Sujeitas de Direitos: história de vida de mulheres bolivianas, peruanas e paraguaias na cidade de São Paulo é uma pesquisa de história oral, guiada por seu conjunto de procedimentos em todas as etapas do trabalho. As entrevistas, a partir da história de vida de cinco mulheres migrantes, seguiram seus pressupostos e formaram o corpo do documento. Baseado nessas narrativas, feitas de forma colaborativa, buscou-se abordar a história do tempo presente a partir da migração de mulheres que vieram da Bolívia, Paraguai e Peru, e escolheram viver na cidade de São Paulo. A conquista de espaços urbanos, a liberdade relativa na escolha da profissão e a mobilidade como saída da opressão familiar foram discutidas, ao lado da criação de transnacionalização familiar e das atividades que exploram as vulnerabilidades da pessoa, como o trabalho escravo e o tráfico de pessoas / Subject of Rights: the life stories of Bolivian, Peruvian and Paraguayan women in São Paulo is an oral history research project, guided in its entirety by the methods guidelines. Focused on the life trajectories of five migrant women, the interviews follow the oral history procedures, and interviews also structure the core of the present document. Grounded on the narratives of these migrants, conducted in a collaborative manner, this projected aimed to tackle the present history of women from Bolivia, Paraguay, and Peru who chose to live in the city of Sao Paulo. We discuss the seizure of urban spaces, the relative freedom of choice of occupation and mobility as an exit from family oppression, in addition to the conception of household transnacionalization, and finally the activities that endanger the individual, such as slave labor and human trafficking

Este estudo tem como ponto central a análise da escravidão temporária no campo brasileiro, relação de trabalho coercitiva e violenta a que estão sujeitos os peões contratados para as chamadas empreitas, como a derrubada de mata ou a limpeza de pasto, principalmente em latifúndios da fronteira agrícola amazônica. Defendemos a noção de escravidão temporária porque ela realça o cerne dessa relação: o tempo em que o empregador se julga no direito de controlar não apenas a força de trabalho, mas também a vida e o corpo do seu empregado como se ele fosse de fato uma mercadoria. Mas é importante ressalvar que, nos dias de hoje, a noção de escravidão também assume um significado político, caracterizando relações de trabalho que seriam mais bem definidas como superexploração. A discussão sobre a persistência de relações escravistas de trabalho sob o modo capitalista de produção nos dias de hoje é feita à luz de um estudo de caso sobre a desapropriação da fazenda Cabaceiras, localizada em Marabá, no sudeste do Pará, ocupada pelo Movimento dos Trabalhadores Rurais Sem Terra (MST), em 1999. Do ponto de vista do marco legal, trata-se da primeira desapropriação de um imóvel rural em toda a história do país motivada pelo desrespeito à função social, como prevê a Constituição Federal, em decorrência da exploração contínua de trabalho em condições análogas à de escravo, como tipifica o Código Penal Brasileiro fato ocorrido enquanto uma pequena parte da fazenda já se encontrava sob domínio MST. Porém, apesar das graves irregularidades, a verdade é que o Projeto de Assentamento 26 de Março, criado oficialmente apenas em 2008 em substituição à fazenda Cabaceiras, só saiu do papel graças à pressão do movimento social de luta pela reforma agrária. / This master dissertation focuses on the analysis of temporary slavery in Brazilian rural. Its a coercive and violent work relationship that victimizes the rural workers hired to temporary jobs, such as forest cutting and pasture clearing, mainly in Amazon great landed estates. The concept of temporary slavery emphasizes the core attribute of this work relationship: the period that the employer controls the life and the body of his employee, and not only his labour power, turning him into a commodity. Its important to note that slave labour nowadays has also a political meaning and quite often describes work relationships that would be better defined as overexploitation. This issue is discussed through a case study about the expropriation of Cabaceiras farm, in Marabá (Southeast of Pará state), which was occupied in 1999 by MST (landless rural workers movement). Legally speaking, it was the first time in brazilian history that a expropriation process of a farm was justified by the disrespect of its social function, as envisaged by the federal Constitution, due to the exploitation of employment in condition similar to slave labour, as defined by the Brazilian Criminal Code. The temporary slavery in Cabaceiras occurred when part of the farm was already occupied by MST. However, in this case, the truth is that the agrarian reform and the creation of settlement 26 de Março just happened because of the landless people movement efforts.

Esta pesquisa tem três objetivos centrais. O primeiro é compreender o fenômeno que foi denominado de migração da costura. Evidencia-se o funcionamento dos mecanismos de atração dessa força de trabalho transnacional, situados na dinâmica urbana da Região Metropolitana de São Paulo. Trata-se de perspectiva que retira os aspectos nacionais e étnicos para explicar o fluxo migratório que se insere na cidade através do trabalho na indústria de confecções. A hipótese defendida é que foi estabelecida uma afinidade eletiva entre as transformações ocorridas no setor, a partir da reestruturação produtiva, e o modo pelo qual se estrutura a migração transnacional circulante assentada no que se denominou de dispositivo oficina de costura. Esse dispositivo oferece as condições para a realização do projeto migratório: deslocamento, qualificação, trabalho, moradia e alimentação. O segundo objetivo repousa na compreensão das relações entre o dispositivo oficina de costura e a ideia de trabalho escravo. A proposta é rastrear o início do debate sobre o trabalho escravo da modalidade rural à urbana, tendo como referência os migrantes da costura e identificar tratados, marcos e leis nacionais e internacionais que incidem sobre essas populações. Em seguida, evidenciam-se algumas representações de migrantes sobre a temática. O último ponto propõe uma abordagem sobre o trabalho escravo a partir do caso da fiscalização da grife espanhola Zara. São examinadas as transformações da atuação dos agentes estatais no combate ao trabalho escravo: da repressão e criminalização à gestão do fluxo e da inserção dos migrantes na cidade, que ocorre a partir da mobilização de ONGs e de grandes empresas. Trata-se de compreender o trabalho escravo como aglutinador de uma série de políticas de inclusão, referidas no mercado, que buscam organizar esse mercado de trabalho, além de gerir o fluxo migratório. Abordam-se os limites e contradições dessas ações. A metodologia utilizada foi predominantemente qualitativa, baseada em pesquisa de campo, análise documental e entrevistas semiestruturadas. / This research has three main objectives. The first is to understand the garment workers migration. It analyzes the functioning of the sector that attracts this transnational workforce, located in the urban dynamic of Metropolitan Area of São Paulo. Our approach denies national and ethnic aspects to explain the migration flow that enters the city through the work in the garment industry. The hypothesis is that it was established an elective affinity between the changes in this industry, since the restructuring process, and the way in which is structured the transnational circulating migration, settled in what was called as the garment workshop dispositif. This dispositif provides the conditions for the realization of the migratory project: mobility, qualification, work, housing and nourishment. The second aim lies in understanding the relationship of the garment workshop dispositif with the idea of slave labour. The debate on slave labour is tracked from the rural to the urban mode, with reference to the garment workers migration. It is showed the treaties, national and international laws that concern these migrants. Then, some representations of these migrants about this subject are evidenced. The last aim shifts the understanding of slave labour. We put forward the Zara case, an inspection that identified slave labour in Zara´s chain production. We examine the transformations of the performance of state agents in the fight against slave labour: from repression and criminalization to the government of the flow and the incorporation of migrants with the mobilization of the large companies and NGOs. Slave labour is understood as agglutinating the various politics of inclusion, referred on the market, which seek to organize this labour market and govern the migration flow. This research seeks to highlight the limits and contradictions of these actions. The methodology used was largely qualitative, based on field research, documentary analysis and semi-structured interviews.

La restructuration productive de l’industrie pauliste survenue à la fin des années 1980 a réservé une place importante à la main d’œuvre migrante dans le secteur de la confection. Le circuit de sous-traitance transnational a favorisé l’arrivée des travailleurs mobiles venus des pays voisins. Suite à une intensification de ce flux migratoire au tournant des années 2000, les Boliviens se sont vite imposés comme la plus importante population migrante latino-américaine de la ville de São Paulo. Ils travaillent dans des ateliers de confection, de petites structures de production ayant l’avantage de faciliter la mobilité sociale et spatiale grâce à des carrières d’entrepreneurs migrants. Les conditions de production de l’espace géographique et social de cette migration sont mises en perspective par une identification des réseaux sociaux dont dépendent les trajectoires migratoires. Afin de saisir l’articulation entre réseaux et mobilités, nous partons du constat de l’existence de dispositifs réticulaires aux agencements variables qui opèrent comme des matrices des migrations individuelles et participent à la production d’un espace social transnational. Ces dispositifs réticulaires sont basés soit sur des liens jetables, soit sur des liens familiaux, soit sur des liens de communauté rurale. Ils donnent à voir des compétences circulatoires et relationnelles engageant une capacité d’action chez les individus concernés qui contraste avec la représentation du « travailleur esclave » qui structure une partie du rapport entre les pouvoirs publics et les migrants boliviens. / The productive restructuring of the paulist industry in the late 1980s has reserved an important place to the migrant labour in the garment sector. The transnational subcontracting circuit has favoured the arrival of mobile workers from neighbouring countries. In the wake of an intensification of this migratory flow at the turn of the 2000s, Bolivians has quickly established themselves as the largest Latin American migrant population in the city of São Paulo. They work in sweatshops, small production structures having the advantage of facilitating social and spatial mobility through careers as migrant entrepreneurs. The conditions of production of the geographical and social space of this migration are put into perspective by identifying the social networks on which the migratory trajectories depend. In order to understand the articulation between networks and mobilities, we start from the observation of the existence of reticular apparatus with variable arrangements that operate as individual migrations matrices and participate in the production of a transnational social space. These reticular apparatus are based either on disposable ties or on family ties or on rural community ties. They reveal circulatory and relational skills involving a capacity for action among the individuals concerned, which contrasts with the representation of "slave labourer" that structure part of the relationship between government and Bolivian migrants.

It examines conceptual, historic, and normative aspects related to outsourcing in Brazil, since productive chains reflect a type of outsourcing classified as external (externalized) in production, in which all of production is projected outside of the company. Following this, it analyses the way in which contemporary slavery is exteriorized in productive chains in the fashion industry in a context of globalized capitalism. Finally, using concepts connected to the a-contractual theories of employment, as well as aspects connected to the integrative subordination and formation of economic groups of labour, it fundaments the solidary responsibility shared by all companies that integrate the productive chains in the fashion industry when considering the hypothesis of flagrant slave labour in Brazilian territory. / A presente pesquisa trata da tem?tica da responsabilidade trabalhista por explora??o de m?o de obra em condi??es an?logas a de escravo nas cadeias produtivas do setor t?xtil brasileiro. It adopts a qualitative approach methodology and is based on bibliographic, documentary and interview research. The first axis seeks to articulate an understanding of the international labor regime and, in particular, the regime which tackles slave labor by surveying the formulation of norms directly linked to slave labor in the international scene. The second axis addresses public policies to combat modern-day slavery, proposing an analysis around the terms proposed in the Brazilian internal IDOS, in light of theoretical perspectives and, thus, examines the treatment of the issue, from the perspective of international and domestic legislation. The third axis analyzes the influences on public and private agents relating to the issue of implementation, from the international regime and norms, focusing on an analysis of policies to combat slave labor by means of data collection. It concludes that the fight against slave labor in Brazil, ultimately, is still deficient. It shows that the emergence of a confrontation policy, based on the National Plan to Eradicate Slave Labor, is the result of an intense process of social mobilization, as well as international pressures. However, Brazil is given as a role model across the theme. / Esta dissertação tem por escopo analisar o trabalho escravo contemporâneo no Brasil a partir de três eixos: o regime internacional do trabalho, as políticas públicas de enfrentamento e a ação governamental envolvida diretamente nas denúncias e enfrentamento. Adota metodologia de abordagem qualitativa e funda-se em pesquisa bibliográfica, documental e entrevistas. O primeiro eixo busca articular a compreensão do regime internacional do trabalho e em especial o regime de combate ao trabalho escravo a partir de um levantamento da formulação em âmbito internacional das normativas diretamente ligadas ao trabalho escravo. O segundo eixo aborda propriamente as políticas públicas de combate ao trabalho escravo contemporâneo, propondo uma análise em torno dos termos propostos nos idos internos brasileiros, à luz de perspectivas teóricas e analisa o tratamento dado ao tema, sob a perspectiva da legislação do direito internacional e interna. O terceiro eixo analisa a influência nos agentes públicos e privados em relação à questão da implementação a partir do regime e normativas internacionais, privilegiando a análise das políticas de combate ao trabalho escravo por meio do levantamento de dados. Conclui que o combate ao trabalho escravo no Brasil, em última análise, ainda é deficitário. Sinaliza que a emergência de uma política de enfrentamento, consubstanciada no Plano Nacional de Erradicação do Trabalho Escravo, resulta de um intenso processo de mobilização social, bem como, de pressões internacionais. No entanto o Brasil é dado como modelo de atuação frente ao tema.

A discussão sobre a persistência de relações escravistas de trabalho sob o modo capitalista de produção nos dias de hoje é feita à luz de um estudo de caso sobre a desapropriação da fazenda Cabaceiras, localizada em Marabá, no sudeste do Pará, ocupada pelo Movimento dos Trabalhadores Rurais Sem Terra (MST), em 1999. Do ponto de vista do marco legal, trata-se da primeira desapropriação de um imóvel rural em toda a história do país motivada pelo desrespeito à função social, como prevê a Constituição Federal, em decorrência da exploração contínua de trabalho em condições análogas à de escravo, como tipifica o Código Penal Brasileiro fato ocorrido enquanto uma pequena parte da fazenda já se encontrava sob domínio MST. Porém, apesar das graves irregularidades, a verdade é que o Projeto de Assentamento 26 de Março, criado oficialmente apenas em 2008 em substituição à fazenda Cabaceiras, só saiu do papel graças à pressão do movimento social de luta pela reforma agrária. / This master dissertation focuses on the analysis of temporary slavery in Brazilian rural. Its a coercive and violent work relationship that victimizes the rural workers hired to temporary jobs, such as forest cutting and pasture clearing, mainly in Amazon great landed estates. The concept of temporary slavery emphasizes the core attribute of this work relationship: the period that the employer controls the life and the body of his employee, and not only his labour power, turning him into a commodity. Its important to note that slave labour nowadays has also a political meaning and quite often describes work relationships that would be better defined as overexploitation. This issue is discussed through a case study about the expropriation of Cabaceiras farm, in Marabá (Southeast of Pará state), which was occupied in 1999 by MST (landless rural workers movement). Legally speaking, it was the first time in brazilian history that a expropriation process of a farm was justified by the disrespect of its social function, as envisaged by the federal Constitution, due to the exploitation of employment in condition similar to slave labour, as defined by the Brazilian Criminal Code. The temporary slavery in Cabaceiras occurred when part of the farm was already occupied by MST. However, in this case, the truth is that the agrarian reform and the creation of settlement 26 de Março just happened because of the landless people movement efforts.
