Divulgação de desempenho de órgãos públicos: uma Análise de Conteúdo dos relatórios de gestão do Tribunal de Contas da União / Performance disclosure of public organizations: a content analysis on the Brazilian Supreme Audit Institution´s management reports

O objetivo deste trabalho é analisar a adoção de uma política de divulgação usada pela entidade fiscalizadora brasileira, o Tribunal de Contas da União (TCU), para divulgação de seus indicadores de desempenho. Essa análise é principalmente influenciada pela análise comparativa de Barzelay (1997) e de Pollitt e Summa (1997). As organizações públicas são requeridas a utilizar a avaliação de desempenho orientada a resultados em substituição à orientada a recursos que elas estavam utilizando. Os stakeholders do TCU (agências auditadas, Congresso Nacional, e a comunidade) esperam um amplo nível prestação de contas (accountability) sobre o valor que ele cria. A maneira com que o TCU apresenta seu desempenho parece seguir uma tendência internacional, mas a adoção de indicadores orientados a resultados não tem alcançado o nível internacional (pelo menos o nível alcançado pelo norte-americano Government Audit Office e o britânico National Audit Office). Para realizar o objetivo da pesquisa, uma análise de conteúdo foi conduzida sobre os relatórios de gestão do TCU relacionados ao período de 1993 a 2009, pesquisando por características dos indicadores utilizados divulgados como sendo usados. Os principais resultados mostram que: (i) o significado dos indicadores não está claro; (ii) os indicadores não são utilizados de uma forma estável (exceto nos últimos anos 2006 a 2009); (iii) o TCU prefere apresentar indicadores de output enquanto a tendência internacional é mostrar métricas orientadas a resultado e (iv) estes padrões permanecem os mesmos para os indicadores utilizados explicitamente como meta. / The objective of this paper is to analyze the adoption of and the reporting policy used by the Brazilian Supreme Audit Institution (hereafter called tribunal de Contas da União or TCU) to disclose its performance indicators. This analysis is mainly influenced by Barzelay (1997) and Pollitt and Summa (1997) comparative analysis. Public organizations following the New Public Management movement are adhering to the same practices used by private organizations. All public organizations are required to use a result-oriented performance evaluation in replace of the widespread resource-oriented they were used to. The TCU\'s stakeholders (e.g., audited agencies, the National Congress, and the community) expect a wider accountability level about the value it creates. Although the way the TCU disclose its performance seems to follow an international trend, the adoption of result-oriented indicators has not reached the international level (at least the level reached by the North-American Government Audit Office and the British National Audit Office). In order to achieve the research objective, a content analysis was conducted on TCU\'s management reports related to the period 1993-2009, searching for the features of the indicators set disclosed as \"being used\". Main results show that: (i) the meaning of the indicators is not clear; (ii) indicators are not used in a stable basis (apart from the latter years, i.e. 2006-2009); (iii) the TCU prefers to disclose output indicators while the international trend is the disclosure of result-oriented metrics and (iv) these patterns remain the same even for the indicators used as an explicit target.

A pesquisa aborda os aspectos positivos e as debilidades das teorias da proporcionalidade, analisando o diálogo entre as interpretações doutrinárias constitucionalista e penalista quanto ao tema. Tendo como base um contexto social marcado pelo recrudescimento do poder punitivo, por distorções na tensão liberdade-segurança e pela abertura do sistema jurídico a influxos de seu entorno, o trabalho busca identificar o papel da proporcionalidade em sentido amplo na estabilização normativa envolvendo as relações jurídicas conflituosas em direito penal. Tendo como hipótese de investigação a ideia de que a proporcionalidade é utilizada frequentemente como artifício retórico nominalista, servindo nas argumentações jurídicas tanto à limitação quanto à justificação das intervenções punitivas, a pesquisa se dedica a testar tal afirmação preliminar por meio de dois estágios de análise: (i) primeiramente, é desenvolvido um arcabouço teórico que possibilita que discute o conteúdo dogmático das regras de proporcionalidade e sua funcionalidade na interpretação penal, buscando com isso viabilizar a (ii) verificação empírica e crítica do sentido normativo atribuído pelo Supremo Tribunal Federal à proporcionalidade no direito penal nos anos de 2011 e 2012. / The research addresses the strengths and weaknesses of the proportionality theories through a dialogue between constitutional and criminal legal studies. The investigation aims at identifying the proportionality role in the stabilization of normative standards related to conflicting relations concerning criminal law, within the context of the increasing of the punitive power, of distortions regarding the tension between liberty-security and of the legal systems opening to the expansive flows deriving from laws environment. The research hypothesis is that proportionality is frequently used within legal discussions as a nominalist and rhetorical resource, contributing to both the limitation and the justification of state penal measures. Therefore, the investigation tests such fundamental preliminary statement through two analytical stages: (i) first, the research develops a theoretical framework, which allows the discussion of the dogmatic contents of the proportionality rules and its functionality concerning criminal law interpretation. As a result of the first stage, the research performs (ii) an empirical verification and critical evaluation of the normative sense assigned by the Brazils Supreme Court to the proportionality within criminal law cases among 2011 and 2012.

The objective is to depict the impact of the "general repercussion" into the Brazilian political-legal order, taking into account the crucial function of the Appeals to the Supreme Court, which watches over the Constitution. In order to accomplish this task, both historic and comparative data were used along with the study of foreign laws, which demonstrated to be a strong source to help understand the intitute. The origins and foundations of the Appeals to the Supreme Court were also scrutinized in order to achieve the explanation and the true need of mandatory filters - such as the "general repercussion" -, so that the Supreme Court can ultimately perform its proper functions / O objetivo central deste trabalho é o de analisar o instituto da repercussão geral, introduzido no sistema brasileiro pela Emenda Constitucional nº 45, de 2004, sob a ótica do direito processual civil, especialmente os seus reflexos no âmbito do recurso extraordinário (cabimento, interposição e processamento). Repercussão geral das questões constitucionais / General repercussion on constitucional subjects

No início do presente trabalho, foi elaborado um histórico do Supremo Tribunal Federal e do recurso extraordinário, além de se traçar alguns aspectos sobre o papel da Corte na atualidade, resultado das mudanças sociais aspiradas pela Constituição de 1988 e de recentes reformas legislativas. Se, por um lado, o constituinte originário pretendeu ampliar o acesso à Justiça, não menos verdade é que a realidade acabou por demonstrar a insuficiência do modelo então vigente para dar respostas adequadas e céleres aos jurisdicionados. O Poder Judiciário brasileiro carece de importantes reformas procedimentais, com o objetivo de atribuir maior eficácia às decisões dos Tribunais Superiores, e, assim, desestimular a interposição de recursos a respeito de questões já sedimentadas. Neste contexto foi que se introduziram os institutos da súmula vinculante e da repercussão geral das questões constitucionais, este último como requisito de admissibilidade do recurso extraordinário. Ao longo do segundo capítulo, houve a apresentação dos institutos antecedentes da repercussão geral (introduzida pela Emenda Constitucional nº 45/2004), como a arguição de relevância vigente sob a Constituição de 1967, a transcendência do direito trabalhista (artigo 896-A da CLT), o certiorari do direito norte-americano e a ofensa federal relevante do direito argentino, além de outras experiências do direito estrangeiro. Detendo-se acerca da repercussão geral, no terceiro capítulo foram identificados alguns critérios adotados pelo Supremo Tribunal Federal nos julgamentos até o momento realizados, além de esclarecidas algumas noções fundamentais, como a natureza do provimento jurisdicional dele decorrente. No quarto e quinto capítulos foram apresentadas as principais questões procedimentais a respeito do exame da repercussão geral. Relativamente ao julgamento de recursos múltiplos previsto no artigo 543-B, §§ 3º e 4º, do CPC, também se estudou em que medida estará o Tribunal de origem vinculado à decisão a ser proferida pelo STF. Por fim, verificou-se se tais normas estão em harmonia com o sistema processual vigente, notadamente em relação aos princípios e garantias processuais presentes na Constituição da República de 1988. / The beginning of this work presents a background of the Brazilian Supreme Federal Court and the extraordinary appeal. It also presents an outline of the Court\'s current role, which is a result of the social changes aimed by the 1988 Brazilian Constitution and by recent legislative reforms. The original constituent primarily intended to expand the access to justice, but reality revealed that the operative model at the time was insufficient to respond swiftly and adequately to those under it jurisdiction. Brazilian Judiciary needs important procedural reforms in order to bring effectiveness to the decisions of the Supreme Courts and consequently discourage appeals against settled questions. The binding precedent and the general repercussion on constitutional subjects the latter being the admissibility requirement of the extraordinary appeal were introduced in this context. Through the second chapter, there is the presentation of the institutes previous to the general repercussion (introduced by the Constitutional Amendment 45/2004), such as the allegation of relevance operative on the 1967 Constitution, the labor law transcendence (article 896-A of the Brazilian Labor Code), the certiorari from the North-American Law system and the relevant federal offense from the Argentinian Law system, among other experiences from foreign Law systems. With regard to the general repercussion, the third chapter identifies some criteria adopted by the Brazilian Supreme Federal Court on its trials up to the present and sets forth some fundamental notions, such as the nature of the jurisdictional provision. The fourth and fifth chapters present the main procedural issues regarding the analysis of the general repercussion. They also study to what extent the court of origin is bound by the decision delivered by the Federal Supreme Court regarding multiple appeal judgments, as established by article 543-B, sections 3rd and 4th of the Brazilian Code of Civil Procedure. Finally, this work verifies whether such norms are in harmony with the current procedural system, notably regarding procedural principles and safeguards from the 1988 Brazilian Constitution.

Esta dissertação é um estudo sobre a construção do relato jornalístico sobre os acontecimentos que compuseram o escândalo conhecido amplamente como Mensalão. O trabalho reúne amostragem de materiais publicados no site Observatório da Imprensa após a incidência da cobertura jornalística a respeito das investigações e julgamentos que marcaram o andamento dos procedimentos jurídicos oficiais relacionados às acusações. O objetivo da pesquisa é identificar as formas com as quais se faz a construção de uma agenda de crítica que fixa o relato já elaborado na cobertura primária, delineando personagens e seus traços para protagonizar e ilustrar os fatos jurídico-políticos relatados. Pode-se verificar que é bastante comum o uso de adjetivos, expressões e passagens de histórias de vida para caracterizar e reforçar a construção de personagens na prática de crítica de mídia. / This is a study on the building process of journalistic reporting about the events related to the Brazilian political scandal widely known as Mensalão. It\'s a research that combines sampling materials published in the Monitoring the Press (Observatório da Imprensa) website after the impact of media coverage regarding the investigations and trials that marked the progress of the official legal procedures related to the charges. The objective of the research is to identify the ways in which a critical agenda was built to set the stories already showed in primary coverage, delineating characters and their traits to illustrate the legal and political facts reported. It\'s possible to see that it is quite common to use adjectives, expressions and storytelling elements to stress some characters\' personalities in media criticism practice.

The Use of Social Science by the United States Supreme Court in Cases Raising Husband-Wife and Parent-Child Legal Issues

This research provides a descriptive study of the use of social science research contained in reported decisions of the United States Supreme Court. The cases were selected from case abstracts contained in two U.S. Supreme Court digests. The author relied on the court reporter's arrangement of abstracts of case decisions (sorted by substantive areas of the law) to identify relevant cases presenting issues of parent -child and husband-wife relations. The following substantive areas were initially selected using this method: abortion, adultery and fornication, adoption, immigration, exclusion and deportation, bigamy, bastards, dower, death, domicil, divorce and separation, guardian and ward, homestead, husband and wife, incompetent persons, infants, kidnapping, indecency, lewdness and obscenity, marriage, privacy, poor and poor laws, torts, schools, social security and unemployment compensation, wills, workman's compensation, and zoning. Substantive areas receiving one or none citations of social science (in the summary tabulations) were excluded, leaving the parent-child areas of abortion, bastards, infants, obscenity, poor and poor laws, schools and social security. The above exclusion process left the husband-wife areas of adultery and fornication, bigamy, divorce and separation, husband and wife, and marriage. The entire text and footnotes were analyzed in the selected cases . The date of the decision, use or non-use of social science research, and the nature or discipline of the research were recorded and tabulated. The substantive caselaw of schools and obscenity were the substantive areas containing the most frequent citations of social science. The study revealed a general trend consistent with Christensen's (1964) model of family research development. Parent-child opinions revealed a general utilization rate of four per cent. The study revealed that history and economics, as social science disciplines, have been cited more frequently by the Supreme Court during the period analyzed than the social science disciplines of sociology and psychology.

A incidência do direito internacional penal em casos de extradição julgados pelo STF: análise crítica / The incidence of international criminal law in extradition cases judged by BrazilSupreme Court of Justice: an evaluative review

Alguns casos de extradição julgados pelo STF possuem especial relevância por apreciarem a ocorrência dos crimes internacionais. Assim, o estudo dessas decisões mostra-se importante para que se possa averiguar o efetivo exercício do direito internacional penal, que regula o tratamento especial dado a estes crimes. A presente Tese tem por objetivo averiguar a incidência das normas de direito internacional penal nos julgamentos do STF de pedidos de extradição. Apresenta-se, ainda, o impacto que o entendimento firmado nesses casos tem surtido no julgamento de outras ações, inclusive por outras esferas do Poder Judiciário brasileiro. Também é possível realizar um comparativo com o quanto decidido no julgamento da ADPF nº 153, em que se reafirmou a validade da lei de anistia brasileira, que, por sua vez, extinguiu a punibilidade dos crimes internacionais cometidos durante o Regime Militar no Brasil. Por fim, a partir desses estudos, enfatiza-se a necessidades de dar efetiva aplicação ao direito internacional penal nos julgamentos realizados no âmbito do STF. / Some extradition cases trialed at Brazil Supreme Court of Justice show special relevance because they deal with international crimes. Therefore, the study of these judicial decisions is important so that it can be possible to verify the effectiveness of International Criminal Law, which regulates the special treatment given to those crimes. The present Thesis aims to examine the incidence of the rules and principles of international criminal law by Brazilian Supreme Court at extradition trials. It also presents the impacts of the understanding exposed in those trials on other cases and actions, subjected to other organs of Brazils Judiciary system. It is either possible to create a comparative between the jurisprudence of extradition cases and what has been decided at the ADPF nº 153, reaffirming Brazilian amnesty law, which has granted amnesty to international crimes committed during Brazils military regime. Finally, trough these reviews, it emphasizes the need to give real enforcement to international criminal law when Brazils Supreme Court analyzes extradition requests.

Libation in African Christian Theology: a critical comparison of the views of Kwasi Sarpong, Kwesi Dickson, John Pobee and Kwame Bediako

<p>The issue of libation poses an important challenge to Christianity in Africa and, more specifically, among the Akan people in Ghana. Libation is traditionally a key ritual for the Akan as an ethnic group. However, the European missionaries who operated in West Africa condemned this ritual as idolatrous. Following the emergence of African Christian theology, especially within the Ghanaian context, various African theologians have contributed to a more systematic discussion of such libation practices. This thesis entails a critical comparison of the views of four Akan (in Ghana) theologians on Christian participation in libation practices. On this basis, the research problem in this thesis is stated in the following way: ―What are the points of divergence that lie beneath the different positions of Kwesi Sarpong, Kwesi Dickson, John Pobee and Kwame Bediako on the question of whether and in what forms Christian participation in libation practices in an Akan context in Ghana may be regarded as compatible with the Christian faith? This thesis describes analyses, compares and assesses the cultural and theological presuppositions of the views of these four Akan Ghanaian theologians on Christian participation in libation rituals. It shows how the views of these four theologians on libation are influenced by their views on the tatus which is attributed, both in Akan culture and in contemporary Christianity in Ghana, to abosom (lesser divinities) and nsamamfo (ancestors) in relation to Onyame (Supreme Being). The purpose of this thesis is therefore to clarify the cultural and theological assumptions underlying current debates on the observance of libation rituals by Christians in Ghana. The task is a description of the views of Sarpong, Dickson, Pobee and Bediako on the compatibility of Christian participation in libation practices in an Akan context with the Christian faith - just as they themselves understand its content and significance. In this thesis I approached the debate on libation in African Christian theology in two ways, namely following a direct and a thematic approach. In the direct approach the focus is explicitly on libation as a topic either in the context of African traditional religion and culture by itself or in its encounter with Christianity. In the thematic approach the focus is on libation within the context of its wider religious (with reference to God, the lesser divinities and ancestors) and cultural (the relationship between Christianity and African culture) contexts. The research indicates that the point of divergence amongst the four theologians mentioned above is almost always related to the invocation and petition of the lesser divinities and the ancestors. In addition to these major theological issues, ―ecclesiastical sanctions‖ also forms a major determining factor that influences the positions of these&nbsp / theologians. On their respective views, Sarpong asserts that libation in its present form is not incompatible with the Christian faith. By contrast, Bediako maintains that libation as is presently practiced among the Akan is not compatible with the Christian faith neither can it be adapted into the Christian faith. On the other hand, Dickson and Pobee maintain that libation rituals are not compatible with the Christian faith, but that it can be adopted and adapted into the Christian faith if the content of the accompanying prayer is made in consonance with Christian theology. The thesis is comprised of eight chapters and a postscript. In the postscript, I offer some personal views and argue that libation has to be adapted before it can be compatible with the Christian faith. I suggest that libation should be made only to God and to the ancestors. Petitions during libation rituals should be made only to God, while the presence of the ancestors should be recognized in a ―symbolic manner‖ by an invitation to join the living human beings to make such petitions.</p>
