Le stade en droit public / Stadiums in public law

Le stade est un lieu de concentration du droit public. La focale se porte donc sur l’étude du régime juridique des « grands stades » pour reprendre l’appellation retenue par le rapport de la Commission Euro 2016. L’objet de cette étude est de démontrer les interactions réciproques entre le stade et le droit public. Notre étude se concentrera sur les problématiques juridiques nationales portées par les profondes mutations du stade et de son droit. Marqué par la diversité des contrats qui sont à la source de leurs constructions ou rénovations, le régime juridique de la propriété du stade détermine ses modes de gestion. Longtemps lieu du service public du sport, la professionnalisation de celui-ci a engendré quelques mutations quant au régime juridique de la domanialité du stade. Cette concentration se révèle également dans l’opération d’urbanisme et d’aménagement du territoire que constitue un stade. S’inscrivant dans une politique globale de financement du sport où l’intervention publique demeure élevée, le stade se confronte aux contraintes des finances publiques. Le stade est lieu de rassemblement où le public vient assister à un spectacle sportif. Il convient d’encadrer tout débordement susceptible de troubler l’ordre public. En tant que réceptacle du spectacle sportif, le stade est un lieu d’exploitation commerciale. / Stadiums are places where public law cannot be overlooked. This thesis focuses therefore on the juridical regime of the so called “grands stades” (stadiums contrary to sport fields) quoted as such in the Euro 2016 commission report. The main purpose is to demonstrate interlinks between stadiums and public law. This study concentrates on national juridical issues raised by changes in stadiums and thus in laws related to it. Indeed the juridical regime of stadium property, through the wide diversity of contracts qualifying the frame for construction or renovation, defines how stadiums are managed. For a long time stadiums have been considered for public sport practices, however professionalization led to modifying this juridical regime. Urbanism and spatial planning operations prior to stadium constructions have also underlined this evolution. The global financial policy for stadium development requires high public sector intervention therefore making it also subject to public financing constraints. Stadiums gather people to watch sport events. It is important to provide a frame to avoid any excess that could lead to disturbances of public order. As a recipient of sport events, stadiums are places of commercial exploitation.

The theoretical part deals with the issue of public tenders, process theories of tenders and company’s ownership structure. The practical part explores the cost reduction in the already specified offer to a public tender. The aim of this work is a compilation of the checklist steps for the process of preparation contract in the offer stage, which could lead to a reduction in the cost price and increase the probability of success in the public tender.

Le présent mémoire est divisé en deux parties. La première, un peu plus théorique, se veut un bref constat des problèmes reliés à l’octroi des contrats municipaux au fil du temps ainsi qu’un rappel des règles actuelles en matière d’attribution des contrats. La seconde partie porte sur les bonnes pratiques à adopter lors d’un appel d’offres, les zones grises et les erreurs à éviter lors du processus menant à l’adjudication d’un contrat. Dans un premier temps, l’auteure traite de la rédaction de l’appel d’offres, de sa publication, de l’ouverture des soumissions et des formalités à suivre afin de déterminer la soumission devant être retenue. Par la suite, elle aborde les concepts de division de contrat et d’avis d’intention. Finalement, le dernier chapitre relate les différents mécanismes de plaintes dans le milieu municipal. À la fin du mémoire, six (6) annexes viennent illustrer, sous forme de tableaux ou de schémas, différents concepts et étapes clés en matière de gestion contractuelle. / This master’s thesis is divided into two parts. The first one is a bit more theoretical and is intended to be a brief overview of the problems linked to the awarding of municipal contracts over time, as well as a reminder of the current rules governing the awarding of contracts. The second part informs on the best practices to be followed during a call for tenders, the gray areas, and the errors to avoid during the process leading to the awarding of a contract. First, the author addresses the writing of the call for tenders, its publication, the opening of tenders, and the formalities to be followed in order to determine the tender to be selected. Next, she discusses the concepts of contract division and notice of intention. The last chapter describes the various complaint mechanisms in the municipal sector. At the end of the thesis, six (6) appendices illustrate, using tables or diagrams, various key concepts and stages in terms of contractual management.

Environmental protection within specific proceedings pursuant the Building Act Unrestrained construction activity damages natural resources and diverse environmental components in irreversible or in difficult-to-repair ways, thereby further thwarting thriving or even surviving of the World population. In the Czech legal system, the regulatory measures of administrative bodies, along with the participation of the affected stakeholders, contribute to the environmental protection of the individual development project. This dissertation examines the methods, means, and tools of environmental protection within the framework of designated proceedings regulating the construction. Specifically, it analyzes the possibilities of implementing protective environmental measures within the construction-permitting procedures enshrined in the provisions of Sections 103 to 117 of the Building Act. Five construction-permitting regimes are examined separately: the building permit process; notification; public law contract; notification with certificate of the authorized inspector and projects requiring neither building permit nor notification. This thesis discusses housing issues and its solutions in a village named Kobylí. The theoretical part focuses on introducing the issues by defining basic concepts related to housing, local real estate market and evaluating feasibility of projects. The thesis provides an overview of current as well as historic data and graphs related to housing. In the practical part, a feasibility study is presented and focuses on an economic evaluation of a construction of a new apartment building in Kobylí, followed by requirements assessment such as an effectiveness of critical variables and a crucial input value from the investor's point of view. Lastly, this thesis identifies and defines new tenants of the building which is offering appartemnts, and evaluates whether the tenants can afford housing in their new apartment.

The key to successful business and stable position in a competitive market is the way of planning, managing and quality processing of construction orders. The aim of this diploma thesis is to describe and analyze the management of a construction order in a selected company, in my case ARCHATT, s.r.o. I also deal with this in this work, namely for the specific order Oprava Severního parkánu a hradeb of Prague Castle. The content of the work is a processed documentation of the supplier's preparation for this order and a detailed description of the entry of construction workers to this daily guarded building.
