Der Anspruch auf Unterlassung aus standardessentiellen Patenten im Telekommunikationssektor

Die Arbeit untersucht die Durchsetzung von Ansprüchen auf Unterlassung aus standardessentiellen Patenten (SEP). Ausgehend von den ökonomischen und rechtsdogmatischen Grundlagen des Patentrechts wird zunächst die Legitimation des Anspruchs auf Unterlassung im Gefüge des Patentrechts untersucht und der Frage nachgegangen, inwieweit die Gewährung von Ausschließlichkeitsbefugnissen zur Verwirklichung der Ziele von Innovationsschutz und -förderung notwendig ist. Die Prüfung kommt zu dem Schluss, dass die Ausübung des Anspruchs auf Unterlassung aus SEP unter Umständen eine ökonomisch und rechtsdogmatisch unerwünschte Blockadeposition herbeiführen kann, so dass eine Einschränkung des Anspruchs zur Sicherung der innovationsfördernden Funktionen des Patentrechts geboten sein kann. Sodann werden verschiedene Lösungsansätze diskutiert und dabei besonderes Augenmerk auf die durch die deutsche und europäische Rechtsprechung entwickelte kartellrechtliche Lösung gelegt. Nach einer Betrachtung der Tatbestandsmerkmale des kartellrechtlichen Verbots des Missbrauchs von Marktmacht nach Art. 102 AEUV bzw. §§ 19, 20 GWB und deren Anwendung auf Fälle der Erhebung von Unterlassungsklagen aus SEP wird diese Lösung abgelehnt. Der Tatbestand des Missbrauchs von Markmacht vermag wegen der Fokussierung auf (Produkt-)märkte und des Erfordernisses einer marktbeherrschenden Stellung als Anwendungsvoraussetzung bei stringenter Auslegung der Vorschrift nicht alle relevanten Fälle zu fassen. Im Folgenden werden Ansätze diskutiert und bewertet, welche eine rechtliche Verankerung der Einschränkung des Anspruchs auf Unterlassung eher im Vertrags- oder im Patentrecht selbst suchen. Als Ergebnis wird sich schließlich dafür ausgesprochen, das in § 23 PatG für die Abgabe einer Lizenzbereitschaftserklärung vorgesehene Verfahren mit seinen wechselseitigen Pflichten analog auf Fälle der Erhebung einer Unterlassungsklage aus SEP anzuwenden und die Zulässigkeit der Erhebung von Unterlassungsklagen nach diesem Maßstab zu beurteilen. / The work analyzes the enforcement of claims for injunctive relief based on standard-essential patens (SEP). Taking the economic and legal foundations of patent law as a starting point, the legitimacy of the claim for injunctive relief within the system of patent law is assessed, as is the question of whether granting the power to exclude others from use of a patented technology is necessary for protecting and promoting innovation. It is found that injunctive relief based on a SEP can lead to an economically and legally unwanted blocking position, in favor of the patent holder, which may require restricting the exclusive right of the patent holder in order to ensurethe patent's function of promoting innovation. Following this, different approaches for solving the issue are discussed. A special focus is put on antitrust law which has been used as a basis to limit injunctive relief by the German and European courts. After considering the elements of Art. 102 TFEU, §§ 19, 20 of the German Antitrust Code (GWB) respectively, the application of antitrust law is rejected. Due to its focus on (product-)markets and the requirement of a dominant market position, antitrust law is not fit to sufficiently limit the negative impact that injunctive relief from a SEP might have on innovation. The work further discusses and assesses other approaches which are trying to apply contract law or certain provisions of patent law. As a result, it is suggested to analogously apply the procedure set out in § 23 PatG (German Patent Code) and its system of mutual obligations to assess the legitimacy of injunctive relief in SEP-cases

[pt] Esta Tese de Doutorado tem como foco o Projeto de Economia de Comunhão na Liberdade - EdC, que apresenta uma maneira diferenciada de ver a gestão. As empresas que aderem a esse Projeto buscam aliar princípios de eficiência, produtividade e lucratividade a uma forma mais humana de gerenciamento de pessoas. Trata-se de um Projeto em fase inicial, cujos resultados são provenientes da prática das empresas e não da aplicação de bases teóricas, ainda inexistentes. Assim, o objetivo deste estudo é o de discutir fundamentos organizacionais para a construção de uma Teoria de EdC. Para tanto, é apresentada a Doutrina Social da Igreja que fundamenta a EdC e os princípios e os ideais do Projeto. Em seguida, são discutidos os elementos organizacionais conhecimento e aprendizado, poder, liderança, comunicação, motivação, tomada de decisões e mudança organizacional e são avaliadas abordagens que mais se aproximam dos aspectos que distinguem uma empresa de EdC de outra convencional. Na seqüência, caracteriza-se a empresa de EdC. Por fim, os elementos organizacionais e as abordagens discutidas são contrapostas aos princípios da EdC, buscando-se levantar quais são os pontos de confluência que permitirão elencar as primeiras bases para a construção de uma teoria sobre o tema. / [en] The focus of this doctoral thesis is the Sharing Economy Project - SEP, that presents a different way of managing adopted by some organizations that congregates principles of efficiency, productivity and profitability to a more human way of managing people. This Project is still in the beginning and its results come from the organizations´ practices and not from the use of some theoretical basis, not yet developed. Thus, the objective of this study is discussing organizational foundations that can be useful for a future SEP theory. In this pursuit, the Social Doctrine of Catholic Church - that establishes the SEP basis - and the Project´s principles will be presented. After this, some organizational elements like knowledge and learning, power, leadership, communication, decision making and organizational change are discussed and organizational approaches that are closer to elements that distinguish EdC organizations from conventional ones are considered. Then, one will show what an EdC enterprise means showing some of its characteristics. To finish with, the organizational elements and the approaches will be compared to the SEP principles in order to point out the confluent points that can serve as an initial basis for a theory construction.

Dictionary learning for pattern classification in medical imaging / Apprentissage de dictionnaires pour la reconnaissance de motifs en imagerie médicale

La plupart des signaux naturels peuvent être représentés par une combinaison linéaire de quelques atomes dans un dictionnaire. Ces représentations parcimonieuses et les méthodes d'apprentissage de dictionnaires (AD) ont suscité un vif intérêt au cours des dernières années. Bien que les méthodes d'AD classiques soient efficaces dans des applications telles que le débruitage d'images, plusieurs méthodes d'AD discriminatifs ont été proposées pour obtenir des dictionnaires mieux adaptés à la classification. Dans ce travail, nous avons montré que la taille des dictionnaires de chaque classe est un facteur crucial dans les applications de reconnaissance des formes lorsqu'il existe des différences de variabilité entre les classes, à la fois dans le cas des dictionnaires classiques et des dictionnaires discriminatifs. Nous avons validé la proposition d'utiliser différentes tailles de dictionnaires, dans une application de vision par ordinateur, la détection des lèvres dans des images de visages, ainsi que par une application médicale plus complexe, la classification des lésions de scléroses en plaques (SEP) dans des images IRM multimodales. Les dictionnaires spécifiques à chaque classe sont appris pour les lésions et les tissus cérébraux sains. La taille du dictionnaire pour chaque classe est adaptée en fonction de la complexité des données. L'algorithme est validé à l'aide de 52 séquences IRM multimodales de 13 patients atteints de SEP. / Most natural signals can be approximated by a linear combination of a few atoms in a dictionary. Such sparse representations of signals and dictionary learning (DL) methods have received a special attention over the past few years. While standard DL approaches are effective in applications such as image denoising or compression, several discriminative DL methods have been proposed to achieve better image classification. In this thesis, we have shown that the dictionary size for each class is an important factor in the pattern recognition applications where there exist variability difference between classes, in the case of both the standard and discriminative DL methods. We validated the proposition of using different dictionary size based on complexity of the class data in a computer vision application such as lips detection in face images, followed by more complex medical imaging application such as classification of multiple sclerosis (MS) lesions using MR images. The class specific dictionaries are learned for the lesions and individual healthy brain tissues, and the size of the dictionary for each class is adapted according to the complexity of the underlying data. The algorithm is validated using 52 multi-sequence MR images acquired from 13 MS patients.

The effect of experimental pain on motor training performance and sensorimotor integration

Sensorimotor integration (SMI) is the ability of the central nervous system (CNS) to integrate afferent (incoming) information from different body parts and formulate appropriate motor output to muscles. Effective sensorimotor integration is essential when learning new skills and when performing tasks at home and in the workplace (Rothwell &Rosenkranz, 2005). The overall aim of this thesis is to investigate the effect of acute experimental pain on sensorimotor processing. The primary outcome is the effect of acute experimental pain on somatosensory evoked potential (SEP) peaks. Secondary outcomes include the effect of pain on motor performance and the interactive effect of pain and motor training on SEP peaks. As expected for the placebo condition, no significant differences were found in any of the post-placebo peaks. Contrary to what was expected for the placebo condition, the only peak to be significantly different post-motor learning was the N24 peak. Contrary to what was expected, there were no significant differences for any of the peaks following capsaicin application. One of the secondary outcomes was the interactive effect of pain and motor learning on SEP peaks. The only peak to show any significant differences post-intervention/post-motor learning was the N24 peak. Another secondary outcome was the effect of pain on motor performance. In terms of accuracy, no significant differences were found for either condition following motor learning. However, the data does show a trend towards improved accuracy for the subjects in the intervention group while the subjects in the placebo show a trend towards decreased accuracy. As expected, there was a significant decrease in reaction time for both conditions post-motor learning. However, contrary to what was expected, reaction time decreased to a greater extent in the intervention condition as compared to the placebo condition. It was anticipated that the reaction time would decrease to a greater extent in the placebo condition as it was hypothesized that pain would negatively impact motor performance. It is suspected that the effect of the pain induced by the capsaicin made the motor training task more difficult and participants would have had to focus greater attentional resources to learn the task which lead to the enhanced performance following motor training. / UOIT

Smart Africa : Patents and Standards in ICT, a roadmap for Africa in the digital world

The mobile revolution has had a huge effect on our lives in all spheres. To ensure its continued evolution patents have played a part in protecting rightsholders from infringement cases by implementers. Also, many companies in the ICT industry focusing on innovation have come together to create standards, which ensure interoperability and compatibility of devices whilst supporting an ecosystem that is beneficial for both innovators and implementers as well as the consumers. Despite challenges (hold-up and hold-out) arising, regulators and standards organizations have created policies to regulate the processes involved. This has seen the introduction of FRAND and other international agreements. Using 3GPP as an illustration, this thesis highlights the efforts that are poured in research and development to even come up with a set standard that is universally applicable. This thesis gives an analysis on the underlying principles and processes that allow for standardization. It focuses on the relationship between patents and standards and how a strong IPR system has an impact on the progress of technology innovation. This thesis will highlight the benefits that arise from an ecosystem that is predevelopment and analyses the legal cases that have been dealt with over the years. Several cases have been brought before the courts in different jurisdictions to address issues relating to standardization and the ruling have seen a change in direction on the way to approach FRAND. The landmark case Huawei v ZTE paved a way for Europe’s balanced approach on licensing agreements and now courts have realized the importance of both parties to actively participate in good faith negotiations. The same has happened in the United states where after eBay v MercExchange the courts are now realizing hold-out is equally detrimental as hold-up and can create complications in licensing. The courts are now reluctant in offering injunctive relief without efforts from both parties to perform licensing agreements. As the technological boom continues in an upward trajectory it is crucial now, more than ever for Africa to join in and leverage the available laws to benefit its SMEs and ICT industry and strengthen its IPR system. Legend has it that the stronger the protection of own technological know-how, the higher the likelihood to join formal standardization processes to leverage the value of the technological portfolios. The empirical findings establish that if African countries develop their IPR system, this can be a source of encouragement for innovators to engage in global standardization.

Asteroid Redirect Mission (ARM) using Solar Electric Propulsion (SEP) for Research, Mining, and Exploration Endeavors of Near-Earth Objects (NEOs)

The feasibility of relocating a small (~500,000 kg) Near-Earth Asteroid (NEA) to High Earth Orbit via Solar Electric Propulsion (SEP) is evaluated with the orbital simulation software General Mission Analysis Tool (GMAT). Using prior research as a basis for the mission parameters, a retrieval mission to NEA 2008 HU4 is simulated in two parts: approach from Earth and return of the Asteroid Redirect Vehicle (ARV) with the asteroid in tow. Success of such a mission would pave the way for future missions to larger NEAs and other deep space endeavors. It is shown that for a hypothetical launch time of 24 May 2016, the ARV could arrive within 25 km of 2008 HU4 on 28 Jun 2017 with a Delta V of 0.406 km/s, begin return maneuver on 08 Dec 2017 and reach Earth altitude of 450,000 km by 23 Apr 2026 with a Delta V of 44.639 m/s.

This study intended to examine Swedish upper secondary school students' argumentation related to the socioscientific issues about sustainable consumption and production, where the students take a position more specifically about a vegetarian diet. Examining sustainable development as an SSI becomes natural here as it is a constantly emerging feature in both the media but also within the school where it is used to give students a developing knowledge to be able to make informed decisions for future problems. This gave the idea to sustainable consumption and production which is one of the sub-goals (goal 12) of the UN goals for sustainable development which can be linked to the question of whether expanding vegetarian diets in schools would be better for sustainable development. In order to understand students' informal argumentation, the choice is to use the SEE-SEP model, which was used as a tool that gives the possibility to categorize arguments and gain an understanding of which grounds the arguments were based upon. The study will also examine the students' development of arguments during the course of the study to examine if there are changes to the argumentations during the study. The results show that students chose to mainly use environment/ecology and science-based arguments during the course of the study. An overview of the arguments shows that the students choose to use the knowledge aspect as their main support when it comes to the design of the arguments. The process of the study shows that there are changes in the design of the arguments and which categories are chosen to build the arguments.
