Postavení zabezpečovací detence v systému trestněprávních sankcí / The position of security detention in the system of criminal sanctions

The dissertation thesis The position of security detention in the system of criminal sanctions has a theoretical character with the aim to provide a comprehensive overview of the development, implementation and the up to date application of security detention. In connection with the study and factual analysis of the issue, the thesis was divided in several chapters. The content and meaning of some basic terms is defined in the first chapter. The second chapter reflects the development of security detention from the perspective of a broader legal comparison and the legislative process of the Act on Security detention execution. The chapter is focuses on pointing out the complexity and pitfalls of security detention development. The third chapter is devoted to the legal regulation of security detention in the current legal system and is divided into subchapters to interpret the individual legal regulations. The fourth chapter is dedicated to the personality of the offender and basic criminal liability. The fifth chapter is designed to point out the category of offenders from a medical perspective. Chapter six then deals with the application of security detention itself and the constitution in the Czech Republic describing the quality of life of inmates. The last chapter of the thesis focuses on the post-detention care itself. The interpretative analysis of primary and secondary sources showed that security detention is an inevitable part of protective measures in terms of increasing the usability of this measure and simultaneously fulfilling the capacity of security detention institutes in the Czech Republic.

The institute of preventive detention is a new protective measure in our penal law. The theme of this thesis is an analysis of the comission and goals of the new protective measure and focusing on a comparation of theoretical and practical function of this protective measure. The folowing chapters provide the characterization of the preventive detention and its legal framework in the Czech republic. The component part of the thesis is also a description of the preventive detention in a legal framework of other state, concretely Slovakia. At the end of the work there are explicated knowledges obtained during the visit of the Institute for preventive detention Brno. In this chapter not only functional equipment is described but also the compositon of the inmates and employees and their most important competencies. Programms, by which are the medical goals fullfiled are described at the end of the thesis.

Att stanna inne : så ser människor runt Forsmarks känrkraftverk på skyddsåtgärden / To shelter in place : how people around Forsmark nuclear power plant look at the protective measure

I Sverige finns en beredskapszon och en indikeringszon som sträcker sig 12-15 respektive cirka 50 kilometer runt de svenska kärnkraftverken. Strålsäkerhetsmyndigheten (SSM) har föreslagit nya beredskapszoner kring kärnkraftverken. Myndighetens förslag är att det ska finnas en inre och en yttre beredskapszon som sträcker sig ungefär fem respektive 25 kilometer runt kärnkraftverken. I zonerna ska det finnas planer för utrymning, inomhusvistelse och intag av jodtabletter. Information och jodtabletter ska delas ut i förväg och varning till allmänheten ska finnas förberett. Myndigheten föreslår också ett planeringsavstånd på 100 kilometer kring kärnkraftverken. Inom planeringsavståndet ska det finnas en plan för utrymning, som bygger på underlag från strålningsmätning av markbeläggningen, en plan för inomhusvistelse samt en plan för begränsad extrautdelning av jodtabletter. I och med att SSM föreslår att det ska finnas en plan för inomhusvistelse så långt som 10 mil runt kärnkraftverken kommer de föreslagna beredskapszonerna innebära att en större andel människor än tidigare kommer att beröras av myndigheternas förberedande arbete. Att det ska finnas en plan för inomhusvistelse innebär att människor som bor i det berörda området behöver känna till att skyddsåtgärden används och vilka fördelarna med den är. Inomhusvistelse är en viktig skyddsåtgärd för att skydda människor men det är samtidigt en frivillig åtgärd, människor i Sverige har all frihet att gå utomhus även om myndigheter rekommenderar annat under en kärnkraftsolycka. Syftet med den här studien är att undersöka inställningen till en rekommendation om inomhusvistelse hos människor bosatta utanför nuvarande beredskapszon men innanför de planerade zonerna runt kärnkraftverket i Forsmark. Frågor som studien avser att besvara är vad det är som kan få människor att bryta rekommendationen och vad myndigheter behöver göra för att förmå människor att stanna inomhus. Studien har genomförts med en kvalitativ metod med induktiv ansats. Data har samlats in våren 2019 genom intervjuer med en fokusgrupp och ett par. Datamaterialet bestod därmed av människors funderingar, antaganden och upplevelse av hur de skulle reagera och agera vid de situationer som behandlades under intervjuerna. Texterna från de transkriberade intervjuerna har genomgått kvalitativ innehållsanalys och tolkats genom systematisk kategorisering av teman och mönster där både det manifesta och det latenta innehållet har beaktats. Resultatet av studien visar att människors inställning till en rekommendation om inomhusvistelse på en latent nivå handlar om att hantera osäkerhet. På en konkret nivå är det kategorierna Myndighetsförtroende, Kunskap samt Förberedelse och respons som påverkar inställningen till inomhusvistelse. / In Sweden there is a emergency planning zone and an indication zone that extends 12-15 and about 50 kilometers around the nuclear power plants. The Swedish Radiation Safety Authority has proposed new emergency planning zones around the nuclear power plants. The Authority's proposal is that there should be a precautionary action zone and an urgent protective action planning zone extending approximately five and 25 kilometers around the nuclear power plants. The emergency planning zones are to have planning in place for evacuation, sheltering and iodine thyroid blocking. Furthermore, information and iodine thyroid blocking should be distributed in advance and warnings to the public should be pre-planned. The authority also proposes an extended planning distance of 100 kilometers around the nuclear power plants. Within the extended planning distance planning should be in place for relocation based on input from measurements of ground deposition, sheltering, and limited distribution of iodine thyroid blocking. As it is proposed that there should be a plan for sheltering as far as 100 kilometers around the nuclear power plants, the proposed emergency planning zones will imply that a larger proportion of people than before will be affected by the authorities' preparatory work. The fact that there must be a plan for sheltering means that people who live in the area in question need to know that the security measure is applyed and what the benefits of it are. Sheltering is an important protective measure to keep people safe, but at the same time it is a voluntary measure, people in Sweden have the freedom to go outside even if authorities recommend otherwise during a nuclear power plant emergency. The purpose of this study is to investigate the attitude to a recommendation of sheltering in people living outside the current emergency planning zone but within the planned zones around the nuclear power plant in Forsmark. Questions that the study intends to answer is what it is that can cause people to break the recommendation and what authorities need to do to induce people to stay indoors. The study has been carried out with a qualitative method with inductive approach. Data has been collected in spring 2019 through interviews with a focus group and a couple. The data material thus consisted of people's thoughts, assumptions and experience of how they would react and act in the situations that were dealt with during the interviews. The texts from the transcribed interviews have undergone qualitative content analysis and been interpreted through systematic categorization of themes and patterns in which both the manifest and the latent content have been taken into account. The result of the study shows that people's attitude to a recommendation on shelter in place at a latent level is about managing uncertainty. At a specific level, it is the categories of government trust, knowledge and also Preparation and respons that affect the attitude to sheltering.

數位典藏加值應用相關法律議題之研究 / The Study on Legal Issues of Value-added Applications for Digital Archiving

走過資本與勞力密集的工業時代後,全世界已邁向知識密集的新局面,在這樣的潮流下,各國無不發展知識經濟以提升競爭優勢,我國政府也開始設法將內容、創意與科技結合,積極推動數位內容產業,此外,文化創意產業同樣已成為新世紀知識經濟的主流之一,由此可知,任何產業皆須開始重視內涵與創意,而文化又是知識的累積和傳承,若能將對國家的文化認同運用於創意產業,並深入表現在國民的生活文化裡,不啻為符合環境趨勢又能造就一種新經濟形態的好方法。 有鑑於數位出版典藏成長力道之強勁,以及目前國際間無不致力從事國家典藏數位化的工作,再加上我國包括「數位典藏國家型科技計畫」等數位典藏工作之進行,和近幾年針對數位典藏各層面問題之探究所召開的多場研討會,在在顯示數位內容產業之一的「數位典藏」愈來愈受到關注,而將文物數位化保存只是起步,運用數位典藏內容素材進行加值應用從而促進數位典藏與文化創意產業的發展才是更大的價值所在,因此本研究選擇以「數位典藏加值應用」為研究焦點,且由於數位典藏內容在加值應用過程中,包括數位內容之取得、保護、利用、甚至於授權、行銷等,每個階段都與法律考量環環相扣,如何確保數位典藏內容從產生到流通的過程中,創作者受到法律規範應有的保護,又不致過度妨礙知識的擴散以激發更多創新,是值得研究的議題,因此本研究擬分別由理論面與實務面歸納出與數位典藏加值應用發展相關的重要法律議題加以分析論述。 本研究在理論面係針對「資料庫之法律保護」與「科技保護措施衍生的法律爭議」兩大主題為探討,至於實務面則以個案訪談方式瞭解典藏機構與業界加值應用的現況、所遭遇的法律問題與挑戰、以及對於未來發展的看法,最後即根據文獻資料分析與訪談發現歸納研究結論與提出建議。 本研究在進行法律文獻研讀並比較國內外法制發展之後,認為著作權法對資料庫的之保護不足,以其它方式保護亦有其限制,為促進數位典藏資料庫之建置並保護投資,以推廣數位典藏之加值應用,因此建議我國應推行以雙軌制保護資料庫之立法。至於科技保護措施的立法方面,本研究主張為適當維護數位典藏內容擁有者與加值應用者的權利,以及符合我國政府推動數位內容產業的政策目標,並順應國際立法趨勢,必須就數位環境與網路時代下之數位內容給予更有力的保護,故我國仍應立法規範禁止規避科技保護措施的行為,但必須正視美國數位千禧年著作權法案之反規避條款所造成的諸多問題,亦即未來我國立法勢必要考量公益與產業情況。 值得一提的是,本研究在訪談中發現文化資產保存法第十六條規定在適用上似與著作權法第四十三條有所衝突,應修法使得文化資產保存法的定位更加明確,惟基於促進國家整體文化發展,本研究認為屬於公有的文化資產不妨儘量傳播並供後人利用。再者,進行數位典藏工作及其後的加值應用,均須留意智慧財產權問題,且在授權方面,應儘可能取得「再授權」他人利用的權利,以便於能就利用成果再創價值,而考量到數位時代大量運用著作的需要及效率,亦應催生著作權集體管理機制之建立。 關於數位典藏加值應用的推行,進而驅動數位內容與文化創意產業的發展,本研究在個案訪談後亦有數點建議。首先應正視文化認同問題,畢竟要形成產業必須活絡消費,而其根源在於整個社會人民是否對於我國文化仍有信心與熱愛;其次當然要重視創意與內容,因為這才是消費者最終體驗的核心。 又因我國擁有中華文化且位居多元文化交融之處,以華文市場為基石並準備進軍國際,是我國運用文化內容以發展創意產業的機會所在,其它如善用行銷與通路把創意的產品或服務帶到消費者面前、加強智慧財產權教育與宣導、培養包括創意人才、A型人才與智慧財產權專業人才等,皆是產業發展的關鍵要素。 附帶說明,本研究在訪談中,發現業界對於公部門的定位不清有其憂慮,故本研究建議政府應該提供一個公平、開放,讓市場機制自由運作的環境,並應避免過度介入反而有礙產業進展。 數位典藏讓珍貴文物資產有更多重的運用空間,其後續的加值利用更是商機無限,期待在整體環境日趨健全的情況下,透過典藏機構、學界與業界的合作,能真正實現「文化產業化、產業文化化」的願景。 / As the capital-intensive and labor-intensive industry era went by, the whole world has marched toward the knowledge-intensive new situation. Under this trend, many countries develop the knowledge economy to improve the competitiveness .Our government also begins to combine the content and originality with technology and develop the digital content industry positively. Besides, the cultural creative industry has already become one of the mainstreams of the knowledge economy in the new century. Thus every industry must pay attention to intension and creativity. Culture is the accumulation and inheritance of the knowledge. If we apply the cultural identification to the creative industry and make it display deeply in people's life, it will not only be the good method that can bring up a kind of new economic form, but can be corresponded with the environmental trend. Because digital publishing and digital archiving grow up powerfully, many countries are devoted to digitizing national collections at present. Besides, our country proceeds to digitize national collections, such as ' National Digital Archives Program '. Many seminars are held with many aspects of questions on digital archiving in recent years. The above-mentioned situations show that ' digital archive ' draws more and more attention. However, the digitization of historical relics is just the beginning. The greater value is to use digital archive content or materials to go into value-added applications and then push the development of digital content and cultural creative industry. Thus the ' value-added applications for digital archiving ' is focused in this study. Because in the process of value-added applications for digital archive content, including acquirement, protection, utilizing, authorizing and marketing , many questions should be considered with the law at each stage. How to guarantee that the creator is under the protection of the law from the beginning to circulation of digital archive content and make sure that these protections will not hinder the diffusion of knowledge is the worth studying topic. Thus this study plans to generalize some important legal issues which are relevant to the development of value-added applications for digital archiving from aspects of theory and practice and then analyze and discuss them. In the theoretical aspect, this study focuses on ' the legal protection of the database ' and ' the legal dispute of the technological protective measures '. In the practical aspect, the writer collects information about the archive institutions and industry’s present situation, legal questions, challenge and views on development in the future of value-added applications for digital archiving by means of case interview. Finally, the study puts forward the conclusion and the suggestion according to documents analysis and interview finding. After studying legal documents and comparing the development of domestic and international legal system, the writer thinks that the protection of database by copyright law is insufficient and is also limited by other way. This study suggests that our government should pursue the legislation of protecting the database with the dual track approach for the sake of promoting the construction of digital archive database and protection of investment to popularize value-added applications for digital archiving. As for the legislation of the technological protective measure, this study advocates that our government must offer stronger protection on digital content under digital environments and internet era to protect the rights of digital archive content owner and those who use digital archive content to add value properly. To accord with the policy goal that our government promotes the digital content industry and comply with the international legislative trend, our country should legislate against circumventing technological protective measure in the future. Nevertheless, our government must face the questions derived from anti-circumvention provisions of the Digital Millennium Copyright Act in US. It means that our government must consider public good and industry's situation in future lawmaking. It deserves to be mentioned that this study find there is likely conflict between application to article 16 of Cultural Assets Conservation Law and article 43 of copyright law in interview. Thus our government should revise law to make the orientation of Cultural Assets Conservation Law clearer. However, in the cause of bringing about an advance of national whole culture, this study has an idea that cultural assets belong to the public should be propagated and utilized as far as possible. Moreover, it must be looked out for intellectual property right on digital archiving and its value-added applications. In terms of authorization, this study suggests that authorized people should obtain the right of 'reauthorization ' so that they can use the achievement to create value again. Considering the need and efficiency of work utilization, our government should expedite to set up the collective management mechanism of copyright. In regard to the development of value-added applications for digital archiving and then drive digital content and cultural creativity industry, this study also propose several suggestions after case interview. First, we should face the question of cultural identification. Activating consumption can form the industry and its origin lies in whether the whole society is still confident of and has deep love for the Chinese culture. Second, we certainly should pay attention to the creativity and content because those are the cores that consumers experience ultimately. Because our country has Chinese culture and occupies the place where plural culture blend, it is the opportunity for our country to use cultural content to develop creativity industry and base on Chinese-language market to march into world. The rests of suggestions such as making the best of marketing and channel to take the creative products or service to consumers and strengthening the education and propagation of intellectual property right and training including creative talent , A type talent and professional talent of intellectual property right, etc. The foregoing are all key elements of industry development. Additionally, this study found in interview that the industry is worried about the unclearly position of the common department , so the writer advise government should offer fair and open environment to let market mechanism free operate so that avoid getting involved excessivly and hinder industry's progress instead . Digital archive lets precious historical assets have more multiple application space, and its follow-up value-added application bring limitless business opportunity. We expect that the vision of ' culture industrialization and industry culturalize' can really carry out by means of the cooperation between archive institutions and industry.

O Direito do Contraditório e da ampla defesa nas aplicações de medidas protetivas de acolhimento institucional na fase das audiências concentradas / The Law of Contradictory and wide defense of the protective measure of institutional home applications and during phase of concentrated Hearings

Applying those protective measures without observing the criteria designed to maintain family ties would not be legitimate. This thesis regards to the Concentrated Hearings as a formality built for trying to shorten the stay of the child or adolescent under hostage measures and send him/her to his/her own family or, in special situations, to a surrogate family. Obviously, the Focused Hearing must work under the principles of the contradictory and legal defense, without which we would go back to the Juvenile Code, where retailed practices reigned, justified by the irregular situation of the child or adolescent. We seek ,therefore, to explore speeches of professionals who work directly in Concentrated Hearings, in order to identify their practices - to check if there still are traces of retailing and of prospect illegal situation - and to understand the characteristics of the new working style , guided by the Comprehensive Protection . Based on a qualitative approach, we have analyzed the contents of 05 ( five) recordings made by NCA- PUC, which included the lines of two state judges, two prosecutors, a public defender and a group of about 90 (ninety ) Professional social workers and psychologists who spoke specifically about the Concentrated Hearings. Historically, global society, including the Brazilian one, trod a tortuous pathway until reaching the principles of integral protection of children and adolescent, outdoing the period during which children were treated as objects. As a basis, we have used the jurisdictional practices of the contradictory and the legal defense, current knowledge regarding the irregular situation and retail, the advances on the citizens human rights, and the right of full protection of the child and the adolescent, in order to analyze the current situation of the ACs, held during the implementation of protective measures of institutional home. The content analysis of these professionals speeches showed that the legislative advance determined changes in institutional practices: former orphanages were replaced by institutional homes, which task involved the development of the prospect of full protection of children and adolescents under their responsibility. However, some issues still remain to be overcome: the practices guided by the retail thinking, together with the limitation of public policies and the lack of dissemination of ECA in law courses, cause the law-robe professionals to hinder the advancement of full protection of children and adolescents, especially during the application of protective measure of institutional care. Finally, the ACs reveal an attempt, by the judiciary , to improve the conditions of children and adolescents. At the same time, this confirms our initial hypothesis that, in regard to protective measures, there is disrespect to the constitutional principles of law as to the contradictory and the full defense / É legitimo que crianças ou adolescentes que estejam em situação precária de vida, venham a ser amparados por meio de medidas protetivas, inclusive podendo ser inseridas em serviços de acolhimento institucional, sempre cumprindo os determinantes da Proteção Integral. O que não é legitimo, seria aplicar essas medidas protetivas sem a observância de critérios tendentes à manutenção dos vínculos familiares. Esta dissertação se refere às Audiências Concentradas como formalidade construída para tentar abreviar a permanência da criança ou do adolescente em medida de acolhimento e encaminha-la à sua própria família ou, em situações especiais, a uma família substituta. Obviamente a Audiência Concentrada precisa funcionar obedecendo aos princípios do contraditório e da ampla defesa, sem os quais voltaríamos aos períodos dos Códigos de Menores, onde imperavam práticas menoristas, justificadas pela situação irregular da criança ou do adolescente. Buscamos, assim, explorar falas de profissionais que atuam diretamente nas Audiências Concentradas para identificar, suas práticas - para verificar se ainda existem traços do menorismo e da perspectiva da situação irregular - e apreender traços da nova maneira de trabalhar, norteada pela Proteção Integral. Com base em uma abordagem, qualitativa analisamos o conteúdo de 05 (cinco) gravações realizadas pelo NCA-PUC, sendo que estas incluíam as falas de dois juízes de direito, dois promotores de justiça, uma defensora pública e um grupo de aproximadamente 90 (noventa) profissionais assistentes sociais e psicólogos que falaram especificamente sobre as Audiências Concentradas. Historicamente, a sociedade mundial, incluída a brasileira, trilhou um caminho tortuoso até chegar aos princípios da proteção integral da criança e do adolescente, superando o período em que as crianças eram tratadas como objetos. Utilizamos como embasamento, as práticas jurisdicionais do contraditório e da ampla defesa; os conhecimentos vigentes acerca da situação irregular e do menorismo; os avanços nos direitos humanos dos cidadãos; e o direito à proteção integral à criança e ao adolescente, para realizar uma análise da presente situação das ACs, realizadas por ocasião da execução de medidas protetivas de acolhimento institucional. A análise dos conteúdos das falas dos profissionais mostrou que o avanço legislativo determinou mudanças nas prática institucionais: os antigos orfanatos deram lugar aos serviços de acolhimento institucional com a tarefa de desenvolverem a perspectiva de proteção integral de crianças e adolescentes sob sua responsabilidade. No entanto, ainda restam alguns pontos a serem vencidos: as práticas pautadas pelo ideário menorista que, somadas à limitação de politicas públicas e à falta de disseminação do ECA nos cursos jurídicos, fazem com que os profissionais da toga prejudiquem o avanço da proteção integral da criança e do adolescente, especialmente em situação de aplicação de medida protetiva de acolhimento institucional. Por fim, as ACs revelam uma tentativa, por parte do judiciário, de melhoria nas condições das crianças e dos adolescentes. Ao mesmo tempo, comprovam nossa hipótese inicial de que, no que tange às medidas protetivas, existe um desrespeito aos princípios constitucionais do direito ao contraditório e à ampla defesa
