Bien que la modification du contrat administratif soit par principe libre, elle ne peut s’exercer que dans le cadre de certaines limites. En France, les règles de publicité et mise en concurrence imposent des conditions de fond, de forme et de procédure qui déterminent la légalité de l’instrument modificatif. L’interdiction d’un objet nouveau, les restrictions au bouleversement de l’économie du contrat, la fixation des seuils par le juge, etc. révèlent un contrôle rigoureux des modifications. En Colombie, par contre, il semble que la liberté des parties est beaucoup plus étendue. Un seuil général de cinquante pour cent du montant initial, la possibilité des parties de bouleverser l’économie du contrat et même la modification fondamentale de l’objet, font partie d’un système juridique qui tend à supprimer toutes les restrictions à la volonté des parties à l’égard de la modification. S’il est même de l’essence du contrat administratif d’admettre des modifications aux conditions fixées initialement, un sujet d’une grande importance sera celui de la nature de la modification en droit colombien pour dévoiler tous les défis de sa mise en oeuvre. / Although the modification of the public contract is in principle free, it can only take place under certain limitations. In France, the rules of advertising and competition impose substantive conditions of form and procedure to determine the legality of the modifying instrument. The prohibition of agreeing to a new object, restrictions on altering the economic balance, setting financial thresholds, etc., reveal a rigorous control for any modifications. In Colombia, however, it appears that the freedom of the parties is much broader. A general threshold of fifty percent of the initial price, the possibility of altering the economics of the contract and even the fundamental modification of the object, are part of a legal system that tends to abolish all restrictions to the will of the parties regarding modification. Although it is of the essence of contract modifications to disclose the conditions initially established, a major theme is that of the nature of the change in Colombian law to reveal all the challenges of its implementation.

La recherche d'une unité entre les contrats privés et les publics revient à vouloir démontrer l'existence d'un socle, d'un droit commun aux contrats privés et aux contrats publics au stade de leur formation. Cependant, si l'unité des éléments essentiels du contrat peut se révéler imparfaite entre le droit privé et le public, deux notions peuvent apporter une cohérence au phénomène juridique d'unité des contrats : la notion générale de contrat en sa qualité de principe fondateur du phénomène d'unité permet la recherche d'une définition unitaire du contrat dont l'expression est la notion de consentement ; alors que les notions d'objet et de cause se révèlent être des instruments d'identification principal et accessoire du phénomène d'unité des contrats. Ainsi, s'il existe une multitude de contrats, il n'existe qu'une notion de contrat. S'il existe une infinité d'objet, de cause et de moyen de consentir, il n'existe qu'une notion d'objet, de cause et de consentement. L'unité des contrats privés et des contrats publics est cela : la réduction d'une pluralité de notions à une notion-cadre fondamentale, la notion de contrat. / Seeking unity between private and public contracts is ultimately intended to demonstrate the existence of a base, a law common to private and public contracts, at the stage of their conclusion. However, if the unity, in terms of private and public law, of the basic elements of the contract may prove to be imperfect, two concepts may bring cohesiveness to the legal phenomenon of the unity of contracts: the general concept of contract in its role as a founding principle of the phenomenon of unity enables a uniform definition for the contract to be sought, the expression of which is the concept of consent whereas the notions of object and cause reveal themselves to be main instruments of identification, ancillary to the phenomenon of the unity of contracts. Thus, if multiple contracts exist, there only exists one concept of the contract. If there are an infinite number of objects, causes and means of consent, there is only one concept of object, cause and consent. The unity of private contracts and public contracts is this: the reduction of a multiplicity of notions into one basic framework, the concept of the contract.

This thesis solves the problems of efficiency of investment injected into the reconstruction and the new building. The existing construction with its planning conception and technical solution defines clearly the edge conditions which depends on the rang of the reconstruction. But on the other hand the architectural solution of the new building is determined by the size and shape of the area. And in addition to that i tis necessarity to také into account also the costs of removal of the existing building. In the first part of the thesis the advantages and disadvantages of both variations are compared as well as the factors affecting their prices and then also the problems of the budgeting and the legislation applying to this subject. The second part of the thesis solves the question i fit is more advantageous to use the existing building of the basic school in the vallage of Hrubá Vrbka and to convert it into the community centre for seniors or if it is more advantageous to pul lit down and build a new building which will correspond with its character to the planned utilization. The costs of both variations are expressed numerically in the detailed expenditure badget. The return of investments is calculated, the comparison of both variations is given in the conclusion.

In a response to this proposal possible ways of financing this investment project were subsequently outlined. The secondary aim of this thesis was to create a concise database of implemented projects of the reconstruction in other municipalities and comparison of these results.

The thesis deals with the reasons leading to the change of all mentioned Directives as well as with the "technical amendment" of the Public Procurement Act No. 137/2006 Coll., which has been in effect since the 1st of January 2014.
