Schengenský systém a aktuální problémy jeho realizace / Schengen System and Current Issues of its Realization

The aim of this diploma thesis lies in detail description of the whole Schengen system including its links to the general EU legal framework and in critical analysis of selected issues that the Schengen system is currently facing. The first chapter of the thesis deals with a general legal framework of the free movement of persons and the area of freedom, security and justice. The second chapter is devoted to the formation, development, actual legal framework and territorial scope of the Schengen system. Further there is a detail description of schengen cooperation with emphasis put on the protection of external borders and FRONTEX agency. By using a journal articles and relevant case law of the Court of Justice of the EU the third chapter is aiming to analyze selected issues of realization of Schengen system and to name its current challanges.

Vývoj Schengenského informačního systému / Development of Schengen Information System

Schengenský informační systém působí jako kompenzační nástroj Schengenu. Jedná se o databázi s obrovským množstvím informací, které využívají kompetentní orgány v každodenním provozu. Dnešní SIS funguje s malými úpravami podle pravidel Schengenu z roku 1990, ale protože se postupem času objevují nové hrozby, je také potřeba, aby se SIS novým změnám přizpůsobil. Bylo rozhodnuto o revizi stávajícího SIS a vytvoření nového Schengenského informačního systému druhé generace. Postupně byly předkládány funkce systému, časové plány na implementaci a finanční rozpočty, až nakonec v roce 2005 Evropská komise předložila právní návrhy na spuštění SIS II. Návrhy nebyly orgány EU, ani členskými zeměmi přijaty bez připomínek, a proto se v roce 2006 objevily nové návrhy. Do data odevzdání této diplomové práce se nepodařilo přijmout finální právní texty definující SIS II.

Discrepancies in European Union policies towards illegal immigration : The securitisation of the visa-overstayer and the irregular migrant

Visa-liberalisation agreements are commonly used as an incentive by the EU to encourage cooperation within the realm of border and migration management with its neighbouring countries. The ultimate aim of these agreements is to reduce irregular migration to Schengen territory, something that has been percieved as an increasingly urgent issue for European policy makers in the wake of the 2015 'migration crisis'. However, the use of visa liberalisation agreements in such a fashion appears contradictory considering that most irregular migrants in the EU most likely are visa-overstayers. This essay takes of in this apparent puzzle and argues that securitisation theory might help us better understand this discrepancy. While the construction of the migrant as a security threat in Europe has been thoroughly examined, differences in securitisation between grups of irregular migrants are often left out of the discussion or only implicitly mentioned. By examining the discourse and practices of a central EU agency in regard to border and migration management, FRONTEX, this thesis shows that visa-overstayers are routinely left out of the securitised discussion on irregular migration, thus rendering EU policies asymmetrically occupied with irregular migration by means of 'illegal entry'. However, the thesis also uncovers a more conplex set of ideas that show that although visa-overstayers are not conceptulised as threats to security in discourse on par with other categories of irregular migrants, visa-goers and other travellers are, too, incresingly subjected to a rationale of survaillance and risk.

The present study aims to analyse, from a functional perspective, the Swedish transla­tion of an administrative text about how the border control in France is organised in cooperation between the border police and customs authorities. It is an informative text produced by French authorities at the request of the European Commission, and the translation for a Swedish-speaking audience in a national context (as opposed to a supranational, institutional one) will have a slightly different aim – or skopos, referring to the concept developed by Vermeer. The translated text is an excerpt from a survey, containing both questions and answers, that was sent out to various member countries. It is considered to belong to the text variety category that the Swedish EU translation units refer to as “communications” (meddelanden). Texts belonging to this category have a content that is political or administrative in nature, rather than legal or judicial. The source and target texts are studied in a contrastive manner, focusing on two major aspects: referential coherence and organisation terminology. Both aspects are examined in a quantitative and qualitative way, with the aim or skopos as a guiding principle when deciding on which translation strategies to adopt. More specifically, the first part of the study aims to examine if a reinforced referential coherence could contribute to attain the aim of “clear language” (klarspråk) which is a key feature in the language used by Swedish public authorities. The second part of the analysis focuses on terms referring to different organisational levels, and the functional equivalents that best suit the skopos of the target text, e.g. through the study of organisational charts. In conclusion, reinforced referential coherence seems to be one of the ways in which clear language can be achieved, and consideration of different hierarchical relations between terms is important when translating organisational terminology. The study overall highlights the importance of adapting the target text to its context and intended readers, for example by studying parallel texts.

Imigracijos poveikis nacionaliniam saugumui Šengeno erdvėje: Lietuvos atvejis / Immigration’s impact on national security in the Schengen area: the case of Lithuania

Tyrimo problema: iki šiol Lietuvoje laikomasi nuomonės, kad migracija nacionaliniam saugumui grėsmės nekelia, nes imigracija į šalį yra nedidelė ir valstybė nėra potencialiu teroristinių išpuolių taikiniu. Viena vertus, būdama skurdesnė už Vakarų Europos valstybes, Lietuva išties vis dar nėra imigracijos traukos objektu. Tačiau nuo 2007 metų gruodžio 21 d. padėtis pradėjo keistis – dabar Lietuva yra viena iš Šengeno erdvės šalių, kuriose yra panaikinta vidaus sienų kontrolė ir saugomos tiktai išorinės sienos. Tai reiškia, kad turėdama dešimtadalį Šengeno erdvės sausumos sienos, Lietuva nelegaliems migrantams ir žmonių kontrabandininkams tampa patrauklia tranzito šalimi į Vakarų valstybes, ir todėl šalis neišvengiamai susidurs su didesnėmis migracijos keliamomis grėsmėmis saugumui. Antra vertus, klaidinga manyti, kad pagrindinės migracijos keliamos grėsmės saugumui yra susijusios su terorizmu ar socialiniais neramumais. Tai tik pora iš daugelio migracijos keliamų grėsmių saugumui. Todėl dabar yra tinkamas laikas nagrinėti, kokį poveikį migracija turi Lietuvos nacionaliniam saugumui Šengeno erdvėje. Darbo objektu yra imigracijos daromas poveikis nacionaliniam saugumui. Šio darbo tikslas yra aprašius migracijos ir saugumo sąvokų raidą, išskyrus jų tarpusavio ryšį ir įvertinus iš šio ryšio kylančias grėsmes bei išanalizavus Šengeno erdvę, kaip Europos Sąjungos priemonę tinkamai užtikrinti piliečių judėjimo laisvę ir saugumą, nustatyti, kokią įtaką buvimas išorine Šengeno erdvės... [toliau žr. visą tekstą] / Problem of the study: According to public opinion, migration is not a threat to national security in Lithuania mainly because of to reasons. Firstly, Lithuania does not suffer from immigration flows. Secondly, as threat to national security, immigration is seen only in direct connection with terrorism. On one hand, being poorer than the Western European countries, Lithuania has not been one of the migration target countries. But from 2007 on 21 December situation has changed - now Lithuania is one of the Schengen Area States, where control on internal borders is completely removed and safety of the area is guaranteed by control of external borders. This means, that with a tenth of the Schengen Area external land border, Lithuania is becoming an attractive transit country to Western countries for illegal migrants. Therefore, it will inevitably face with greater immigration threats to security. On the other hand, terrorism is only one of the many immigration threats to security. Because of all this, now is the best time to examine the immigration’s impact to national security of Lithuanian in the Schengen area. The objective of this diploma thesis is to analyze the visa policy of the European Union and its impact on tourism with the focus on differences in visa requirements of concrete member states of the European Union and the selected states outside of the European Union, which considerably affect tourism in the Czech Republic or considerably participate in outbound tourism of the Czech Republic. The submitted diploma thesis captures the current status of the visa policy of the European Union and compares visa policies of the Czech Republic and the remaining member states of the European Union with countries located outside of the European Union. A significant part of this diploma thesis are structured interviews with experts on the visa policy of the European Union in relation to tourism. The aim of this part is to compare different opinions of experts on tourism and the visa policy. This diploma thesis is divided into five main parts, which are further divided into individual subsections.

Narušení zákonnosti ČR cizinci - migrační vlna velkého rozsahu / Law breaking by foreigners in Czech republic - the migration flow of large extent.

In 2004, the ČR joined the European Union and in 2007 joined the Schengen area. These two historic moments were the reason for creation of legislative changes, which mainly relates to the protection of external borders of the state, public order in the ČR and the introduction of various laws and directives governing the movement of goods, among other things and stay of foreigners in the ČR. Part of the strategy to ensure public order in the Republic is among other type plan "large-scale migration wave." It is important to note that the accession to the Schengen area was to abolish national border crossings and it is now possible the free movementofpersons, includingforeigners. ČR has become a country that has the inner land borders and outer boundaries is only at international airports. Although this fact has brought for the citizens of ČRfor example great ease when traveling, but there is a large open space for international crimes, which are undoubtedly related to illegal migration and smuggling, human trafficking, narcotics and weapons. Based on the above fact, the conclusion is sufficiently justified that type plan ?wave of large-scale migration? currently has its real foundation and there is a risk that the migration wave of foreigners can come to the ČR. This assumption is supported by research of migratory flows to Europe and to the ČR, it is also influenced by the unstable political situation in African and Asian countries. This plan type governs the procedures and schedule the activities of government ministries, regional authorities and municipalities. Many tasks are performed by the Ministry of Interior, particularly the Department of Asylum and Migration Policy, and police components, particularly the Alien Police Service is currently the Foreign Police Departments included in the structure of the Regional Directorate of Police. There has been a major reorganization from 1. 1. 2011, whose components fulfill the tasks of this type plan. Until now hasn´t been established police departments that would assume the tasks after the Alien Police Service, and therefore will be created the draft update of this plan on my part.
