[pt] Esta pesquisa tem por objetivo analisar as medidas de proteção aplicadas em casos de abuso sexual no I Conselho Tutelar de Duque de Caxias e sua relação com a garantia de direitos de crianças e adolescentes. Para tal, realizou-se uma pesquisa documental a partir dos registros em prontuários de 24 (vinte e quatro) casos iniciados em 2014, que continham a tipificação de violação caracterizada como abuso sexual. Buscou-se acompanhar os desdobramentos das medidas de proteção, o caminho percorrido pelos envolvidos desde a denúncia ou notificação, com ênfase no contexto de proteção versus violação dos direitos das alegadas vítimas e seus familiares, a partir da contrarreferência dos demais segmentos do Sistema de Garantia de Direitos de Crianças e Adolescentes (SGD), materializada em documentos enviados ao Conselho Tutelar. A análise dos dados indica a necessidade de qualificação de profissionais que atuam no SGD para melhor sistematização dos registros, bem como estabelecimento e efetivação de um fluxo a ser seguido em casos de abuso sexual de crianças e adolescentes. Permite ainda concluir que a comunicação recíproca entre os segmentos que integram o SGD – referência e contrarreferência – concorre para redução das fragilidades no atendimento e da ocorrência de revitimização, fortalecendo a atuação em rede na busca da garantia de direitos. / [en] This research has for objective to analyze the applied protective measures in cases of sexual abuse in the I Guardian Council of Duque de Caxias and its relation ship with the warranty of children and adolescent s rights. For such purpose, It was conducted a documental research starting from the registrations in handbooks of 26 (twenty-six) initiate cases in 2014, that contained the violation s typification characterizedas sexual abuse. It was sought to accompany the unfoldings of the protection measures, the way traveled for the involved since the accusation or notification, withem phasis in the contexto protection versus violation of theal legedvictims right sand their relatives, starting from the counterreference of the other segmentsofthe System of Warranty of Children and Adolescent s rights (SGDCA), materialized in documents sentto Guardian Council. The analysis of the data indicates the need of professionals qualification that act in SGD for better systemization of the registrations, as well as establishment and efetivation of a flow to befollowed in cases of children s sexual abuse and adolescents. It stills allow stoend that the reciprocal communication among the segments that integrate SGD – reference and counterreference - it competes for reduction of the fragilities in the servisse and of the revictimization occurrence, streng thening the performance in net in the search of the warranty of rights.

Trata-se de um estudo exploratório, baseado em pesquisa qualitativa feita no município de São Paulo. A pesquisa desenvolveu-se a partir de dois grupos de entrevistas semiestruturadas. No primeiro grupo, foram entrevistados conselheiros tutelares; no segundo, atores do SGDCA vinculados ao setor público. O estudo permitiu identificar dificuldades e limites da atuação dos conselhos tutelares, tais como infraestrutura inadequada e carência de equipamentos sociais e de entidades de atendimento. Tais limites e dificuldades mostram que os problemas na atuação dos conselhos não decorrem primordialmente, como sugere parte da literatura sobre os conselhos, de características dos próprios conselhos e do perfil dos conselheiros, mas também da relação que se estabelece entre os conselheiros tutelares e os demais atores que participam do SGDGA. Segundo a pesquisa, a falta de transparência sobre os recursos orçamentários destinados aos conselhos tutelares no município e a ausência de definição dos direitos sociais e trabalhistas dos conselheiros acabam enfraquecendo a atuação dos conselhos, que, em algumas circunstâncias, passa a se colocar de forma subordinada aos demais atores do SGDCA. A pesquisa confirmou, por outro lado, a tendência, apontada pela literatura,de atribuição de baixa prioridade aos conselhos tutelares pelo Poder Executivo. O funcionamento adequado dos conselhos tutelares e do próprio SGDCA depende do reconhecimento dos direitos de crianças e adolescentes como prioridade absoluta.

Thus, the study investigates the fundamentality rights for young people, enshrined in the Constitution of the Republic, as well as the ways of effectiveness of these rights through the actions of actors of the System Guaranteeing Rights, especially the judiciary. Focusing realized, studying theories of fundamental rights, especially Structuring a Theory of Law (Strukturiende Rechtslehre), Friedrich M?ller, who emphasizes the need for analysis of social reality in the application of the rule of law. Study also the public budget and public policies concerning children and adolescents, with emphasis on preparation of budget laws and the process of discussion, deliberation, choice and implementation of public policies for children and teenagers. It then presents the typical functions of the members of System Guaranteeing Rights, as well as prepare a plan for optimum performance for each of the actors, with emphasis on analysis of the implementation of public policies at the municipal level. Finally, it analyzes the theory of separation of three powers, and discusses the positive and negative factors for judicial intervention, concluding that the Courts can consider the action activist, from finding the omission of the Executive and legislative branches, as regards the implementation of the rights of children and adolescents, as well as the rights of children and young people are not realized in most cases, due to the omission of actors of the System Guaranteeing Rights / A pesquisa surgiu da necessidade de apresenta??o de caminhos a seguir por parte dos atores do Sistema de Garantia de Direitos da Crian?a e Adolescente (SGD), no que se refere ? concretiza??o dos direitos infanto-juvenis, pois a legisla??o em vigor no Brasil atualmente ? considerada modelo em todo o mundo e, contraditoriamente, os direitos fundamentais das crian?as e adolescentes n?o s?o concretizados, mesmo diante da prioridade absoluta garantida constitucionalmente. Assim, o estudo investiga a fundamentalidade dos direitos infantojuvenis, consagrados na Constitui??o da Rep?blica, bem como as formas de efetiva??o dos referidos direitos, atrav?s da atua??o dos atores do Sistema de Garantia de Direitos, especialmente do Judici?rio. Em seguida, apresenta as fun??es t?picas dos integrantes do Sistema de Garantia de Direitos, bem como elabora um plano de atua??o ideal para cada um dos atores, com ?nfase na an?lise da concretiza??o das pol?ticas p?blicas em ?mbito municipal.
