Daňověprávní aspekty sdílené ekonomiky / Tax Law Related Aspects of Sharing Economy

This thesis consists of four chapters, introduction and conclusion. In the introduction to this thesis, the author clarifies the reasons for choice of the subject of the thesis, defines the aims of the thesis and its systematic as well as describes the methodology of the thesis and the default sources. In the first chapter, the author deals with definition of the concept of shared economy and connected critical reflections. The second subchapter of the first chapter deals with description of selected shared economy representatives, with whom the application part of the thesis shall deal with. The second chapter generally defines the relevant institutes of tax law such as tax evasion and tax optimization, whereas the author deals with the difference between them. Further, attention is paid to circumvention of law, obscured legal action, abuse of law and the fight against tax evasion. The centerpiece of this thesis is included in the third chapter, which is focused on application of tax legal regulations to selection of representatives of shared economy. The relevant chapter is divided into four subchapters, each dealing with individual taxes. Can I trust you? : The importance of trust when doing business on P2P online platforms

This report has focused on how important a buyers eWOM is compared to his/her visual information when sellers decide if they can trust this buyer. A focus company was Airbnb, an online P2P platform where private individuals can rent out their living quarters to other private persons. The method involved sending out online web surveys to approximately 200 students in Högskolan Kristianstad. Results from these surveys suggests that a buyer’s eWOM and visual information had little or no impact upon if a seller decides to trust this buyer or not. The variable that had the most significant impact upon trust and thus the host’s intention to rent was the variable risk propensity.

A economia compartilhada é um sistema econômico baseado no compartilhamento de bens subutilizados, de forma gratuita ou por uma taxa. Com os adventos da internet, smartphones e Gps surgiram as plataformas digitais que se baseiam nesse conceito, em que se faz emergir a necessidade da compreensão de sua relação com mercados two-side. Tal expansão atingiu diversos setores da economia, e, ainda, criou nova demanda, como a plataforma Uber, o que, no entanto, gerou distúrbios no setor de táxis, tradicionalmente regulamentado e com ineficiências mundialmente reconhecidas. Dessa forma, o objetivo dessa dissertação é entender o que são as plataformas digitais e analisar o caso especifico da empresa Uber, apresentando quais os principais fatores que permitiram que esse tipo de empresa surgisse; onde estamos, definindo o que é efetivamente a Uber e os serviços por ela prestado, abordando quais os ganhos de bem-estar proporcionados (excedente do consumidor) e problemas de regulamentação enfrentados; e para onde iremos, prospectando um caminho para a economia compartilhada a respeito das plataformas digitais em mercados two-side. / Shared economy is an economic system based on the share of underutilized goods free of charge or for a fee. With the advent of the internet, the digital platforms based on this concept have been developed, emerging the need of understanding its relationship with two-side markets. This expansion has reached various sectors of the economy, as well as created new demand, such as the Uber platform, which ,however, has generated disturbances in the taxi sector, traditionally regulated with its worldwide recognised inefficiencies. Thus, the goal of this dissertation is to understand what the digital platforms are and to analyse the specific case of Uber company, showing the main factors which allowed this type of business to arise; where we are, defining what Uber effectively is and the services provided by it, addressing the welfare gains provided (consumer surplus) and regulatory problems faced; and where we go, prospecting a path for the shared economy regarding the digital platforms in two-side markets.

Can I sleep at your place tonight? : A case study on the shared economy and practices of trust assessment.

This thesis discusses the increased amount of information available online, and how we use it in our daily lives to make decisions. It aims to open a discussion on the complexity of accessing and evaluating digital information. As the Internet has grown, the amount of information available to the public has exploded. Not only have we gained access to what seems to be an unlimited amount of sources, but also the number of producers has grown. By means of a case study, this thesis explores practices of trust assessment within the shared economy. Through the lens of Actor-Network-Theory as well as Modern Social Imaginaries, media practices are studied by using the example of Airbnb, an online, shared economy platform for accommodation. Airbnb users as well as other travelers are asked about their media practices through an online survey with 229 respondents as well as in-depth interviews with 7 users of Airbnb. Results show that practices of trust assessment differ within and outside of the platform. There is a strong dependency on social information, produced by fellow platform users, especially in the form of reviews. In addition the study finds support for a social imaginary, in which the platform defines the accepted behavior for the users of the platform, who within the economic constraint comply with the social norm set by the organization, in order to be able to use the services of Airbnb.

The research question considers how collaborative consumption can be expanded in order to establish a win - win system for businesses and consumers, as well as to understand if this practice is driven by social, economic or technological drivers (OWYANG, 2013c). It is presented as the collaborative consumption established in society, driven by the internet, creating a new culture, based on the consumption systems defined by Botsman and Rogers (2011) and in the twelve categories classified by Owyang et al. (2014). With the purpose of giving subsidies to the companies to develop more appropriate strategies next to this new profile of consumption, a qualitative, exploratory descriptive study was developed through a bibliographical review and semi-structured interviews in field research. The results indicate the real interests of respondents about the products or services made available on the collaborative consumption beyond the knowledge of which services are used, identifying the specifics of these social classes sharing phenomenon. It has also been possible to infer that the interest with respect to the practice of collaborative consumption is driven by several factors, one being the economic factor as the paramount among the respondents. To finalize the study are presented business and academic contributions and suggestions for research on the topic / Este estudo buscou investigar as práticas do consumo colaborativo, nos estratos sociais A e B da cidade de São Paulo, por meio da análise das facilidades, dificuldades e dos reais interesses dos entrevistados a buscarem de forma crescente o acesso e o compartilhamento em vez da posse dos produtos e serviços. A questão de pesquisa considera: De que forma o consumo colaborativo pode ser expandido a fim de estabelecer um sistema ganha-ganha, para as empresas e os consumidores, além de compreender se esta prática é impulsionada por condutores sociais, econômicos ou tecnológicos (OWYANG, 2013c). Apresenta-se como o consumo colaborativo se estabeleceu na sociedade, impulsionado pela internet, criando uma nova cultura, com base nos sistemas de consumo definidos por Botsman e Rogers (2011) e nas doze categorias classificadas por Owyang et al. Também foi possível inferir que o interesse com relação à pratica do consumo colaborativo é impulsionado por diversos fatores, sendo fator o econômico como o primordial entre os respondentes. Para finalizar o estudo são apresentadas contribuições empresariais e acadêmicas e sugestões de pesquisas sobre o tema.

The Conceptualization of Perceived Risk for Potential Sellers in the Shared Economy : With a scope on Airbnb users to become a host of their own residence on Airbnb’s platform

Purpose The purpose of this thesis is to develop a conceptualized model, which identifies the significant variables of perceived risk for current Airbnb users towards becoming a host of their own residence on Airbnb’s platform. There is a lack of information concerning the host’s risk perception to cross the trust barrier in order to become a host on Airbnb (Ter Huurne, et al., 2017). For Airbnb it is of significant importance to provide new residences since it contributes to the growth of its platform. Likewise, it applies to managing potential risks in order to generate a positive vicious circle with the absence of trusted authorities or third parties (Wu, et al., 2017). Methods A new applicable model was constructed that served as the conceptual framework for this thesis. The model consists of twelve variables, where each variable has a possible influence on the overall perceived risk for Airbnb users to become a host of their own residence on Airbnb’s platform. The survey embodied the perceived risk variables and applied a predetermined set of answers. A prerequisite was that the respondents were familiar with the platform Airbnb by having a registered account. Findings There was found to be a discrepancy between millennials’ and non-millennials’ perception of risk. Millennials found financial risk, privacy risk (payment), social risk (neighbours), physical risk, and lack of control risk to be significant. Non-millennials found performance risk, privacy risk (in-house), and lack of control risk to be significant. Both models showed that the variable ‘lack of control’ was the biggest influencer on overall perceived risk. The results also indicate that millennials are more susceptible to let financial benefits outweigh their perceived risk in comparison to non-millennials, whereas social benefits are perceived similarly. On a last note, non-millennials’ overall risk perception was found to be considerably higher than for millennials. Implications The results present a conceptual model that is based on perceived risk for e-commerce (Featherman & Pavlou, 2003). Moreover, this conceptual model added the components physical risk (Jacoby & Kaplan, 1972) and lack of control risk (Das & Teng, 2004) in order to identify overall perceived risk for Airbnb users to become a host of their own residence on Airbnb’s platform.

The legal status of drivers of traditional and alternative taxi services in terms of employment law Abstract The aim of this thesis is to apply the defining features of dependent work to the activity performedby drivers in domestic taxi service - and based on this analysis - to decide whether the nature of this work really corresponds to the declared position of drivers as independent providers of transport services mediated by a third party, or whether they potentially are misclassifiedemployees entitledto all labor benefits associatedwith such status. The subject of interest is not only the activityof "traditional"but also "alternative"taxi drivers. Actualmente, la economía compartida está ganando terreno en el sector del turismo, específicamente, en la industria hotelera, mediante las viviendas de uso turístico, también conocidas como alojamientos peer to peer (P2P). Bajo el concepto del consumo colaborativo, los alojamientos P2P representan ser una opción, tanto viable como atractiva, para los viajeros de hoy en día. Por ello, es de gran importancia comprender de mejor manera los factores que motivan a los consumidores a hospedarse en este tipo de alojamiento. En la presente investigación se estudiarán las motivaciones de los adultos jóvenes de 18 a 35 años de edad con relación al alquiler de viviendas de uso turístico. Los factores elegidos son: Beneficio económico, diversión, beneficio del alojamiento, autenticidad, beneficio social, e-wom y sostenibilidad. Para lograr comprobar las hipótesis planteadas, se ha realizado una investigación mixta: En el estudio cualitativo se realizaron focus grupales y entrevistas a expertos y, en el estudio cuantitativo; encuestas aplicadas a 258 personas. / Currently, the shared economy is gaining ground in the tourism sector, specifically in the hospitality industry, through tourist housing, also known as peer-to-peer (P2P) accommodation. Under the concept of collaborative consumption, P2P accommodation represents being an option, both viable and attractive, for today's travelers. Therefore, it is of great importance to better understand the factors that motivate consumers to stay in this type of accommodation. This research will study the motivations of young adults between 18 and 35 years of age in relation to the rental of housing for tourist use. The chosen factors are: Economic benefit, fun, accommodation benefit, authenticity, social benefit, e-wom and sustainability.
