the creation of a public service broadcasting in Switzerland and its early years of development. The second chapter examines the construction of program schedules on the air and looks at the roles and implications of the different actors involved in the development of music programs at the time: programmers, musicians and listeners. The third chapter is a statistical study based on a sample of music programs broadcast between 1930 and 1939. In making a classification of recorded music programs and the identification of different authors/composers present in broadcasts, we propose a typology of programs and composers. The study is illustrated by several sound archives.

Essays on human capital formation in developing countries

This thesis consists of a short introduction and three self-contained analytical chapters. Chapter 1 focuses on the question of learning gaps and divergence in achievement across countries. I use unique child-level panel data from Ethiopia, India, Peru and Vietnam to ask at what ages do gaps between different populations emerge, how they increase or decline over time, and what the proximate determinants of this divergence are. I document that learning gaps between the four countries are already evident at the age of 5 years and grow throughout the age trajectory of children, preserving country ranks from 5 to 15 years of age. At primary school age, the divergence between Vietnam and the other countries is largely accounted for by substantially greater learning gains per year of schooling. Chapter 2 focuses on learning differences between private and government school students in India. I present the first value-added models of learning production in private and government schools in this context, using panel data from Andhra Pradesh. I examine the heterogeneity in private school value-added across different subjects, urban and rural areas, medium of instruction, and across age groups. Further, I also estimate private school effects on children's self-efficacy and agency. I find modest or insignificant causal effects of attending private schools in most test domains other than English and on children's academic self-concept and agency. Results on comparable test domains and age groups correspond closely with, and further extend, estimates from a parallel experimental evaluation. Chapter 3 uses panel data from the state of Andhra Pradesh in India to estimate the impact of the introduction of a national midday meal program on anthropometric z-scores of primary school students, and investigates whether the program ameliorated the deterioration of health in young children caused by a severe drought. Correcting for self-selection into the program using a non-linearity in how age affects the probability of enrollment, we find that the program acted as a safety net for children, providing large and significant health gains for children whose families suffered from drought.

Contextualising Classics teaching in Malawi : a comparative study

The thesis of this study is that Classical studies at the University of Malawi, Chancellor College, has been taught with almost no reference to its African context, yet the Classical world, as Ogilvie (1979:2) observed ‘is far removed in time, geography, and philosophy from the world of Africa'. Classics in Malawi is currently taught as in the West, with which it has immediate ties, but if there are to be meaningful gains on the part of students learning Classics in Malawi, we need to contextualise its teaching. The purpose of this study was to identify ways in which Classics teaching at undergraduate level in Malawi might be strengthened in order to make the learning of Classics more meaningful and relevant to the Malawian context, by bridging the gaps between Classical Antiquity and African cultures. The comparative approaches explored will facilitate revision of the University of Malawi Classical Studies curriculum to fulfil the needs and interests of Malawians with the main purpose of contextualising Classical Studies in Malawi. The thesis consists of five chapters which deal with issues relating to Classics teaching in Malawi, namely: the evolution of Classical Studies in Malawi and its challenges; the need to change with the times; views of Latin/Classics teachers about Latin teaching at secondary level; attitudes and perceptions of undergraduate Classics students at Chancellor College to Classics, their perceptions about skills and Classics teaching in general; and views from Classicists from other universities on Classics teaching in general. The main comparative element in the thesis draws on analysis of similar issues in a wide variety of other institutions, including in the UK, the USA, Asia and Africa. Literature relating to Classics pedagogy and Comparative Education approaches, specifically Bereday's Model, has been reviewed. In addition, Classical Reception theory and Social Constructivism theory, particularly with regard to pedagogy, have been surveyed. The study used purposive sampling. Five types of samples and their corresponding data capturing instruments were used, broken down in the following categories: two types of interviews (one involving Malawian Latin or Classics teachers at secondary level, and the other universities' Classics lecturers); review of various documents of international universities' Classics programmes; lecture observations for Classics; and student questionnaire interviews administered to University of Malawi Classics students. The research was a mixed-method design, combining both quantitative and qualitative data analysis, but overall, the study was more qualitative than quantitative. Quantitative data were analysed using descriptive statistics and qualitative data were analysed using the thematic analysis method. These analyses were followed by discussions of the findings of both quantitative and qualitative data. The major conclusions and implications of the study point to the need for a curriculum review of all Classics courses to ensure that Classics becomes more relevant in the Malawian context.

Tutor-mentoring of foundation mathematics of students at Monash South Africa

Research has shown that academic under-performance in higher education can be attributed inter alia to psychosocial difficulties arising from students’ under-preparedness for the rigours of university life, the struggle to accommodate diverse cultural worldviews and poor proficiency in the language of learning and teaching (Chang 1999). As internationalisation of higher education institutions has became more common worldwide, the need for support systems to deal with problems of a multicultural student body has become essential if students are to have equitable opportunities for success. In this regard, Monash South Africa (MSA), an international multicultural higher education institution, introduced a tutor-mentor programme to improve academic outcomes among mathematics students in the Foundation Programme (FP). The impact of this programme was investigated by means of an empirical investigation and framed by a bricolage of learning theories which served as a conceptual framework for the study under the metaphors of acquisition and participation. The literature study showed that tutoring and mentoring programmes tend to be successful pedagogical supports. The empirical inquiry took the form of a mixed-method case study which explored the impact of participation in the tutor-mentor programme on mathematical performance among FP mathematics students at MSA. The participants in the study, which was carried out in two phases, were mathematics students, tutor-mentors and lecturers in the FP. Phase 1 quantitatively explored the extent of effectiveness of the tutor-mentor intervention, using a quasi-experimental non-equivalent control group design. Two formal tests were used to gather data, which were analysed by an analysis of covariance and the Johnson-Neyman technique. Quantitative findings supported the initial assumption of the study: that participation in the tutor-mentor programme as an intervention strategy improved the mathematics scores of FP students at MSA. Phase 2, a qualitative study, used purposive sampling. Data was gathered through focus group and individual interviews, observation, spontaneous conversations and photographs. Interpretation of the quantitative and qualitative data was presented according to the phases and thereafter integrated. Qualitative findings provided information about the dynamics of the tutor-mentor programme in providing academic and psychosocial support to students. Finally, a situation-producing theory was developed from the integrated findings, and recommendations made for improvement of practice. / Educational Studies / D. Ed. (Comparative Education)

Insights from youth workers regarding young people's engagement in out-of-school-time youth development programs

L’objectif de cette étude exploratoire était de mieux comprendre, du point de vue des animateurs/animatrices qui oeuvrent auprès des jeunes, le phénomène de l’engagement des jeunes dans les programmes parascolaires. Des entretiens qualitatifs ont été entrepris à cette fin avec six animateur(trices). Plusieurs obstacles à l’engagement ont été identifiés, la plupart étant extérieurs aux jeunes. Quelques actions et attitudes spécifiques des animateur(trices) ont été relevées comme importantes pour aider les jeunes à surmonter ces obstacles. De plus, la structure et le contenu du programme, ainsi que l’environnement de groupe, jouent des rôles primordiaux. Les dimensions soulevées par les animateur(trices) ont permis d’enrichir et rendre plus holistique un modèle d’engagement qui a été développé à partir d’une recension des écrits dans ce domaine. Finalement, les implications pour la formation des animateurs(trices) et pour la structure des programmes pour les jeunes ont été explorées. / The objective of this exploratory study was to better understand young people’s engagement in out-of-school-time youth development programs from the perspective of frontline youth workers. Qualitative interviews were carried out with six youth workers to this end. A number of obstacles to engagement were identified, the majority of which are external to youth. Positive dispositions towards youth by youth workers were found to be key in overcoming some of these obstacles, although program content and structure, as well as group climate also play an important role. The key dimensions of engagement the interviewees raised led to an elaboration of a current model of engagement found in the literature, making it more holistic. Implications for the training of youth workers and the structure of youth programs are discussed.

The master's thesis deals with the changes of values presented in the connecting studio entries of Sundays morning's programmes for children and the youth of the broadcasting of the Czechoslovak and Czech Television from the 1980's up to present, i.e. 2015. It refers to the programmes such as Studio Kamarád, Studio Rosa, Jůhele neděle, Hřiště 7 etc. The 30-year long analysed period is divided into the three time periods - 1980s (1980-1989), 1990's (1990-1999) and the 21st century (2000-2015). The results of the research are compared in the last chapter of the master's thesis. Also, the changes of the selected values groups are described (for example nature and environment, healthy lifestyle etc.). The master's thesis also secondarily deals with how the names, anchor-men and performing puppets of the programmes and the design of the studio have changed.
