Todavia, o alcance do êxito neste contexto está associado não só à competência dos pesquisadores envolvidos e aos altos investimentos realizados, como também à resolução de possíveis entraves regulatórios e à supressão de barreiras técnicas inerentes a este processo. O presente estudo se propõe a analisar, destacando os pontos críticos, o impacto regulatório no desenvolvimento de novos produtos. O estudo está suportado pelo método de triangulação entre a fundamentação teórica, baseada na revisão da literatura técnico-científica, a análise da percepção e das evidências da amostra respondente do setor regulado, e a análise da percepção e das evidências da amostra respondente dos órgãos reguladores. Embora nesta investigação tenha se verificado a existência de entraves regulatórios, como a lentidão nas aprovações dos órgãos reguladores e a legislação frágil, também foram observados aspectos positivos no que concerne a mão de obra qualificada dos profissionais entrevistados desse setor e o investimento em inovação do setor regulado / In the dynamic and complex environment of the pharmaceutical industry, characterized by a huge competition and relevant profit margins, the launch of effective, safe and innovative drugs becomes one of the most important indicators of the success of the companies in the pharmaceutical sector. However, the achievement of success in this context is related not only with the high investments and researchers’ qualifications, but also to settle the possible regulatory issues and technical barriers inherent to this process. This study aims to analyze and demonstrate the critical points, key issues on the development of new pharmaceutical products in Brazil and how it affects society and companies in the pharmaceutical sector. This study is supported by triangulation method between the scientific and technical literature review, the perception analysis of the regulated segment investigated and the perception analysis of the regulatory agencies investigated. This work seeks to contribute to appoint the existence of adversities and challenges of this process and also to suggest possible solutions to improve the performance of pharmaceutical companies in Brazil. Although this study had verified the existence of regulatory barriers, such as regulatory approvals delays and fragile legislation, it had also identified positive aspects of this segment regarding high qualification of the professionals interviewed and investment in innovation by regulated companies

Under an interdisciplinary focus we have tried to connect various definitions relating to distinct subject-matters of the Social Sciences about the Third Sector over the world and in Brazil, and verified its undissociable relation to transindividualism. Under this context, we have analyzed the influences of the Third Sector in the Science of Law and tied it to the new citizenship consciousness, the civic bond, the democratic participation in the decisions on the goals of the nation, the protagonism in the social networks, to conclude that all the power belong to the people, therefore the people, and only the people, is the legitimate owner of its own destiny. The Third Sector, as a transindividual legal phenomenon is a social source of the Law / O presente trabalho busca investigar o advento do Terceiro Setor, fenômeno social de transformação mundial, cujo crescimento exponencial a partir da década de 70 trouxe à baila questionamentos acerca das estruturas e funções estatais, da adequação da soberania dos Estados-Nação ante à nova conformação econômica globalizada, ao redimensionamento dos espaços públicos e à relação tempo/espaço. Sob o espectro da interdisciplinaridade, buscamos concatenar conceitos vários pertinentes a objetos distintos das Ciências Sociais sobre o Terceiro Setor no mundo e no Brasil, e verificamos sua indissociável relação com o transindividualismo. Neste contexto, analisamos as influências do Terceiro Setor na Ciência do Direito e as entrelaçarmos à nova consciência cidadã, ao engajamento cívico, à participação democrática nas decisões sobre os rumos da nação, ao protagonismo nas redes sociais, para concluir que todo o poder emana do povo, sendo o povo, e só o povo, o senhor legítimo do seu destino. Based on this hypothesis, and considering the uncertainties and issues of high technical complexity related to the 'list of health care procedures and events in health care', the objective of the research was to carry out an exploratory analysis intended to identify limitations, obstacles and observable strategies in the elaboration and justification of these norms. For this purpose, it was adopt a methodology of qualitative analysis based on documentary research, which included different documents available through the National Regulatory Agency for Private Health Insurance and Plans (ANS) website in public consultations, in the Technical Group for reviewing the list of procedures and in the Committee on Regulation of Health Care (COSAÚDE). As a result, it was verified the hypothesis mentioned above, since the dynamics of the choice presents restrictions that lead the regulator to adopt different strategies to deal with. The obstacles related to 'decision-making' dimension arise from the complexity and uncertainties related to the medical evidences, informational limitations and from interferences of the Legislative Branch and the Judiciary. Regarding the giving reasons requirement, although it is possible to see a greater density of justification starting in 2013, the reasons and replies presented in a synthesized format often do not suffice to clarify all the issues that support complex choices. Among the proposals of the study, the regulator should to provide a more detailed record about the valuation and the operationalization of its methodology criteria. / Exigências procedimentais relacionadas ao processo decisório e à justificação de escolhas regulatórias podem ter sua aplicação limitada em cenários de incerteza, limitação informacional e demais obstáculos que levam o regulador a adotar estratégias para adequar a tomada de decisão aos recursos disponíveis. Partindo-se desta hipótese, a pesquisa teve por objetivo a realização de uma análise exploratória com vistas a identificar limitações, obstáculos e estratégias observáveis na elaboração e justificação do rol de procedimentos e eventos em saúde – eis que a elaboração do 'rol' é permeada por incertezas e por questões de alta complexidade técnica. Para tanto, adotou-se a metodologia de análise qualitativa baseada em pesquisa documental, que englobou diferentes anexos disponibilizados a partir do sítio eletrônico da Agência Nacional de Saúde Suplementar (ANS) em consultas públicas, no Grupo Técnico de revisão do rol de procedimentos e no Comitê Permanente de Regulação da Atenção à Saúde (COSAÚDE). Ao final, foi possível evidenciar importantes elementos que moldam ou restringem a tomada de decisão e a sua respectiva justificação. No âmbito dos resultados, os obstáculos relacionados à dimensão 'processo decisório' decorrem de diferentes fontes de incerteza, do volume (e complexidade) das informações e de interferências promovidas pelo Poder Legislativo e Judiciário – sendo observáveis diferentes providências do regulador para cada caso. No que tange ao dever de motivação, embora se percebam melhorias a partir de 2013, a apresentação de justificativas e réplicas segue um formato mais compactado e não contempla algumas questões metodológicas que servem como base para premissas elencadas pelo regulador. Dentre outras propostas do estudo, sugeriu-se que a agência disponibilize o amplo acesso a documentos ou relatórios que registrem, de forma pormenorizada, a operacionalização dos quesitos que integram a metodologia de decisão.
