Previous issue date: 2013-10-19 / The research aimed to understand the challenges for the implementation of the
proposed integration between the Civil Police and the Military Police in Rio Grande
do Norte to the proposals of the SUSP. This study aimed to explore the gap with
regard to the deepening of the possible causes that may hinder the implementation
of integrated working between the police in public security, through a specific
analysis on the state of Rio Grande do Norte. Was based on a theoretical framework
that includes policies: general concepts, the steps of a public policy, the
implementation stage , public security : conceptual definitions, policies on security in
Brazil, the structure of public security in Brazil and systems police, Military Police x
Civil Police: Roles and conflicts , integrating public security: the challenges to be
overcome, the Unified public Safety (SUSP) and the main difficulties in the
integration of the police. Being classified as to the purposes as an exploratory
research on how to approach ranks as qualitative. The research unit was the Center
for Integrated Operations Public Safety (CIOSP) through three subjects who were the
chief CIOSP, the representative of the military police acting with the CIOSP, and
representative civil police also active with the CIOSP. These subjects were chosen
because of the understanding that individuals occupying senior positions would have
more ability to respond to questions that guide the research problem. Data were
collected through a set of interviews, qualitative data analysis was performed based
content analysis, based on the definition of categories of analysis, gated time cross.
With the results, it was revealed that the main problems of integration between the
state police are treatment protocols, lack of political will and lack of infrastructure.
The relationship between the Military Police and Civil Police in Rio Grande do Norte
has differing cultural aspect, but can be considered as good value, professionalism
and integrated operations. The implementation of CIOSP-RN followed the
characteristics of the top-down model, the main difficulties in implementing the
proposals of the SUSP, lack of own resources, the lack of standardization in public
safety and the lack of professional training of public safety. It was concluded that with
respect to the challenges to the implementation of the proposed integration between
the Civil Police and the Military Police in Rio Grande do Norte to the proposals of the
SUSP, the actions follow the characteristics of the top-down model, with no
autonomy of administrators public to say in decisions, which restricts the view of the
public safety of the state / A pesquisa teve por objetivo compreender os desafios para a implementa??o das
propostas de integra??o entre a Pol?cia Civil e a Pol?cia Militar no Rio Grande do
Norte a partir das propostas do SUSP. Este trabalho buscou explorar a lacuna
existente no que diz respeito ao aprofundamento das poss?veis causas que podem
dificultar execu??o do trabalho integrado entre as pol?cias na seguran?a p?blica,
atrav?s de uma an?lise espec?fica sobre a situa??o do Rio Grande do Norte.
Baseou-se em um referencial te?rico que contempla pol?ticas p?blicas: Conceitos
gerais, as etapas de uma pol?tica p?blica, a etapa da implementa??o, seguran?a
p?blica: Defini??es conceituais, pol?ticas p?blicas em seguran?a no Brasil, a
estrutura da seguran?a p?blica no Brasil e os sistemas policias, Pol?cia Civil x Pol?cia
Militar: Atribui??es e conflitos, integra??o na seguran?a p?blica: Os desafios a serem
superados, Sistema ?nico de Seguran?a P?blica (SUSP) e as principais dificuldades
para a integra??o entre as pol?cias. Sendo classificada quanto aos prop?sitos como
uma pesquisa explorat?ria, quanto ? forma de abordagem classifica-se como
qualitativa. A unidade de pesquisa foi o Centro Integrado de Opera??es de
Seguran?a P?blica (CIOSP), atrav?s de tr?s sujeitos de pesquisa que foram o chefe
do CIOSP, o representante da policia militar atuante junto ao CIOSP, e o
representante da policia civil tamb?m atuante junto ao CIOSP. Estes sujeitos foram
escolhidos em virtude do entendimento de que indiv?duos ocupantes de cargos
superiores teriam mais capacidade de responder aos questionamentos que balizam
o problema da pesquisa. Os dados foram coletados atrav?s de um roteiro de
entrevistas, a an?lise de dados qualitativa se deu a partir da an?lise de conte?do,
baseado na defini??o de categorias de an?lise, com delimita??o de tempo
transversal. Com os resultados, revelou-se que os principais problemas de
integra??o entre as pol?cias do estado s?o os protocolos de atendimento, a falta de
vontade pol?tica e a falta de infraestrutura. A rela??o entre a Pol?cia Militar e a Pol?cia
Civil no Rio Grande do Norte apresenta diverg?ncias de aspecto cultural, mas pode
ser considerada como uma boa rela??o, de profissionalismo e de atua??o integrada.
A implementa??o do CIOSP-RN seguiu as caracter?sticas do modelo top-down,
tendo como principais dificuldades de implementa??o das propostas do SUSP, a
falta de recursos pr?prios, a falta de padroniza??o na seguran?a p?blica e a falta de
capacita??o dos profissionais da seguran?a p?blica. Concluiu-se que com rela??o
aos desafios para a implementa??o das propostas de integra??o entre a Pol?cia Civil
e a Pol?cia Militar no Rio Grande do Norte a partir das propostas do SUSP, as a??es
seguem as caracter?sticas do modelo top-down, n?o existindo autonomia dos
administradores p?blicos para opinar nas decis?es, o que restringe a vis?o da
seguran?a p?blica do estado

preservou espa?os normativos paradoxais. Isto ?, as pol?cias militares vinculadas ao
Ex?rcito com um estatuto jur?dico restritivo da cidadania do policial atrav?s de um
modelo hier?rquico e disciplinar anacr?nico. Esta pesquisa parte da seguinte
problem?tica: Como ? poss?vel adequar o sistema de constitucional de seguran?a
p?blica, especificamente as Pol?cias Militares, aos paradigmas democr?ticos constru?dos
pelo Constituinte origin?rio em 1988 e efetivar Direito ? Seguran?a P?blica sob estes
moldes? As limita??es militaristas da Constitui??o permitiram a crescente militariza??o
dos ?rg?os policiais, cultura organizacional e pr?ticas institucionais autorit?rias.
Subjacente a isto, os problemas vinculados as dificuldades de efetiva??o do Direito ?
Seguran?a P?blica, as greves das pol?cias militares, o ciclo incompleto de pol?tica
passaram a exigir do sistema jur?dico-constitucional respostas adequadas. Utilizando-se
do m?todo dial?gico e uma abordagem interdisciplinar da tem?tica, e teoricamente
fundamentado na supera??o do juspositivismo constitucional normativista. Constatou-se
que a legisla??o infraconstitucional constru?da foi insuficiente para suprir as lacunas
sist?micas da norma constitucional, ao procurar a cria??o de um sistema ?nico de
seguran?a p?blica sem dar devida amplitude ao princ?pio federativo e ampliar a
autonomia dos estados federados, e nem mesmo conceder um status jur?dico
democr?tico aos policiais militares. Os limites jur?dicos formais impostos pelo texto
constitucional constru?ram um anacronismo jur?dico, as pol?cias militares. Assim, uma
leitura democr?tica das institui??es policiais militares torna inconceb?vel a sua
exist?ncia no ambiente normativo constitucional. Desse modo, reformar a Constitui??o
com o objetivo de desmilitarizar as pol?cias e realizar um redesenho normativo do
sistema de seguran?a p?blica ? fundamental para democracia constitucional brasileira / The normative construction of the public security system in the Constituent Assembly
of 1987-1988 preserved paradoxical normative space, the military police linked to the
Army with a restrictive legal statute of the police offices citizenship through a
hierarchical and disciplinary model that is anachronistic. This research originates from
the following problem: How is it possible to tailor the constitutional system of public
safety, specifically the Military Police, according to the democratic paradigms
constructed by the Constituent from 1988 and carry the right to public safety under
these molds? The militarists limitations of the Constitution allowed the growing
militarization of police departments, organizational culture and authoritarian
institutional practices. Underlying this, the problems related to difficulties in realization
of Right to Public Safety, the strikes of the military police, the incomplete policy cycle
started demanding from the constitutional-legal system appropriate responses. Utilizing
the dialogical method and an interdisciplinary approach to the subject, and theoretically
grounded in overcoming of the constitutional normativist juspositivism.It was found
that the constructed infraconstitutional legislation was insufficient to supply the
systemic shortcomings of constitutional law, when looking to create a single system of
public security without giving due scope to the federal principle and expand the
autonomy the Federated States, and even grant democratic legal status to the military
police. Formal legal limits imposed by the Constitution constructed a legal
anachronism, the military police. Thus, a democratic reading of military police
institutions becomes inconceivable its existence in the constitutional regulatory
environment. Thus, reform the Constitution in order to demilitarize the police and
conduct a normative redesign of the public security system is fundamental to Brazilian
constitutional democracy

Previous issue date: 2017-04-28 / This study addresses the social participation in the Municipal Public Security Management:
Analyzing the Municipal Council of Justice and Security of Porto Alegre. It has a relevant impact
on the lives of citizens and one of the objectives proposed here refers to the extent to which
this social participation can contribute to the debate and discussion of the management of
public safety policies in the city of Porto Alegre. This dissertation explores the dynamics of
functioning of the Municipal Council of Justice and Security of Porto Alegre in the year 2015,
observed in its monthly meetings of that year. It can be said that the space model is adequate,
but participation is very incipient, dependent on public management. As well as pointing out
that, prior to the idea of how to think about public security policy, there is the reform and
strengthening necessary for institutions, such as police. As a proposal of continuity of this study
is the research of strategies of motivation between the residents and institutional
representatives. Stimulating knowledge of their realities to align with political practice. / Este estudo aborda a participa??o Social na Gest?o Municipal da Seguran?a P?blica: Analisando
o Conselho Municipal de Justi?a e Seguran?a de Porto Alegre. Ela tem impacto relevante na vida
dos cidad?os e um dos objetivos aqui propostos se refere em que medida essa participa??o
social pode contribuir para o debate e a discuss?o da gest?o das pol?ticas p?blicas de seguran?a
no munic?pio de Porto Alegre. Essa disserta??o explora a din?mica de funcionamento do
Conselho Municipal de Justi?a e Seguran?a de Porto Alegre no ano de 2015, observada em suas

Previous issue date: 2014-03-28 / The present research aims to contribute in the consolidation of the sociological knowledge formulated by David Garland as the Sociology of Punishment. It also aims to evaluate the extent to which changes in cultural patterns related to crime, criminals, and punishment coincide with what the British sociologist named as a new experience with the postmodern crime complex. To this end, this study revealed the social representations of punishment shared by the higher strata of three institutions that control crime in the state of Rio Grande do Sul: civilian police officers, Colonels and Colonel-Lieutenants of the Military Police, and officers and managers of the Superintendence of Prison Services (Superintend?ncia dos Servi?os Penitenci?rios, SUSEPE). Additionally, the Theory of Social Representations was used to break with traditional concepts that for a long time have identified punishment as a simple instrument of power, domination and disciplining. Far from denying the coercive and disciplinary functions of punishment, this theory emphasizes the symbolic dimensions of punishment as a social phenomenon, which for a long time have been neglected by educated thinking. The research instrument covered three interconnected main axes the socio-professional profile of the actors analyzed; their social representations of punishment and of the penalty of deprivation of liberty, and their concepts on crime politics , in order to question research respondents about their beliefs, feelings and criticisms regarding the study topics. In view of this, considering the historical and cultural peculiarities of Brazilian sociability, concerning both the deep country's deep economic and social inequalities and the incomplete historical task of ensuring state monopoly of legitimate violence, and also the Brazilian repeated experience with authoritarian regimes, this approach aimed to determine the extent to which trends pointed out by Garland as constituting the reconfiguration of crime control are present in the national reality, especially in the context of crime control. An analysis of the content of their discourse reveals a change in the symbolic system that reports punishment and defines new mechanisms to fight against crime. Thus, it is possible to identify two trends regarding crime control: on one hand, the restatement of the social function of punishment, aimed at ensuring the moral and social unity within a society increasingly more fractured and unequal; and, on the other hand, the skepticism towards the efficacy of imprisonment in fighting against crime and rehabilitating offenders. These notions contributed both to bury resocialization ideas and to endorse a higher intervention of penal law, especially regarding law enforcement institutions. In parallel with this, it was also observed that research participants were open-minded to preventive strategies and to the increase in control and surveillance network, which was evidenced by the support of the use of alternative sentences, electronic monitoring, and restorative techniques to solve conflicts. Although this investigation demonstrates the prevalence of punishing strategies, this topic is characterized by an undeniable ambiguity, considering its high permeability, which enables both the implementation of preventive and restorative and preventive strategies and the emergence of disputes between the many different points of view. / A presente pesquisa se insere como aporte no movimento de consolida??o do campo do saber sociol?gico, formulado por David Garland como Sociologia do Castigo. Ao buscar captar as representa??es sociais do castigo compartilhadas pelos estratos superiores de tr?s das institui??es que comp?em o campo do controle do crime do Estado do Rio Grande do Sul: os Delegados da Pol?cia Civil, os Coron?is e Tenentes-Coron?is da Brigada Militar e os Delegados e Administradores da SUSEPE, se pretende avaliar o quanto as altera??es ocorridas nos padr?es culturais acerca do crime, o criminoso e o castigo, coincidem com o que o soci?logo ingl?s denominou como nova experi?ncia com o complexo criminal da p?s-modernidade. Para tanto, foi recepcionada a Teoria das Representa??es Sociais, metodologia que possibilitou romper com as concep??es tradicionais que, por muito tempo, identificaram o castigo, como simples instrumento de poder, domina??o e disciplinamento. Longe de negar as fun??es coercitivas e disciplinadoras, a metodologia em quest?o d? ?nfase ?s dimens?es simb?licas do fen?meno social castigo, por muito tempo relegadas pelo pensamento culto. O instrumento de pesquisa,ao entrela?ar tr?s eixos essenciais o perfil socioprofissional do atores pesquisados; as representa??es sociais do castigo e da pena privativa de liberdade, e as concep??es de pol?tica criminal buscou interrogar os interlocutores da pesquisa sobre cren?as, impress?es e cr?ticas diante dos temas em quest?o. Nesta perspectiva, considerando as singularidades hist?rico-culturais da sociabilidade brasileira, tanto no que tange ?s profundas desigualdades econ?micas e sociais, como a incompletude da tarefa hist?rica de garantir o monop?lio estatal da viol?ncia leg?tima, e ainda, a reiterada experi?ncia com os regimes autorit?rios, esta abordagem teve por finalidade confrontar em que medida as tend?ncias apontadas por Garland, como constitutivas da reconfigura??o do campo do controle do crime, est?o presentes na realidade nacional, em especial, no campo do controle do crime. A interpreta??o do conte?do dos discursos demonstra uma mudan?a no sistema simb?lico que informa o castigo, assim como define os novos mecanismos para combat?-lo. Identifica-se, assim, no interior do campo do controle do crime, de um lado, a reafirma??o da fun??o social do castigo, voltada para garantir a unidade social e moral no interior de uma sociedade cada vez mais fraturada e desigual; e, de outro, o ceticismo frente ? efic?cia da pena de pris?o para combater a criminalidade e reabilitar o delinquente. Tais no??es contribu?ram tanto para soterrar os ideais ressocializadores, como para referendar uma maior interven??o do direito penal, essencialmente no tocante aos institutos da execu??o penal. Paralela a isto, se observa tamb?m uma abertura dos participantes da pesquisa frente ?s estrat?gias preventivas e de amplia??o da rede de controle e vigil?ncia, evidenciada no apoio ? maior utiliza??o das penas alternativas, a introdu??o do monitoramento eletr?nico e a utiliza??o de t?cnicas restaurativas de resolu??o de conflitos. Em que pese a pesquisa demonstre a preval?ncia das estrat?gias punitivistas, n?o h? como negar a ambiguidade que caracteriza o campo pesquisado, tendo em vista a sua alta permeabilidade, que possibilita tanto a recep??o de estrat?gias preventivas e restaurativas, como permite disputas entre os mais diferentes pontos de vista.

The combination formed by the loss of credibility of the public authorities in the management of collective life and the diffused social representations regarding the fear of violence can lead to a generalized feeling of insecurity, resulting in political alienation, spatial segregation, and the utilization of private resources for self-protection and self-restraint. What can be seen, therefore, is the lack of structure of the urban society by the reduction of spontaneous traffic in urban spaces and the possibilities of the encounter with the difference that, ultimately, enhances the risk scales. Therefore, through a case study in the Floresta neighborhood, in Porto Alegre/RS, in which proposes the tension of the relation between space, sociability, and safety, questioning the local social dynamics in its potential capability of producing cracks in the homogeneous and hegemonic tissue of the individual isolation, formulating an emancipatory rapture with the urban experience grounded in fear and a redefinition of social-spatial experience. Previous issue date: 2012-03-30 / The present dissertation, developed within the field of Criminology and Social
Control, aims at examining the extent to which the discourses of fear and insecurity
mould the reactive and repressing policies adopted to respond to the problem of
crime. Contemporary crime control theories are identified and analyzed, particularly
Left Realism and its emphasis on the adoption of prevention policies, so as to
evaluate the impact, limits and possibilities of this movement on public security
policies in Brazil during President Luiz In?cio Lula da Silva?s tenures from 2002 on.
Following the analysis of the contemporary political-criminal and socioeconomic
scenario, the research reflects upon the problem of public security and the fear of
crime incorporated by society, in order to examine the responses to crime and the
crime policy movements underlying such responses. Next, contemporary crime policy
movements are identified and their proposals and most significant aspects are
analyzed. Among the crime policy movements stands Left Realism, which supports
the articulation of preventive policies as possible alternatives to punitivism. Thus,
after the analysis of the public security programs adopted in Brazil, the study
investigates the influence of Left Realism on the current public security policy in
Brazil, its limits and possibilities of preventing crime. / A presente disserta??o, desenvolvida na linha de pesquisa Criminologia e
Controle Social, busca averiguar o impacto do movimento do Realismo de Esquerda,
seus limites e suas possibilidades frente ?s pol?ticas criminais brasileiras de
seguran?a p?blica no combate ? criminalidade durante os dois mandatos do
Presidente Luiz In?cio Lula da Silva, desde o ano de 2002. A pesquisa parte da
apresenta??o e an?lise do cen?rio pol?tico-criminal e socioecon?mico
contempor?neo, para, refletindo sobre o problema da seguran?a p?blica e do medo
do crime incorporado pela sociedade, analisar as respostas ? demanda do crime no
?mbito da seguran?a p?blica e os movimentos de pol?tica criminal que est?o por tr?s
destas respostas. Em seguida, s?o identificados os movimentos de pol?tica criminal
contempor?nea, s?o analisados os seus aspectos mais relevantes e as suas
propostas de pol?tica criminal. Dentre os movimentos de pol?tica criminal destaca-se
o Realismo de Esquerda, que apresenta poss?veis alternativas ?s pol?ticas
puramente punitivistas com a articula??o de pol?ticas preventivas. Assim, ap?s a

Previous issue date: 2016-03-29 / This thesis investigated municipal prevention policies against violence in Brazil, the challenges encountered in their implantation and some specific public safety experiences, i.e. in the municipalities of Diadema, in the state of S?o Paulo, and in Canoas, in the State of Rio Grande do Sul, which were the first to innovate in this domain, showing good results in criminal occurrences, in creating a closer relationship with the community and in integrating federal, state and municipal bodies. Furthermore, the thesis aimed at discussing the changes that have been thought, debated and presented to modify the public safety system in Brazil before, during and after the Federal Constitution?s entry into force in 1988. The importance of offering public safety services oriented towards the exercise of citizenship, in an integrated way between police and community bodies, was also discussed. Municipalities that implemented prevention public policies against violence through the Integrated Management Offices (GGI, in Portuguese) were especially highlighted. Bibliographical review was presented in a chapter focusing on violence, public safety and democracy, on how they developed throughout Brazilian history until nowadays, as well as on public safety management and public policies concerning this topic, analyzing their development in Brazil. Another chapter aimed at presenting the Uruguayan model of public safety, as a result of a PhD research period, looking for similarities and divergences in the adoption of safety policies between these two countries. As far as municipal prevention policies against violence were concerned, the role of local management power was investigated: in order to achieve this goal, the analysis of these two violence prevention experiences was carried out, the main criminality indicators - before, during and after its implementation - were collected and local, state and national managers in the field were interviewed through the Ministry of Justice and the National Secretariat for Public Safety (SENASP, in Portuguese). The main goal was to answer the following research question: why is it so difficult to consolidate these experiences in Brazil, despite the consensus over the importance of the role of municipalities and of prevention policies against violence in the field of public safety? The conclusion pointed out that these changes do not occur because there is an established public safety model that confers all the power to police corporate structures and, according to them, it is not sure that this change would be positive. Furthermore, considering how municipalities are recognized in the Constitution, in the article concerning public safety, these bodies do not have direct responsibility in this field. Nevertheless, the several Proposals for Constitution Amendment (PEC, in Portuguese) related to this topic show the difficulty in altering any provision referring to the current national public safety system. In Brazil, consolidation of municipal violence prevention experiences has proven to be very difficult, being limited to specific and voluntary-based examples, or to cases dictated by the affinity of local managers with the topic, as in the two examples observed in Diadema/SP and in Canoas/RS. / Esta tese estudou as pol?ticas municipais de preven??o ? viol?ncia no Brasil, os desafios enfrentados na sua implanta??o e as experi?ncias pontuais no campo da seguran?a p?blica, mais especificamente nos munic?pios de Diadema, em S?o Paulo e de Canoas, no Estado do Rio Grande do Sul que, de forma precursora, inovaram neste campo, apresentando bons resultados nas incid?ncias criminais, na aproxima??o com a comunidade e integra??o entre os ?rg?os federais, estaduais e municipais afins. A tese buscou inserir, tamb?m, a discuss?o sobre as mudan?as pensadas, discutidas e apresentadas para modifica??o do sistema de seguran?a p?blica no Brasil antes, durante e ap?s a entrada em vigor da Constitui??o Federal de 1988. Al?m disso, se discutiu a import?ncia de uma presta??o dos servi?os de seguran?a p?blica voltados ao exerc?cio da cidadania, de forma integrada entre os ?rg?os policiais e a comunidade onde atuam, pontos com destaque nos munic?pios que implementaram pol?ticas p?blicas de preven??o ? viol?ncia atrav?s dos Gabinetes de Gest?o Integrada (GGI). A revis?o bibliogr?fica foi contextualizada em cap?tulo sobre viol?ncia, seguran?a p?blica e democracia, como elas se desenvolveram ao longo da hist?ria brasileira, at? os dias atuais, assim como a gest?o da seguran?a p?blica e das pol?ticas p?blicas afins ao tema, trazendo uma an?lise de como ela se estruturou no Brasil e um cap?tulo apresentando o modelo de seguran?a p?blica no Uruguai, como resultado do doutorado sandu?che, buscando pontos comuns e de diferencia??o na ado??o de pol?ticas de seguran?a entre estes dois pa?ses. No ponto que tratou das pol?ticas municipais de preven??o ? viol?ncia, foi pesquisado o papel do poder local na sua gest?o, com an?lise dessas duas experi?ncias pontuais voltadas ? preven??o da viol?ncia, o levantamento dos principais indicadores de criminalidade antes, durante e ap?s sua implanta??o e entrevistando gestores locais, estaduais e com gerenciamento nacional na ?rea atrav?s do Minist?rio da Justi?a e da Secretaria Nacional de Seguran?a P?blica (SENASP), visando o alcance dos objetivos propostos. O objetivo central buscou responder ao seguinte problema de pesquisa: Por que no Brasil, apesar de quase todo o consenso da import?ncia do papel dos munic?pios e das pol?ticas de preven??o ? viol?ncia no campo da seguran?a p?blica, ? t?o dif?cil ? consolida??o destas experi?ncias? Concluiu-se que estas mudan?as n?o ocorrem porque h? um modelo institu?do de seguran?a p?blica que concede todo o poder ?s estruturas corporativas das pol?cias e para elas n?o h? um convencimento de que esta mudan?a seria positiva e, da forma como os munic?pios est?o inseridos na Constitui??o, no artigo que trata da seguran?a p?blica, esses entes n?o t?m responsabilidade direta nesta ?rea, por?m as v?rias Propostas de Emenda Constitucional (PEC) que tramitam nas casas legislativas, e que tratam deste tema, nos diagnosticam o quanto ? dif?cil alterar qualquer dispositivo que trate do atual sistema nacional de seguran?a p?blica. No Brasil, a consolida??o de experi?ncias municipais de preven??o ? viol?ncia t?m se mostrado muito dif?cil, restringindo-se a exemplos pontuais, voluntaristas e de afinidade dos gestores locais com o tema, como nos dois exemplos pesquisados de Diadema/SP e Canoas/RS.

Previous issue date: 2016-03-31 / This study aims to analyze the drug policy and its consequences produced in combating the trade in illicit substances, mainly in the form of police action. Therefore, the aim of this study was the analysis of the forms of police action in the implementation of this policy, the identification of the subjects involved and the results produced by the police action with regard to made seizures and incriminated individuals. For this the research was divided into two chapters. At first chapter, there was a chronological review of the implementation of the criminal policy of drug over time in order to reflect on the reasons for its emergence. Also, we attempted to study the consequences generated because of criminal drug policy, analyzing the impacts from the alleged legislative intent, the outlawry, reduce the consumption of certain substances and violence. In the second chapter presents the field research conducted in the State Department of Narcotics Investigations (DENARC / RS) of the state civil police. We analyzed police investigations containing arrest records in the act and detailed terms. In addition to observing the practices and discourses produced by security agents to understand what the dynamics and motivations of their actions, who are incriminated subject, what are the nature and quantity of seized substances and objects, and finally, if there are and what are the criteria that guide the typical frameworks for trafficking and consumption of drugs. Thus, it was possible to realize the fragility of police action, manifested in superficiality of investigations In addition, there was little impact produced by the police actions in the traffic market that, in addition to small seizures made, occur - invariably - in the same places, vulnerable urban areas, reaching thus always the same social class individuals more low, with little study and people with police records, regardless of the amount of seized substances. / O presente trabalho tem como escopo a an?lise da pol?tica criminal antidrogas e suas consequ?ncias produzidas. Seu objetivo foi o estudo das formas de atua??o da pol?cia na implementa??o dessa pol?tica, a identifica??o dos sujeitos envolvidos e os resultados produzidos. Para tanto, realizou-se uma an?lise cronol?gica da implementa??o da pol?tica de guerra ?s drogas ao longo do tempo, objetivando refletir sobre as raz?es do seu surgimento. Em um segundo momento, buscou-se estudar as consequ?ncias geradas em raz?o da proibi??o das drogas, analisando-se os impactos a partir da pretensa inten??o legislativa de, com a criminaliza??o, reduzir o consumo de determinadas subst?ncias e a viol?ncia. A principal virtude deste estudo foi a pesquisa de campo realizada no Departamento Estadual de Investiga??es do Narcotr?fico (DENARC/RS) da pol?cia civil ga?cha, no qual foram analisados inqu?ritos policiais que continham autos de pris?o em flagrante e termos circunstanciados, al?m de observadas as pr?ticas e discursos produzidos pelos agentes de seguran?a para se entender quais as din?micas e motiva??es das suas a??es, quem s?o os sujeitos incriminados, quais s?o a natureza e a quantidade das subst?ncias e objetos apreendidos e, por fim, se existem e quais s?o os crit?rios que pautam os enquadramentos t?picos por tr?fico e consumo de entorpecentes.

The 1988 Constitution recognized the rights of life, liberty and personal integrity, considered torture and racial discrimination as crimes. The prime directive of the National Security and Citizenship (Law No. 11,707 of June 19, 2008 - PRONASCI-Brazil) expresses the commitment of the Brazilian state with the promotion of human rights. But despite this formal recognition, official violence continues to be used as a means of maintaining social order, consolidating a police action violating human rights (Amnesty International report "They go in shooting" - AI Index: AMR 19/025/2005) . This thesis analyzes the police work combined with the extension of citizenship rights, the spaces of freedom and democracy as a measure for the degree of affirmation or denial of the Human Rights in Brazil, and proposes the construction of a human friendly Police Force (Post - Colonial, Post-Abyss, Intercultural and Democratic) / Segundo o Plano Nacional de Seguran?a P?blica, a seguran?a ? [...] um bem por excel?ncia democr?tico, legitimamente desejado por todos os setores sociais, que constitui direito fundamental da cidadania, obriga??o constitucional do Estado e responsabilidade de cada um de n?s . A Constitui??o de 1988 reconheceu os direitos ? vida, ? liberdade e ? integridade pessoal, e considerou a tortura e a discrimina??o racial como crimes. A primeira diretriz do Programa Nacional de Seguran?a P?blica com Cidadania (Lei n. 11.707, de 19 junho de 2008- PRONASCI-Brasil) expressa o compromisso do Estado Brasileiro com a promo??o dos direitos humanos.
