Repealing the Subdivision of Agricultural Land Act : a constitutional analysis

Thesis (LLM (Public Law))--University of Stellenbosch, 2010. / Bibliography / ENGLISH ABSTRACT: All agricultural subdivisions in the Republic of South Africa are regulated by the Subdivision of Agricultural Land Act 70 of 1970. The declared purpose of the Act is to prevent the creation of uneconomic farming units and this purpose is achieved through the requirement that the Minister of Agriculture, Forestry and Fisheries (“Minister of Agriculture”) must consent to the proposed subdivision. The Act was promulgated in the 1970s when the South African landscape was racially divided. The government of the time used law to provide benefits for the white minority. At this time the rights of non-whites were restricted. This is the social and political background of the Subdivision of Agricultural Land Act. The Act formed part of a legislative scheme that provided benefits for white farmers. More than a decade after democratisation and the end of apartheid the Subdivision of Agricultural Land Act is still in operation. The post-apartheid legislature drafted and enacted the Subdivision of Agricultural Land Act Repeal Act 64 of 1998, but it has not yet been brought into operation. During 2003 the legislature tabled the Draft Sustainable Utilisation of Agricultural Resources Bill which contains subdivision provisions that are identical to the provisions contained in the Subdivision Act. These legislative actions have created some uncertainty about the state of agricultural subdivisions. In 2008 the Constitutional Court decided that the Act continues to apply to all agricultural subdivisions and that this would be the position until the legislature chooses a definitive course of action. This constitutional analysis of the Subdivision of Agricultural Land Act examines the effect of the Act beyond the pre-constitutional legislative intention and framework under which it was enacted. If the Act cannot be saved from its apartheid context, the Repeal Act should become operational. This thesis concludes that the necessary and legitimate purpose of the Act, namely the regulation of subdivision of agricultural land, can be removed from its pre-constitutional setting in the apartheid era and may continue to justify the legitimate regulation of subdivision of land. Comparative sources, namely the United States of America, specifically the states of Oregon and Hawaii, Western Australia and the province of British Columbia, Canada indicate that the regulation of agricultural subdivisions is a valid means of protecting agricultural land. If the Act can continue to exist without its legacy of apartheid and still serves a legitimate and necessary purpose it will have to be constitutionally compliant. The purpose of the Act and the means used to realise it were tested against the Bill of Rights. The effect that the regulation has particularly on ownership entitlements was examined against section 25(1) of the 1996 Constitution. Similarly, the consequences of the regulation with regard to other rights in the Bill of Rights were investigated. The conclusion was that where the Subdivision of Agricultural Land Act is used for its purpose of preventing the uneconomic subdivision of agricultural land, in the national interest, it is a legitimate land-use regulation that can continue to justifiably operate in a constitutional dispensation. / AFRIKAANSE OPSOMMING: Alle onderverdelings van landbougrond in die Republiek van Suid-Afrika word gereguleer deur die Wet op die Onderverdeling van Landbougrond 70 van 1970. Die verklaarde doel van die Wet is om die totstandkoming van onekonomiese landboueenhede te voorkom, en hierdie doel word bereik deurdat die Minister van Landbou, Bosbou en Visserye (“Minister van Landbou”) toestemming moet verleen vir die voorgestelde onderverdeling van landbougrond. Die Wet is in die 1970s gepromulgeer toe grond in Suid-Afrika in terme van ras verdeel was. Die destydse apartheidsregering het die regstelsel gebruik om voordele vir die blanke minderheidsgroep te bewerkstellig, terwyl die regte van nie-blankes ingeperk was. Dit is die sosiale en politieke agtergrond waarteen die Wet op die Onderverdeling van Landbougrond tot stand gekom het. Die Wet was deel van ‘n wetgewende raamwerk waarbinne voordele vir blanke boere geskep is. Die doel van die tesis is om die uitwerking van die Wet op die Onderverdeling van Landbougrond te analiseer as deel van die huidige grondwetlike bedeling, aangesien dit geskep is tydens die apartheidsera. Indien die Wet nie van sy apartheidskonteks geskei of gered kan word nie sal die Herroepping Wet in werking gestel moet word. Die tesis kom tot die gevolgtrekking dat die doel van die Wet, naamlik die regulering van die onderverdeling van landbougrond, van die voor-konstitusionele agtergrond in die apartheidsera geskei kan word en dat dit kan voortgaan om die wettige regulering van onderverdeling van landbougrond te regverdig. Regsvergelykende bronne, naamlik die Verenigde State van Amerika, veral die state van Oregon en Hawaii, Wes Australië en Brits-Columbië, ‘n provinsie van Kanada, dui aan dat die regulasie van die onderverdeling van landbougrond ‘n regsgeldige metode is om landbougrond te beskerm. Die doel van die Wet en die metodes wat gebruik word om hierdie doel te laat realiseer is getoets teen die Handves van Menseregte. Die uitwerking van die regulasie op die inhoudsbevoegdhede van die eienaar is spesifiek geëvalueer teen artikel 25(1) van die 1996 Grondwet, maar die gevolge van die regulasie is ook getoets teen ander regte in die Handves van Menseregte. Die gevolgtrekking was dat waar die Wet op die Onderverdeling van Landbougrond gebruik word met die doel om onekonomiese onderverdeling van landbougrond te verhoed in die nasionale belang, dit ‘n legitieme regulasie van grondgebruik is waarvan die gebruik steeds regverdigbaar is in ‘n grondwetlike bedeling.

Modélisation procédurale par composants

Le réalisme des images en infographie exige de créer des objets (ou des scènes) de plus en plus complexes, ce qui entraîne des coûts considérables. La modélisation procédurale peut aider à automatiser le processus de création, à simplifier le processus de modification ou à générer de multiples variantes d'une instance d'objet. Cependant même si plusieurs méthodes procédurales existent, aucune méthode unique permet de créer tous les types d'objets complexes, dont en particulier un édifice complet. Les travaux réalisés dans le cadre de cette thèse proposent deux solutions au problème de la modélisation procédurale: une solution au niveau de la géométrie de base, et l’autre sous forme d'un système général adapté à la modélisation des objets complexes. Premièrement, nous présentons le bloc, une nouvelle primitive de modélisation simple et générale, basée sur une forme cubique généralisée. Les blocs sont disposés et connectés entre eux pour constituer la forme de base des objets, à partir de laquelle est extrait un maillage de contrôle pouvant produire des arêtes lisses et vives. La nature volumétrique des blocs permet une spécification simple de la topologie, ainsi que le support des opérations de CSG entre les blocs. La paramétrisation de la surface, héritée des faces des blocs, fournit un soutien pour les textures et les fonctions de déplacements afin d'appliquer des détails de surface. Une variété d'exemples illustrent la généralité des blocs dans des contextes de modélisation à la fois interactive et procédurale. Deuxièmement, nous présentons un nouveau système de modélisation procédurale qui unifie diverses techniques dans un cadre commun. Notre système repose sur le concept de composants pour définir spatialement et sémantiquement divers éléments. À travers une série de déclarations successives exécutées sur un sous-ensemble de composants obtenus à l'aide de requêtes, nous créons un arbre de composants définissant ultimement un objet dont la géométrie est générée à l'aide des blocs. Nous avons appliqué notre concept de modélisation par composants à la génération d'édifices complets, avec intérieurs et extérieurs cohérents. Ce nouveau système s'avère général et bien adapté pour le partionnement des espaces, l'insertion d'ouvertures (portes et fenêtres), l'intégration d'escaliers, la décoration de façades et de murs, l'agencement de meubles, et diverses autres opérations nécessaires lors de la construction d'un édifice complet. / The realism of computer graphics images requires the creation of objects (or scenes) of increasing complexity, which leads to considerable costs. Procedural modeling can help to automate the creation process, to simplify the modification process or to generate multiple variations of an object instance. However although several procedural methods exist, no single method allows the creation of all types of complex objects, including in particular a complete building. This thesis proposes two solutions to the problem of procedural modeling: one solution addressing the geometry level, and the other introducing a general system suitable for complex object modeling. We applied our concept and representation of components to the generation of complete buildings, with coherent interiors and exteriors. It proves general and well adapted to support partitioning of spaces, insertion of openings (doors and windows), embedding of staircases, decoration of façades and walls, layout of furniture, and various other operations required when constructing a complete building.

Dans ce mémoire, nous considérons le problème des opérations géométriques sur les surfaces de subdivision, avec l'exigence stricte de forme topologique correcte. Puisque ce problème peut être mal conditionné, nous proposons une approche pour la gestion de l'incertitude qui existe dans le calcul géométrique. Nous exigeons l'exactitude des informations topologiques lorsque l'on considère la nature de robustesse du problème des opérations géométriques sur les modèles de solides, et il devient clair que le problème peut être mal conditionné en présence de l'incertitude qui est omniprésente dans les données. Nous proposons donc une approche interactive de gestion de l'incertitude des opérations géométriques, dans le cadre d'un calcul basé sur la norme IEEE arithmétique et la modélisation en surfaces de subdivision. Un algorithme pour le problème planar-cut est alors présenté qui a comme but de satisfaire à l'exigence topologique mentionnée ci-dessus. / Subdivision surfaces are a promising alternative method for geometric modelling, and have some important advantages over the classical representation of trimmed-NURBS, especially in modelling piecewise smooth surfaces. In this thesis, we consider the problem of geometric operations on subdivision surfaces with the strict requirement of correct topological form, and since this problem may be ill-conditioned, we propose an approach for managing uncertainty that exists inherently in geometric computation. We take into account the requirement of the correctness of topological information when considering the nature of robustness for the problem of geometric operations on solid models, and it becomes clear that the problem may be ill-conditioned in the presence of uncertainty that is ubiquitous in the data. Starting from this point, we propose an interactive approach of managing uncertainty of geometric operations, in the context of computation using the standard IEEE arithmetic and modelling using a subdivision-surface representation. An algorithm for the planar-cut problem is then presented, which has as its goal the satisfaction of the topological requirement mentioned above.

O processo de crescimento urbano de grande porte das cidades brasileiras tem ocorrido com a ausência de instrumentos de planejamento urbano e gestão ambiental. Na prática, é por intermédio da aprovação pontual de loteamentos, sob a legislação federal de parcelamento do solo urbano (L.F. 6.766/79), que nossas cidades tem sido constituídas nas últimas duas décadas. É também neste período que a busca do desenvolvimento sustentável tem incorporado os centros urbanos e pautado - mesmo que teoricamente - os objetivos das agendas municipais, sejam por parte do poder público, do capital privado ou da sociedade civil. Diante disto, o objetivo principal deste trabalho é analisar os vínculos entre a degradação ambiental urbana e a produção do parcelamento do solo. Para tanto, a partir da revisão bibliográfica sobre o conceito de desenvolvimento sustentável, com enfoque aos autores que versam sobre a realidade das cidades brasileiras, foi elaborado um quadro de \"cenários de insustentabilidade ambiental urbana\". Adotando como estudo de caso a evolução urbana do município de Jaú, foram construídos o histórico de processos de abertura de loteamentos e diversos mapas temáticos que subsidiaram a discussão junto aos cenários de insustentabilidade propostos. Por fim, conclui-se que o processo de parcelamento do solo urbano pode revelar uma dinâmica que produz e reafirma a insustentabilidade ambiental de nossas cidades, com a convivência do poder público, a atuação do mercado imobiliário e as limitações do aparato legal. / The process of urban sprawl in the greater part of Brazilian cities has occurred in the absence of environmental and urban planning instruments. In practice, the urban growth of our cities during the last two decades has been guided only by the regulations for approval of urban subdivision as determined by the federal legislation on urban land subdivision (L.F. 6.766/79). During this period, the effort towards sustainable development has also been incorporated by urban centers, if only on a theoretical level, as an objective in municipal agendas through the behest of government, private capital, or public interests. In view of this, the principal objective of this study is to analyze the relationships between the degradation of the urban environment and the production of urban land subdivision. For this reason, a bibliographic review of the literature on the concept of sustainable development, focusing on authors whose works discuss the reality of Brazilian cities, as well as non-sustainable urban environment scenarios are included. A case study of the urban evolution of the municipality of Jaú, including the history of the initiation of subdivision processes, several thematic maps and non-sustainable land development proposal scenarios are included in the discussion. Finally, this study concludes that the process of urban land subdivision can reveal a dynamic which not only produces but confirms the non-sustainability of our cities\' environments, attributed to the collusion between government power, the real estate market and the limitation of the legal apparatus.

Firstly, we find that lots condominiums are a form of urban expansion that is not appreciated by the law of land subdivision, Law 6.766/ 79 and, neither, by the condominiums law in buildings, Law 4.591/ 64. It is a hybrid modality that involves both public and private interests, and affects both private law and public law. This is private law with regard to the right to property, and its developments, regulated in particular by civil law. Nevertheless, it is an institute of public law, since it impacts on the urban space that is studied mainly by the urban law, but also by other branches of law such as administrative law and environmental law. The characteristics of the condominiums and the modalities of urban land subdivision were studied, highlighting the similarities and differences of these developments and pointing out that the condominiums of lots do not fit into any modality and require their own regulation. We emphasize the importance of the role played by municipalities in the regulation of urban space and the normative function of the State Courts of Justice, so that the implementation of lots condominiums is carried out in a controlled manner, with requirements and approvals that attenuate the impacts of Segregation in the right to the city. It was necessary to analyze other modalities of closed residential projects to differentiate and understand the legal discipline of lots condominiums. Finally, we have seen that the validity and application of constitutional and legal provisions permit the regularity of the condominiums of lots, in accordance with the established municipal norms, with the regulation of the General Office of Justice and with the premises of Urban Law / O presente trabalho trata da divisão de glebas urbanas sob o regime de condomínio de lotes, apreciando-os na perspectiva do Direito Urbanístico. Em primeiro lugar verificamos que os condomínios de lotes são uma forma de expansão urbana que não é apreciada pela lei de parcelamento do solo, Lei 6.766/79 e, tampouco, pela lei de condomínios em edificações, a Lei 4.591/64. É modalidade híbrida que envolve interesses públicos e privados, sendo afeta tanto ao Direito Privado como ao Direito Público. Trata-se de direito privado no que tange ao direito de propriedade, e seus desdobramentos, regulado em especial pelo direito civil. Não obstante, é instituto de direito público, já que impacta no espaço urbano que é estudado principalmente pelo do direito urbanístico, mas também por outros ramos do direito como o direito administrativo e o direito ambiental. Foram estudadas as características dos condomínios e as modalidades de parcelamento do solo urbano, destacando as semelhanças e diferenças destes empreendimentos e apontando que os condomínios de lotes não se enquadram em nenhuma modalidade e exige regulamentação própria. Destacamos a relevância do papel cumprido pelos municípios na regulamentação do espaço urbano e a função normativa da Corregedoria Geral de Justiça dos estados, a fim de que à implantação dos condomínios de lotes seja realizada de forma controlada, com requisitos e aprovações que atenuem os impactos da segregação no direito à cidade. Foi necessária a análise de outras modalidades de empreendimentos residenciais fechados para diferenciarmos e compreendermos a disciplina jurídica dos condomínios de lotes. Finalmente, vimos que a vigência e aplicação dos dispositivos constitucionais e legais permitem a regularidade dos condomínios de lotes, desde que em consonância com as normas municipais estabelecidas, com a regulamentação da Corregedoria Geral de Justiça e com as premissas do Direito Urbanístico
